Thank you very much to the honourable members of the Senate Standing Committee on Official Languages (the “Committee”) for inviting me to testify and submit a brief as part of the study of the official languages reform proposal entitled French and English: Towards a Substantive Equality of Official Languages in Canada (“the reform proposal”). A) The reform proposal includes ambitious and essential measures 2. First, I would like to congratulate the Minister of Economic Development and Official Languages for her leadership and vision. It is, in my opinion, the most ambitious official languages reform proposal since the enactment of the Constitution Act, 1982 (“CA1982”)1 and the Canadian Charter of Rights and Freedoms (“Charter”),2 which enshrined the main provisions of the Official Languages Act (“OLA”)3 of 1969 in the Canadian Constitution. The last reform of the OLA was in 1988 and it is past time to modernize it to adapt it to Canada’s linguistic realities and challenges in the 21st century. 3. The Charter and the OLA proclaim that “English and French are the official languages of Canada and have equality of status and equal rights and privileges as to their use in all institutions of the Parliament and government of Canada.”4 In reality, however, as reported by Statistics Canada,5 English is dominant everywhere, while French is declining, including in Quebec. -

I 9 92? 11 ABSTRACT Two secondary social studies textbooks, Canada: A Nation Unfolding, and Canada Today were analyzed with regard to the inclusion of the lives, experiences, perspectives and contributions of females throughout history and today. Drawing on the existing literature,-a framework of analysis was created comprised of four categories: 1) language; 2) visual representation; 3) positioning and; 4) critical analysis of content. Each of these categories was further broken into a series of related subcategories in order to examine in depth and detail, the portrayal of women in these two textbooks. -

CONSTITUTION-MAKING AS INTERGOVERNMENTAL RELATIONS A Case Study of the 1980 Canadian Constitutional Negotiations Adam D. McDonald1, University of Waterloo The Constitution Act, 1982 is a document that profoundly changed the Canadian political landscape. It brought home the highest law of the land; it provided Canadians a mechanism to change their Constitution; it created a Charter of Rights and Freedoms, entrenched within the Constitution, out of the reach of one government. Perhaps its most important legacies, however, are the seemingly permanent isolation of Quebec and the primacy of place in Canadian history it gave Pierre Trudeau. This paper will examine the constitutional history of Canada with a view to determining what made the 1980 negotiating sessions successful when the sessions that led to both the Meech Lake Accord and the Charlottetown Accord were not. It is important, however, to note that the word “successful” is used in the sense that an agreement was reached. Unlike Meech and Charlottetown, the repatriated constitution did not have unanimity among the participants. The question that comes to mind is this: if the governments did not really agree in 1981, why was a Constitution ratified? More importantly, are there lessons that can be drawn from this agreement that can be applied to the failed accords of the Mulroney era? In order to complete this examination, the paper will be divided into two parts. In the first part, Canada’s constitutional story will be told. This is a necessary part of any examination of the constitutional negotiations, for without knowing what the players wanted historically, one cannot see what was changed by the 1980s. -

The purpose of C-6 is to create one class of Canadian. Unless amended, the Bill will not achieve its objective. Preamble: “A Canadian is a Canadian is a Canadian.” –Justin Trudeau, acceptance speech as Prime Minister, October 19, 2015. “We believe very strongly that there should be only one class of Canadians, that all Canadians are equal, that a Canadian is a Canadian is a Canadian from coast to coast to coast.” –John McCallum, Citizenship Minister, February 3, 2016. Fabulous words. Now let’s make it a reality. Bill C-6, as written, is but a start- it doesn’t get Canada to the Promised Land. If passed into law, unequal rights will continue, resulting in different classes of Canadian citizen- some with more rights than others. There will also be people denied citizenship altogether due to ongoing discrimination within the Act. My point in the following discussion is to exemplify the confusion and unjust legislation that bonds us together as Canadians. Trying to explain our current citizenship act is easy vs. deciding who under the law qualifies to call themselves Canadians, and why. For example, Canadian citizenship as we know it is an amalgamation of all the previous citizenship and immigration legislation going back more than 100 years. As such, the current Act is not a complete code for citizenship and nationality in that certain provisions of the 1947 Act must still be read as unrepealed. The authority for this is the Interpretation Act 1985 (44[h]), which specifies that provisions of a repealed Act must be read as unrepealed if those provisions are required to give effect to the Current Act. -

As such, besides examining the lives of prime ministers and other elites, we will also analyse, for example, what things were like for ordinary people; besides focussing upon the French-English divide, we will also look at issues revolving around gender roles and Canada’s First Peoples; and besides noting cultural expressions such as "high art," we will also touch upon things such as various forms of popular entertainment. The general story will come from the lectures. However, your outline will refer to chapters from the Francis, Smith and Jones texts, Journeys. You should read these, especially if parts of the lecture remain unclear. The textbook will provide background; it will not replicate the lectures. Required readings will consist of a series of primary source documents. The lectures will refer to many of those documents, suggesting how they might be understood in relation to the general flow of events. Thus, on the mid-term test and final examination, you should be able to utilize the required readings and the lecture material in responding to questions. -
