Foreword to the Minister for Planning

The 2012/13 financial year has been exceptionally good at Planning Panels Victoria. The whole team has continued to provide excellent advice on a wide range of matters with respect to Planning Scheme Amendments, Advisory Committees and Environmental Effect Inquiries. This advice has been undertaken with rigour, timeliness, commitment and without fear or favour. In the second half of 2012, PPV undertook its three year review of sessional members, with a number of members retiring, mainly due to the issue of avoiding the potential for real or perceived conflict of interest by “sitting on both sides of the table”. At the end of year professional development seminar, former Secretary Andrew Tongue acknowledged and thanked the longest standing members, including John Keaney, John Glossop, Robin Saunders, Colin Burns, Megan Carew, Neville Wale, Helen Weston and Craig Czarny. The introduction of Ministerial Direction No 15 relating to timeframes for all aspects of the Amendment process was introduced in October 2012 and has resulted in PPV reviewing and updating its administration procedures. This has added a significant increase in workload for the administration team, but the systems put in place by PPV have enabled a smooth introduction of the new Direction (see Section 2.2(i)). I take this opportunity to particularly acknowledge the outstanding commitment of our administration team – Harry, Sharon, Adrian and Laura. All staff work exceptionally well and the administration team, who have been one position short for just on eight months, have worked really well together to ensure that all administration and financial matters are dealt with in a most timely and committed manner. Recently, a Senior Sessional Member sent an email of thanks to Adrian and Laura which in part said “A quick note to thank you for your support during the recent … Amendment hearing process. I’m not sure that you realise how valuable your efforts are, and how much we appreciate your work. …. Your prompt responses to my frequent requests of assistance made by life so much easier. Adrian, your editing and commitment to get the report out on time was above and beyond the call of duty!” These sentiments are greatly appreciated, and are testament to the work of the whole team. I would like to thank all staff and sessional members for your support to Planning Panels Victoria over the past year and for the contribution made by all.

1 About Planning Panels Victoria

1.1 Planning Panels Victoria

Planning Panels are established under either the Planning and Environment Act 1987 or the Environment Effects Act 1978 and are a means of facilitating public participation in the planning and environment decision making process. They provide a process to independently assess planning scheme changes or development proposals through the consideration of submissions, the conduct of hearings and the preparation of reports. Planning Panels are advisory and make recommendations; with the final decision made by the responsible statutory body or the Minister for Planning. Planning Panels are administered by Planning Panels Victoria (PPV), which is located within the Planning, Building and Heritage Group of the Department of Transport, Planning and Local Infrastructure (DTPLI). DTPLI began operating on 1 July 2013 and comprises parts of the former Departments of Planning and Community Development, and Transport. As at 30 June 2013, PPV comprised the Chief Panel Member, six Senior Panel Members, 73 Sessional Panel Members, a Senior Project Manager/Officer, and five administration and support staff.

1.2 Staff Update

In January 2013, PPV farewelled Margaret Baird who completed a 12 month secondment to replace Lester Townsend, who was seconded to assist on the Metropolitan Strategy. Lester returned to PPV in January 2013. In May 2012 approval was received to fill the vacant Senior Panel Member position left vacant by Mark Marsden. After advertising and interviewing for the role, a recommendation was made to the Minister for Planning to appoint Con Tsotsoros to the position. Con commenced with PPV on 16 July 2013 and comes with a very strong and diverse background in Planning and Economics. Jessica Cutting was confirmed as ongoing in her role as Senior Project Manager in March 2013. Jessica has been with PPV since April 2010 on a fixed term basis. In November 2012, PPV farewelled Tina Ding who was the Accounts Payable and Administrative Assistant since February 2011. In June 2013, PPV began the process of sourcing an administrative trainee to fill this position for at least the next twelve months. Dylan Cropley was appointed to the role and commenced with PPV in July 2013.

1.3 2013 Sessional Member Review

In August 2012, the Minister for Planning approved a full review of all sessional members to appoint new members for a fixed three year term. PPV began this review in October 2012 and culminated in the appointment of 15 new sessional members in December 2012. As part of the review, 16 sessional members retired from PPV. PPV thanks these members for their contribution and wishes them well for the future. The departing members and the number of years as PPV sessional members are as follows:

Senior Sessional Members In December 2012, Kathy Mitchell announced that Rodger Eade and Bill O’Neil would be designated as Senior Sessional Members as a result of their long and extensive contribution to PPV. Along with Michael Kirsch, this brings the total number of Senior Sessional Members to three.

1.4 Chief Panel Member

Kathy Mitchell Kathy is a member of the Planning, Building and Heritage Executive Management Team at DTPLI. Part of her role as Chief Panel Member includes regular meetings with the Minister for Planning, the Secretary and the Deputy Secretary to keep them abreast of current and emerging matters that PPV deals with. Until the change of Department, Kathy was the Planning, Building and Heritage representative on the Department wide Aboriginal and Torres Strait Islander Champions Group. She is a technical member of the Victorian Design Review Panel. Kathy regularly speaks at industry wide forums, seminars and conferences on issues relating to PPV, as well at municipal councils and the MAV. She remains a Victorian State Judge for the UDIA Awards of Excellence. In February and March, Kathy undertook the Australian Institute of Company Directors Course, which was a pilot course focused on the Victorian Public Sector. Kathy’s major Panels for 2012/13 included:  Chair of Structure Plans for Major Activity Centre in Bayside (C101, C102, C103, C104);  Southern Grampians Amendment C25 – review of strategic planning for Hamilton township and surrounds;  Further retail development in Warrnambool through Amendment C70 and the concurrent planning permit application, and Amendment C84;  Standard Development Contributions Advisory Committee – major review of the development contributions system in Victoria, which resulted in two reports (December 2012 and May 2013), as well as Supplementary Terms of Reference to review opportunities for a State Infrastructure Levy;  A new Precinct Structure Plan for Greenvale Central through Hume Amendment C154;  Development of a Masters Home Improvement Store at Corio through a combined Planning Scheme Amendment C268 and planning permit application 337/2012.

