Apesar de objecto de tres edi(;des 1 e de ser geralmente conhe- cido e citado, este texto nao tern despertado grande atenqao . No presente texto, seguiu-se a tercelra ediqao Sobre Pas- coal de Melo, v., por todos, VITOR FAVEIRO, 1968 494 A M Hespanha no entanto, trata-se, a meu ver, de uma peqa impair, quer no con- fronto com a tradi(;ao legislativa europeia, quer pela importan- cia que vai ter como modelo (muitas vezes implicito ou silencia- do) das futuras tentativas de codificaqao penal em Portugal Z . Neste estudo, pretendo contribuir para colmatar esta lacuna da nossa historiografia. Ao faze-lo, dou-me conta, porem, do caricter inusitado do em- preendimento, no contexto das actuais tend6ncias da hist6ria ins- titucional e juridica . Numa fase de critica generalizada, e global- mente justa, a uma histbrica juridico-institucional voltada para os textos -legislativos ou doutrinais- e separada do estudo dos factos sociais, eis que me re-proponho um estudo textua13, numa area onde, para mais, proliferam leituras antropoldgicas, socio- logicas e political -a hist6ria do crime e da pena 4. Ocorre, portanto, colocar algumas questoes preliminares so- bre o estatuto tecirico da hist6ria textual, nesta nossa epoca que rompeu definitivamente com os postulados da historiografia ju- ridico-institucional de cariz dogmatico (Dogmengeschichte) . A primeira questao a ser levantada 6 a de saber se tem senti- do, para quem pretenda fazer uma hist6ria dos sistemas de con- trole e marginalizaqao sociais, preocupar-se assim com os textos . Na verdade, e quanto aos textos legais, todos sabem que as leis -mesmo as penais- nunca sao pontualmente cumpridas e que, em alguns casos, nem sequer visam -como diremos adian- te- essa aplicaqao pontual . Que, ademais, elas nao constituem todo o direito, existindo normas socialmente eficazes no piano da marginalizaqAo e da puniqao de diverssissima origem, desde os es- tilos de julgar ate a regras muito pouco estruturadas de compor- tamento social 5. E, no entanto, os textos, nao apenas sao, eles mesmos, reali- dades da histbria juridica e institucional, como mantem uma in- tima rela(;ao com outras realidades de que se alimenta quotidia- namente a tal hist6ria social das instituic,6es. Comeqo por este ultimo aspecto . Um dos temas actuais da his- tbria penal europeia e o das grandes linhas de evolu(;Ao da crimi- nalidade na Europa, da idade media aos nossos dias. Explorando uma sugestdo inicial de uma transiqao da criminalidade violenta para a criminalidade patrimonial (from violence to theft) ', tem-se procurado, com base em estudos estatisticos dos registos judi- ciais, comprovar ou infirmar esta tese. Mas, «furto» ou «violen- cia» sao realidades conceituais e nao empiricas (no sentido mais lhano da palavra). E realidades conceituais que, como se vera, ex- perimentaram mudanqas bruscas no decurso da evolucao dogma- tica de ciencia penal . Como os factos sociais do passado nos che- gam atraves de textos -e de textos que os filtram pelas catego- rias da grande tradiqao dogmatica europeia- esta tradicao tex- tual acaba por constituir uma chave indispensavel para fazer a hist6ria dos factos empiricos. Mas, mais do que isto, parece importante sublinhar como os textos, em si mesmos, sdo factos socials «htstoridveis» ; como nao sao apenas receptaculos neutros e disponiveis de ideias ou de coi- sas, mas realidades internamente estruturadas, dotadas, por as- sim dizer, de uma villa e l6gica evolutiva pr6prias. Realidades que seleccionam as coisas (os objectos) de que neles se pode falar; que atribuem um certo estatuto s6cio-institucional ao autor e que pre-figuram um certo audit6rto; que autorizam certa maneira de argumentar ou de provar e excluem outras; que, entre si, auto- nomamente dialogam, convidando a leitura de outros textos e, em contrapartida, interditando certas referencias (i .e ., que criam uma certa intertaxtualtdade)' . 