After scoping for the aforementioned proposal, committee decided to consider the proposal under B1 category keeping cluster situation & Hon’ble National Green Tribunal Order dated 13 September 2018 in view, It was decided to recommend TOR approved by SEIAA on 07/03/2019 for Non sand mining without blasting for conducting the EIA study to be done for the proposals in cluster considering 10 Km radius from the periphery of the mine lease area including public hearing including following additional TOR to SEIAA.

PP shall ensure participation of people during public hearing with equality in genders so as to encourage women participation in public hearing and at the same time the issues of women shall also be given weightage. 2. Carry out need based survey for CER and give details of budgetary provision for five years for effective utilization of the same. 3. Dust mitigation measures due to mining, handling of mineral, loading, unloading, transportation and other allied activities similar to the measures guided in Notification issued by MOEF&CC dated 25/01/2018 vide GSR 94(E).

The draft EIA report also covering the above TOR shall be prepared and submitted to the GPCB for conducting the public hearing / consultation process as per the provisions of the EIA Notification, 2006. The project shall be appraised after submission of the final EIA report.

Mining will be done on the dry part of the river bed.The daily water demand will be only 10.0 KLD. Water for Drinking, dust suppression and plantation will be collected from nearby villages.There will be no industrial effluent discharge from prosed project. Sewage will be disposed off into soak pit. There will be dust emission from the handling of mineral and excavation process. Water sprinkling will be done to suppress the fugitive dust emission. The transport and handling of mineral likely to emit fugitive dust which will be controlled by- regular water sprinkling on the site, dispatch trucks carrying ore will be covered with tarpaulin.There are no bridge piers / water intake wells / irrigation structures within 500 m distance from boundary of above lease area.Minimum set back distance to be maintained is 10 meter to prevent bank erosion.Depth of the working will be maintained as 3 meter or water whichever is earlier. District geologist has validated that block is falling in cluster and it is not an in-stream mining and located in dry river bed. Cluster of 3 leases is formed having total cluster area of 09.46 Ha.

To Carry out need based survey for CER and give details of budgetary provision for five years for effective utilization of the same. 3. To incorporate study of rate of replenishment in approved mine planand proposed rate of mining shall be in accordance to rate of replenishment rate. 4. The project proponent along with their consultant remained present. They informed that method of mining will be semi mechanized open cast mining.Over burden during mining is proposed to be stacked temporarily at the site. Height and width of the benches will be 3 meter and more than 3 meter respectively with slope of 45 degree. Controlled blasting with carried out with compliance of all the conditions of safety prescribed by the DGMS. Maximum working depth is 17 meter and depth of water table is 35-40 meter below ground level hence working will not intersect ground water table. Adequate control measures to prevent soil erosion and washing off of the stacked material are proposed that include making of garland drain and maintaining height of the stacked material.

Water requirement of the proposal is 8.5 KLPD to be sourced from the nearby Tankers. Water will be used for sprinkling, green belt development and domestic purpose. Sewage will be disposed off to soak pit. Sewage will be disposed off into soak pit. There will be no generation of industrial wastewater. Diesel will be used as fuel. Regular water sprinkling is proposed to curb fugitive emission during loading, unloading and transportation. All the vehicles will be covered during transportation of mineral. Proposed air pollution control measures include water sprinkling on haul roads, tree plantation in periphery and road sides, etc. After completion of mining period, pit is proposed to be reclaimed by the overburden and soil and remaining void pit will be used as a water reservoir. After scoping for the aforementioned proposal, committee decided to consider the proposal under B1 category keeping cluster situation & Hon’ble National Green Tribunal Order dated 13 September 2018 in view, It was decided to recommend TOR approved by SEIAA on 07/03/2019 for Non sand mining with blasting for conducting the EIA study to be done for the proposals in cluster considering 10 Km radius from the periphery of the mine lease area including public hearing including following additional TOR to SEIAA.

1. PP shall ensure participation of people during public hearing with equality in genders so as to encourage women participation in public hearing and at the same time the issues of women shall also be given weightage. 2. Carry out need based survey for CER and give details of budgetary provision for five years for effective utilization of the same. 3. Dust mitigation measures due to mining, handling of mineral, loading, unloading, transportation and other allied activities similar to the measures guided in Notification issued by MOEF&CC dated 25/01/2018 vide GSR 94(E).

The draft EIA report also covering the above TOR shall be prepared and submitted to the GPCB for conducting the public hearing / consultation process as per the provisions of the EIA Notification, 2006. The project shall be appraised after submission of the final EIA report.

