Email Campaign Message: Streams in the Siskiyou Region Deserve Equal Protection

Dear Chair Imeson and Members of the Board,

The Board is faced with a decision on June 5th about whether to begin developing new water protection rules to meet the “Protecting Coldwater Criterion” in the Siskiyou Region of Southwest Oregon, which encompasses most of the Rogue Basin in Jackson and Josephine Counties.

This decision is only necessary because in 2015 this Board excluded the Siskiyou Region from a rule change implemented in 2017 on small and medium Salmon, Steelhead and Bull Trout streams in the rest of Western Oregon.

The Board’s Siskiyou exclusion was a mistake for at least the following reasons:

1. The law is the same – the same state water quality standard under the Clean Water Act applies equally in the Siskiyou to prohibit streamside shade removal that allows measurable stream warming.

2. The ODF stream rule that was found insufficient in the rest of western Oregon to meet the Clean Water Act is effectively the same as the current standard in the Siskiyou. The no-cut buffer (20 feet) and Riparian Management Area (50 and 70 feet for small and medium streams respectively) requirements were found to be inadequate to meet the law in the rest of Western Oregon.

3. There is no evidence to demonstrate that the scientific research relied upon to change the steam protection rules in the rest of Western Oregon that established shade-stream temperature relationships does not also hold true in the Siskiyou.

It’s time to fix this mistake. In the last three years, the legal and ecological situation has not changed. No new information has come to light that provides a scientific justification for this Board to find that current FPA stream buffers are adequate to meet the Protecting Coldwater Criterion in the Siskiyou.

To the contrary, the research reported in the Department’s Siskiyou “evidence review” is fully consistent with and validates extrapolation of the RipStream findings to the Siskiyou, even though these studies do not replicate the exact prescriptions used in that study. This study demonstrated that logging practices under current stream protection rules did not reliably meet the Protecting Cold Water Criterion (“PCW”), which is the anti-degradation component of the state water quality standard for temperature under the Clean Water Act. In other words, logging practices under the existing rules resulted in warmer streams that violated a state water quality standard for temperature.

Please act on June 5 to find that current stream rules are not adequate to meet the Protecting Coldwater Criterion in the Siskiyou region. New rules are needed to better protect the public waters running through the state and private forests of Southwest Oregon.

The very least you can do is expand the protections of trees near the rivers to increase the Cold Water Criterion. The Board is faced with a decision on June 5th about whether to begin developing new water protection rules to meet the “Protecting Coldwater Criterion” in the Siskiyou Region of Southwest Oregon, which encompasses most of the Rogue Basin in Jackson and Josephine Counties. This decision is only necessary because in 2015 this Board excluded the Siskiyou Region from a rule change on small and medium Salmon, Steelhead and Bull Trout streams in the rest of Western Oregon.

GAIL FOSTER, 2745 SE CRYSTAL LAKE DRIVE Corvallis OR 97333, [email protected] To All it Concerns, I read the pre-generated letter that was written out for me to send however I would like to make it more personalized because I feel very strongly on this issue. Oregon is my home I was born and raised here and believe the state to be one of the most beautiful in the country. In my short time on this Earth I have experienced many hunting and fishing adventures with my father and grandfather. I have grown to appreciate the natural resources the forest has to offer and have done my best to give back to the land. I studied biology and graduated from Southern Oregon University in 2012. Durning the summer I was fortunate enough to work for the National Park Service as a crew member preforming stream assessments in the Cascade Siskiyou National Monument. I also chose to research macro invertebrates as a baseline study in the Ashland watershed before thinning occurred to prevent wildfire. I now work for the Oregon Department of Fish and Wildlife stocking the rivers with salmon and steelhead. I have recently started section hiking the Pacific Crest Trail starting at the California, Oregon boarder. I love my state to say the least and try to give back as much as I can. While working, studying and recreating I have seen some very very poor forest management. When I think of most forests in Oregon I thing of large scale farming and how companies plant trees back in a way to turn a profit. There is no thought given when about the environment when it AGENDA ITEM A Attachment 32 Page 14 of 15 comes to financially profiting. If you need any examples just look at the lack of old growth forests. My concerns for harvesting and disturbing riparian vegetation are as follows; 1. Shade - Working with fish and macros the temperature of the water plays a key role in what can flourish. Exposure to direct sun can cause increased amounts algae. 2. Equipment operation - Most all equipment used leaks oil and hydraulic fluid and the closer the equipment is to the water the more likely it will seep in. 3. Spraying vegetation - Logging companies don’t like plants outcompeting their crops so they will spray. This gets washed into the streams and even more so with less vegetation to buffer the stream. 4. Habitat - Water is a source of life for all creatures and a cool place for terrestrial creatures to rest eat and hide. 5. Run off - The less riparian vegetation there is the more silt will make its way into the water source. This changes the substrate in the streams. That changes the ecosystem in the stream. It also effects spawning grounds by suffocating eggs of fish along with preventing eggs to reach gravel in which they need to develop. 6. Erosion - The banks of streams need root systems to hold back the soils. Traveling to Madagascar I witnessed chalk brown rivers due to deforestation and lack of bipartisan vegetation. It takes away all the topsoil needed to regrow the plants that are being chopped down. I am saying I wish they would have spared more old growth. What will my great grandchildren say?
