Dear Mr. Cates:

During August of 2019, Bio-Tech Consulting, Inc. (BTC) conducted an environmental assessment of the approximately 12.81-acre 2910 North Narcoossee Road Site. This site is located north of Deerfield Street and west of North Narcoossee Road at the physical address 2910 North Narcoossee Road; within Sections 5 & 8, Township 25 South, Range 31 East in Osceola County, Florida (Figures 1, 2 & 3). This environmental assessment included the following elements:

• Review of soil types mapped within the site boundaries; • Evaluation of land use types/vegetative communities present; • Field review for occurrence of protected flora and fauna; and, • Delineation of on-site wetland communities.

SOILS

According to the Soil Survey of Osceola County, Florida, prepared by the U.S. Department of Agriculture (USDA), Natural Resource Conservation Service (NRCS), two (2) soil types exist within the subject site (Figure 4). These soil types include the following:

• Adamsville sand, 0 to 2 percent slopes (#1) • Pomello fine sand, 0 to 5 percent slopes (#34)

The following presents a brief description of each of the soil types mapped for the subject site:

Adamsville sand (#1) is a nearly level, somewhat poorly drained soil found on narrow ridges adjacent to and slightly higher than sloughs, marshes, and lakes, and on low knolls in the flatwoods. Slopes of this soil type range from 0 to 2 percent. The surface layer of this soil type generally consists of dark gray sand about 4 inches thick. The water table for this soil type is at a depth of 20 to 40 inches for 2 to 6 months annually. Permeability of this soil type is rapid throughout.

Pomello fine sand, 0 to 5 percent slopes (#34) is a nearly level to gently sloping, moderately well drained soil found in transitional areas between the high sand ridges and the flatwoods and on knolls and low ridges throughout the flatwoods. The surface layer of this soil type generally consists of gray fine sand about 4 inches thick. This soil type has a water table at a depth of 24 to 40 inches for periods of about 1 to 4 months during normal wet seasons. During dry seasons, the water table is at a depth of about 40 to 60 inches. Permeability of this soil type is very rapid in the surface and subsurface layers, moderately rapid in the subsoil, and rapid to a depth of 80 inches or more.

The Florida Association of Environmental Soil Scientists (FAESS) does not consider the soils found on-site or their components/inclusions to be hydric. This information can be found in the Hydric Soils of Florida Handbook, Third Edition, March 2000.

LAND USE TYPES/VEGETATIVE COMMUNITIES

The 2910 North Narcoossee Road Site currently supports eight (8) distinct land use types/vegetative communities (Figure 5). These land use types/vegetative communities were identified utilizing the Florida Land Use, Cover Forms Classification System, Level III (FLUCFCS, FDOT, January 2004). The on-site upland area consists of Fixed Single-Family Units (111), Improved Pastures (211), Other Open Lands (260), Live (427), Hardwood – Conifer Mixed (434), and Mixed Hardwoods (438). The onsite wetland/ surface water areas consist of Streams and Waterways (510) and Reservoirs less than 10 acres which are dominant features (534). The following provides a brief description of these land use types/vegetative communities identified on the project site:

Uplands:

111 Fixed Single-Family Units

Near the east end of the site is an area of land with a number of permanent single-family residences. A total of three (3) residential dwellings with associated driveways, detached structures, pools, etc. were found to exist across this portion of the property. As such this area best fits the FLUCFCS classification for Fixed Single-Family Units (111). The vegetative species observed in this area include a scattered canopy and sub-canopy of laurel oak (Quercus laurifolia), live oak (Quercus virginiana), sweet gum (Liquidambar styraciflua), slash pine (Pinus elliottii), and crape myrtle (Lagerstroemia indica); with an understory of greenbrier (Smilax spp.), muscadine (Vitis rotundifolia), beautyberry (Callicarpa americana), dogfennel (Eupatorium capillifolium), beggar ticks (Bidens alba), sand blackberry (Rubus cuneifolius), St. Augustine grass (Stenotaphrum secundatum), bahiagrass (Paspalum notatum), Bermuda grass (Cynodon dactylon), and southern sandbur (Cenchrus echinatus) along with a variety of landscaping/ornamental .

