1.2 VOTES OF CONGRATULATIONS

An Chomhairle extended a vote of congratulations to the following:-

- Rochestown College on winning the U16½ Munster Football College Title. - Cork Senior Hurlers on winning the Division 2 National Hurling League. - Glanmire Basketball Team on winning the National Basketball Title. - Blue Demons Basketball Team on winning the National Basketball Title. - Mayfield United Youth Teams achievement on reaching the Munster Youth Cup Final for the 1st time in the Clubs History. - T.E.A.M on the organisation of St. Patrick’s Festival. - The Lord Mayor on St. Patrick’s Festival Charities Ball - The Lord Mayor on St. Patrick’s Festival Flower Show. - Cork County Board (GAA) on securing the promotion to the top tier of the League, good wishes for the rest of the season. - Cork City F.C., on winning the U19 League. - Mayfield Training Centre on the display of their painting/photo’s in the Foyer of the City Hall, a result of the positive work with you people in Mayfield.

1.3 LORD MAYOR’S ITEMS

1.3.1 THE FREEDOM OF THE CITY OF CORK

An tArd-Mhéara nominated President Michael D. Higgins for The Freedom of the City of Cork, An tArd-Mhéara stated that:-

Michael D. Higgins was elected President of Ireland on 11th May 2011, also served as a Member of Dáil Éireann for 25 years and a Member of the Seanad for 9 years. A passionate political voice, poet, writer, academic, statesman.

In his dedicated life to public service;

 Instrumental in bringing forward private members bill, to abolish the status of illegitimacy for the first time, putting the right of the child above property in the state.  Raising and dealing with issues that were neither favourable nor fashionable, such as the Bill for Decriminalisation of Homosexuality  Repeal of Section 31 of the Broadcasting Act  Ireland first Minister of the Arts & Gaeltacht setting up TG4. His reinvigoration of the Irish Film Industry. Locally his part played in supporting the setting up of the Tryscal Arts and the Quay Co-Op.  As Minister with his keen interest in environment and heritage he drove the reclaiming and opening up of 1,000 km of Ireland’s canal network.  As Minister he had direct responsibility for the Irish Language and for the economic and social development of Irish speaking areas in the state.  His solidarity in supporting immigrants, particularly Irish immigrants in Great Britain.  Promotion of Education, first Member of his family to access higher education all his life he has been passionate about access to education and worked extensively in the promotion of, and putting in place evening classes for interested citizens.  Ability to articulate and raise international human rights issues such as Somalia, Chile, Palestine  His empathy with people, and in recent weeks visiting Cork to meet and listen to business and shop owners, following the recent floods.  His flow of language, being able to converse in subjects from human rights, arts, and in particular his passion for sports and his own interest being soccer.

In recognition of President Michael D. Higgin’s commitment to public service. The Presidents outstanding achievements in advancing civil rights and social justice nationally and internationally I nominate President Michael D. Higgins for the Freedom of the City.

As the numbers voting for awarding The Freedom of the City of Cork were greater than those voting against, An tÁrd-Mhéara declared the vote carried and The Freedom of the City of Cork to be awarded to President Michael D. Higgins.

1.3.2 CITY MANAGER

An tArd-Mhéara and Party Whips expressed their thanks and appreciation to the City Manager for all his help and advice to them over the last three years, and wished him every happiness in his future role as Cork County Manager. The City Manager thanked An tArd-Mhéara and Comhairleoirí for their kind words.

An Chomhairle noted the City Manager’s Report dated the 24th March 2014 on No. 1, Lapp’s Quay.

2. MINUTES

An Chomhairle considered and approved the minutes of the following:-

 Ordinary Meeting of An Chomhairle held on 10th March 2014  Comhairleoir P. Gosh clarified that following Council agreement at its meeting of the 24th February 2014, that traders directly affected by the works on Washington Street be invited to the meeting which is being arranged with the NTA.