1.5 Senior Panel Members

Margaret Baird Margaret completed her one year secondment from the Victorian Civil and Administrative Tribunal at the end of 2012. During the second half of 2012, Margaret’s Panels included:  Review of a new Activity Centres Strategy for Ballarat (C151) and a proposal to expand the Wendouree Plaza Shopping Centre (Ballarat C159) through rezoning and a planning permit application.  Rezoning of land for a regional soccer facility in Monbulk (Yarra Ranges C115).  Review of design controls and rezoning relating to the MegaMile (West) Major Activity Centre, Nunawading, and Blackburn Neighbourhood Activity Centre (Whitehorse C143).  Review of proposed heritage controls in Cardinia (C161).  Implementation of the Kororoit Creek Regional Strategy in the City of Hobsons Bay (Hobsons Bay C87).  Rezoning of land and associated controls/permits for land in Upper Beaconsfield (Cardinia C115); Pakenham (Cardinia C170); Beechworth (Indigo C52 and C54); and Point Cook (Wyndham C137).  Consideration of local policy change for the Glen Eira Planning Scheme (Glen Eira C93). Margaret is a member of the Geographic Place Names Advisory Panel, a member of the Victorian Civil and Administrative Tribunal Rules Committee, and a judge for the Victorian State Planning Awards conducted by the Planning Institute of Australia.

Trevor McCullough Trevor chaired Panels and Advisory Committees covering a range of matters including Environmental Effects Enquiries, introduction of structure plans, development contributions plans and a number of rezoning amendments. During the year Trevor presented to a VPELA seminar on the Car Parking Provisions and was a guest lecturer in planning at RMIT. Together with Nick Wimbush, Trevor convenes the PPV Energy, Environment and Infrastructure Group. Trevor’s major matters for 2012‐13 included:  Member of the Standard Development Contributions Advisory Committee which presented two reports to the Minister.  Western Highway duplication Stage 2 – Beaufort to Ararat ‐ EES and draft Planning Scheme Amendment.  Western Highway duplication Stage 3 – Ararat to Stawell ‐ EES and draft Planning Scheme Amendment.  Changes to Development Contributions Plans (Nillumbik C63 and Melton C110).  New Design and Development Overlay and other controls in Mt Eliza (Mornington Peninsula C162).  Development Plan Overlay for Kinnears Rope Works site in Footscray (Maribyrnong C93).  New Structure Plan, changes to Business and Residential Zones in Korumburra (South Gippsland C52, C66, C70, C71).  Rezoning amendments and planning permits (Bass Coast C121, Cardinia C169, Strathbogie C65, Wodonga C87, and Wyndham C168).

Cathie McRobert Cathie chaired Panels on a range of amendments relating to local policy and strategies, development provisions, heritage and rezoning proposals for specific sites. Significant Panels Cathie chaired in 2012‐13 included amendments relating to:  Rural strategies in the Colac Otway Shire (C69).  Rezoning and subdivision of land adjoining a Ramsar listed wetland in Kingston (C125)  Moreland public open space contributions  Heritage in Mount Alexander Shire (C55) and Moorabool Shire (C6 Part 2).  Coastal development in Warrnambool (C75 and C76) and Crib Point (C163 Part 2).  The Epping Principal Activity Centre (C130).  Review of the Stonnington Municipal Strategic Statement (C161). Cathie has maintained her interest in planning for bushfire protection and chairs the Advisory Committee considering the associated planning provisions and overlay mapping. Cathie attended the Australasian Conference of Planning and Environment Courts and Tribunals in Western Australia. Of particular interest to the work of PPV were the series of papers relating to:  The economic, community, personal and environmental demands following recent natural disasters, recovery responses and strategies to manage risks of fire, floods, cyclones and earthquakes.  The experience in various jurisdictions of proactive management of expert evidence, including the pros and cons of court appointed experts, collaborative processes of expert peer review, structured expert conferencing facilitated by a commissioner, joint witness statements and concurrent presentation of evidence. Cathie convenes the PPV Regional Issues, and Social and Housing Interest Groups. During the year Cathie provided training in planning scheme amendments through the PLANET training program.

Jenny Moles Jenny chaired Panels on a range of amendments relating to heritage and rezoning proposals for specific sites, restructure plans, shopping centre expansions and extensions to the Queenscliffe Ferry Terminal. Jenny’s Panels for 2012/2013 included:  54 new heritage overlays including three new precinct overlays and two group listings with supporting policy and other scheme changes in the towns and nearby rural areas of Shepparton and Tatura (Greater Shepparton C110).  109 new individual place heritage overlays and 12 new or revised precinct overlays with supporting policy and reference documents for Echuca, Kyabram and other towns and districts in Campaspe Shire (Campaspe C50).  Four new heritage precincts in the Surrey Hills area (Boroondara C150).  Residential rezoning adjacent to Moorabbin Airport (Kingston Planning Scheme C111 Round 2).  Extensions to the Queenscliffe Ferry Terminal (Queenscliffe C23).  Design and development controls at the Mentone Junction Activity Centre (Kingston C128).  Restructure plans for old and inappropriate subdivisions and Crown townships (Mount Alexander C63 and C69).  Residential rezoning within Bunyip Township and associated permit (Cardinia C72).  Urban rezoning at the edge of Drouin Township (Baw Baw C88).  Business rezoning and overlays at edge of Glen Huntly Activity Centre (Glen Eira C80).  Business and other rezonings and overlays at the edge of Caulfield South Activity Centre (Glen Eira C95).  Rezoning of former Urban Floodway Zone to residential in Berwick with associated permit (Casey C168).  New licensed premises policy (Moonee Valley C131).  Competing shopping centre expansions at Caroline Springs and Burnside Activity Centres (Melton C91 and C112). Jenny also organised two heritage seminars for the Department’s PLANET program and presented at a post‐ graduate seminar at University of Melbourne. Jenny continues to convene the heritage interest group of Panel members.