211 Improved Pastures

The majority of the site’s upland community is composed of open land with scattered used as pasture for horses. As such this area best fits the FLUCFCS for Improved Pastures (211). The vegetative species observed in this area include a widely scattered canopy of laurel oak and Chinese tallow; with a ground cover composed of dogfennel (Eupatorium capillifolium), muscadine vine (Vitis rotundifolia), pokeweed (Phytolacca americana), chain fern (Woodwardia virginica), sand blackberry (Rubus cuneifolius), Bermuda grass (Cynodon dactylon), St. Augustine grass (Stenotaphrum secundatum), bahiagrass (Paspalum notatum), southern sandbur (Cenchrus echinatus), rag weed (Ambrosia artemisiifolia), vanilla (Trilisa odoratissima), and pale meadowbeauty (Rhexia mariana).

260 Other Open Lands

Along the southern boundary of the site is an area of open land with scattered trees and no clear purpose. As such, this area best fits the FLUCFCS for Other Open Lands (260). This area is fenced off from the remaining portion of the property. The vegetative species observed in this area include a canopy and sub-canopy of scattered live oak (Quercus virginiana), laurel oak (Quercus laurifolia), bluejack oak (Quercus incana), sweetgum (liquidambar styraciflua) and red maple (Acer rubrum); with an understory composed of sand blackberry (Rubus cuneifolius), wax myrtle (Morella cerifera), muscadine vine (Vitis rotundifolia), dogfennel (Eupatorium capillifolium), swamp fern (Telmatoblechnum serrulatum), beggar ticks (Bidens alba), greenbrier (Smilax spp.), torpedo grass (Panicum repens), bahiagrass (Paspalum notatm), Bermuda grass (Cynodon dactylon), and St. Augustine grass (Stenotaphrum secundatum).

427 Live Oak

Along the northern boundary of the site, near the eastern extent of the property, is an area of land with a closed canopy comprised primarily of live oak. As such, this area best fits the classification for Live Oak (427). The vegetative species observed in this area include a canopy and sub-canopy of predominantly live oak (Quercus virginiana), with scattered laurel oak (Quercus laurifolia); and an understory of greenbrier (Smilax spp.), muscadine vine (Vitis rotundifolia), pokeweed (Phytolacca americana), beggar ticks (Bidens alba), sand blackberry (Rubus cuneifolia), dog fennel (Eupatorium capillifolium) and American beautyberry (Callicarpa americana).

434 Hardwood – Conifer Mixed

Near the center of the eastern half of the site is an area of land with a canopy comprised of and pines without neither species dominating. As such, this area best fits the FLUCFCS for Hardwood – Conifer Mixed (434). The vegetative species observed in this area include a mixed canopy of laurel oak (Quercus laurifolia), slash pine (Pinus elliottii), live oak (Quercus virginiana), and camphor (Cinnamomum camphora); with an understory of American pokeweed (Phytolacca americana), American beautyberry (Callicarpa americana), sand blackberry (Rubus cuneifolius), beggar ticks (Biden alba), muscadine vine (Vitis rotundifolia), and greenbrier (Smilax spp.).

438 Mixed Hardwoods

Along both the eastern boundary and within the western extent of the site are areas of land with a mix of hardwood species. As such, this area best fits the FLUCFCS for Mixed Hardwoods (438). The vegetative species observed in this area include a canopy of live oak (Quercus virginiana), camphor tree (Cinnamomum camphora), laurel oak (Quercus laurifolia), sweetgum (Liquidambar styraciflua), water oak (), Japanese maple (Acer palmatum), and Chinese tallow (Triadica sebifera); with an understory of American pokeweed (Phytolacca americana), American beautyberry (Callicarpa americana), sand blackberry (Rubus cuneifolius), beggarticks (Biden alba), dogfennel (Eupatorium capillifolium), greenbrier (Smilax spp.), and muscadine vine (Vitis rotundifolia).