3. QUESTIONS

3.1 COST OF THE REPORTS UNDERTAKEN BY MVA ( KNOWN NOW AS SYSTRA) FOR

In response to the following question submitted by Comhairleoir L. McGonigle, a written reply was circulated as outlined below:-

Can the manager provide the council with the cost of the reports undertaken by MVA (known now as Systra) for Cork city council and can he confirm as to whether each of these reports were tendered?

The reports are as follows:

1. The Cork Area Transit Study (CATS), 2009 2. The CASP Transport Model Development, 2010-present day 3. Cork Docklands Transport Assessment, 2009 4. Dunkettle Interchange Assessment, 2010 4

Can he also confirm that Systra do not have a Cork office?

REPLY

The Transportation Division advises that the following projects were not carried out by Cork City Council and so we are not in a position to advise on the procurement or the costs associated with them.

 Dunkettle Interchange Assessment, 2010  Cork Area Public Transport Study (for NTA), 2012  Douglas Land Use and Transport Strategy (DLUTS), 2013  N28 Sustainable Transport Strategy, 2014

The Transportation Division advises in relation to the other projects as follows;

 The Cork Area Transit Study (CATS), 2009 was tendered in 2008 all work involved in modelling and production of reports € 192,345.30+ vat.  The CASP Transport Model Development, 2010 was tendered and any subsequent modelling work is done as part of a framework .  Cork Docklands Transport Assessment, 2009 . No report was carried out in relation to Cork Docklands in 2009.  City Centre Movement Strategy, 2013 was tendered in May 2012 . Arup / MVA were awarded the contract jointly and the total cost was €96818.85 + vat. Systra does not have a Cork office and are based in Dublin at 12/13 Exchange Place, IFSC, Dublin 1.

3.2 WORKS ON ELIZABETH FORT

In response to the following question submitted by Comhairleoir S. Martin, a written reply was circulated as outlined below:-

Can the Manager confirm that there is €4.275m available for works on Elizabeth Fort this year?

REPLY

A Working Group has been established to prepare a brief for exhibition design and interpretive consultants to bring forward a development plan for Elizabeth Fort. Only when this work is completed, and costed, can an application for funding be made to Fáilte Ireland to carry out this work. It is anticipated that this plan will be completed by Autumn 2014.

3.3 RESURFACING MAGLIN GOVE, TOHER

In response to the following question submitted by Comhairleoir M. Shields, a written reply was circulated as outlined below:-

Maglin Grove, Togher is in great need of resurfacing and I would be grateful if it was put on a priority list for the future when money becomes available again for such work.

In the meantime would it be possible to have the pot holes filled and maybe some patching done? It is most important in this area where large number of people use this road when attending the Togher Family Centre.

REPLY

Maglin Grove has been assessed and is programmed for pothole repairs to address existing issues. The location will be considered for inclusion in next year’s resurfacing programme.

3.4 EXPENSES ACCRUED BY COUNCILLORS

We have no record of a planning application for the banner on this property. The building is not on the Protected Structure list or on the list of Architectural Heritage sites.

3.7 NOISE EMANATING FROM TRAFFIC ON THE SOUTH RING ROAD

In response to the following question submitted by Comhairleoir J. Buttimer, a written reply was circulated as outlined below:-

To ask the City Manager in relation to noise emanating from traffic on the South Ring Road;

I. What sound mapping was conducted on the South Ring Road between the Kinsale Road Flyover/Interchange and the Bandon Road Flyover/Interchange? II. What does the mapping show for the N40/N25 from the east of Westside Estate Togher Cork at lower Pouladuff Road flyover to the west at the Bandon Road interchange? III. What sound mitigation measures were identified for this roadway, were those measures put in place and was their efficacy assessed? IV. Can he confirm if specific wall mounted measures were identified for properties in Westside Estate and, if so, when is it proposed to have these installed? And,

