Discovery – Audit trail - Proportionality standard

1. As with all other discovery, electronically stored information is governed by a proportionality standard in order that discovery obligations are consistent with the just, speedy and inexpensive determination and resolution of litigation disputes. The proportionality standard requires the court, within the framework of the purpose of discovery of giving each party the opportunity to prepare its case, to consider: (a) the nature and scope of the litigation, including the importance and complexity of the issues and the amounts at stake; (b) the relevance of electronically stored information and its importance to the court’s adjudication in the given case; (c) the cost, burden, and delay that may be imposed on the parties to deal with electronically stored information; (d) the ease of producing electronically stored information and whether substantially similar information is available with less burden; and (e) any other factors rele- vant under the circumstances. 2. The parties’ present discovery dispute focuses on Premier’s representation as to its production of its “audit trail” for plaintiff’s medical record and plaintiff’s challenge to that representation. Plaintiff requested production of an “audit trail”, defined to include a computer file related to the patient’s medical record noting every time someone accesses a patient’s chart, the identity of the person logging into the chart, the time of the login, the location of the individual logging in and the parts of the chart reviewed and/or changed. It was also requested that this information be exported into its native file format. Defen- dant produced what it contends is its “audit trail”, a 31-page document entitled “patient worklog” which includes the information sought in the discovery request. Noting not all medical providers utilize the same record systems or medical records software, and that the information provided was relevant to that requested and would allow plaintiff to seek additional discovery if neces- sary, the Court Held Plaintiff’s Motion to Compel Defendant to Comply with the discovery Order was denied. 1 The parties’ present discovery dispute focuses on Premier’s production of its “audit trail” for plaintiff’s medical record, previously requested by plaintiff during discovery. The court had ordered Premier to pro- duce the information requested in plaintiff’s Request for Production No. 2 and to provide the court with an affidavit confirming that the information had been provided or if not, why not. Premier filed the requested affidavit and maintains that it has complied with the court’s order and plaintiff’s request. Plaintiff challenges that representation. In the definitional section of plaintiff’s request for production, the term “audit trail” is defined as follows:

14. “Audit Trail” shall mean the computer file related to the patient’s medical re- cord. In the functioning EMR, every time someone accesses a patient’s chart on the computer for any reason, that access is logged. Moreover, the identity of the person logging into the chart, the time of the login, the location of the individual logging in and the parts of the chart reviewed and/or changed are logged. These logs are kept in real time and the log file becomes a computerized trail of all access to the patient’s chart. For example, if Dr. A accesses patient X’s chart at 13:45 on October 22nd, the log file (audit trail) records this in real time.

PLEASE NOTE that every entry or log, regardless of date, e.g. not restricted to the dates of admission is requested. (Example: Dr. A makes an entry on 11/20/2016 which pertains to an October 2015 admission. This should be produced). This information is to include, but is not limited to the following: a. log entries of each and every user who accessed Plaintiffs’ medical record during or after any hospitalizations or office visits, including the date and time of each and every access by each and every user for each level of security; b. identification of each login by number and user (include full name and depart- ment and the location of the terminal from which the file was accessed) (pass- words are not requested); and c. the action that each user authorized, ordered, or completed. PLEASE NOTE that this information is to be exported into its native file format with instructions and code key pertaining to all the requested fields as outlined above (this is usually a drop-down menu on the “export” or similar tab). If any fields contain terms of art, please provide definitions of same.

Following argument, Premier produced to plaintiff what it contends is its “audit trial” for the plaintiff’s medical record. The document produced (31 pages) is entitled “Patient WorkLog” and includes the following information for the period 7/17/2017-5/21/2020: time record accessed, identity of person accessing record, and note of action taken. The log also reflects “encounters” and “contacts”, and again identifies person, action taken and location. Plaintiff in response produced to the court an “audit trail” from another piece of litigation to indicate what she believes Premier should have produced.

The Explanatory Comment to Rule 4009.1 reminds parties of the following:

EXPLANATORY COMMENT--2012

A. No Importation of Federal Law Though the term “electronically stored information” is used in these rules, there is no intent to incorporate the federal jurisprudence surrounding the discovery of electronically stored information. The treatment of such issues is to be determined by traditional principles of proportionality under Pennsylvania law as discussed in further detail below.