Wetlands/Surface Waters:

510 Streams and Waterways

Near the center of the site is an upland excavated ditch that connects the on-site reservoir to a reservoir just south of the site. As such this area best fits the FLUCFCS for Streams and Waterways (510). The vegetative species observed in this area include scattered water oak (Quercus nigra)

and laurel oak (Quercus laurifolia) along the perimeter of the ditch; with greenbrier (Smilax spp.), duckweed (Lemna spp.), torpedo grass (Panicum repens), marsh pennywort (Hydrocotyle spp.), and creeping primrose willow (Ludwigia repens).

534 Reservoirs less than 10 acres which are dominant features

Near the center of the site is an upland excavated water feature. The surface water has an area of approximately 0.5 acres. As such, this area best fits the FLUCFCS for Reservoirs less than 10 acres which are dominant features. The vegetative species observed in this area include a perimeter of scattered water oak (Quercus nigra), laurel oak (Quercus laurifolia), wax myrtle (Morella cerifera), and Brazilian pepper (Schinus terebinthifolia); with spatter dock (Nuphar advena), American white waterlily (Nymphaea odorata), duckweed (Lemna sp.), nutgrass (Cyperus rotundus), torpedograss (Panicum repens), marsh pennywort (Hydrocotyle sp.), and creeping primrose willow (Ludwigia repens).

PROTECTED SPECIES

Utilizing methodologies outlined in the Florida’s Fragile Wildlife (Wood, 2001); Measuring and Monitoring Biological Diversity Standard Methods for Mammals (Wilson, et al., 1996); and Florida Fish and Wildlife Conservation Commission’s (FFWCC) Gopher Tortoise Permitting Guidelines (April 2008 - revised May 2017), an assessment for “listed” floral and faunal species occurring within the subject site boundaries was conducted on August 20, 2019. The survey covered approximately 100% of the subject site’s developable area, included both direct observations and indirect evidence, such as tracks, burrows, tree markings and vocalizations that indicated the presence of species observed. The assessment focused on species that are “listed” by the FFWCC’s Official Lists - Florida’s Endangered Species, Threatened Species and Species of Special Concern (December 2018) that have the potential to occur in Osceola County (Table 1).

No species listed by either The Florida Department of Agriculture (FDA) or U.S. Fish and Wildlife Service (USFWS) was identified on the project site during the assessment conducted. The following is a list of those wildlife species identified during the evaluation of the site:

No species observed on site were identified in the FFWCC’s Official Lists - Florida’s Endangered Species, Threatened Species and Species of Special Concern (December 2018). The following provides a brief description of wildlife species as they relate to the development of the project site.

Indigo Snake (Drymarchon couperi) Federally Listed as “Threatened” by USFWS

The indigo snake (Drymarchon couperi) is a federally listed threatened species. The basis for this listing was a result of dramatic population declines caused by over-collecting for the domestic and international pet trade as well as mortalities caused by rattlesnake collectors who gassed gopher tortoise burrows to collect snakes. Since its listing, habitat loss and fragmentation by residential and commercial expansion have become much more significant threats to the . This species is widely distributed throughout central and south Florida and primarily occurs in sandhills habitat in northern Florida and southern Georgia.

No evidence of indigo snakes was observed within the subject site during the wildlife survey conducted by BTC. Furthermore, the site does not contain gopher tortoise burrows or habitat to support this species. Additionally, based upon the USFWS’s August 2017 Revised Consultation Key for the Eastern Indigo Snake, the property is located within Osceola County and will result in the removal of less than 25 acres of eastern indigo snake habitat, a key determination would result in a finding of “NLAA.” (Not Likely to Adversely Affect). Based on the required permit conditions that would allow the above finding, a survey specific to indigo snakes should not be required. However, if for some reason a survey is required, the survey can be accomplished from October 1st thru April 30 for a minimum of five (5) surveys with 2 days of optimal weather (overnight low temperature above 60º F). At a minimum, the Corps permit will be conditioned for the use of the USFWS’s “Standard Protection Measures for the Eastern Indigo Snake.” It will also be

conditioned “such that all gopher tortoise burrows, active or inactive, will be excavated prior to site manipulation in the vicinity of the burrow. If an eastern indigo snake is encountered, the snake must be allowed to vacate the area prior to additional site manipulation in the vicinity.” Any permit will also be conditioned “such that holes, cavities, and snake refugia other than gopher tortoise burrows will be inspected each morning before planned site manipulation of a particular area, and, if occupied by an eastern indigo snake, no work will commence until the snake has vacated the vicinity of proposed work.” As long as the above mentioned “Standard Protection Measures” are adhered to, the development activities associated with the subject site would result in a key determination of “Not Likely to Adversely Affect” the eastern indigo snake.

