Y como final, un cuento .............................................................. 813 9 NOTA INTRODUCTORIA Recoge este libro una serie de artículos sobre Historia del Derecho, del Estado y la Administración, aparecidos en los últimos años en revistas científicas, libros- homenaje por efemérides académicas, y libros colectivos de naturaleza diversa, algunos coordinados o dirigidos por el propio autor. En aras de un mayor orden y sistemática, los artículos han sido agrupados en seis partes o secciones que tienen un fondo de afinidad. La primera trata del gobierno del Estado en el Antiguo Régimen, e incluye, tras una síntesis de la historia de la monarquía, varios trabajos correspondientes a distintos reinados; así los referidos al gobierno de Carlos V y Felipe II, en el siglo XVI; a los de priva- dos y validos en el XVII; al relativo a la participación de ministros italianos en el XVIII, y a los de Carlos IV e Isabel II en ese siglo y en el XIX. Por último, dos estudios sobre la presencia de la nobleza y de los extranjeros en general en los altos cargos del gobierno de España. La segunda parte se centra en la historia de la Administración territorial y, más en concreto, en los Decretos de Nueva Planta, con una visión general y dos trabajos sobre esos Decretos en Aragón y Cataluña. La tercera, más amplia, es la relativa a la Administración Central, en la que, tras un artículo introductorio sobre el régimen polisinodial o de Consejos, y el ministerial de las Secretarías del Despacho, se ofrecen otros particulares sobre instituciones de los reinados de los Austrias, del reformismo borbónico o de la ordenación de la Administración en la Constitución de Bayona. Concluye con unas reflexiones sobre el Consejo de Estado como organismo cardinal en la Administración pública de los últimos siglos. La cuarta parte da cabida a trabajos referidos a América. Entre una introduc- ción sobre la condición jurídica de los indios, y el epílogo a propósito de ciertas propuestas hechas desde España de abandonar todos o parte de los territorios de ultramar, esos trabajos se dedican al organismo principal, el Consejo de Indias, en los siglos XVI, XVII y XVIII, refiriendo las luchas por el poder dentro de él; al complementario Consejo de Cámara de Indias y a la Secretaría del Despacho de Indias que luego se transformará en Ministerio de Ultramar. 11 Estudios de Historia del Derecho La quinta parte contiene trabajos sobre las Cortes y Constitución de Cádiz, y sobre ciertos lugares (Cuba), personas (Antonio Alcalá Galiano) o instituciones (el municipio) especialmente relacionadas con el mundo gaditano y el recién estre- nado liberalismo español. La sexta, y última, en fin, es una miscelánea de temá- tica diversa. Encontrará en ella el lector, en materia de fuentes, un estudio sobre la compleja génesis de la Nueva Recopilación de 1567 y sus sucesivos redactores. En lo relativo a historiografía, otro referido a Joaquín Costa como historiador del Derecho, y otro más sobre las relaciones

Castillo August, 2017 ii ABSTRACT This dissertation examines the role of the Catholic Church in defining racial categories and construction of the social order during and after the Spanish conquest of Mexico, then New Spain. The Catholic Church, at both the institutional and local levels, was vital to Spanish colonization and exercised power equal to the colonial state within the Americas. Therefore, its interests, specifically in connection to internal and external “threats,” effected New Spain society considerably. The growth of Protestantism, the Crown’s attempts to suppress Church influence in the colonies, and the power struggle between the secular and regular orders put the Spanish Catholic Church on the defensive. Its traditional roles and influence in Spanish society not only needed protecting, but reinforcing. As per tradition, the Church acted as cultural center once established in New Spain. However, the complex demographic challenged traditional parameters of social inclusion and exclusion which caused clergymen to revisit and refine conceptions of race and gender.

