The official position on both sides during the 1950s was that cooperation was of the essence. In the beginning, the Americans believed that the virtues of democracy could best be cultivated in the German consciousness if the Germans themselves implemented democratic programs under broad, philosophical guidelines, while simultaneously observing Americans and American ideas in practice. This study points out that the Germans accepted the guidelines and their responsibilities for building a democracy, and by the end of the decade, Germany was

    Karim Fertikh The Godesberg Programme and its Aftermath A Socio-histoire of an Ideological Transformation in European Social De- mocracies Abstract: The Godesberg programme (1959) is considered a major shift in European social democratic ideology. This article explores its genesis and of- fers a history of both the written text and its subsequent uses. It does so by shedding light on the organizational constraints and the personal strategies of the players involved in the production of the text in the Social Democra- tic Party of Germany. The article considers the partisan milieu and its trans- formations after 1945 and in the aftermaths of 1968 as an important factor accounting for the making of the political myth of Bad Godesberg. To do so, it explores the historicity of the interpretations of the programme from the 1950s to the present day, and highlights the moments at which the meaning of Godesberg as a major shift in socialist history has become consolidated in Europe, focusing on the French Socialist Party. That the 1950s programme should be mentioned before a primetime audience bears witness to the widespread dissemination of the phrase in French political culture. “Faire son Bad Godesberg” [literally, “doing one’s Bad Godesberg”] has become an idiomatic French phrase. It refers to a fundamental alteration in the core doctrinal values of a politi- cal party (especially social-democratic and socialist ones).

Relations with the United States What actually brought the political and economic crisis into the open and hastened Erhard's downfall was that he returned empty-handed from his Sep- tember visit to President Lyndon B. Johnson. Erhard appealed to Johnson for an extension of the date when payment of $3 billion was due for military equipment which West Germany had bought from the United States to bal- ance dollar expenses for keeping American troops in West Germany. (By the end of 1966, Germany paid DM2.9 billion of the total DM5.4 billion, provided in the agreements between the United States government and the Germans late in 1965. The remaining DM2.5 billion were to be paid in 1967.) During these talks Erhard also expressed his government's wish that American troops in West Germany remain at their present strength. Al- though Erhard's reception in Washington and Texas was friendly, he gained no major concessions. Late in October the United States and the United Kingdom began talks with the Federal Republic on major economic and military problems.     The Constitutional Protection of Property Rights: Lessons from the United States and Germany John N. Drobak* and Julie D. Strube** (April 2005 Draft: Do not quote without the permission of the authors.) Constitutional limitations on a government=s power to confiscate property, whether by an outright taking of title or by excessive regulation, are important to economic growth. Over the past 200 years, the Supreme Court of the United States has used different clauses in the constitution as the basis for this protection. When the usefulness of one clause waned, the Supreme Court turned to another clause to continue its protection of property rights. Our paper will trace the path from the use of the contract clause in the nineteenth century to the rise of substantive due process after the Civil War and its demise during the New Deal to the modern use of the takings clause. After analyzing the extent of the protection accorded property rights in the United States today, we will turn to the German constitution for a comparison of constitutional property rights protection. In many ways, the German courts have used Article 14 of the German constitution to provide similar protection to that given in the United States. However, the German courts have used a principle of Aproportionality@ as a basis for greater scrutiny of legislative action. We will show that the German Aproportionality@ principle is similar to the principles that had been used in the United States under substantive due process but no longer apply under the takings clause. We will also show that the decision of the United States Supreme Court and the German Constitutional Court are so similar that they could be viewed as part of one legal doctrine, both in terms of analysis and outcome.

Barthé, Jr. (Doctorate of Philosophy in History) Becoming American in Creole New Orleans: Family, Community, Labor and Schooling, 1896-1949 Summary: The Louisiana Creole community in New Orleans went through profound changes in the first half of the 20th-century. This work examines Creole ethnic identity, focusing particularly on the transition from Creole to American. In "becoming American," Creoles adapted to a binary, racialized caste system prevalent in the Jim Crow American South (and transformed from a primarily Francophone/Creolophone community (where a tripartite although permissive caste system long existed) to a primarily Anglophone community (marked by stricter black-white binaries). These adaptations and transformations were facilitated through Creole participation in fraternal societies, the organized labor movement and public and parochial schools that provided English-only instruction.

    CULTURE, COERCION, AND PATRIOTISM: THE GERMAN-AMERICAN EXPERIENCE IN SAN FRANCISCO DURING WORLD WAR I Marcus L. Bacher N July 15, 1914, a German naval cruiser, the Nürnberg, sailed from Q Mexican waters into the port of San Francisco. That evening, fifteen of the ship’s officers attended a banquet joined by San Francisco Mayor James Roiph and sixty prominent San Francisco Germans at the Saint Francis Hotel, to toast the Kaiser, President Woodrow Wilson, and the Nürnberg. The following day the front page of the California Staats Zeitung read, “City representatives and Germans warmly welcome the cruiser Nurnberg” and featured a picture of the warship and its captain, Commander von Schonberg. Over the following days, local German organizations like the German singing society and the German-American League of San Francisco entertained and celebrated the ship’s officers and crew, sang the German national anthem and the “Star Spangled Banner,” and exchanged toasts offriendship between the two nations in what the San Francisco Chronicle summarized as a “brilliant reception.” Three weeks later, American-German relations splintered as Germany became embroiled in war with England, France, and Russia.’ This paper is an examination of a period when international affairs had radical domestic impact. The First World War and the perceived belligerence ofthe German Empire produced a domestic hysteria against German Americans. A broad cross-section of Americans attacked their patriotism and loyalty and sought to restrict and marginalize their culture. Such widespread hatred directed against them was something entirely new to most of the German population. Since colonial times, German immigrants and German Americans had been one of the most diverse and influential non-English speaking ethnic groups in the U.S.
