At its fifty-fifth session, the International Law Commission established a Working Group on unilateral acts of States, which recommended (recommendation 4) that: “4. The report which the Special Rapporteur will submit to the Commission at its next session will be exclusively as complete a presentation as possible of the practice of States in respect of unilateral acts. It should also include information originating with the author of the act or conduct and the reactions of the other States or other actors concerned”.1 2. The question of the definition of a unilateral act is still under discussion within the Commission. As an interim measure, with a view to being able to make progress with its work, the Commission endorsed the Working Group’s recommendation and adopted the definition given below. While this is only a working definition, it will serve as a basis for the adoption in due course of a definitive definition of a unilateral act which the Commission can use for its work of codification and progressive development: “Recommendation 1 1. For the purposes of the present study, a unilateral act of a State is a statement expressing the will or consent by which that State purports to create obligations or other legal effects under international law”.2 3. In accordance with the Commission’s regular practice, a suitable definition of a unilateral act, one that can be used for purposes of developing rules governing the functioning of this category of legal acts, must be based on adequate consideration of the practice of States. This point was made by a number of members of the Commission in 2003, with reference to the Special Rapporteur’s sixth report. “The examination of State practice was limited. The analysis should focus on relevant State practice for each unilateral act, with regard to its legal effects, requirements for its validity and questions such as revocability and termination; State practice needed to be assessed so as to decide whether it reflected only specific elements or could provide the basis for some more general principles relating to unilateral acts”.3 “It was felt that, based on State practice, unilateral acts which create international obligations could be identified and a certain number of applicable rules developed”.4 4. Similar remarks were made by representatives of several States in the Sixth Committee of the General Assembly in 2003: that in the absence of a systematic analysis of existing State practice in that area it would be difficult, if not premature, to proceed until a wider response from States had been received;5 that at the current __________________ 1 See Official Records of the General Assembly, Fifty-eighth Session, Supplement No. 10 (A/58/10), para. 308. 2 A/58/10, para. 306. 3 A/58/10, para. 277. 4 A/58/10, para. 282. 5 Statement by Israel, A/C.6/58/SR.17. 4 A/CN.4/542 stage, more information should be gathered on State practice in that field;6 that information on State practice would be useful;7 and that the Special Rapporteur should submit as complete a presentation as possible of the practice of States in respect of unilateral acts.8 5. The Working Group established in 2003 offered some guidelines which the Special Rapporteur has taken into consideration in preparing this report: “Recommendation 5 5. The material assembled on an empirical basis should also include elements making it possible to identify not only the rules applicable to unilateral acts stricto sensu, with a view to the preparation of draft articles accompanied by commentaries, but also the rules which might apply to State conduct producing similar effects. Recommendation 6 6. An orderly classification of State practice should, insofar as possible, provide answers to the following questions: – What were the reasons for the unilateral act or conduct of the State? – What are the criteria for the validity of the express or implied commitment of the State and, in particular, but not exclusively, the criteria relating to the competence responsible for the act or conduct? – In which circumstances and under which conditions can the unilateral commitment be modified or withdrawn? Recommendation 7 7. In his next report, the Special Rapporteur will not submit the legal rules which may be deduced from the material thus submitted. They will be dealt with in later reports so that specific draft articles or recommendations may be prepared”.9 6. As he had stated last year that he would do, the Special Rapporteur — with the invaluable assistance of the University of Málaga, to the professors and students of which he wishes to express his sincere thanks for their excellent work — undertook a study of the practice of States, based on an abundant bibliography (a full list of sources will be found in the annex to this report), from which he has selected a series of unilateral acts, some of which may be useful for the purposes of a consideration of the topic under review. 7. It is important to note that an assessment of the practice of States can only be subjective, inasmuch as Governments’ own views on the nature of their statements are not available; this, indeed, may be one of the characteristics of these acts. In section II below, an attempt has been made to organize the practice of States by subdividing it into acts that fall into various categories of material acts, as usually designated in international doctrine. These acts, despite previous statements to the contrary, have been assigned to the three categories that appeared to be most satisfactory as a basis for a general classification, namely (a) acts whereby a State assumes obligations (promise and recognition); (b) acts whereby a State renounces a right (renunciation); and (c) acts whereby a State asserts a right or legal claim (protest). Notification is discussed separately; certainly it is no less unilateral from a formal standpoint, but there is some disagreement as to whether it is a unilateral act in the sense with which the Commission is concerned.

