Purpose

This report is to request that Council nominate its delegates to attend the 5th Annual TEQ (Tourism Events Queensland) Regional Events Conference to be held in Townsville from the 1st - 3rd November 2013.

Background/Discussion

At the 5th Annual Regional Events Conference, delegates will learn from tourism and events industry experts how to build an instant database of advisors, consultants and suppliers; develop long-term support networks and exchange ideas and experiences. The skills, networks and knowledge gained from the Regional Events Conference will help delegates approach their events like a business and pursue strategic planning for future growth and success.

Councillors discussed the matter at their Councillors Forum.

9.3 INFLOW & INFILTRATION PROGRAM - OCTOBER TO DECEMBER 2013

Purpose

To present to Council, the sewerage network Inflow & Infiltration (I&I) Source Detection Investigations area of operations for the period October - December 2013 and to seek the adoption of a resolution as required by legislation in accordance with the Local Government Act 2009.

Background/Discussion

The proposed works under the I&I Program identifies the sources of stormwater inflow and groundwater infiltration into the sewerage network, which result in surcharge and sewage spillage events during the wet season. The Report, titled "Inflow & Infiltration Management Plan for Mackay and Sarina" dated November 2010, identified a number of sewerage catchments for prioritised Inflow & Infiltration Source Detection works comprising of smoke testing, property and maintenance hole (MH) inspections and /or sewer pipeline CCTV surveys.

The smoke testing and MH inspections target Rainfall Dependent Inflow & Infiltration (RDII) whereas CCTV surveys target sewers believed to be experiencing high Groundwater Infiltration (GWI) due to a combination of poor structural condition and high groundwater elevation.

In response to the 2010 report, a number of prioritised catchments have already been surveyed for Inflow & Infiltration.

Subsequent to the Inflow & Infiltration Management Plan, other planning investigations have identified that current areas of concern for High RDII are catchments contributing to the following sewage pump stations (SPS):

 Connors Road SPS  Gooseponds SPS  Zammit Street SPS  Beaconsfield No 1 SPS

While the Connors Road SPS catchment is comprised mostly of commercial/industrial properties, the catchments are predominantly residential properties.

In addition to Inflow & Infiltration Source Detection benefits, the CCTV and MH inspection work proposed for the Gooseponds is required for asset condition assessment due to the age of the sewers. It is therefore proposed to carry out comprehensive Source Detection (smoke testing, property inspections, manhole inspections and CCTV inspections) in the Gooseponds catchment but only smoke testing and MH inspections in the Connors Road, Zammit Street and Beaconsfield No 1 SPS catchments as the latter were constructed relatively recently.

Mackay Regional Council has appointed the following contractors to compliment the Mackay Water Service’s (MWS) Network Operations internal program of Inflow & Infiltration Source Detection activities in order to take advantage of the dry weather to maximise ground covered during these investigations:

 Interflow for sewer pipeline CCTV inspections  Flowpro for smoke testing, property inspection and MH condition assessment

We propose to carry out the inspections in the identified catchments between October and December 2013.

Consultation and Communication

The I&I Program is based on the best available operational and planning information. A Working Group, with representatives from Networks, Planning and Sustainability, Infrastructure Delivery and Business Services Programs, meets as required for project related discussions to develop and implement the Program:

Public Notices will be prepared for distribution through the media in advance of the proposed works. The contents of such notices will also be available on the MRC website. Customer Services will be advised in advance of the impending communications.

An I&I related Technical Factsheet is being prepared to assist property owners to understand the nature of the most common non-compliances and this will accompany any formal Notices.

This process of communication with residents is further facilitated by a letterbox drop and doorknock by the members of the I&I Team with 48 hours advance notice provided.

The communication initiatives identified above are in keeping with the Project Community Engagement Plan and relevant legislative and regulatory requirements.

Resource Implications

The funding for these works is in the WWS Water Capital Budget 2013/2014 - SRP Inflow - Infiltration - with $1,026,000.00 allocated.

Risk Management Implications

The proposed I&I Program will help mitigate sewage surcharge and spillage events in the identified catchments and specifically into properties. The information collected from the inspections will also feed into the future remediation decision making process which will ensure a more considered allocation of Capital.

Legal advice and training has been obtained to ensure inspections and the resulting remediation enforcements, if any, are carried out within the legislative and regulatory requirements. The enforcement of defects carries some risk as there can be significant cost associated with some rectification works; however, a process has been developed to address this.