B. Proportionality Standard As with all other discovery, electronically stored information is governed by a proportionality standard in order that discovery obligations are consistent with the just, speedy and inexpensive determination and resolution of litigation disputes. The proportionality standard requires the court, within the framework of the purpose of discovery of giving each party the opportunity to prepare its case, to consider: (i) the nature and scope of the litigation, including the importance and complexity of the issues and the amounts at stake; (ii) the relevance of electroni- cally stored information and its importance to the court’s adjudication in the given case; (iii) the cost, burden, and delay that may be imposed on the parties to deal with electronically stored information; (iv) the ease of producing electronically stored information and whether substantially similar information is available with less burden; and (v) any other factors relevant under the circumstances.

With these principles in mind, the court views Premier’s production of the “audit trail” as defined by plaintiff to include the “the computer file related to the patient’s medical record” which reflects every time someone accesses a patient’s chart on the computer for any reason, the identity of the person logging into the chart, the time of the login, the location of the individual logging in and the parts of the chart reviewed and/ or changed are logged to be compliant. Not all medical providers utilize the same record systems or medical records software. The requirement and capabilities of a large health system can, and very often are, different 187 CHESTER COUNTY REPORTS Wagner v. The information relevant to plaintiff’s claim was provided to plaintiff and in a format that would allow plaintiff to seek additional discovery, if such was needed. The “audit trail” record provided to plaintiff reflects what the court understands is the information plaintiff needs/wants and in fact is substantially similar to the audit trail plaintiff believes it should have received.

Scott W. Reid Sworn In as United States Magistrate Judge for the Eastern District of Pennsylvania

The United States District Court for the Eastern District of Pennsylvania announc- es that Scott W. Reid was sworn in as a United States Magistrate Judge on May 24, 2021. Judge Reid succeeds former Magistrate Judge Thomas J. Rueter and will sit in Philadelphia. He will be the third African American to serve as a Magistrate Judge in the Eastern District of Pennsylvania. Before his appointment as a Magistrate Judge, Judge Reid served for over 6 years as an Assistant United States Attorney in the Civil Division of the United States Attorney’s Office for the Eastern District of Pennsylvania. His experience includ- ed defending federal agencies and employees in Title VII, Federal Tort Claims Act, Administrative Procedure Act, Bivens, immigration, quiet title, tax, and some appellate litigation. His duties also included investigating and prosecuting affirmative cases on behalf of the United States under the False Claims Act, the Controlled Substances Act, and federal civil rights statutes. He served on the Critical Incident Response Team and as chair of the Summer Internship Committee, Black Affairs Program lead, co-chair of the Youth Court program, and member of the Diversity Committee. Before joining the United States Attorney’s Office, Judge Reid was employed as a Member Attorney with the Cozen O’Connor law firm. In addition to his work for the United StatesAttorney’s Office, Judge Reid serves as an Adjunct Professor of Law at the Temple University Beasley School of Law, where he teaches trial advocacy. Judge Reid has dedicated his career to serving the legal community. During the course of his career he has served as an advisory board member and past president for the Barristers’ Association of Philadelphia, member of the Widener University School of Law Board of Overseers, fellow for the Leadership Council for Legal Diversity, member of the Pennsylvania Bar Association House of Delegates and Minority Bar Committee, chair of the Philadelphia Bar Association’s Diversity in the Profession Committee and member of the Board of Governors, member of the American Bar As- sociation TIPS Leadership Academy, and member of the National Bar Association. Judge Reid has been honored by a number of organizations. These honors include the Barristers’ Association of Philadelphia’s J. Austin Norris and Outstanding Young Lawyer Award, National Bar Association Women’s Law Division’s President’s Award, National Bar Association’s 40 Under 40 Award, The Philadelphia Tribune’s Under 40 Award, West Chester University’s “Drum Major for Justice Award,” induction into the West Chester University Alumni Legacy of Leadership, Kappa Alpha Psi, Kappa Gam- ma Chapter Webb Hallman Alumni Achievement Award, and Kappa Alpha Psi, Chester Alumni Chapter Achievement Award. Judge Reid received a Bachelor of Arts degree from West Chester University and a Juris Doctor from Widener University School of Law. While in law school, Judge Reid served as the president of the Black Law Students Association and as senior staff for the Delaware Journal of Corporate Law, and he received the Outstanding Student Service Award.
