Introduction La décision 626/2008/CE1 crée une procédure communautaire de sélection commune des opérateurs de systèmes mobiles par satellite qui utilisent les bandes de fréquences 1980-2010 MHz (pour les communications Terre-satellite) et 2170-2200 MHz (pour les communications satellite-Terre). Elle établit également les dispositions relatives à l’autorisation coordonnée, par les États membres, des opérateurs sélectionnés pour l’utilisation des fréquences assignées en vue de l’exploitation des systèmes mobiles par satellite. La sélection a été effectuée par la Commission européenne2. Deux opérateurs ont été sélectionnés : Inmarsat Ventures Limited (ci-après « Inmarsat ») et Solaris Mobile Limited3. L’arrêté royal du 11 février 2013 relatif aux systèmes fournissant des services mobiles par satellite (ci-après « arrêté royal du 11 février 2013 ») autorise les opérateurs sélectionnés par la Commission européenne à exploiter un système mobile par satellite, pour autant qu’ils aient fait une notification pour la fourniture de services de communications électroniques conformément à l’article 9 de la loi du 13 juin 2005 relative aux communications électroniques. Le réseau satellitaire peut être assisté par des éléments terrestres complémentaires utilisant les mêmes fréquences que la composante satellitaire. En vertu de l’article 8 de l’arrêté royal du 11 février 2013, les opérateurs sélectionnés peuvent installer des éléments terrestres complémentaires (ci-après « ETC ») qui ont été approuvés par l’IBPT. L’objet de la présente décision est l’approbation des ETC prévus par Inmarsat. 2. Rétroactes Le 17 juin 2014, Inmarsat a fait une notification pour la fourniture de services de communications électroniques conformément à l’article 9 de la loi du 13 juin 2005 relative aux communications électroniques. Le 13 avril 2016, Inmarsat a transmis à l’IBPT les caractéristiques de six ETC dont la mise en service était prévue le 1er juillet 2017. Par la décision du Conseil de l’IBPT du 29 juin 2016 concernant les droits d’utilisation de Inmarsat Ventures Ltd pour éléments terrestres complémentaires (ci-après « décision du 29 juin 2016 »), l’IBPT a approuvé les six ETC. La décision du 29 juin 2016 a été annulée par la Cour des marchés le 14 mars 2018. Le 9 avril 2018, l’IBPT a envoyé un courrier à Inmarsat avec des demandes d’informations supplémentaires concernant le fonctionnement de son réseau EAN4. Dans son courrier du 20 avril 2018, Inmarsat a répondu aux questions de l’IBPT. 3. Cadre réglementaire 3.1. Cadre européen Plusieurs décisions communautaires concernent l’utilisation des bandes de fréquences 1980- 2010 MHz (pour les communications Terre-satellite) et 2170-2200 MHz (pour les communications satellite-Terre) par des systèmes mobiles par satellite : 1 Décision du Parlement européen et du Conseil du 30 juin 2008 concernant la sélection et l’autorisation de systèmes fournissant des services mobiles par satellite (MSS). 2 Décision de la Commission du 13 mai 2009 concernant la sélection des opérateurs de systèmes paneuropéens fournissant des services mobiles par satellite (MSS). 3 Solaris Mobile Limited sera renommée ultérieurement Echo Star. 4 European Aviation network. 3 • la décision 2007/98/CE5 qui a pour objet d’harmoniser les conditions garantissant la disponibilité et l’utilisation rationnelle des bandes de fréquences 1980-2010 MHz et 2170-2200 MHz pour les systèmes fournissant des services mobiles par satellite dans la Communauté ; • la décision 626/2008/CE1 qui a pour objet de favoriser le développement d’un marché intérieur concurrentiel des services mobiles par satellite dans la Communauté et d’assurer une couverture progressive dans tous les États membres ; • la décision 2009/449/CE2 qui retient Inmarsat Ventures Limited et Solaris Mobile Limited3 comme candidats admissibles à l’issue de la première phase de sélection de la procédure de sélection comparative prévue à la décision 626/2008/CE ; • la décision 2011/667/UE6 qui définit les modalités de l’application coordonnée des règles d’exécution des États membres concernant un opérateur autorisé de systèmes mobiles par satellite en cas de manquement présumé aux conditions communes dont son autorisation est assortie. En particulier, la décision 626/2008/CE contient les dispositions pertinentes relatives aux ETC. L’article 2.2 de la décision 626/2008/CE contient les définitions suivantes : « a) « systèmes mobiles par satellite », les réseaux de communications électroniques et installations associées permettant de fournir des services de radiocommunications entre une station terrienne mobile et une ou plusieurs stations spatiales, ou entre des stations terriennes mobiles à l’aide d’une ou de plusieurs stations spatiales, ou entre une station terrienne mobile et un ou plusieurs éléments terrestres complémentaires utilisés en des points déterminés. Les systèmes de ce type comprennent au moins une station spatiale; b) « éléments terrestres complémentaires » de systèmes mobiles par satellite, les stations au sol utilisées en des points déterminés afin d’augmenter la disponibilité du service mobile par satellite dans les zones géographiques, situées à l’intérieur de l’empreinte du ou des satellites du système, où les communications avec une ou plusieurs stations

Interactive system) INTRODUCTION Malaysian Flight MH370, a modern airliner B777, disappeared seven years ago on 2014.03.08 seemingly without a trace. Authorities and experts from various fields (i.e. Inmarsat) did not prevail until today in finding the wreckage of the modern airliner and wide body aircraft Boeing B777-200ER. The ham radio community can contribute by using stored WSPR data since 2008 from the database www.wsprnet.org. The data for that night's tragedy as well as the SAR operations exist in addition to many air accidents (AF447, MH17,...). The doomed flight happened close to the peak of solar cycle 24 in April 2014. In 2021 we have detected several aircraft in Antarctica such as a B787-9, two Dassault Falcon 900EX, an Iljuschin IL- 76TD and a DC3C commuter airplane by conducting WSPR tests between DP0GVN as TX and ZL2005SWL as RX. Reference location data were used from Flightradar24. Some radio paths also succeeded from Australia (VK), EA8 and South America. This kind of research was not possible before the 2nd half of 2020 as there were not enough ADS-B receivers on parts of the shore line of Antarctica in the vicinity for airfields from Neumayer III station QAN, SANAEIV, QAT, QAO, QAP to Australian Davis Station QAD.