6 Sobre o tema, v JENS CHR V JOHANSEN, 1986 ' Cf para estes aspectos, M FOUCAULT, 1969 (estruturas discursivas a condiq6es da pritica discursiva), P ZYMA, 1977, 1980 (sobretudo para o concerto de intertex- to) Apresentaqao geral destes temas, em portuges, CARLOS REIS, 1981 . Hespanha Falar de autonomia dos textos pode constituir um equivoco, se nao se esclarecer imediatamente que este sistema interno dos discursos e a outra face das condicoes sociais e institucionais e ate materiais em que eles sao produzidos . Condiqoes sociais, ins- titucionais e political modelam o universo dos autores e dos lei- tores e estabelecem o modelo das suas rela(;6es reciprocal. Cir- cunstancias materiais (v .g., estado dal bibliotecas) e culturais (v.g., linguisticas) condicionam o universo dal referencias . Por sua vez, sao de novo pondi<;oes sociais e political que estabelecem os limites do impacto social (da recepqdo) de um texto $. E este o contexto teorico, e esta a pre-compreensao metodol6- gica, em que vai decorrer a seguinte apresentaqao do Projecto de C6digo Criminal de Pascoal de Melo . Numa primeira parte (caps. II e III), procuraremos definir o es- paqo politico em que se situa (em que e eficaz) o grande discurso penalista de que faz parte a obra de Pascoal de Melo. Estudare- mos, para isso, o espaqo punitivo do direito legal doutrinal -a que por simplifica(;ao chamaremos o direito real-, na orbita do qual este discurso se situa, a fim de surpreender as apostas poli- ticas que ai se jogam. Num piano, as apostas da coroa, enquanto promotora desta es- pecifica ordem penal ; noutro, as dos pr6prios juristas, enquanto titulares da mediaqAo juridica letrada . No primeiro plano, veremos comp, durante o periodo da mo- narquia «corporativa)) 9, o direito real constituiu uma ordem ju- ridtca apenas virtual, mais ortentada para uma intervenqao siin- b6lica, ligada a promo(;ao da imagem do rei como sumo dispen- sador da justiqa, do que para uma intervenqao normativa que dis- ciplinasse, efectivamente, as condutas desviantes . Este caracter virtual da ordem penal real expltca, por sua vez, o caracter «li- vresco» da teoria penal que incide sobre ela e a sua aparente in- sensibilidade aos problemas sociais e humanos da puniqao. Por isso, gritan- tes questoes de politica criminal -como, por exemplo, a da uti- lidade social das penas ou a da preven(;ao penal- sao completa- mente submergidas pelo peso da tradiqao textual e pelos cliches.

    Augustine and the Art of Ruling in the Carolingian Imperial Period This volume is an investigation of how Augustine was received in the Carolingian period, and the elements of his thought which had an impact on Carolingian ideas of ‘state’, rulership and ethics. It focuses on Alcuin of York and Hincmar of Rheims, authors and political advisers to Charlemagne and to Charles the Bald, respectively. It examines how they used Augustinian political thought and ethics, as manifested in the De civitate Dei, to give more weight to their advice. A comparative approach sheds light on the differences between Charlemagne’s reign and that of his grandson. It scrutinizes Alcuin’s and Hincmar’s discussions of empire, rulership and the moral conduct of political agents during which both drew on the De civitate Dei, although each came away with a different understanding. By means of a philological–historical approach, the book offers a deeper reading and treats the Latin texts as political discourses defined by content and language.     GUILT, REDEMPTION AND RECEPTION: REPRESENTING ROMAN FEMALE SUICIDE ELEANOR RUTH GLENDINNING, BA (Hons) MA Thesis submitted to the University of Nottingham for the degree of Doctor of Philosophy DECEMBER 2011 Abstract This thesis examines representations of Roman female suicide in a variety of genres and periods from the history and poetry of the Augustan age (especially Livy, Ovid, Horace, Propertius and Vergil), through the drama and history of the early Principate (particularly Seneca and Tacitus), to some of the Church fathers (Tertullian, Jerome and Augustine) and martyr acts of Late Antiquity. The thesis explores how the highly ambiguous and provocative act of female suicide was developed, adapted and reformulated in historical, poetic, dramatic and political narratives. The writers of antiquity continually appropriated this controversial motif in order to comment on and evoke debates about issues relating to the moral, social and political concerns of their day: the ethics of a voluntary death, attitudes towards female sexuality, the uses and abuses of power, and traditionally expected female behaviour. They have written two of the most influential histories of Rome. Livy covers from the founding of Rome until the Reign of Augustus. Tacitus focuses on the early empire, writing from the end of Augustus’ reign through Nero. This sets up a nice symmetry, as Tacitus picks up where Livy stops. Much has been written about the men they include, but the women also play an important role. This essay plans to outline how the women in each work are used by the authors to attain their goals. In doing so, each author’s aim is exposed. Livy: Women as Exempla Livy’s most famous work, Ab Urbe Condita, is meant to be read as a guide.