It will not end with us.” -U.S. Defense Secretary Jim Mattis1 Strategic Reasoning for Closer U.S. –Mexico Military Ties Despite the deep cultural and economic diversity of North America’s 486+ million inhabitants, the interconnectedness of the three countries means that they all face, to various degrees, the same threats, which range from serious to existential. Existential threats have long been narrowed to a nuclear war with Russia, to a much lesser degree China, and the now aspiring North Korea. The lack of an existential threat from the south has meant that Mexico was not a priority for the U.S. defense community. Mexico’s non-interventionist interior-looking foreign policy, the lack of an external threat, and an extremely complex politico-military relationship also meant that the defense relationship with the United States was cordial, but distant over several decades. Since the 1980’s, the Mexican Navy and Air Force did source their token conventional fighting capacity from the United States: a squadron of tactical jet fighters and a flotilla of second-hand destroyers and frigates; however, this was mainly out of convenience rather than a strategic decision to develop binational defense ties.

  • Islamic Organisations of Guyana
    History and Politicking of Islamic Organisations in Guyana Introduction Muslims make up about fifteen percent of Guyana’s total population (see figure # 2), and they are represented by a plethora of Islamic institutions, both organisations and mosques. Jamiat-ul Ulama-E-Deen was the first Islamic Organisation established in Guyana. It was founded in 1934 by Maulvi Mohammad Ahmad Nasir. The Islamic Association of British Guiana was formed in 1936 to mobilize and preserve the Muslim identity in an ocean of evangelism. In 1936 the IABG published the first Islamic journal in Guyana, which was called Nur-E-Islam. Jamiat and IABG were defunct by the late 1930’s and the Sadr-E-Anjuman filled the void. Present day Guyana is home to a large number of Islamic organisations: Guyana United Sadr Islamic Anjuman (GUSIA), Anjuman Hifazat-ul-Islam (HIFAZ), Central Islamic Organization of Guyana (CIOG), Guyana Islamic Trust (GIT), Muslim Youth League (MYL), Muslim Youth Organization (MYO), Hujjatul Ulama/Tabligh Jamaat, Guyana Muslim Mission, the Guyana Islamic Forum (GIF), Diamond Dar Uloom, Imam Baqir Islamic Centre, and the Guyana Islamic Institute. Tensions exits between the CIOG, HIFAZ, GUSIA, MYL, GIF and the GIT. The oldest surviving organizations are the GUSIA and HIFAZ. HIFAZ, GUSIA and MYL have had a strong relationship and have been cooperating on numerous programmes. GIT sees the practice of Islam by the traditionalists who are those that attached great importance to certain practices those there Muslim ancestors who came from South Asia practiced, as corrupted with innovations (bidah). The CIOG it is trying to accommodate South Asian Muslims of the Hanafi Mazhab who attached great importance’s to some of these “traditional practices.” GIT on the other hand, brand these practices as unorthodox or bidah (innovations) that have no place in Islam.