V. What sound mitigation measures are identified for Brampton Court/Tiffany Downs?

REPLY

I. As part of the Environment Impact Statement (EIS) process in 2003/2004, an assessment was carried out of the likely noise impact associated with the scheme as follows. In order to assess the noise impact of any proposed road scheme, the following methodology is adopted. The first stage is to assess and quantify the noise environment at representative sensitive receptors that may be affected by the proposed development. In the case of a road scheme, the selected noise sensitive locations are likely to be those in closest proximity to the proposed road. The noise levels resulting from the operational phases are then calculated using established prediction techniques. Traffic noise levels are predicted in accordance with relevant guidelines and the predicted values are then assessed against pertinent conditions in order to assess the need for mitigation measures. The noise impact is assessed by comparing the predicted noise climates both with and without the proposed scheme in place. This procedure is in accordance with the guidance currently advocated by the National Roads Authority and employed in respect of major road schemes. II. The mapping identified the mitigation measures for this roadway. These included low noise surfacing for the road pavement, solid noise barriers on the elevated flyovers and solid noise barriers/block walls at other selected locations. III. The NRA will only fund additional noise barriers where the noise levels are predicted to increase as a result of the scheme. The pre-construction noise assessment for this scheme identified the mitigation measures for this roadway and most of these have now been put in place as part of the contract. These include low noise surfacing for the road pavement, solid noise barriers on the elevated flyovers and solid noise barriers/block walls at other selected locations. The contract for this scheme requires the contractor to carry out noise surveys after the works have been completed and the cost of this work is included in the contract sum. The works are not complete so the surveys have not yet been done. IV. No wall mounted measures were identified for properties in Westside Estate. V. A 2.4m high block wall was identified for Brampton Court/Tiffany Downs but the residents opted to retain the existing mature trees rather than have a new block wall which would have required their removal.

3.8 LETTER TO CITY MANAGER BY CORK CITY COUNCIL TENANTS RESIDENTS OF THE GLEN AND RATHMORE ROADS AFFECTED BY THE CONSTRUCTION ON THE NEW CORK PRISON

In response to the following question submitted by Comhairleoir T. Gould, a written reply was circulated as outlined below:-

Has Cork City Council acted upon the request made in a letter to the City Manager on the 20/04/14 by residents of the The Glen and Rathmore Road areas who are tenants of Cork City Council and are affected by the construction of the new Cork Prison.

1. Concerns regarding the risk of structural instability to homes emerging as a consequence of vibrations arising from the major construction works being undertaken and the equipment being used on the site. 2. As construction work advances, serious problems in relation to ongoing disturbances, noise, infestation / rodents, security risks to families and children. As the landlord is Cork City Council going to do anything to support its tenants and ensure that everything is being carried out correctly?

REPLY

The construction of the new Cork prison was not subject to a normal Planning Application to Cork City Council. During the consultation process that did take place, Cork City Council made a detailed submission to The Irish Prison Service raising a number of concerns. The submission, inter alia, expressed concern regarding the potential negative impact of the development on adjacent social housing both during construction and thereafter, and included recommendations regarding monitoring of noise and vibration during construction. Concerns were also addressed regarding dust levels and traffic impact. It appears that Cork City Council have not been informed as to whether any of the detailed concerns raised or the potential negative impact were addressed in the final design or whether protective measures or ongoing monitoring were incorporated into the construction contract. In the absence of any formal role by City Council’s Planning Department in monitoring the development or the construction process, the Housing Directorate will endeavour to make contact with the Irish Prison Service to establish what, if any, measures are in place to address the matters raised.

3.9 CHANGES AFFECTING LOCAL DEVELOPMENT COMPANIES

The following question was submitted by Comhairleoir M.Nugent.

Can the Manager comment on proposed changes affecting Local Development Companies?