Bald Eagle (Haliaeetus leucocephalus) State protected by F.A.C. 68A-16.002 and federally protected by both the Migratory Treaty Act (1918) and the Bald and Golden Eagle Protection Act (1940)

In August of 2007, the US Fish and Wildlife Service (USFWS) removed the Bald Eagle from the list of federally endangered and threatened species. Additionally, the Bald Eagle was removed from FFWCC’s imperiled species list in April of 2008. Although the Bald Eagle is no longer protected under the Endangered Species Act, it is still protected under the Bald and Golden Eagle Protection Act, the Migratory Bird Treaty Act, and FFWCC’s Bald Eagle rule (Florida Administrative Code 68A-16.002 Bald Eagle (Haliaeetus Leucocephalus).

In May of 2007, the USFWS issued the National Bald Eagle Management Guidelines. In April of 2008, the FFWCC adopted a new Bald Eagle Management Plan that was written to closely follow the federal guidelines. In November of 2017, the FFWCC issued “A Species Action Plan for the Bald Eagle” in response to the sunset of the 2008 Bald Eagle Management Plan. Under the USFWS’s management plans, buffer zones are recommended based on the nature and magnitude of the project or activity. The recommended protective buffer zone is 660 feet or less from the nest tree, depending on what activities or structures are already near the nest. As provided within the above referenced Species Action Plan, the USFWS is the regulating body responsible for issuing permits for Bald Eagles. In 2017, the need to obtain a State permit (FFWCC) for the take of Bald Eagles or their nests in Florida was eliminated following revisions to Rule 68A-16.002, F.A.C.. A USFWS Bald Eagle “Non-Purposeful Take Permit” is not needed for any activity occurring outside of the 660-foot buffer zone. No activities are permitted within 330 feet of a nest without a USFWS permit.

In addition to the on-site evaluation for “listed” species, BTC conducted a review for any FFWCC recorded Bald Eagle nests on or within the vicinity of the project site. This review revealed that there is one (1) Bald Eagle nest (OS-155), through the 2016-2017 nesting season, within one (1.0) mile of the 2910 North Narcoossee Road Site. Nest OS-155 is located approximately 4,992-feet to the south of the site. Thus, the 2910 North Narcoossee Road Site lies outside the 660-foot

protection buffer of the nest, and therefore the nest, at its current location, would not impose limitations on developing the subject site. As such, no developmental constraints are anticipated with respect to Bald Eagle nests.

USFWS CONSULTATION AREAS

The U.S. Fish and Wildlife Service has established “consultation areas” for certain listed species. Generally, these consultation areas only become an issue if USFWS consultation is required, which is usually associated with permitting through the U.S. Army Corps of Engineers. The reader should be aware that species presence and need for additional review are often determined to be unnecessary early in the permit review process due to lack of appropriate habitat or other conditions. However, the USFWS makes the final determination.

Consultation areas are typically very regional in size, often spanning multiple counties where the species in question is known to exist. Consultation areas by themselves do not indicate the presence of a listed species. They only indicate an area where there is a potential for a listed species to occur and that additional review might be necessary to confirm or rule-out the presence of the species. The additional review typically includes the application of species-specific criteria to rule-out or confirm the presence of the species in question. Such criteria might consist of a simple review for critical habitat types. In other cases, the review might include the need for species-specific surveys using established methodologies that have been approved by the USFWS.

The following paragraphs include a list of the USFWS Consultation Areas associated with the subject site. Also included, is a brief description of the respective species habitat and potential for additional review:

Audubon’s Crested Caracara (Polyborus plancus audubonii) Federally Listed as “Threatened” by USFWS

The subject site falls within the USFWS Consultation Areas for the species Audubon’s Crested Caracara (Polyborus planeus audubonii). Currently the Audubon’s Crested Caracara is listed as threatened by the USFWS due primarily to habitat loss. The Audubon’s Crested Caracara commonly occurs in dry or wet prairie areas with scattered cabbage palms, lightly wooded areas with saw palmetto, scrub oaks and cypress. The Audubon’s Crested Caracara also uses improved or semi-improved pasture with seasonal wetlands. Audubon’s Crested Caracaras construct new nests each nesting season, often in the same tree as the previous year.