Lester Townsend In January 2012, Lester began a 12 month secondment with DPCD (now DTPLI) to help develop the Metropolitan Planning Strategy for Melbourne. This work continued well into 2013. Lester’s work as part of the Metropolitan Planning Strategy team has included:  An analysis previous metropolitan strategies, Managing Melbourne: A Review of Metropolitan Melbourne's Strategic Planning, drawing out lessons for the new strategy. This has been published on the www.planmelbourne.vic.gov.au website. There is also a short video.  Drafting the discussion paper for the Strategy, Melbourne: Let’s talk About the Future.  Working as part of various teams developing background material to inform the Strategy and analysing submissions.  Setting up document templates and style sheets to coordinate input from different authors.  Drafting various components of the Strategy.  Lester has also managed a number of Panels for 2012‐ 13 including two in Sale and one concerning Ballarat’s gaming policy. Manningham C96 considered the introduction of mandatory height controls in residential growth areas. Lester once again delivered the PLANET training course on Effective Strategic Planning.

Con Tsotsoros Con was appointed as a Senior Panel Member in July 2013. Con has a Bachelor of Applied Science in Planning and has previously worked 14 years in the private sector and seven years in state government planning, most recently as Assistant Director ‐ Statutory Systems in the former Department of Planning and Community Development. Prior to that, Con was employed by MacroPlan (and its previous iterations) as Director for several years, following on from stints in Local Government (Northcote and Footscray). He has specialised in retail, economic and strategic planning. Con is a previous committee member and awards convenor of the Planning Institute of Australia (Victorian Division). Con commenced with PPV on 16 July 2013.

Nick Wimbush During the year Nick undertook a number of training sessions for interest groups and universities including Sessional lectures to Monash Environmental Law and RMIT Planning students. He also participated in a Panel session on planning reform at the Victorian Planning and Environmental Law Association conference in Ballarat in September. During 2012 and early 2013 he was a member of the National Environmental Law Association National Conference Committee which culminated in the conference in Melbourne in March 2013. Nick has continued to act as Deputy Chief Panel Member. At the end of 2012 he completed his Masters of Law (Juris Doctor) at Monash University. Nick’s completed 22 Panel reports in 2012‐13 including:  Heritage amendments in Banyule, Baw Baw and Glenelg.  The Wellington Shire old and inappropriate subdivisions (C71).  Redevelopment of the former Caltex site in Kingsville (Hobsons Bay C82).  Height controls for aircraft safety around Essendon Airport (Moonee Valley C121).  Structure Plans in South Gippsland (South Gippsland C72).  An Advisory Committee for the Koo Wee Rup Bypass.  Strategic review of land use in Tatura (Greater Shepparton C151).  Development of the McCalls Tannery Site in Yarraville (Maribyrnong C89).

2 Output and Performance

2.1 Key Achievements in 2012/13

In 2012‐13, a total of 154 matters were referred to PPV for consideration, including Planning Scheme Amendments, Advisory Committees, and Environment Effect Statement Inquiries. The total represents a 7.7% increase from 2011‐12. The number of submissions received fell by just over 10% to 5117.

A list of all matters considered by PPV in 2012‐13 can be found in Appendix A. The main increase in matters referred to PPV has come from the increased numbers of Amendments (including combined Amendments/Permit Applications). In 2012‐13, PPV had three major EES Inquiries and ten Advisory Committees which reflected the increased workload from the previous year. Hearings and submission of reports are generally resolved within agreed timelines. Panels are appointed promptly (within one week of request), hearings process commences within three to four weeks of appointment, and reports are submitted within: Harry Matheas, Assistant Director  20 business days (for a one person Panel)  30 business days (for a two person Panel), or  40 business days (for a three or more person Panel) of a hearing concluding, unless other timelines are stipulated (for example in Terms of Reference for an Advisory Committee and EES). In the 2012‐13 financial year, PPV completed 165 reports. Of these 93% were completed within the required reporting target date (94% for 2011‐12). The breakup of the timing of reports received by PPV can be seen in the following chart. There was one report received between 15 and 30 days late, this was due to personal circumstances out of the control of the Chair.