Can the Manager clarify if Local Authorities will now be responsible for two core funding programmes of Local Development Companies (LDCs), the Local Community Development Programme & the Rural Development Programme (Leader), can the Manager confirm if these programmes will be open to public tendering with the possibility for profit companies becoming involved? Those involved in LDCs fear for the viability of their company & services they provide as a result of these changes.

This question was deferred to the next meeting of An Chomhairle.

3.10 CORK CITY COUNCIL VANS

In response to the following question submitted by Comhairleoir K. McCarthy, a written reply was circulated as outlined below:- 46

To ask the City Manager, why the 2014 City Council vans have a KK registration plus possess an ad for the maker of the coat of arms sticker on the side of the vans?

REPLY

The City Council is now sourcing its fleet vehicles through a hire contract which was tendered during 2012/2013. These vehicles are hired and not owned by the City Council. There is no ads for the crest maker affixed to the vehicles.

3.11 NEW LIGHTING AT THE LOUGH

In response to the following question submitted by Comhairleoir M. Finn, a written reply was circulated as outlined below:-

Is there any progress on the provision of new lighting at The Lough?

REPLY

The 2014 budgetary allocations for the Transportation Division do not provide for new lighting at the Lough. The request will however be referred to the Environment & Recreation Directorate and if resources can be secured proposals will be developed in accordance with same.

3.12 TOTAL AMOUNT COLLECTED FROM HOUSEHOLD CHARGE

In response to the following question submitted by Comhairleoir T. Shannon, a written reply was circulated as outlined below:-

To ask the City Manager to report to City Council on the total amount (in cash terms) collected from the residents of Cork City in respect of the Household Charge and the Property (Family Home) Tax over the years 2012, 2013, 2014 (2014 full year)?

How much of this Household/Property (Family Home) Tax has been returned to Cork City Council as promised by the Government when imposing this tax for use locally in the provision of services to residents of Cork City?

What would the impact (in cash terms) be on the finances of Cork City Council if the following came about:

(a) 15% reduction in the amount levied under the Property (Family Home) Tax? (b) 15% increase in the amount levied under the Property (Family Home) Tax?

What impact would a & b above have on the average (typical) household in Cork City (in cash terms), in terms of savings or increases levied?

REPLY

The Household Charge, requiring the owners of certain residential properties to pay an annual household charge in respect of each property to the local Authority in whose functional area the residential property was situated, came into effect with the passing 47 of the “Local Government (Household Charge) Act 2011”. A full charge applied for 2012. The amount collected in 2012 in respect of the Cork City area was € 3.55m.

The Local Property Tax, which is a charge on the market value of all residential properties in the State, came into effect with the passing of the “Finance (Local Property Tax) Act 2012”. It is being administered by the Revenue Commissioners and a half year charge applied in 2013. A full year charge will apply in 2014.

The latest available figures published by the Revenue Commissioner, (February 2014), which is a preliminary analysis advise that there was a 93% national compliance rate in 2013, with actual collections of €242m.

For Cork City there was a compliance rate of approximately 91.4% in 2013, with actual collections of €5.6m.

While the 2014 forecasted yield for LPT nationally is €550 million, the Commissioners advise that it is not possible to state the precise amount of LPT which is expected to be collected for Cork City Council in 2014. A number of factors could affect the outcome, including the continuation of the strong level of voluntary compliance that was achieved in 2013, the impact of Revenue s compliance programme to follow up with those liable persons who have failed to meet their LPT obligations for 2013 and 2014, and the compliance programme for the collection of arrears of household charge/LPT.

Based on similar compliance and collection rates for 2014 as in 2013, the expected collectable amount to be paid by Cork City Households will be €11.2m.

The Household Charge for 2012 and the Local Property Tax for 2013 and 2014 are paid into the Local Government Fund and there is no direct relationship with the General Purpose allocation to Cork City Council.

Sections 19,20 and 21 of the Finance (Local Property Tax) Act 2012 provide that a local authority may pass a resolution that the basic rate of property tax can be varied (either upwards or downwards) by a specified percentage (not to exceed 15%) in respect of relevant properties situated in the local authority’s functional area.

