Perhaps, if it is the right ship at the right place at the right time. A recent BBC series recreating the mid 18th- century Pacific voyages of Captain Cook, successfully demonstrated in this regard that H.M.S. Endeavour certainly made a difference; to the people who sent her around the world, to the people who saw her coming in off the horizon, billowing and bright, and to wider events and developments which those people could only imagine—and which historians ever since have sought to understand.[1] One might also mention the transpolar voyage of the U.S.S. Nautilus, nearly 200 years after Cook; not so much a mission of exploration and oceanography but a historic display of shipboard nuclear power and potential nevertheless; a 19th century dream, or nightmare, come true.[2] Indeed Jules Verne’s Captain Nemo was well aware that his own Nautilus could not just tip but completely topple the surface world’s ‘balance of power’ at sea, with predictable results. As the captive narrator of 20,000 Leagues Under the Sea exclaimed: Of course, everyone now knew what the supposed monster had turned out to be….a submarine, far more dangerous than a monstrous whale. …Doubtless, everywhere at sea, this fearful engine of destruction was being pursued. -

During this period, the armaments industry underwent a radical transformation, moving from being based on public-owned arsenals and yards to being based on private firms – the system of military procurement prevalent today. -

Steven Haines* Steven Haines is Professor of Public International Law at the University of Greenwich and a retired British naval commander. He chaired the Editorial Board of the UK’s official Manual of the Law of Armed Conflict (2004) and co-authored its chapter on “Maritime Warfare”. He had previously written the Royal Navy’s maritime strategic doctrine (British Maritime Doctrine, 1999). Abstract While most law on the conduct of hostilities has been heavily scrutinized in recent years, the law dealing with armed conflict at sea has been largely ignored. This is not surprising. There have been few naval conflicts since 1945, and those that have occurred have been limited in scale; none has involved combat between major maritime powers. Nevertheless, navies have tripled in number since then, and today there are growing tensions between significant naval powers. There is a risk of conflict at sea. Conditions have changed since 1945, but the law has not developed in that time. Elements of it, especially that regulating economic warfare at sea, seem outdated and it is not clear that the law is well placed to regulate so- called “hybrid” warfare at sea. It seems timely to review the law, to confirm that which is appropriate and to develop that which is not. Perhaps a new edition of the San Remo Manual would be timely. Shortly after the outbreak of the war, the London Times lamented, “American merchant seamen were almost to a man con- verted into privateersmen and the whole of our West India trade either has or will in consequence sustain proportionate loss” (Letters from New York State 1812). -

Naval Gunfire Support at Gallipoli David Stevens Amphibious operations are among the most complex of military endeavours, calling for well defined command responsibilities and close collaboration between the services. In the lead up to an assault, naval forces are expected to provide sea control and deliver the land forces safely to their objective in a combat ready state. The special naval tasks after a landing are to provide direct tactical support to land forces until they break out from the beachhead and shape conditions to ensure that the flow of supplies and reinforcements exceeds that of the enemy. At Gallipoli, the most immediate naval support came through the provision of fire from the sea, and this contribution’s effectiveness has since been the subject of considerable adverse comment. As early as 9 May 1915, Lord Kitchener, who before the assault had envisioned the Turks swept away by the navy’s guns, was expressing his disappointment regarding the actual effect produced.1 At the same time, the naval commander, Vice Admiral John de Robeck, was noting that, ‘…when it is a question of trenches and machine guns the Navy is of small assistance, it is these later that have checked the Army.’2 Australia’s official historian, Charles Bean, was unequivocal, writing that naval gunfire was useless on the peninsula; the ships being unable to ‘fire over impossible angles at undiscoverable targets’.3 Gallipoli’s topography was undoubtedly troublesome. Naval fire control equipment and heavy guns were optimised for use against other ships, with battleship turrets allowing a maximum elevation of just 20 degrees. -

PRESIDENT AND GENTLEMEN or THE ACADEMY :— In conformity with a clause of the Constitution of this Academy, and in obedience to your instructions, I am here to render the tribute of a formal biographical notice in commemoration of one who was numbered among our most venerable and most honored associates. If, in the language of one of our body, on a previous and similar occasion, "it is no unreasonable assumption that public benefit and individual incentives may be derived from the history of any man whose scientific services have rendered him worthy of admittance to your number," that assumption must have a peculiar force when it applies to one who has "finished his course," and has filled a life, protracted beyond the usual term, with scientific labors of no ordinary variety and magnitude. It is but little more than two years since we first met for the great and important work of organizing this National Academy, and with us—of our number, if not personally present—were "both the gray-headed and very aged men." But, alas! these, like autumnal leaves, are rapidly falling away, and already the places of a Totten, a Hitchcock, and a Silliman know them no more, save in the records of their lives and deeds, and in the grateful memories of their associates. What a trio of names, glorious in the annals of science, is this! Well may they be ineentives to us, who yet remain to strive that we may worthily replace them, and establish for this Academy a reputation for usefulness and science which their honored bearers have acquired for themselves. -

Doyle, Jr. N THE OVER TWO HUNDRED YEARS from American commerce raiding I in the Revolutionary War through two World Wars, the Korean and Vietnam wars, and a host of crises along the way, to the Persian Gulf conflict, peacekeeping, and peace enforcement, there has been a continuous evolution in the international law that governs naval operations. Equally changed has been the role of naval officers in applying oceans law and the rules of naval warfare in carrying out the mission of the command. This paper explores that evolution and the challenges that commanders and their operational lawyers will face in the 21st century. The Early Years and Global Wars Naval operations have been governed by international law since the early days of the Republic. Soon after the Continental Congress authorized fitting out armed vessels to disrupt British trade and reinforcement, the Colonies established Admiralty and Maritime courts to adjudicate prizes.1 American captains of warships and privateers were admonished to "respect the rights of neutrality" and "not to commit any such Violation of the Laws of Nations."z The first Navy Regulations enjoined a commanding officer to protect and defend his convoy in peace and war.3 In the War of 1812, frigate captains International Law and Naval Operations employed the traditional ruse de guerre in boarding merchant ships to suppress trade licensed by the enemy.4 President Lincoln's blockade of Confederate ports satisfied the criterion of effectiveness (ingress -

Naval historians and strategists traditionally divide naval strategy into one of two schools, guerre de course, often referred to as commerce raiding, and guerre d'escadre, a strategy focussing on large warships deployed in fleets designed to engage similar enemy vessels similarly organized. The labels for both groups come from nineteenth-century France where theorists of the Jeune École applied methods of analysis common to land warfare to the study of conflict at sea. Proponents of the Jeune École theorized that recent technological developments had rendered obsolete the fleet actions so characteristic of warfare under sail during its highest stage of development. They conceded that such engagements may well have determined the outcome of the Wars of the French Revolution and Empire, but members of the Jeune École pointed out that they were virtually absent from the wars of the mid- and late-nineteenth century. -