2.2 Administration Issues

(i) Ministerial Direction 15 In October 2012, Ministerial Direction 15 (MD15) introduced set timeframes for certain stages in the Planning Scheme Amendment process. One of the timeframes requires Panel Hearing dates to be set before the Amendment commences exhibition. While the opportunity to pre‐set Hearing dates existed before MD15 was introduced, this process is now required for all Amendments proposing public exhibition. The dates are to be agreed to between the Planning Authority and PPV and included in the exhibited Explanatory Report. In summary the dates relevant to PPV are:  The Planning Authority submits a request to pre‐set dates at least 25 business days before the anticipated commencement of exhibition.  PPV confirms pre‐set dates with Planning Authority within 15 business days of the request to pre‐ set dates.  Pre‐set dates should be finalised at least 10 business days before commencement of exhibition  Planning Authority advises PPV of the number of submissions received and the likelihood of a Panel within 5 business days of exhibition closing  The Planning Authority to request a Panel within 40 business days of exhibition closing  The Panel must ‘commence its functions’ within 20 business days of the appointment of the Panel. The Panel must submit the Panel Report:  within 20 business days* (for a one person panel);  within 30 business days* (for a two person panel); or  within 40 business days* (for a three or more person) panel. *after the last hearing day or when further information requested by the Panel is received (whichever is the later).

Whittlesea C130 Hearing

PPV prepared a new web page, a guide and an on‐line form to assist parties understand and use the process introduced by MD15. Since the introduction of MD15, PPV has received 173 requests to pre‐set Panel Hearing dates. Of the 173 requests:  27 (15.6%) have not commenced / completed exhibition.  53 (30.6%) have completed exhibition but the Amendment has not been considered by the Planning Authority.  36 (20.8%) did not require a Panel.  11 (6.4%) are awaiting the receipt of a Panel Request from the Planning Authority, and  46 (26.6%) progressed to Panel. (ii) Archiving of PPV Panel Records PPV has continued its program of archiving material to secondary storage. With possible accommodation moves planned for the coming financial year, this program will be accelerated.

(iii) Quality Control of Panel Reports In terms of continuing improvement, the key area to highlight is in relation to report production and writing. Unfortunately one area of disappointment is in the quality of some reports submitted as ‘final’ reports that require significant editing prior to release by PPV. To address this, PPV will be introducing further guidelines for all members that will require sign off on the final report submission. Hopefully this will assist members in better understanding their obligations regarding the quality of reports.

To complement the Panel Reports templates maintained by PPV and to improve the consistency of Panel Reports submitted, PPV has:  Introduced a process for peer reviewing all Panel Reports (immediately before their submission to the Planning Authority) by the Chief, Senior Panel Members or the Senior Project Manager. This peer reviewing has resulted in common errors being identified and addressed in a checklist.  Prepared a checklist of common Panel Report errors to be avoided by Panels. This checklist was finalised in late July 2013.

(iv) Web Page Updates PPV is constantly reviewing its pages on the DPCD / DTPLI web site. In 2012‐13 significant updates were made to the web pages, including:  on‐going maintenance of all pages  the creation of new pages on:  'Pre‐setting panel hearing dates', to reflect Ministerial Direction No 15, introduced in October 2012. This page informs and guides on the process and enables Planning Authorities to apply for pre‐set Panel Hearing dates through an on‐line form.  'Recent Panels and Committees' ‐ reports not available through 'Amendments online' will now be available on the new page for at least two years after a decision is announced on the matter. This page complements the 'Current Panel and Committees' page. Previously, matters that appeared on the 'Current' page were not available after their completion. (v) PPV Finance Summary Panel expenditure was $2.7 million for the 2012‐2013 financial year of which $2.58 million was recouped. In recent years, the PPV budget has been reduced substantially. PPV endeavours at all times to meet its budgetary obligations and discussions have been held with the Department with a view of obtaining additional resources. The 11% Panel charge which has been in operation since January 2011 has resulted in recoups of $245,000 for the 2012‐2013 financial year. PPV recoups costs for most matters. Invoices are sent to the relevant Planning Authority (or party as provided for in the Act) either on an interim basis (if requested) or on completion of the Panel Report. The standard fees and charges that relate to PPV are:

 Panel Member Fees – Senior Chair ($433 per half day) Sessional Chair ($418 per half day) and member at ($378 half day).*  Mileage (cents per km method) based on engine capacity of vehicle (Australian Taxation Office rates); 63 cents small, 74 cents medium and 75 cents large vehicle.*

PPV members are required to submit monthly claim forms for each Panel they are working on. Once the Panel Report has been submitted a final claim is submitted. The Finance Manager then prepares an invoice for the charges relating to the Panel and sends it to the Planning Authority or other party as allowed for in the legislation. The Finance Manager regularly deals with cost inquries from Proponents and Planning Authorities, or parties that are representing them. A regularly asked question is ‘how much are the Panel fees going to be?’ PPV does not provide quotes or estimates of what they think each Panel might cost as each matter varies in complexity, location, number of members, etc. However, PPV provides information on standard fees and charges that will be applied.

3 PPV Internal Activities and Update

3.1 New Member Induction Day

An induction day for new members was held on 7 February 2013 where Kathy Mitchell, Chief Panel Member, welcomed all new members. Information on their new role was given and that was followed by a session on legal issues in relation to Panels which was presented by Sarah Carlisle (Department Legal Officer).

3.2 Chair Training Day

On 23 April 2013, PPV held a Professional Development Forum for Panel Chairs which provided training and discussion for member’s chairing Panels. The day was attended by 41 people including 27 sessional members and included sessions by Mark Dwyer, Deputy President VCAT and Meredith Doig, Professional Company Director and Governance Adviser. The session also generated some interesting discussion and was well received by those who attended.

