The purpose of C-6 is to create one class of Canadian. Unless amended, the Bill will not achieve its objective. Preamble: “A Canadian is a Canadian is a Canadian.” –Justin Trudeau, acceptance speech as Prime Minister, October 19, 2015. “We believe very strongly that there should be only one class of Canadians, that all Canadians are equal, that a Canadian is a Canadian is a Canadian from coast to coast to coast.” –John McCallum, Citizenship Minister, February 3, 2016. Fabulous words. Now let’s make it a reality. Bill C-6, as written, is but a start- it doesn’t get Canada to the Promised Land. If passed into law, unequal rights will continue, resulting in different classes of Canadian citizen- some with more rights than others. There will also be people denied citizenship altogether due to ongoing discrimination within the Act. My point in the following discussion is to exemplify the confusion and unjust legislation that bonds us together as Canadians. Trying to explain our current citizenship act is easy vs. deciding who under the law qualifies to call themselves Canadians, and why. For example, Canadian citizenship as we know it is an amalgamation of all the previous citizenship and immigration legislation going back more than 100 years. As such, the current Act is not a complete code for citizenship and nationality in that certain provisions of the 1947 Act must still be read as unrepealed. The authority for this is the Interpretation Act 1985 (44[h]), which specifies that provisions of a repealed Act must be read as unrepealed if those provisions are required to give effect to the Current Act. -

The first volume, Entry Denied,1 published in 1991, contains eight essays, four of which analyze how the exclu- sion laws and the changing ways in which they were enforced affected Chinese communities in the United States. The other four essays docu- ment how members of those communities dealt with the constraints on their lives by relying on a complex institutional structure that enabled them to combat the laws while connecting them to larger developments in both China and the United States. In contrast to the focus on institu- tions in the first volume, the seven chapters in Claiming America,2 the sec- ond volume published in 1998, explore the multidimensional conscious- ness of individuals. They examine how some first- and second-generation Chinese Americans claimed America as their own by forcefully asserting that they, too, believed in democracy and equality. They declared that Chinese were not simply earning a living in the United States as “sojourn- ers,” but were also self-consciously embracing the American creed despite the fact that their presence was not welcomed on American soil. In the present volume, Chinese American Transnationalism, the eight contribu- tors dissect the many ways in which Chinese living in the United States maintained ties to China through a constant transpacific flow of people, economic resources, and political and cultural ideas, the exclusion laws notwithstanding. -

1 IMMIGRATION REFORM IN CANADA AND THE UNITED STATES: A COMPARATIVE ANALYSIS Mai Nguyen (York University) Garth Stevenson (Brock University) Paper prepared for presentation to the annual meeting of the Canadian Political Science Association, Vancouver, British Columbia, June 4, 2008. 2 It is not surprising that most public policies in Canada and the United States are fairly similar, nor is it surprising that innovations in public policy have often occurred at about the same time in the two countries. Similar economic, social and cultural conditions in the two countries might be expected to produce such a result. It is also a fact, although not always acknowledged by Canadians, that American innovations in policy have often been copied in Canada within a few years. John A. Macdonald’s National Policy was based on policies implemented by the United States in the 1860s. More recent examples would include anti- combines legislation in the early 20th century, the largely abortive Bennett New Deal of the 1930s, P.C. 1003 of 1944 (modelled on the Wagner Act), the formation of Via Rail (modelled on Amtrak), the deregulation of the transportation industries in the 1980s, and even the Charter of Rights and Freedoms. Immigration is one area of public policy in which the two countries have followed somewhat similar, although not identical, paths. Both accepted large numbers of immigrants from European sources during the century that followed the war of 1812. Both sought to limit Asian immigration by overtly discriminatory means beginning in the latter part of the 19th century. Both, by more subtle means, limited immigration from southern and eastern Europe in the first half of the 20th century. -

1 ASIAN-AMERICAN TIMELINE (prepared by Dr. Bonnie Khaw-Posthuma) 1521 Portuguese explorer Ferdinand Magellan claims the Phillipines in the name of the Spanish crown; colonial rule begins in 1565; first Filipinos reportedly arrive in California in 1587. 1790 Congress passes the Naturalization Act – granting U.S. citizenship to all “free white” persons. 1834 Afong Moy, the first Chinese woman known to have visited the U.S. is exhibited in a theater in New York. 1839-1842 China signs the Treaty of Nanjing –opening Chinese ports to trade by Western and later Japanese powers. 1843 Japanese citizen Nakahama Manjiro becomes the 1st Japanese individual to land in the U.S. 1848 First Chinese (two men, one woman) immigrate to the U.S. and land in San Francisco; discovery of gold leads to Chinese immigration to America (also known as “Gold Mountain”). 1852 Lured by the gold rush, more than 20,000 Chinese arrive in California (it was a myth that all Chinese wished to get rich quickly and return—only 50% did). 1853 Several hundred years of isolation end as Commodore Matthew Perry of the U.S. forces Japan to open its door to foreign commerce. 1854 People vs. Hall, a California case, rules that Chinese cannot testify for or against white persons in court. 1860 A Californian law bars Chinese-Americans, Indians, and African- Americans from public schools. 1865 Plans for the first transcontinental railroad in the U.S. are developed, and the Central Pacific Railroad begins hiring Chinese laborers. 1870 Congress grants naturalization rights to free whites and people of African descent, omitting mention of Asian (or as they call it “Oriental”) races. -

JOURNEY TO GOLD MOUNTAIN: Early Chinese Life & Labour in Canada The first recorded Asians in Canada were brought to Vancouver Island in 1788 by the British Captain John Meares to work as shipwrights. About 130 Chinese workers arrived, but shortly thereafter they were cap- tured and imprisoned during the Spanish seizure of Nootka Sound. What happened to them is a mystery, but there are reports that some were taken as forced labourers to Mexico and that some escaped and were captured by the Nootka people or married into their community. GOLD RUSH In 1856, gold was found near the Fraser River in the territory of the Nlaka’pamux First Nations people. Almost immediately, the discovery brought tens of thousands of gold miners to the region, marking the beginnings of white settlement on BC’s mainland. By 1858, Chinese gold miners had also started to arrive, and as word spread about the money to be made, British Columbia became known in China as “Gold Mountain”. By the 1860s, 6000-7000 young Chinese men were living in BC, most intending to return to China with their savings. The Gold Rush brought not only Chinese miners but also the merchants, labour- ers, domestics, gardeners, cooks, launderers and other service industry workers needed to support the large mining communities that sprang up wherever gold was discovered. By 1860, the goldfields of the Fraser canyon were declining and the Gold Rush was redirected into the Cari- boo, where large mining camps sprang up, requiring services that were often provided by the Chinese. These included laundries, restau- rants, vegetable gardens, and fisher- ies. -

Engage with primary source artifacts from the Royal British Columbia Museum to infer about experiences of Chinese immigrants and communities in BC. Evaluate the objects/artifacts and, as a class, decide if the “graffiti” is a historically significant artifact. HISTORICAL THINKING CONCEPTS This activity relates to concepts introduced by the Historical Thinking Project.
