1966, No. 26-Local An Act to authorise the Council to establish and lease a bus depot and to borrow money for the acqJlisition and establishment thereof, and to authorise the Manukau City Council, the Mount Wellington Borough Council, the Otahuhu Borough Council and the City Council to meet the cost thereof [21 October 1966 WHEREAS it is desirable and expedient that the Manukau City Council, be authorised to establish a bus depot and to lease the same to passenger transport service operators and to borrow money for the acquisition and establishment of a bus depot: And whereas it is desirable and expedient that the Manukau City Council, the Mount Wellington Borough Council, 'the Otahuhu Borough Council and the Papatoetoe City Council be authorised to meet the cost of acquiring and establishing such bus depot: And whereas doubts have arisen whether the said Councils have power to do so at present: BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows: 1. 2. ~terpretation-In this Act, unless the context otherwise reqwres,- "Bus depot" includes lands and premises where passenger transport sezvice vehicles may be garaged, sezviced, repaired, and overhauled and staff and administration facilities and offices for passenger transport sezvices provided: "Contributing authorities" means the Manukau City Council, the Papatoetoe City Council, the Mount Wellington Borough Council and the Otahuhu Borough Council and where necessary includes the corporations of the cities of Manukau and Papatoetoe and of the boroughs of Mount Wellington and Ota­ huhu. "Council" means the Manukau City Council, and where necessary includes the corporation of the city of Manukau.

3. Authority to establish a bus depot-The Council may establish a bus depot within the City of Manukau and for that purpose may purchase, subject to such terms and conditions as it thinks fit any area or areas of land or buildings and may erect such buildings and carry out and execute such works and provide such facilities as it thinks fit.

4. Authority to lease a bus depot-Notwithstanding any­ thing contained in any Act the Council may lease the bus depot established under the authority contained in this Act to any passenger transport sezvice operator or operators upon and subject to such terms and conditions as it thinks fit; and may accept surrenders, grant renewals, and consent to assign­ ments of any such lease as it thinks fit.

5. Application of Public Bodies' Leases Act 1908-Sections 8 and 9 of the Public Bodies' Leases Act 1908 shall not apply to any lease granted by the Council under section 4 of this Act.

6. Authority to borrow money-Subject to the provisions of the Local Authorities Loans Act 1956, the Council may borrow money for the acquisition, establishment, and erection, maintenance and improvement of the bus depot as it thinks fit. 1900 South Auckland Local Authorities 1966, No. 26 Empowering

7. Contributing authorities to meet cost of bus depot­ ( 1) The contributing authorities shall in every year whilst and so long as any principal moneys remain due and owing on any loan moneys borrowed by the Council pursuant to section 6 hereof pay to the Council a proportion of the principal repayment of such loan moneys for the previous year. (2) The amounts payable under subsection (1) of this section shall be assessed and charged to the respective contri­ buting authorities in proportion to the mean percentage of the rateable capital value and population of their respective districts or of the portions thereof benefited by the operation of any transport service operator to whom the bus depot in respect of which the loan has been raised is for the time being leased by the Council pursuant to the powers given by section 4 of this Act. (3) Upon the sale or-other disposal of the bus depot by the Council, the Council shall pay to each contributing authority a proportion of the net proceeds of such sale or other disposition, such proportion to be the same as the proportion that the total moneys paid by each contributing authority towards the repayment of loan moneys in respect of the bus depot bears to the total amount of the loan raised for the bus depot. 8. Costs of promoting Act-The casts of promoting this Act, and of all matters preparatory and incidental thereto, shall be paid out of the District Funds of the cities of Manukau and Papatoetoe and the boroughs of Mount Wellington and Otahuhu.