3.3 Professional Development of Staff and Members

PPV is keen to ensure that all staff and members participate in a range of professional development activities. Staff and members are encouraged to attend courses and seminars, and to run seminars and contribute to programs where appropriate. PPV scheduled three full day professional development and training seminars for members during the 2012‐13 year. Two of these were held on 23 August 2012 and 18 December 2012. The seminar scheduled for 24 May 2013 was cancelled due to a number of reasons, including member availability. Due to budgetary issues, sessional members are not paid for this time, but can claim travelling expenses (especially if they are travelling from regional Victoria). Speakers over the past year included:  Matthew Guy MLC ‐ Minister for Planning;  Andrew Tongue, Secretary – Department of Planning and Community Development;  His Honour, Justice Garde, President, VCAT  Peter Seamer, CEO Growth Areas Authority; and  Jon Hickman – Chair, Victorian Coastal Council; and  Peter Allen –Director, Office of Planning Performance, Department of Planning and Community Development Other speakers also presented to PPV and addressed topics on Rural Strategies and the 2011 Census. Members of PPV conduct smaller groups meetings for Special Interest Groups on an as required basis and these have included matters relating to energy and environment and social impact assessment. PPV provides regular email updates and provision of key DTPLI information, significant VCAT decisions and other matters of interest to members on an as required basis, including significant Panel reports. There is continuing professional development for Senior Members through participation, attendance and in many cases, the running of seminars, conferences, and presentation of papers, including:  PLANET Training – both as presenters and participants;  Presentation and participation at VPELA, PIA and UDIA conferences, seminars and forums; and  Representation at DPCD Regional Conference and forums. Administration staff undertake regular training courses and seminars, including MS Word and Excel, financial training, web design, and PLANET courses.

3.4 Panel Member Interest Groups

The Energy, Environment and Infrastructure Group (convened by Nick Wimbush and Trevor McCullough) held a successful seminar in April 2013 for 25 members who heard presentations on the South West Landscape Assessment Study, upcoming major projects likely to require Panel involvement, the Victorian Climate Change Adaptation Plan and the revised EPA Guidelines for Industrial Residual Air Emissions.

At a Regional Issues Forum held in August 2012, Cathie McRobert and Margaret Baird provided an overview of issues raised in Panel reports relating to Rural Strategies; Damien Kennedy from DPCD briefed members on State level initiatives for regional areas; and Gareth Hately from the MAV canvassed issues being confronted by local government and reported on the MAV review of rural strategies and provisions. A further session of the regional interest group to update members on bushfire provisions has been deferred until the consultation process for new mapping is underway. A session of the Social and Housing interest group (convened by Cathie McRobert) is planned to explore the implications of and promote a consistent response to the change to the Act that will require planning decisions to consider significant social (and economic) effects of Amendments and applications is planned. The Heritage interest group (convened by Jenny Moles) met in late July to discuss the forthcoming changes to the Act and common issues arising in heritage amendments. Likewise the Precinct Structure Plan interest group (convened by Kathy Mitchell) met in late July and had briefings from the GAA and the City of Greater Geelong about the current and forthcoming issues relating to the Growth Area planning in metropolitan Melbourne, Geelong and regional Victoria.

3.5 PPV Staff Meetings

PPV has two regular meetings where information can be exchanged and issues discussed. Every Monday, a general staff meeting is held where staff are informed of any issues raised at Executive meetings which the Chief Panel Member (or her delegate) attends, or any other Departmental forums. In addition, staff can raise issues for discussion or clarification on any other items which affect the operations of PPV. A more formal meeting is held on the last Friday of each month where staff meet to discuss broader issues and important work projects. These meetings have an agenda and minutes and action items are recorded. These meetings also allow staff who have travelled to conferences and/or overseas to share their experiences with the rest of the group.

3.6 PPV Regional Visits

A number of visits were undertaken during the year to meet with Regional Councils and Planners as follows:

(i) Barwon South West Margaret Baird, Laura Agius and Tina Ding visited Geelong/Barwon in July 2012 to present as part of a regional Forum.

(ii) Gippsland Cathie McRobert and Greta Grivas met with DPCD regional staff and a good representation of local government, consulting and agency planners in August 2012. They responded to local planners’ request to discuss ‘What makes a good submission to a Panel?’ and explained matters such as preparing for hearings, Panel reports and recommendations.

(iii) Hume Trevor McCullough and Harry Matheas travelled to Shepparton to meet with Hume Region and local government planners in August 2012. A presentation on PPV and how to present to a Panel was made and was well received.

(iv) Metropolitan Melbourne In October 2012, Nick Wimbush and Jessica Cutting attended the Regional Planners Meeting (Western Metro) at Moonee Valley City Council attended by planning representatives from Moonee Valley, Brimbank, Darebin, Hobsons Bay, Hume, Maribyrnong, Melton, Mitchell, Moreland, Whittlesea and Wyndham Councils. Nick and Jessica briefed attendees on good practice before Panels and provided tips and advice on participating in a successful Panel Hearing. Current issues before Panels were discussed including Development Contributions, Heritage Matters, Precinct Structure Planning and other Panel issues such as conflict of interest and privacy.

(v) Remaining regions Visits to the Loddon Mallee and Grampians regions were undertaken late in the 2011/12 year.

4 Key Projects

4.1 Environment Effects Inquiries

(i) Western Highway duplication project – Section 2 – Beaufort to Ararat and Section 3 – Ararat to Stawell VicRoads proposed to duplicate the Western Highway between Beaufort and Stawell as part of a larger project to duplicate this highway between Ballarat and Stawell. The EES Inquiry and Advisory Committee Hearings were held in December 2012 (Section 2) and March 2013 (Section 3) and comprised Trevor McCullough (Chair), Darrel Brewin, Gordon Anderson (Section 2) and Trevor McCullough (Chair), Darrel Brewin and Ian Harris (Section 3). The Inquiry was supported by Greta Grivas. The Inquiry was required to:  Consider and report on the potentially significant effects of the project taking into account the procedures and requirements the Minister required for the preparation of the EES and the controlling provisions under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) (Commonwealth); and  Address matters relevant to the alignment and design of the project and the draft planning scheme amendments Greta Grivas ‐ Senior Project Officer prepared by VicRoads. The Inquiry submitted its Section 2 report in February 2013 with the Minister releasing his assessment in May 2013 which endorsed the Panel’s recommendation to support alignment option 1. The Section 3 report was submitted to the Minister in June 2013 and has not yet been released.