    First in Flight: Etruscan Winged “Demons” Marvin Morris University of California, Berkeley Classical Civilizations Class of 2016 Abstract: Etruscan winged Underworld figures (commonly referred to as winged “demons”) represent one of the most fascinating and least understood aspects of funerary iconography in ancient Etruria. Their function, along with their origin, has long been the subject of scholarly debates. However, over the last two decades, scholars have begun to take a closer look at these chthonic figures. Recent scholarship has begun to provide answers to many of the most fundamental questions concerning their role, even if disagreements remain over their murky origins. Expanding on interpretations that have cast new light on how these winged (and non winged) Underworld figures functioned, questions concerning Etruscan religious beliefs and funerary ideology can now be reconsidered. Rives) This dissertation examines the construction and negotiation of Etruscan ethnic identity in the first century BCE using both archaeological and literary evidence. Earlier scholars maintained that the first century BCE witnessed the final decline of Etruscan civilization, the demise of their language, the end of Etruscan history, and the disappearance of true Etruscan identity. They saw these changes as the result of Romanization, a one-sided and therefore simple process. This dissertation shows that the changes occurring in Etruria during the first century BCE were instead complex and non-linear. Detailed analyses of both literary and archaeological evidence for Etruscans in the first century BCE show that there was a lively, ongoing discourse between and among Etruscans and non-Etruscans about the place of Etruscans in ancient society. My method musters evidence from Late Etruscan family tombs of Perugia, Vergil’s Aeneid, and Books 1-5 of Livy’s history. Chapter 1 introduces the topic of ethnicity in general and as it relates specifically to the study of material remains and literary criticism.

Romer PhD Major Department: History This thesis argues that the emperor Hadrian used vast building projects as a means to display and project his distinctive religious policy in the service of his overarching attempt to cement his power and rule. The undergirding analysis focuses on a select group of his building projects throughout the empire and draws on an array of secondary literature on issues of his rule and imperial power, including other monuments commissioned by Hadrian. An examination of Hadrian’s religious policy through examination of his architectural projects will reveal the catalysts for his diplomatic success in and outside of Rome. The thesis discusses in turn: Hadrian’s building projects within the city of Rome, his villa at Tibur, and various projects in the provinces of Greece and Judaea. By juxtaposing analysis of Hadrian’s projects in Rome and Greece with his projects and actions in Judaea, this study seeks to provide a deeper understanding of his religious policy and the state of Roman religion in his times than scholars have reached to date. RELIGIO AND RELIGIONES IN ROMAN THINKING Despite the continuity of the term, the concept of “religion” as used in the history of religion and contemporary political discussion, is not identi- cal with the concept implied in the Latin word religio 1. To explore the conceptual differences, I will analyse the meaning and maybe the history of the meaning of different terms that might pertain to our concept of “religion” as far as the Roman empire is concerned. The body of texts thus analysed is limited and restricted to Latin texts, as I am interested in the main lines of thought that determined political and juridical and religious action on a larger scale. 1. Cicero Of all words, that might denote something like “religion”, religio, ob- viously, had the most consequential history. The word (and hence religio- sus) is present from Plautus onwards (Asinaria 781, Curculio 350, Mercator 881), clearly implying religious language, from a direct rela- tionship towards a deity till rather general scruple. The word is frequent in Cicero, in speeches as well as in philosophical texts. Exceptional are the speeches against Verres, collector of statues and unrestrained violator of human and divine property, that use the term and its adjective more than one hundred times. The much shorter speeches “On his house” and “On the answer of the haruspices” show between fifty and sixty occurrences, in similar order the philosophical treaty “On the Nature of the Gods” and De legibus with its second book concentrated on what we term religion — already the selection demonstrate the conceptual link between religio and religion.