Conclusion

That Inflow & Infiltration Source Detection works are a fundamental component for managing sewage spillage from the sewerage network during wet weather. The proposed inspections will enable the mitigation of sewerage network surcharge and spillage events in the identified catchments and will be undertaken as per the requirements of the Local Government Act 2009 Chapter 5, Part 2, Subdivision 3 - Powers to enter property etc.

Officer's Recommendation

THAT Council, in accordance with the Local Government Act 2009 requirements, approve Council Authorised Officers to undertake a systematic Inspection Program to enter and inspect all or selected properties both residential and commercial/industrial as determined by the specific Inspections Schedule during the period October to December 2013, in the following catchments:

 Connors Road SPS  Gooseponds SPS  Zammit Street SPS  Beaconsfield No 1 SPS

9.4 BGCI AND ICOM JOINT CONGRESS IN NEW ZEALAND

Purpose

This report is to request that Council approve Botanic Gardens Curator Dale Arvidsson and Botanic Gardens Team Leader Ross Demuth's participation in the forthcoming Botanic Gardens Australian and New Zealand (BGANZ), Botanic Gardens Conservation International (BGCI) and The International Council of Museums (ICOM) Joint Congress to be held in Dunedin, New Zealand from 20 - 26 October 2013.

Background/Discussion

The Botanic Gardens Australia and New Zealand Inc (BGANZ) is the chief body representing the interests of botanic gardens in Australia and New Zealand. BGANZ promotes the interests and activities of Australian and New Zealand botanic gardens and botanic gardens generally and enhances the state of botanic gardens for the benefit of the community.

Botanic Gardens Conservation International (BGCI) is an international organisation that exists to ensure the world-wide conservation of threatened plants, the continued existence of which are intrinsically linked to global issues including poverty, human well-being and climate change.

BGCI represents over 700 members - mostly botanic gardens - in 118 countries. BGCI supports the development and implementation of global policy – specifically the Global Strategy for Plant Conservation (GSPC) - at a global, regional, national, and local level.

The International Council of Museums (ICOM) is an organisation created by and for museum professionals. Botanic Gardens worldwide receive the classification 'Living Museums' as institutions holding collections and displaying live specimens of plants, such as botanical and zoological gardens. Many Botanic Gardens also house historic and cultural artefacts. ICOM is a network of almost 30,000 members and museum professionals who represent the global museum community. The development of professional standards is one of the core objectives of ICOM, particularly in the area of advancement, sharing, and communication of knowledge to the broad-ranging global museum community.

The 5th Global Botanic Gardens Congress, 6th Biennial Botanic Gardens Australia & New Zealand Congress, hosted by the Dunedin Botanic Garden in New Zealand and International Council of Museums inaugural Congress hosted by the Toitū Otago Settlers Museum, Dunedin will include a programme of plenary keynote addresses, symposia and workshops that will cover the challenges and achievements of botanic gardens and partner organisations around the world. With over 250 attendees from Australia to Brazil, Nigeria to China and United Kingdom to USA, this is the first time all three congresses have been combined and the first BGCI congress to be in held in the Southern Hemisphere since 2003.

There will be a significant depth of discussion and range of topics:

 Sustainability and climate change  Biodiversity conservation  Ecosystem restoration  Plant and artefact collections management  Community well-being, social relevance and education  Cultural partnerships  Industry innovation.

These three congresses are at the centre of the Mackay Regional Botanic Gardens core roles.

 Dale Arvidsson is Vice President of BGANZ and will be stepping into the role of President at Dunedin. Dale will be joint hosting sessions in Living Collections Policy development.

 Ross Demuth is a key member of the Botanic Records Officer Network (BRON) of BGANZ, developing collections management systems for all botanic gardens to access.

9.5 LEASE OF LAND: MACKAY CONTRACT BRIDGE CLUB INC.

Purpose

To approve the renewal of the Mackay Contract Bridge Club Inc. lease for an area of approximately 1012m2 being part of Lot 449 on SP112233, 414 Shakespeare Street, Mackay.

Background/Discussion

Council is trustee for the Local Government Purposes Reserve being Lot 449 on SP112233 located on the western end of Shakespeare Street. This lot is located next to both the Army Reserve and Mackay Pre-school and Kindergarten Association.

Mackay City Council established a 30 year lease with the Mackay Contract Bridge Club Inc. on the site in 1979, and such lease expired on 30th June 2009.