4.2 Advisory Committees

(i) Standard Development Contributions Advisory Committee In May 2012, the Minister for Planning announced the Government’s preferred framework for development contribution plans. The preferred framework outlined a new system of standard levies that can be selected and applied to different development settings. The new system would give councils a set of standard development contribution levies for different development settings based around five infrastructure categories:  Community facilities  Open Space facilities  Transport infrastructure  Drainage infrastructure  Public land The Minister for Planning appointed an Advisory Committee to provide advice on the final framework for a new standard development contributions system and on the establishment of the standard levies. The Committee comprised Kathy Mitchell (Chair), Trevor McCullough, Rodger Eade, Chris De Silva and Bryce Moore. The Committee was assisted by Jessica Cutting, Senior Project Manager and Andrew Natoli, lawyer.

The Advisory Committee was required to report its findings and recommendations in two stages:  a report detailing the framework of the new system by Monday 17 December 2012 and  a report setting the standard levies for the new system by Friday 31 May 2013. Report 1 was prepared as an interim report and provided the thoughts and views of the Committee based on its work to date. The Committee held approximately 35 stakeholder meetings in late 2012 with over 100 participants. A total 58 written submissions were also received. Report 1 set out a proposed approach to assigning standard levies in different Development Settings. Report 2 reviewed the comments and feedback provided in consultation in submissions. A total 69 written submissions were received. The Committee also met with over 100 organisations in forums and one‐on‐one meetings, consulting with over 800 people. Report 2 provided refinements to the levy framework and set standard levies for each Development Setting. The Standard Development Contributions Advisory Committee was subject to a probity audit and received favourable reports from the Probity Auditor, Ann Larkins, Director of Dench McClean Carlson. The Minister has since asked the Committee to undertake further work on a possible State Infrastructure Levy.

(ii) Moonee Valley Racecourse Redevelopment An Advisory Committee has been appointed by the Minister for Planning to report on the redevelopment of the Moonee Valley Racecourse. The Committee comprises Kathy Mitchell (Chair), Gordon Anderson, Stephen Hancock, Jim Holdsworth, and Lucinda Peterson. The Committee is being assisted by Jessica Cutting, Senior Project Manager. The Moonee Valley Racing Club (the Club) prepared a Master Plan to redevelop the racecourse and it was placed on informal public consultation in June 2011. Following a Heritage Assessment, Moonee Valley City Council proposed permanent heritage controls for structures and buildings on the Moonee Valley Racecourse site.

Draft Amendments to allow the site redevelopment and to introduce the heritage controls have been prepared by the Club and the Council respectively. The Committee’s Terms of Reference require it to complete its task in stages. As part of Stage 1, the Committee met with the various parties listed its Terms of Reference. The Club prepared and presented a revised Master Plan to the Committee and to relevant parties, and a detailed site inspection was undertaken on 4 June 2013. The Advisory Committee has considered the revised Master Plan and provided advice on the suitability of the Master Plan for formal exhibition. The following stages will be completed in the coming financial year: Jessica Cutting Senior Project Manager  Stage 2: Exhibition The Department of Transport, Planning and Local Infrastructure will exhibit the draft Planning Scheme Amendments and proposed Master Plan for a period of six weeks.  Stage 3: Public Hearing The Advisory Committee is expected to carry out a public hearing and provide all submitters with an opportunity to be heard.  Stage 4: Outcomes The Advisory Committee will produce a written report to the Moonee Valley City Council and the Minister for Planning providing an assessment of the redevelopment and recommendations as to how the project should proceed.

(iii) Ballarat West Development Contributions Advisory Committee An Advisory Committee has been appointed to report on the Ballarat West Development Contributions Plan. The Committee comprises William O'Neil (Chair), Geoff Glynn and James Golsworthy. The Committee is being assisted by Jessica Cutting, Senior Project Manager. On 2 October 2012 the Minister approved Amendment C158 to the Ballarat Planning Scheme. Amendment C158 introduced the Ballarat West Precinct Structure Plan (which covers the four remaining precincts in the Ballarat West Growth Area) and the Ballarat West Native Vegetation Precinct Plan into the scheme. The proposed Ballarat West Development Contributions Plan was not introduced into the scheme. Following further consultation on the contributions plan, the Council referred the submissions it received during the consultation, to the Advisory Committee. The Advisory Committee held a Directions Hearing on 14 May 2013. The Hearings on this matter were scheduled to be held in June and July 2013. On Day 1 of the Hearing, the Committee received a request to adjourn the hearing to identify further DCP cost savings. The Committee supported the adjournment request to enable further negotiation to take place. A further Directions Hearing will be held at in August 2013 to reset the hearing dates.