Although the subject site falls within the USFWS Audubon’s Crested Caracara consultation area, no crested caracaras were observed and no suitable habitat for this species exists within the project boundaries. No further action should be required pertaining to crested caracaras.

Everglade Snail Kite (Rostrhamus sociabilis) Federally Listed as “Endangered” by USFWS

The project site falls within the USFWS Consultation Area for the Everglade Snail Kite. Currently the Everglade Snail Kite is listed as “Endangered” by the USFWS. Everglade Snail Kites are similar in size to Red-shouldered Hawks. All Everglade Snail Kites have deep red eyes and a white rump patch. Males are slate gray, and females and juveniles vary in amounts of white, light brown, and dark brown, but the females always have white on their chin. Everglade Snail Kites vocalize mainly during courtship and nesting. They may occur in nearly all of the wetlands of central and southern Florida. They regularly occur in lake shallows along the shores and islands of many major lakes, including Lakes Okeechobee, Kissimmee, Tohopekaliga (Toho) and East Toho. They also regularly occur in the expansive marshes of southern Florida such as Water Conservation Areas 1, 2, and 3, Everglades National Park, the upper St. John’s River marshes and Grassy Waters Preserve.

Although a portion of the project site contains wetlands/surface waters, no Everglade Snail Kites were observed within the subject site during the wildlife survey conducted by BTC. The potential habitat on site is extremely poor and, as such, a formal survey is not anticipated to be required by the USFWS or another agency to determine if any Everglade Snail Kites utilize any portions of the site.

Florida Grasshopper Sparrow (Ammodramus savannarum floridanus) Federally Listed as “Endangered” by USFWS

The Florida Grasshopper Sparrow is a subspecies of grasshopper sparrow that is endemic to the dry prairie of south-central Florida in the counties of Polk, Osceola, Highlands, and Okeechobee. This subspecies is extremely habitat specific and relies on fire every two to three years to maintain its habitat. This species was listed as endangered by the State of Florida in 1977. The USFWS listed the Florida Grasshopper Sparrow as endangered in 1986. The main threats to the Florida grasshopper sparrow are habitat destruction, degradation, and fragmentation. The conversion of open prairie habitat to agriculture fields has caused destruction of available habitats for the Florida Grasshopper Sparrow. Florida Grasshopper Sparrow habitat consists of large, treeless, relatively poorly-drained grasslands that have a history of frequent fires.

No Florida Grasshopper Sparrows were observed on the site during the wildlife survey conducted by BTC. Since there is no suitable habitat for this species within the site boundary, a formal survey is not required by the USFWS or another agency to determine if any Florida Grasshopper Sparrows utilize any portions of the site.

Florida Scrub-Jay (Aphelocoma coerulescens) Federally Listed as “Threatened” by USFWS

Currently the Florida Scrub-Jay is listed as threatened by the USFWS. Florida Scrub Jays are largely restricted to scattered, often small and isolated patches of sand pine scrub, xeric oak, scrubby flatwoods, and scrubby coastal stands in peninsular Florida (Woolfenden 1978a, Fitzpatrick et al. 1991). They avoid wetlands and forests, including canopied sand pine stands. Optimal Scrub-Jay habitat is dominated by shrubby scrub, live oaks, myrtle oaks, or scrub oaks from 1 to 3 m (3 to 10 ft.) tall, covering 50% to 90 % of the area; bare ground or sparse vegetation less than 15 cm (6 in) tall covering 10% to 50% of the area; and scattered trees with no more than 20% canopy cover (Fitzpatrick et al. 1991).

No Florida Scrub-Jays were observed within the project site during the wildlife survey conducted by BTC. As no suitable habitat exists within the limits of the subject site, it is not likely that a formal survey would be required USFWS or another agency to determine if any Florida Scrub- Jays utilize any portions of the site.