Following expiration of the lease Council wrote to the Club to enquire if they were interested in entering into a further lease agreement and requested a new Land Management Plan be prepared and provided to Council looking forward for a further lease term.

Property Services and Recreation Services entered into lease negotiations with the club to ensure all requirements were met and satisfied. This process can take considerable time due to club volunteer member abilities in understanding and skill in completing the required documentation. Council staff provided assistance as and when required to avoid undue delay.

As this process progressed the Club confirmed that it would submit its Land Management Plan (attached) following their next Annual General Meeting and subsequent election of new committee members.

The club requests to remain on their current site with a renewed lease to allow them to be able to carry on as a well-respected recreational organisation for their members. They intend to continue with maintaining the site to a high level including their clubhouse, car parks and landscaping.

The club has operated on the site and maintained their facilities over the last 30 years without any major impost on Council, no objections were raised during the negotiation process that would warrant the lease not being renewed.

The lease will be a standard ‘trustee’ type lease inclusive of peppercorn rental.

Risk Management Implications

The Mackay Contract Bridge Club Inc. have been in existence on the site since 1979 inviting people from across the region’s various communities to learn to play and compete in Contract Bridge. Should the lease not be renewed, both our community and region would not be able to benefit from the opportunities that arise from such a community group.

It should be noted that there is no existing lease as the previous document has expired.

Conclusion

The renewal of the lease to Mackay Contract Bridge Club Inc. who have shown a long term commitment to the land, its infrastructure and the local community, is the most advantageous outcome to Mackay Regional Council.

9.6 LEASE OF LAND: PIONEER POTTERS MACKAY INC.

Purpose

To approve the renewal of the Pioneer Potters Mackay Inc. lease for an area of approximately 389m2 being part of Lot 1 on RP702773, 8 Loughnane Court, North Mackay.

Background/Discussion

Mackay Regional Council is the owner of Lot 1 on RP702773 located on the northern end of Loughnane Court, North Mackay. This lot is located in and around other like community groups including Mackay Riding for the Disabled and Mackay Gymnastics.

Pioneer Shire Council established a 30 year lease with the Pioneer Potters Mackay Inc. on the site in 1991, and such lease expired on 3rd March 2011.

Property Services and Recreation Services staff entered into lease negotiations with the club to ensure all requirements were met resulting in the completion of the Land Management Plan (Attachment 2).

The club requests to remain on their current site with a renewed lease to allow them to be able to carry on as a well-respected recreational organisation for their members and relevant community groups. They foresee no possible problems with continuing to co-exist with the other nearby community groups and the wider community.

The club has operated on the site and maintained their facilities over the last 30 years without any major impost on Council, no objections were raised during the negotiation process that would warrant the lease not being renewed.

12.1 MRC 2013-089 PANEL OF PREFERRED SUPPLIERS - PROVISION OF INFORMATION AND COMMUNICATIONS TECHNOLOGY

Purpose

To present to Council for approval, tenders submitted in response to MRC 2013-089 Panel of Preferred Suppliers - Provision of Information and Communications Technology.

Background/Discussion

To supplement Councils internal Information and Communications Technology (ICT) resources, a panel of external ICT Consultants is required, to be utilised in conjunction with the availability of Local Buy contracts, as necessary to assist Council’s ICT department.

The formation of the panel is in accordance with section 232 of the Local Government Regulation 2012 which enables Council employees to obtain the provision of ICT services requested in the Request for Tender (RFT), without the need to obtain quotes each time, whilst ensuring that providers utilised have the appropriate technical, financial and managerial capabilities necessary to perform the services.

The proposed commencement date for this panel arrangement is the 14th October 2013 for an initial period of twenty-four (24) months with the option of a twelve (12) month extension period.

The categories requested in the RFT were:

Council has previously sourced providers of ICT services either via the Local Buy contract or on an individual ad-hoc basis.

The objective of establishing this panel is not to replace the existing Local Buy Contract, but to compliment Local Buy’s awarded contract for the provision of Information, Communication & Technology (Goods and services).

Official correspondence was issued by Local Buy’s representative to their panel members advising that Mackay Regional Council was issuing this tender and it was not necessary to apply for this panel.

An initial compliance check was conducted on the 18th June 2013 to identify submissions that were non-conforming with the immediate requirements of the RFT. This included compliance with contractual requirements and provision of requested information.

Dialog Information Technology and Resolute IT were deemed non-conforming as they are currently listed on the Local Buy contract.