(iv) Healesville‐Koo Wee Rup Advisory Committee The Healesville‐Koo Wee Rup Road is approximately 15 km in length and extends from Bald Hill Road in the north to the . The Road passes through the commercial centre of the Koo Wee Rup township. The route is currently a two lane rural road and has experienced an increase in traffic since the opening of the Pakenham Bypass. The Proponent, VicRoads, proposed to upgrade Koo Wee Rup Road south of the in order to accommodate future traffic growth and provide safer conditions. VicRoads’ long term proposal is to provide a freeway standard route between the (Pakenham Bypass) and the South Gippsland Highway, incorporating a bypass of the Koo Wee Rup township. In response to exhibition of VicRoads’ Planning Assessment Report, 15 submissions were received. The Advisory Committee Hearing was held in September 2012. The Advisory Committee was comprised of Nick Wimbush (Chair), Ian Gibson and Des Grogan and was assisted by Greta Grivas, Senior Project Officer. The Advisory Committee’s task was to consider controlled provisions under the EPBC Act, the road alignment and vehicular safety access and agricultural impacts.

4.3 Other Major Matters

(i) Hume C154 ‘Greenvale Central Precinct Structure Plan’ Amendment C154 to the Hume Planning Scheme applies to 236 hectares of land in Greenvale known as the Greenvale Central Precinct. The Amendment sought to incorporate the Greenvale Central Precinct Structure Plan, Greenvale Central Development Contributions Plan and Greenvale Central Native Vegetation Precinct Structure Plan into the Planning Scheme. It was prepared by the Growth Areas Authority as Planning Authority in consultation with Hume City Council, state agencies and various landowners. A Panel was appointed to consider the submissions made in respect of the Amendment. The Panel comprised Kathryn Mitchell (Chair), Des Grogan, Richard Horsfall and Chris McNeill. The Panel was assisted by Jessica Cutting, Senior Project Manager. The Panel held hearings for 8 days between 3 and 13 December 2012, and on 5 February 2013. A total of 268 submissions were considered by the Panel. Following a review of post exhibition submissions, the Growth Areas Authority made a number of revisions to the Greenvale Central Precinct Structure Plan, the most significant of which were to:  Identify the southernmost part of Greenvale Central Precinct Structure Plan area (known as the Pan Handle) for low density rather than conventional density development and exclude this area from the Development Contributions Plan; and  Introduce a directional buffer around the existing Greenvale Poultry Farm in the northern area of the Greenvale Central Precinct Structure Plan area. More than half of the submissions related to Aitken College and the road layout near the school. The Panel believed these issues were, for the most part, resolved to submitters’ satisfaction during the Panel Hearing. The key issues in dispute between the parties included: the implications of the proximity of Melbourne Airport, roads and access issues, the future of the Pan Handle area, the post exhibition inclusion of a local convenience centre, existing use rights associated with an egg farm within the Greenvale Central Precinct Structure Plan area, matters relating to Aitken College, the identification and location of a non‐Government school site, native vegetation issues, the management of

encumbered open space, the Development Contributions Plan and the removal of restrictive covenants. The Panel concluded that the Greenvale Central Precinct Structure Plan would be difficult to implement primarily due to the highly fragmented nature of land ownership in the area and the existing subdivision pattern. The Panel also concluded that the Amendment provides for the future development and growth of the Greenvale Central area through to implementation of the Greenvale Central Precinct Structure Plan and its associated provisions.

(ii) Wellington Planning Scheme Amendment C71 The ‘Old and Inappropriate Subdivisions’ on the 90 Mile Beach in Gippsland have been an intractable planning problem for over 40 years. Nearly 12,000 lots at residential densities with few or no services were subdivided in the remote coastal dunes of the 90 Mile Beach, primarily in the 1960s. Since the early 1970’s successive State and local governments have imposed various levels of planning controls to prevent or minimise development in the fragile landscape. The issue came to a head with Wellington Shire Council’s Amendment C71 to introduce permanent development prohibition into the area. The Panel heard numerous heartfelt submissions from owners of properties in the Amendment area, some of whom have been fighting the planning controls for three generations. The Panel reflected on the difficult history of the area but ultimately supported the Amendment given the undoubted environmental values present and poor planning outcome that would result if development proceeded.

(iii) Surf Coast C66 The Amendment proposed to introduce a number of strategic planning studies that affect the future growth and development of Torquay‐Jan Juc:  Torquay‐Jan Juc Neighbourhood Character Study and Vegetation Assessment (2006) and Torquay‐Jan Juc Neighbourhood Character Study Review (2012);  Sustainable Futures Plan Torquay‐Jan Juc 2040 (2012);  Torquay‐Jan Juc Retail Strategy (2011);  Torquay Town Centre Parking and Access Strategy (2011‐2016); and  Torquay North Outline Development Plan (Revised, 2012). The Panel, assisted by Greta Grivas Senior Project Officer, is currently hearing the issue which attracted 538 submissions and received considerable local media attention.

(iv) Moonee Valley C108 Amendment C108 to the Moonee Valley Planning Scheme proposed to introduce a new Local Planning Policy, Stormwater Management (Water Sensitive Urban Design), at Clause 22 in the Moonee Valley Planning Scheme and make a minor change to Clause 21.03‐2 to cross reference the new policy. The Amendment will apply to all land in the municipality, where an application is made for a new building; extension to an existing building which is 50 square metres in floor area or greater; and a subdivision in a business zone (except for subdivision of existing buildings). Four other Councils (Port Phillip, Yarra, Melbourne and Stonnington) have proposed similar amendments to their local planning policies that have been submitted to the Minister for approval.

4.4 Other Matters

(i) Updating the Panel Members Manual to include guidance when considering matters ‘On the papers’ Normally a Hearing will take place as a result of a Panel request. However, occasionally a Panel report can be written without a Hearing. This process is called ‘On the papers’. On the papers involves the Panel considering the written submissions referred to it by the Planning Authority (usually the Council), and considering the Amendment generally, and then preparing its report. It will not involve a main Hearing. The update to the Panel Members Manual provides guidance to Panel members about when it is and is not appropriate to conduct a matter on the papers and the process that is involved.