Pels esdeveniments al·ludits, aquesta obra ha de datar de l’inici de la Guerra de la Successió (1702-1715), probablement de juny de 1706 o poc després. L’autor anònim s’adreça directament a l’arxiduc Carles d’Àustria tot incitant-lo a deixar la conquesta d’Aragó per la del Rosselló, on comptarà amb el suport de la po- blació autòctona. Aquesta peça constitueix un document notable sobre l’impacte d’aquest conflicte bèl·lic a la Catalunya del Nord uns cinquanta anys després d’haver estat annexionada a la corona de França en el Tractat dels Pirineus (1659). Paraules clau arxiduc Carles III d’Àustria, Guerra de la Successió, Rosselló, poesia popu- lar, propaganda Abstract: AN UNPUBLISHED POEM ABOUT THE WAR OF THE SPANISH SUCCESSION IN ROUSSILLON We edit and contextualise an unpublished and unknown poem copied in ms. 1052 of the University of Barcelona Library. Judging from the events mentio- ned, this work must date from the beginning of the War of the Spanish Suc- cession (1702-1715), probably in June 1706 or shortly thereafter. The anony- mous author goes straight to the Archduke Charles III of Austria, urging him to change the conquest of Aragon for the conquest of Roussillon, where he will have the support of the local populace.

    MEADOWS MUSEUM ANNOUNCES SEPTEMBER 20TH OPENING DATE FOR POSTPONED ALONSO BERRUGUETE EXHIBITION, FIRST MAJOR EXHIBITION OF THE ARTIST’S WORK OUTSIDE OF SPAIN Accompanying exhibition of pre-Spanish Civil War photographs from Meadows’ Archivo Mas collection show Berruguete’s art works in their original contexts DALLAS (SMU)—September 2, 2020— The Meadows Museum, SMU, has announced September 20th as the opening date of a major exhibition exploring the art and history of the Spanish Renaissance sculptor Alonso Berruguete (c. 1488–1561), whose dramatic style—reflecting the more than ten years he spent in Italy in the early years of his career—revolutionized the arts of Spain. Alonso Berruguete: First Sculptor of Renaissance Spain is the first exhibition devoted to the artist to be presented outside Spain. Originally scheduled to open in March, the exhibition was postponed due to the COVID-19 pandemic. Organized by the Meadows Museum and the National Gallery of Art, Washington, in collaboration with the Museo Nacional de Escultura, Valladolid, Spain, the exhibition includes some 45 paintings, sculptures, and works on paper drawn from a range of international collections. In tandem with Berruguete’s work, the Meadows is also presenting an exhibition of photographs—originally from the Archivo Mas and now in the holdings of the museum—that provide the rare opportunity to see some of Berruguete’s larger commissions in their original locations. Berruguete Through the Lens: Photographs from a Barcelona Archive includes 31 black- and-white images from the early 20th century that reflect the work of Spaniards to create and preserve a visual record of Spain’s artistic patrimony.

Traditio- nalistic vision of regionalism by Juan Vàzquez de Mella (1861—1928) In response to the emergence of the ethnic nationalism with increasing separatist ten- dencies in Catalonia and the Basque Country at the turn of the 20th century Juan Vàsquez de Mella — the main theorist of Carlism (Carlismo) — redefined the traditionalist concept of Spanish regionalism that positioned itself equally distinctly from the liberal centralism and from the separatism of regional nationalisms. The core of this concept was the treatment of each region as a relatively autonomous community, yet linking its unique lifestyle with the others in the spirit of unity combining all regions with what is common and supreme, i.e. the nation and the state. Spain is hence the federation of regions who share — despite their specific characteristics — the common history and who belong to the same civilisa- tion (hispanidad), itself inseparable from the Christianity (cristiandad). Separatism — as a selfish refusal to share this destiny with other regions — is considered by the author as an unacceptable attitude, comparable — depending on the degree and consequences of the said separation — with schism, heresy or even religious apostasy. On the other hand, Vàsquez de Mella granted the state the sovereign authority exclusively in the area of the relations with the Church, foreign policy, army command, public order as well as the intermediation and arbitration between the regions and social classes, leaving all the other competences with the local, trade and provincial communities.