ANNEXURE 1

Additional Conditions:

1. Transportation route for vehicles carrying mineral shall have least minimum pass near human habitation. 2. PP shall pursue CER activities as proposed in declaration 3. Validity of the EC shall be coterminous with validity of lease. 4. Dust mitigation measures due to mining, handling of mineral, loading, unloading, transportation and other allied activities shall be implemented in letter and spirit similar to the applicable measures guided in Notification issued by MOEF&CC dated 25/01/2018 vide GSR 94(E).

Project Specific Conditions :

1. All the conditions prescribed in Office Memorandum of Ministry of Environment, Forest and Climate Change, New Delhi dated 24 th June 2013 for mining of ordinary earth shall be complied with in a letter and spirit which are as under.

i. The activity associated with borrowing/excavation of ‘brick earth’ and ‘ordinary earth’ for purpose of brick manufacturing, construction of roads, embankments etc. shall not involve blasting. ii. The borrowing/excavation activity shall be restricted to a maximum depth of 2 m below general ground level at the site. iii. The borrowing/excavation activity shall be restricted to 2 m above the ground water table at the site.

iv. The borrowing/excavation activity shall not alter the natural drainage pattern of the area. v. The borrowed/excavated pit shall be restored by the project proponent for useful purpose(s). vi. Appropriate fencing all around the borrowed/excavated pit shall be made to prevent any mishap. vii. Measures shall be taken to prevent dust emission by covering of borrowed / excavated earth during transportation. viii. Safeguards shall be adopted against health risks on account of breeding of vectors in the water bodies created due to borrowing/excavation of earth. ix. Workers / labourers shall be provided with facilities for drinking water and sanitation. x. A berm shall be left from the boundary of adjoining field having a width equal to at least half the depth depth of proposed excavation. xi. A minimum distance of 15 m from any civil structure shall be kept from the periphery of any excavation area.

ANNEXURE II

Beside above standard TOR, following additional TORs are recommended: 1. Project site specific details such as distance of the project site from nearest (1) Village(Habitation) (2)Water Body : River / Creek / Nallah / Lake / Pond /Check dam/ Reservoir / Canal /French well/ Percolation Well(3) National Highway/Bridge Pier (4) State Highway /Bridge Pier(5) Railway line/Bridge (6) Heritage site (7) National Park / Wild Life Sanctuary /Reserve Forest / Protected Forest shall be included in the rapid EIA report to be prepared covering one season (other than monsoon) data. A map indicating the aerial distance of the lease area from these entities. 2. Distance of nearby mining lease areas from the periphery of the proposed project including a map covering distance of 1 Km from the periphery of the proposed project. In case of no mining lease areas are existing within 500 meter periphery of the proposed project, certificate of the concerned geologist in this regard.ion)Commissioner of Geology & Mining, Indian Bureau of Mines, GPCB, current lease renewal status from Industries and Mine department, Government of Gujarat with opinion of the district geologist regarding compliance of all the conditions in lease deed and copy of renewed lease (if any) etc. to be incorporated.

3. Approved mining plan including progressive mine closure plan shall be provided with EIA report. Letter of approval of IBM shall also be incorporated with compliance of all the recommendations mentioned in approved mining plan. 4. Specific Terms of Reference for the project on assessment of ecological damage, remediation plan and natural and community resource augmentation plan for the proposals under violation of EIA Notification 2006.

1. Ecological damage shall be assessed with respect to air, water, land and other project & location specific environment attributes. The collection and analysis of data shall be done by an environment laboratory duly notified under Environment (Protection) Act, 1986, or an environment laboratory accredited by NABL, or a laboratory of a council of Scientific and Industrial Research (CSIR) institution working in the field of environment.

2. The Environment Management Plan shall be prepared which shall comprise of the remediation plan and community & natural resource augmentation plan corresponding to the ecological damage assessed and economic benefits derived due to violation. The remediation plan and the natural & community resource augmentation plan prepared shall be included as an independent chapter in the EIA report.

3. The project proponent shall submit bank guarantee to Gujarat Pollution Control Board prior to grant of environmental clearance equivalent to the amount of remediation plan and Natural & Community augmentation plans as per the amount assessed in below mentioned table as per the indicative guideline OR equivalent to the CER amount as per the MOEF&CC’s office Memorandum No: F NO 22-65/2017- IA-III dated 01/05/2018, whichever is higher. The amount shall be recommended by the SEAC and finalized by the regulatory authority. The bank guarantee shall be released after successful implementation of the remediation plan and Natural and Community Resource Augmentation Plan, and after recommendation by regional office of the Ministry followed by recommendations of the SEAC and approval of the regulatory authority.