(ii) A Guide to the Use of Reference Documents in Panel Reports The role of reference documents, and the manner in which they are referred to in planning schemes, are often addressed in submissions about planning scheme Amendments that are subsequently considered by Panels. During the year, PPV prepared an internal paper which identified examples of these issues and different approaches to them arising through the consideration of some Panels.

(iii) Planning and Environment Amendment (General) Act 2013 and its Implications for PPV The Planning and Environment Amendment (General) Bill passed both houses in February 2013 and received Royal Assent on 19 February 2013. It is now known as the Planning and Environment Amendment (General) Act 2013. The Amendment Act amends the Planning and Environment Act 1987 (P&E Act) with the intention to improve the operation of the planning system in Victoria. The Amendment Act comes into operation on 28 October 2013. The key reforms in the Amendment Act are to—  abolish Development Assessment Committees;  provide for a Planning Application Committee to work with councils to deliver better local planning decisions;  provide for two types of referral authority that will be set out in planning schemes;  provide for reporting to the Minister by planning authorities, responsible authorities and referral authorities to improve the transparency of the planning system;  improve the processes for amending planning schemes and assessing planning permit applications by reducing delays and speeding up information exchange;  improve the decision‐making process at the Victorian Civil and Administrative Tribunal;  improve the operation of planning agreements by expanding the options for amending and ending agreements;  make miscellaneous changes to improve the operation of the P&E Act which will reduce uncertainty and delays, and deliver better planning outcomes. In addition, the Amendment Act amends the Subdivision Act 1988 in relation to public open space and includes consequential minor changes to the Subdivision Act 1988 and the Local Government Act 1989.

Implications for Planning Panels Currently the Proponent does not have the right to be heard under the P&E Act. The Amendment Act confirms in legislation the right of the Proponent to be heard, although in practise it will have little effect on Panels which give the Proponent the opportunity to be heard as a matter of course. The Amendment Act clarifies that the same procedural rules apply to advisory committee hearings as to Panel Hearings. Similar to practice day hearings conducted by VCAT, the Amendment Act gives Planning Panels the option of holding ‘Directions Panels’ whereby a number of Directions Hearings are conducted in one day by a particular Panel which is not necessarily the same Panel as that which is appointed to the main Hearing. It is expected that Directions Panels would be used only rarely but it may be a useful provision in limited circumstances. Under the Amendment Act, Panel members will be immune from liability and cannot be sued personally provided the Panel acted in good faith in discharging its functions. In practice, it will not represent a substantive change to how Panel proceedings are conducted at present. New definitions of a ‘referral authority’ under Part 4 of the Amendment Act will enable a planning scheme to provide for the two kinds of referral authority as below:  A determining referral authority has the power to require a permit application to be refused or for certain conditions to be included in a permit.  A recommending referral authority may comment on an application. This change is relevant to combined planning scheme amendments and planning permit (Section 96D) Panels. In this case the Panel will need to be clear as to whether the referral authority is a ‘determining’ referral authority or a ‘recommending’ referral authority when considering a permit application. The same will apply to section 97E (Ministerial call‐ in permits). Prescribed amendments can now be approved by a council and the Minister without the requirement of a Panel Hearing. The implication for Planning Panels will depend on what is defined as a ‘class’ or ‘classes’ of amendments. At present, the Act and Amendment Act do not contain definitions of these classes but it is likely that some smaller and administrative‐type amendments may be diverted from the Panel process. Part 10 of the Amendment Act makes it mandatory for the Planning Authority to take social effects and economic effects of the use or development of the land into account when preparing an amendment to a planning scheme, and also when issuing planning permits. Previously there was only a requirement to consider significant environmental matters in the preparation of an amendment (section 12(2)(b)) but there was discretion as to whether social and economic effects were to be considered by the planning authority (and thus the Panel). Potentially, heritage panels, and possibly others, may need to change the way they assess heritage proposals and take social and economic impacts into account at the Amendment stage. Section 18 of the Subdivision Act is amended to apply only where the requirement for public open space is not specified in the planning scheme. 5 The Year Ahead

The year ahead brings many challenges. This time last year, PPV thought it would be moving to 1 Spring Street, but that did not eventuate for a number of reasons. Now that DPCD no longer exists, the new DTPLI will be consolidating most of its operations and staff at 1 Spring Street by the end of 2013. This will include PPV, and at the time of writing, it would seem as though PPV offices will be located on Level 5 and hearing rooms on the ground floor. One of the complications of this is that additional staff facilities will be required on the ground floor to enable staffing whenever a Hearing is in progress. The budget is always presenting a challenge for PPV while another challenge for the year ahead is the apparent heavy program of major environmental cases, as well as metropolitan and regional PSP matters. This may require additional staff resources in terms of administration and project officer support. Soon there will be a new Metropolitan Strategy and seven Regional Growth Plans. These will be co‐ordinated and implemented by the new Metropolitan Planning Authority which is to commence operations in October 2013. As we currently understand, the role of PPV will not change in this new operating context. With the recent introduction of the new residential, commercial, industrial and rural zones, changes to the Planning and Environment Act 1987, the current review of the State Planning Policy Framework, and the ongoing reform of the Victoria Planning System, PPV will need to ensure its members are fully abreast of the implications of these changes in the delivery of its services. Challenges however, are exciting and always bring with it new energies, ideas and thought processes. All at PPV look forward to the next 12 months and the opportunities it will realise.