Following the review of the remaining submissions, the evaluation panel noted that People Connexion Recruitment and Roll Inn Private Ltd were recruitment agencies, and were deemed non-conforming due to these services being outside the scope of the RFT.

Council received advice from Aarthi Manohar that she wished to withdraw her submission.

All other submissions were progressed through to the qualitative criteria assessment on the basis that all terms and conditions and mandatory requirements of the RFT had been met.

The initial qualitative criteria assessment was carried out by the Evaluation Panel on the 29th July 2013 with the Evaluation Panel scoring the tenders according to the evaluation matrix.

The weighting attributed to each qualitative criteria was:

Relevant Experience - 25% Key personnel skills and experience - 25% Tenderers Resources - 20% Demonstrated Understanding - 20% Local Content - 10%

Tenderers were requested to provide hourly rates for contract terms from 0-3 months, 3-6 months, 6-9 months and 9-12 months in order to provide Council with value for money.

Tender Information Requests (TIR) were issued on the 30th July 2013 and 15th August 2013 to Business Reporting Systems, Redman Solutions Pty Ltd and Sunpay Pty Ltd in order to clarify details contained in their submissions. All responses were received by the 22nd August 2013.

The Evaluation Panel met again on the 2nd September 2013 to discuss the responses received as a result of the TIR issued. The responses were taken into consideration when reviewing the initial scores attributed to the qualitative criteria.

Resource Implications

Due to the nature of this contract and the diverse range of ICT services required by Council, the evaluation panel recommends that all conforming tenders be accepted onto the panel for the Provision of Information and Communications Technology to allow the availability to Council to receive the most efficient outcome and value for money.

As advised in the RFT documents, Council reserves the right to contact any Consultant within the category specific to the projects requirements. Council may seek quotes from a number of Consultants on the panel or may source directly from one Consultant based upon the emergent demand for the services requested.

Risk Management Implications

The recommended respondents are required to provide all relevant insurances prior to the executing of their contract.

The conditions of contract provide sufficient remedies to Council based on the risk profile of the services being provided.

Conclusion

Where Council assessed that a Consultant and/or their key personnel have demonstrated relevant experience and have met the key elements of the particulars of service, the Evaluation Panel recommend their appointment to the panel. Risk Management Implications

Conclusion

It is recommended that MRC 2014-020 Sale of Plant and Equipment be awarded to the best priced tenderers for the prices listed, based on their demonstrated value for money.

The seven plant items which received no offers be included in future asset disposal tenders or seek to dispose of these items other than by tender as provided under the Section 236 1(a) of the Local Government Regulation 2012.

12.3 MRC 2014-010 NEBO ROAD, SHAKESPEARE AND MILTON STREETS - WATER MAIN UPGRADES

Purpose

To present to Council for approval, tenders submitted for MRC 2014-010 Nebo Road, Shakespeare and Milton Streets – Water Main Upgrades.

Background/Discussion

The Mackay Regional Council issued a Request for Tender (RFT) MRC 2014-010 Nebo Road, Shakespeare and Milton Streets – Water Main Upgrades, inviting submissions to undertake the construction of two capital water projects, being a new trunk water main crossing of Nebo Road, on the northern side of Shakespeare Street and a new reticulation main to be installed on Milton Street, between Gordon and Victoria Streets.

The Nebo Road DN450 diameter Trunk Water Main (TWM) was built in 1937 and is located beneath the pavement of the northern traffic lanes of Nebo Road. This water main is the primary source of water for the Mackay Central Business District (CBD). Proposed pavement upgrades by the Department of Transport and Main Roads (DTMR) to Nebo Road will require this existing main to be removed. Out of three options considered for an alternative feed (i.e. Cemetery Road, Nebo Road and Paradise Street), the Cemetery Road alignment is the preferred option and includes a crossing of Nebo Road on the northern side of Shakespeare Street.

The Department of Transport and Main Roads have a project to perform pavement works at the intersection of Nebo Road and Shakespeare Street in the near future. It is a requirement that works which will be open trenched through pavement areas will need to be installed prior to DTMR completing their finished surface in that area. Hence, this intersection phase of the project is the first phase in providing the alternative feed through Cemetery Road to allow the removal of the existing 450 in Nebo Road, and has been brought forward to 2013/2014 by DTMR.

The scope of works around the Nebo Road and Shakespeare Street area includes the supply and installation of approximately 130m of Ø450 Ductile Iron Cement Lined (DICL) pipe, 75m of Ø450 (508 OD) Mild Steel Cement Lined pipe, approximately 95m of Ø300 DICL and the

construction of approximately 45m of 762mm OD Mild Steel Enveloper Pipe under-bore beneath Nebo Road and connection into an existing Ø300mm main in Shakespeare Street (see Figure 1 below).