Where a local authority passes such a resolution, it must notify the minister in writing and inform the Revenue Commissioners of the local adjustment factor.

It is anticipated that July 1st 2014 will be appointed as the day on which sections 19, 20 and 21 of the Finance (Local Property Tax) Act come into operation so as to allow the charge for 2015 to be varied.

If 80% of the LPT were to be remitted directly to the relevant local authorities, a 15% variation for Cork City Council based on most recent Revenue Commissioners reports would result in either a reduction or increase in income of €1,344,000 for the City Council.

There are no statistics to hand as to the number of Cork City houses within the various valuation bands.

The Manager’s recommended Alterations 6, 13 and 14 are rejected. The floorspace target should be revised to reflect CASP’s minimum of 20m²/job”.

E) SUB AREA MOTION 9

“The Manager’s Proposed Alterations No. 64 to Sub Area 9: Jacob’s Island should be amended as follows to give full effect to existing planning decisions and to the proposals for 15,000 m² of business and technology offices:

 Residential Development Indicative additional population target of 964 should be omitted.  Non-residential development Gross Floor area (as a % of total) – 5% Maximum should be replaced with 30% maximum.

Non-residential type – reference to 15,000 gsm business and technology employment uses should be maintained.

Land Use Strategy Manager’s Proposal to omit reference to Business and Technology uses being acceptable on Jacob’s Island is rejected and Paragraph 1 should make specific reference to business and technology uses on Jacob’s Island.

Urban Design Last sentence of final paragraph should be omitted on page 88 of the lap which seek to restrict building heights to 3-5 stories which impairs the existing planning’s”.

‘That City Council would examine the road surface at the bus stop on Rossa Avenue particularly outside the house NO.68 [ CHARLTON ] which is right beside this stop. This whole stretch needs a reinforced surface to facilitate the high volume of buses that stop/park here and while the potholes are filled regularly these reappear again after a few days. This bus stop caters for 5 C.I.E. routes and various private coaches that facilitate the C.I.T. student population.’

16.20 TASK FORCE TO TACKLE DERELICTION IN THE BLACKPOOL AND SHANDON STREET AREAS

‘That Cork City Council would organise a Task Force to tackle dereliction in the Blackpool and Shandon Street areas to help encourage businesses to set up locally. If 63

Blackpool and Shandon Street areas are to thrive then a plan or vision needs to be put in place

The Task Force would need to be comprised of key decision makers from each department from within Cork City Council and a representative from the Business Association that could develop a framework to facilitate business start ups.

The Task Force would initiate similar to the rate schemes in the past where new businesses would pay reduced scale rates over a number of years to help establish them.

The Task Force would be key to make these areas focal points once again by identifying suitable companies to locate within these areas.’

16.22 VARIATION NO. 12 TO CORK CITY DEVELOPMENT PLAN 2009-2015

‘Having regard to the Council's decision on planning application TP 13/35575 and to Paragraph 4.54 of the City Development Plan, which indicates that the retail provision on Jacob’s Island “will” change to neighbourhood centre where it can be justified. As TP 13/35575 provides this justification, the 2009 Cork City Development Plan should be varied both in the text and zoning objective to formally recognise the TP 13/35575 site as a Neighbourhood Centre.’ (Ref Map 8: South Eastern Suburbs of volume 2 of the 2009 CDP)

17.1 END THE FLUORIDATION OF DRINKING WATER

‘That Cork City Council ends the fluoridation of drinking water to Cork City and calls on the Irish Government to end the practice of artificial fluoridating drinking water supplies because of scientific evidence of its dangers. As citizens of Europe the Irish people must have the same standard of care as our European neighbours. Currently water fluoridation does not meet the minimum standards as required of the

‘precautionary principle’ enshrined in the treaty of Europe. It is imperative that this practice ceases.’