    THE ABOLITION OF THE MANDATORY DEATH PENALTY IN AFRICA: A COMPARATIVE CONSTITUTIONAL ANALYSIS Andrew Novak* 1. INTRODUCTION The mandatory death penalty for the crime of murder is in rapid retreat worldwide. Originally diffused to the common law countries of the Caribbean, Africa, and South and Southeast Asia by way of the British Empire, the penalty has been found unconstitutional and incompatible with human rights norms in at least ten Caribbean nations since the year 2000. A new wave of litigation has appeared in the postcolonial common law nations of East and Southern Africa, and courts in Malawi, Uganda, and now Kenya have found an automatic sentence of death unconstitutional and have replaced mandatory schemes with discretionary ones that allow consideration of mitigating factors in the capital sentencing process.1 The resulting criminal justice regimes operate in closer conformity with international human rights norms and explicitly adopt these norms in their domestic legal systems. This harmonization of death penalty regimes across borders is no accident: it was the deliberate intention of a small network of international anti- death penalty advocates to create a body of transnational jurisprudence from which to draw in bringing incremental challenges in national courts.2 By initially petitioning the United Nations Human Rights Committee and the Inter- American Human Rights System to find the mandatory death penalty incompatible with human rights treaty obligations, this core of advocates succeeded in developing a corpus of persuasive reasoning on which they could * Adjunct Professor of African Law, American University Washington College of Law.     Recognition in International Law: A Functional Reappraisalt The ambiguous nature of the doctrine of recognition in international law has contributed to significant academic dispute.1 At least two major theories have been advanced to provide a framework for this part of international law. The "constitutive theory" views recognition as the voluntary act of the recognizing state; the "declaratory theory" accepts recognition as automatic.2 Recognition has both legal and political meanings, both internal and external consequences for the recognizing state.3 The law which applies in one set of circumstances may not necessarily apply in another. In strictly public international law acceptance of a declaratory theory re- quiring immediate admission of the fact of existence of a foreign state seems necessary. If, however, domestic legal issues are also involved, a state may legitimately impose other conditions of its own law and policy, resulting in the operation of some elements of a constitutive standard. Such a distinction can readily be discerned within the existing law. It is consistent both with the maintenance of international order and with the protection of domestic legal integrity. I. CLARIFICATION OF TERMINOLOGY A restricted vocabulary has been used to describe a large quantity of concepts. One distinction traditionally made in the literature is that between recognition of a state and recognition of a government. Kiddle Abstract. - This article examines the role that Revolutionary Mexican foreign policy played within Mexican and Cuban society through an analysis of the 1938 voyage to Havana of the Brigada Mexicana and the 1939 visit to Mexico of Colonel Fulgencio Batista. These goodwill missions contributed to Mexican and Cuban state formation. In the Mexican case, the goodwill mission created domestic support by providing evidence of international support for the oil expropriation of 1938, and in the Cuban case, it provided legitimacy to the Batista regime by demonstrating affinity with the Mexican Revolution. While visiting Mexico in 1939, Batista witnessed the commemoration of the Constitution of 1917. Although he may not have been influenced to emulate its radical content in the Cuban Constitution of 1940, the two documents came to carry tremendous symbolic weight in the populist politics of both countries. More than any other large country, the Mexican tradition has been to renounce the un- stated assumptions of "power politics." In its place, twentieth cen- tury Mexican decision makers have substituted a defensive foreign policy distilled from their ideology, prudent self-interest and their national experience. In the late 1980s, this has begun to slowly change. Oil, financial crises, tension at Mexico's northern and southern borders, and domestic unrest have altered Mexico's inter- action with the world. It is unclear whether this has altered Mex- ico's perception of its own interests. Mexico's position and participation in international politics thus defies easy categorization. The issue is not whether it has the means to enter the ranks of powerful nations. Mexico is already a signifi- cant nation whose sense of nationalism confirms that. The question is how Mexico will face its overwhelming problems. Positioned to take off industrially with its resources, energy, and growing tech- nology Mexico is an upwardly mobile nation. The global petroleum economy has brought a new challenge to Mexico, that is now forc- ing major choices on Mexican policy. Even with the potential for being a modern state, Mexico does not appear to have the national self-confidence and attendant interests for even regional power aspi- rations. In strategic terms, Mexico has the foundation to become a powerful nation, but appears reluctant to accept the responsibility.

EXTRATERRITORIAL COURTS AND STATES: LEARNING FROM THE JUDICIAL COMMITTEE OF THE PRIVY COUNCIL by HAROLD AVNON YOUNG Under the Direction of Amy Steigerwalt, PhD ABSTRACT In 2015, South Africa withdrew from the International Criminal Court asserting United Nation’s Security Council bias in referring only African cases (Strydom October 15, 2015; Duggard 2013) and the United Kingdom reiterated a pledge to withdraw from the European Court of Human Rights, asserting that the court impinges on British sovereignty (Watt 2015). Both are examples of extraterritorial courts which are an important part of regional and global jurisprudence. To contribute to our understanding of the relationship between states and extraterritorial courts, I examine arguably the first and best example of an extraterritorial court, namely the Judicial Committee of the Privy Council (JCPC). Drawing on 50 British Commonwealth states, this dissertation explores the factors influencing the decision to accede to an extraterritorial court and why some states subsequently opt to sever ties.
