Staff Report Summary

This report analyzes amendment options to Battle Ground Municipal Code pertaining to the sale and discharge of consumer fireworks.

Background

At councils’ request, staff has conducted an analysis of current regulations, potential changes, and impacts of Battle Ground Municipal Code 8.30 – Fireworks and .

A public outreach survey was posted on April 3, 2018 running through April 27, 2018. Advertisement for the survey was posted to Facebook, Twitter, City Website News, Flash Alert News and it was published in the Reflector. Hard copies of the survey were also made available at City Hall, the Police Department, and the Community Center.

Staff will present the result of the survey during the Council meeting. After the presentation, Council will conduct the public hearing and then deliberate on what direction to take.

Current Restrictions

Currently, the City of Battle Ground has no fireworks ordinances that are more restrictive than state law.

Consumer fireworks are permitted provide they meet the definition below.

"Consumer fireworks" means any small firework device designed to produce visible effects by combustion and which must comply with the construction, chemical composition, and labeling regulations of the United States consumer product safety commission, as set forth in 16 C.F.R. Parts 1500 and 1507 and including some small devices designed to produce audible effects, such as whistling devices, ground devices containing 50 mg or less of materials, and aerial devices containing 130 mg or less of explosive materials and classified as fireworks UN0336 by the United States department of transportation at 49 C.F.R. Sec. 172.101 as of June 13, 2002, and not including fused set pieces containing components which together exceed 50 mg of salute powder. (RCW 70.77.136)

Sale and use of certain fireworks is prohibited.

No fireworks may be sold or offered for sale to the public as consumer fireworks which are classified as skyrockets, or missile-type rockets, firecrackers, salutes, or chasers as defined by the United States department of transportation and the federal consumer products safety commission except as provided in RCW 70.77.311. (RCW 70.77.401)

(Some of these types of fireworks may be purchased in other states or on some tribal reservations, but are illegal in Washington State or outside of a reservation.)

Of the 266 known Washington State Jurisdictions, the following chart illustrates percentages for complete banning, partial restrictions, and no restrictions during the Independence Day Holiday:

Of the (102) Washington State Jurisdictions that have implemented regulations, most have done so by decreasing the amount of days that fireworks can be discharged.

Currently, (4) jurisdictions in Washington State have restricted fireworks discharge to non-aerial type only. These include Washougal, Snoqualmie, Soap Lake, and Okanogan.

Process

Under RCW 70.77, State law governs the regulation of fireworks, including which fireworks are legal, licensing for public fireworks displays and for fireworks sellers, and when fireworks may be discharged. However, it leaves some room for local regulation, such as when fireworks may be sold or discharged, what types of fireworks may be sold or discharged, and for cities and counties to completely prohibit the sale and discharge of fireworks.

In accordance with RCW 70.77.250(4), any local fireworks ordinances that are more restrictive than state law may not take effect until at least one year after adoption.

Fiscal and Policy Implications

Staff has analyzed how the modifying Battle Ground fireworks ordinances impact affect the City, both from an economic standpoint and a services standpoint.

City Services

Community Development Department

Current fireworks stand permit holders renew their permits annually and pay a permit fee of $100.00. (This amount is the maximum allowed by the State under RCW 70.77.555). There are currently seven permit holders for locations in Battle Ground.

The biggest impact to Public Works is the increased dump fees associated with the additional trash in the street as well as the additional work involved with cleaning out the stormwater catch basins that collect the remnants of the fireworks.

Police / Code Enforcement

Any regulations on fireworks imposed that are more restrictive than current code would likely increase the need for enforcement outside of permissible discharge curfew dates and times.

Training to officers on the new ordinance and types of fireworks would be required.

Adequate staffing to provide enforcement as directed by the Council and City Manager would be needed. More letter of the law enforcement would require officers on overtime as enforcement creates more paperwork and takes units out of service for longer periods. This required additional staffing to respond to other calls for service not related to fireworks.

Fire / Emergency Services

Any regulations on fireworks imposed that are more restrictive than current code would likely reduce the number of fire and medical responses by the Fire District. A narrower window of legal discharge times would allow enhanced staffing levels for a targeted time period, rather than remaining on high alert for up to eight consecutive days.

Under current conditions, emergency resources occupied on fireworks discharge calls may be unable to provide the expected level of response to other calls for service unrelated to fireworks in the community.