Red Cockaded Woodpecker (Picoides boreali) Federally Listed as “Endangered” by USFWS

The Red-cockaded Woodpecker (Picoides boreali) is a federally endangered species by the USFWS. The basis for the listing is loss and degradation of suitable habitat. This species is commonly found in open park-like pine forests maintained by periodic fire, such as mature long- leaf pine ecosystem. The Red-cockaded Woodpecker is a federally and state protected endangered species that is protected and should not be injured, harmed, molested or killed.

No Red-Cockaded Woodpeckers were observed within the subject site during the wildlife survey conducted by BTC. As there is no suitable habitat and no nesting trees were found within the limits of the subject site, it is not anticipated that a formal survey would be required by the USFWS or another agency to determine if any Red-Cockaded Woodpeckers utilize any portions of the site.

ENVIRONMENTAL CONSTRAINTS

Permitting through Osceola County, the South Florida Water Management District (SFWMD), and the US Army Corp of Engineers (USACOE) would be required to develop the project site. The site resides in the Lake Hart drainage Basin.

Osceola County

With respect to Osceola County, all wetland and/or other surface water limits as approved by the SFWMD will be acceptable. However, as the subject property is located within the County’s Urban Growth Boundary (UGB), per Policy 1.4.7, dependent upon the final UMAM scores, the wetlands may be classified as Category I, II or II Wetlands. As such, and dependent upon the final wetland category, Osceola County will potentially limit the ability to impact those wetlands (Policy 1.4.10) and will also require upland buffers specific to each of the above categories (Policy 1.4.11). See below for policy requirements:

Policy 1.4.10: Wetland protection standards within UGB.

Within the UGB the following wetland protection standards shall apply:

1. The County shall limit the removal, alteration, and encroachment within Category I wetlands to only those cases where it is in the public’s interest or no other feasible or practical alternatives exist that will permit a reasonable use of the land. Maximizing protection, preservation, and continuing viability of these wetlands shall be the principal consideration for determining the amount and the section of a wetland allowed to be removed, altered or encroached upon.

2. Removal, encroachment, and alteration may be allowed in Category II wetlands where it is in the public’s interest or no other feasible or practical alternatives exist that will permit a reasonable use of the land, or for the purpose of increasing connectivity between neighborhoods as part of a TND development. The value of enhanced neighborhood or community connectivity will be balanced against the value of the wetlands.

3. Removal, encroachment, and alteration of Category III wetlands is presumed to be allowed unless removal, encroachment, or alteration is determined to be contrary to the public interest.

Policy 1.4.11: Mandatory setbacks around wetlands.

Osceola County shall require mandatory setbacks around wetlands. The required setbacks shall remain in native vegetation with impervious surfaces limited to only that allowed in Policy 1.4.16. The mandatory setbacks are as follows:

1. A minimum of a 50-foot setback for Category I wetlands.

2. An average of a 50-foot setback with a minimum of 25 feet at any given location for Category II wetlands.

2. An average of 25-foot setback with a minimum of 15 feet at any given location for Category III wetlands.

Based upon the small size and isolation of the onsite surface waters, it is anticipated that both will be classified as Category III systems per above.

South Florida Water Management District

An Environmental Resource Permit (ERP) will be required through the South Florida Water Management District (SFWMD) for all wetland and/or other surface water impacts (both direct and secondary) in association with the proposed development plan. Impacts to the project’s wetland and/or other surface water communities would be permittable by SJRWMD as long as the issues of elimination and reduction of wetland impacts have been addressed and as long as the mitigation offered is sufficient to offset the functional losses incurred via the proposed impacts.

US Army Corps of Engineers

Permitting will also be required for the project’s wetland/surface water impacts by the US Army Corps of Engineers (USACOE). As the ERP is no longer a joint application between the SFWMD and the USACOE, the Corps will not be notified/copied upon submittal of the ERP application to the District. As with the District, it is anticipated that all impacts to the project’s wetlands communities would be permittable by the USACOE as long as the issues of elimination and reduction of wetland impacts have been addressed and as long as the mitigation offered is sufficient to offset the functional losses incurred via the proposed impacts.