Similarly, the pavement on Milton Street between Gordon and Victoria Streets is planned to be upgraded. It has been identified that the existing reticulation main, which is currently located in the traffic lanes, requires renewal and shall be relocated to the parking lane. Similar to the Nebo Road crossing, the Milton Street section would need to be completed prior to final surfacing of the pavement works in that area. The scope of works at Milton Street includes approximately 200m of Ø200 oPVC pipe, 10m of Ø200 DICL pipe, 25m of Ø100 oPVC pipe and a number of property/fire protection connections as well as connections to the existing reticulation network (see figure 2 below).

The successful tenderer is to supply labour, materials and plant for the complete construction of the Water Main Works.

Tenders were invited on 27 July 2013, via Council's website and advertised locally in The Daily Mercury.

The following submissions were received by the closing time of 10.00am on 20 August 2013:

The evaluation of the tenders was conducted by:

An initial compliance check was conducted on 28 August 2013 to identify submissions that were non-conforming with the immediate requirements of the RFT. This included compliance with contractual requirements and provision of requested information.

All submissions were progressed through to the Qualitative Criteria Assessment on the basis that all terms and conditions and mandatory requirements of the RFT had been met.

The Qualitative Criteria Assessment was carried out by the Evaluation Panel on 28 August 2013, with the Evaluation Panel scoring the tenders according to the Evaluation Matrix.

All applicants were assessed against the Qualitative Selection Criteria. Specific criteria were weighted according to their importance as perceived and agreed by the Evaluation Panel. Relative weightings were published within the RFT.

During the evaluation, tenderers were assessed against the nominated qualitative criteria. The weighting attributed to each qualitative criteria was:

Consultation and Communication

The location, alignment and timing for the delivery of the Ø450mm and Ø300mm trunk water mains at the Nebo Road/Shakespeare Street intersection have been determined in consultation with DTMR Mackay. The works are scheduled to occur prior to DTMR scheduled intersection works.

The design coordination and delivery of the new 200mm water main on Milton Street between Gordon and Victoria Streets has been scheduled ahead of the road pavement upgrade and has been co-ordinated with the Manager Technical Services and Civil Projects. A Community Engagement Plan will be developed in conjunction with the contractor’s detailed implementation programme prior to works commencing.

Resource Implications

The funding for these works is in the WWS Water Capital Budget 2013/2014 in two separate projects - WMT - Cemetery Road DN450 and BWMR - Milton Street (Gordon - Victoria) 200 main. The lowest conforming tender of $826,019.56 for the works is comprised of $604,640.37 (Schedule 1 - Cemetery Road DN450 crossing at Nebo Road) and $221,379.19 (Schedule 2 - Milton Street (Gordon - Victoria) 200 main).

The project shortfall for the Cemetery Road Trunk Water Main is due to the fact that this project was originally funded across two financial years but is now required to be completed prior to DTMR planned works. The funding shortfall across both projects of $500,000 is propsoed to be funded from the anticipated underspend on the Marian WTP project in 2013/2014 due to the delayed award date so funding options can be further explored.

Risk Management Implications

Both Capital Water Projects are driven by pending road pavement upgrades and are required to address concerns with regard to impact of proposed road works on the reliability of existing water mains. The risk to MRC’s water main assets during the road works in these areas is due to potential direct physical damage or construction loading increasing risk of failure of the pipe. A burst water main may cause injury to workers, damage to the roads resulting in extensive repairs costs, disruption to traffic and impact MRC customers from shut-downs to effect repairs.

The DN450 crossing of Nebo Road is required as part of the alternate main feed to Mackay CBD, with this intersection phase of the works brought forward by proposed DTMR works at the Nebo Road/ Shakespeare Street intersection.

Similarly, the upcoming pavement upgrade on Milton Street between Gordon and Victoria Streets requires the existing reticulation main to be replaced prior to surfacing of the pavement works in that area.

An Engagement Plan is being prepared to address any potential impacts to stakeholders.

Conclusion

That awarding the contract to G & MA Lemura Pty Ltd represents the most advantageous outcome to Mackay Regional Council based on their demonstrated understanding of Council’s requirements, their experience, capacity and resources to provide the works to the specified quantity and quality as specified in the RFT.