4. Gujarat Pollution Control Board shall initiate credible legal action against the project proponent under the provisions of the Environment (Protection) Act, 1986, and further no consent to operate to be issued till the project is granted Environmental Clearance.

5. A notarized undertaking stating that (1).Any such violation shall not be repeated in future, (2). All the statutory requirements shall be fully complied with and (3). A status quo shall be maintained at the project site and remaining activity shall be carried out only after obtaining Environmental Clearance from SEIAA.

6. Applicability of CRZ Notification, 2011 shall be verified for the project and if found applicable, due procedure shall be followed as per the CRZ Notification,2011.

5. Project Specific Conditions:

Honorable supreme court vide judgment dated 2nd August 2017 with writ petition (Civil) No 114 of 2014 in the matter of common cause versus union of and others has passed order interpreting section 21(5) of the MMDR Act and directed payment of 100% Penalty for illegal mining operation with reference to the relevant statues, which inter alia include Environment (Protection) Act 1986, the Water( Prevention and Control of Pollution)Act 1974 and Air( Prevention and Control of pollution)Act 1981,The Forest(Conservation)Act 1980 and the Mines and Minerals(Development &Regulation)Act 1957. In this context In order to additionally comply with the direction of Hon’ble Supreme Court dated 02/08/2017 vide writ petition (Civil) NO 114 of 2014 Following additional conditions in TOR are required to address and comply.

1. The project proponent shall give an undertaking by way of affidavit to comply with all the statutory requirements and judgment of Hon’ble Supreme Court dated 2 nd August 2017 in Writ Petition (Civil) No: 114 of 2014 in the matter of common cause versus Union of India and others before grant of TOR/EC. The undertaking inter alia include commitment of PP not to repeat any such violation in future. 2. In case of violation of above undertaking, the TOR/EC shall be liable to be terminated forthwith. 3. The Environmental Clearance will not be operational till such time the project proponent complies with all the statutory requirements and judgment of Hon’ble Supreme Court dated 2nd August 2017 in Writ Petition (Civil) No 114 of 2014 in the matter of Common Cause versus Union of India and others. 4. State government concerned shall ensure that mining operation shall not commence till entire compensation levies, if any, for illegal mining paid by the Project proponent through Their respective department of Mining and Geology in strict compliance of judgment of Hon’ble Supreme Court dated 2nd August 2017 in Writ Petition (Civil) No 114 of 2014 in the matter of Common Cause versus Union of India and others.

6. Validity of ToR:

• The ToR prescribed for the project will be valid for a period of three years for submission of EIA & EMP report. ToR will lapse after three years from date of issue. th 580 meeting of SEAC-Gujarat, Dated 07.01.2020

• The period of validity could be extended for a maximum period of one year provided an application is made by the applicant to the Regulatory Authority, at least three months before the expiry of valid period together with an updated Form-I, based on proper justification and also recommendation of the SEAC.

The above mentioned project specific TORs/additional TORs and the model TORs available in the MoEFCC’s sector specific EIA Manual for Mining Projects shall be considered as generic TORs for preparation of the EIA report in addition to all the relevant information as per the generic structure of EIA given in Appendix III in the EIA Notification, 2006. The project shall be appraised on receipt of the final EIA report.

Note: For the aforementioned assessment, following basis are taken:

1. Quantity of water sprinkling for curbing fugitive emission is assumed as 0.1 Liters per sq.m. 2. Cost of water availability is to be considered on prevailing local market 3. For damage of house, entire construction of house considering built up area and local prevailing rate of construction are to be considered. 5. Cost of preservation, handling and restoration for 1 Ha lease is Rs. 10,000/-.

The project proponent shall submit bank guarantee to Gujarat Pollution Control Board prior to grant of environmental clearance equivalent to the amount of remediation plan and Natural & Community augmentation plan as per the amount assessed in aforementioned table as per the indicative guideline above OR equivalent to the CER amount as per the MOEF&CC’s office Memorandum No: F NO 22-65/2017-IA-III dated 01/05/2018, whichever is higher.

The proposals under violation shall pursue CER activities for the amount double than that arise from the actual provision as per the MOEF&CC’s office Memorandum No: F NO 22-65/2017-IA- III dated 01/05/2018 and it shall be incorporated in the EIA report.

Bank Guarantee shall be released only after

1.
