Status of /"The/ Railroad Association" and "Ohio Railroad Association"

Organized; "The Ohio Railroad Association" was organized on December 19, 1933 at Columbus, Ohio as successor to the "Ohio Railroad Association" which was organized on Decem­ ber 15, 1931 and which had performed the same functions under the same set up. The "Ohio Railroad Association" had succeeded the "Special Committee on Relations of Rail­ way Operation to Legislation in Ohio" which had been in existence since about 1901. However, information furnished with respect to the "Special Committee" is not sufficient upon which to make a determination at this time.

Membership: The following thirteen railroads, all "employers" under the Railroad Retirement Act, became members of the "Ohio Railroad Association" when it was organized on Decem­ ber 15, 1931 and have continued their membership with "The Ohio Railroad Association":

Akron, Canton & Youngstown Railway Company Baltimore and Ohio Railroad Chesapeake and Ohio Railway Company , Cincinnati, & St. Louis Railway , Toledo & Ironton Railroad Company Erie Railroad Central Railroad Company New York, Chicago & St. Louis Railroad Company, The Norfolk and Western Railway Railroad Pittsburgh and Railroad Wabash Railway Company Wheeling and Lake Erie Railway Company, The

Duties, Functions and Activities: To take notice of matters of common interest to TTie"member railroads and to promote and protect their interests. (The title of the original organ­ ization together with the statement that the successors perform the same functions indicates that legislative representation is at least one of the functions.) - 2 Memo to Director, Claims Service

4. Maintained: Funds necessary to the operation of the Association areand have been contributed by member roads which are assessed in the proportion that the mileage of first main track owned, operated or controlled by each in Ohio bears to the total mileage of first main track owned, operated or controlled in Ohio by all the member roads at the time of assessment.

5. Managed: Through a General Committee composed of one representa­ tive of each member road, or of two representatives of each member road if one of the two is from the Legal Department of the member road. The General Committee elects an Execu­ tive Committee of five members, each of whom must be a bona fide employee of the member road he represents, and ho re­ ceives no compensation from the Association for his services on the Executive Committee, The powers and duties of the Executive Committee are delegated to it from time to time by the General Committee, The Executive Committee employs the administrative'officers of the Association. These con­ sist of a Chairman, who may be and is Chairman of both the General and Executive Committees, a Vice-Chairman, a General Counsel, a Secretary, and a Treasurer. The Chairman and Vice-Chairman must be members of the General Committee and do not receive compensation from the Association for their services. All expenditures are made by the Treasurer subject to the approval of the Executive Committee.

6. Conclusion: "The Ohio Railroad Association" and its predecessor "tHe "Ohio Railroad Association" have been railroad associa­ tions controlled and maintained wholly or principally by two or more "carrier employers" under the Railroad Retire­ ment Act and have been engaged in the performance of ser­ vices in connection with or incidental to railroad trans­ portation and qualify, therefore, as "employers" under the Act.

7. Service Creditable: With the "Ohio Railroad Association" from December 15, 1931 to December 19, 1933. With "The Ohio Railroad Association" from December 19, 1933 to date.
