under the Threatened Species Conservation Act 1995

The Scientific Committee established under the Threatened Species Conservation Act 1995 has made final determinations to insert the following ecological communities as endangered ecological communities under that Act and, accordingly, Schedule 1 to that Act is amended by inserting in Part 3 in alphabetical order:

Central Hunter Grey Box—Ironbark Woodland in the New South Wales North Coast and Bioregions (as described in the final determination of the Scientific Committee to list the ecological community) Central Hunter Ironbark—Spotted Gum—Grey Box Forest in the New South Wales North Coast and Sydney Basin Bioregions (as described in the final determination of the Scientific Committee to list the ecological community)

Final Determination The Scientific Committee, established by the Threatened Species Conservation Act has made a Final Determination to list the Central Hunter Grey Box – Ironbark Woodland in the NSW North Coast and Sydney Basin Bioregions as an ENDANGERED ECOLOGICAL COMMUNITY in Part 3 of Schedule 1 of the Act. Listing of Endangered Ecological Communities is provided for by Part 2 of the Act. The Scientific Committee has found that: 1. Central Hunter Grey Box – Ironbark Woodland in the NSW North Coast and Sydney Basin Bioregions is the name given to the ecological community that generally occurs on Permian sediments in the Hunter Valley and is characterised by the assemblage of species in paragraph 2. The community typically forms a woodland to open forest on slopes and undulating hills. 2. Central Hunter Grey Box – Ironbark Woodland is characterised by the following assemblage of species: Acacia pendula Acacia bulgaensis Ajuga australis Allocasuarina luehmanii Angophora floribunda Aristida ramosa Austrostipa scabra Bothriochloa decipiens Brachychiton populneus subsp. populneus Breynia oblongifolia Brunoniella australis Bursaria spinosa subsp. spinosa Calotis lappulacea Callitris endlicheri Cassinia quinquefaria Cheilanthes sieberi subsp. seiberi Cheilanthes distans Chloris ventricosa Chrysocephalum apiculatum Cymbopogon refractus Cyperus gracilis Desmodium varians Dichondra repens Dodonaea viscosa Einadia nutans Eragrostis leptostachya Eremophila debilis Eucalyptus crebra Eucalyptus moluccana Glycine tabacina Lomandra multiflora subsp. multiflora Microlaena stipoides var. stipoides Melichrus ureceolatus Notelaea microcarpa var. microcarpa Phyllanthus virgatus Solanum cinereum Sporobolis creber Vittadinia cuneata 3. The total species list of the community is considerably larger than that given above, with many species present in only one or two sites or in low abundance. The species composition of a site will be influenced by the size of the site, recent rainfall, drought condition and by its disturbance (including fire and grazing) history. The number of species, and the above ground relative abundance of species will change with time since disturbance, and may also change in response to changes in disturbance regime (including changes in fire frequency). At any one time, above ground individuals of some species may be absent, but the species may be represented below ground in the soil seed banks or as dormant structures such as bulbs, corms, rhizomes, rootstocks or lignotubers. The list of species given above is of vascular plant species, the community also includes micro-organisms, fungi, cryptogamic plants and a diverse fauna, both vertebrate and invertebrate. These components of the community are poorly documented. 4. Central Hunter Grey Box – Ironbark Woodland typically forms a woodland dominated by Eucalyptus crebra (Narrow- leaved Ironbark), Brachychiton populneus subsp. populneus (Kurrajong) and Eucalyptus moluccana (Grey Box). Other tree species may be present and occasionally dominate or co-dominate, and include Angophora floribunda (Rough-barked Apple) and Callitris endlicheri (Black Cypress Pine). A shrub layer may also be present and common shrub species include Notelaea microcarpa var. microcarpa (Native Olive), Breynia oblongifolia (Coffee Bush), Bursaria spinosa subsp. spinosa (Native Blackthorn), Cassinia quinquefaria (Cough Bush) and Dodonaea viscosa (Hop Bush). Subshrubs may also be common and include Solanum cinereum (Narrawa Burr), and Phyllanthus virgatus (Spurge) and Maireana microphylla (Eastern Cotton Bush) (Peake 2006). Ground cover can be moderately dense to dense, and consist of numerous forbs and grass species, and a small number of ferns, sedges and twiners. The more common species include Cymbopogon refractus (Barbed Wire Grass), Aristida ramosa (Three-awned Wire Grass), Dichondra repens (Kidney Weed), Cheilanthes sieberi subsp. sieberi (Poison Rock Fern), Chloris ventricosa (Tall Chloris), Austrostipa scabra (Corkscrew Grass), Desmodium varians (Variable Tick-trefoil), Microlaena stipoides var. stipoides (Weeping Rice Grass), Eragrostis leptostachya (Paddock Lovegrass), Sporobolus creber (Slender Rat's Tail Grass), Calotis lappulacea (Yellow Burr Daisy), Lomandra multiflorasubsp . multiflora(Mat Rush), Brunoniella australis (Blue Trumpet), Eremophila debilis (Winter Apple), Chrysocephalum apiculatum (Common Everlasting), Cyperus gracilis, Einadia nutans (Climbing Saltbush), Ajuga australis (Austral Bugal), Vittadinia cuneata (Fuzzweed), Bothriochloa decipiens (Red Grass), and Glycine tabacina (Variable Glycine) (Peake 2006). 5. Central Hunter Grey Box – Ironbark Woodland has been described by Peake (2006) as Central Hunter Box – Ironbark Woodland (Map Unit 10). It has also been described by Thomas (1998) as part of Eucalyptus crebra – Eucalyptus moluccana – Eucalyptus glaucina/tereticornis woodland (Map Unit 4.4) and by Fallding et al. (1999) as Ironbark Forest on Alluvium (Map Unit Q2). It shares some characteristics with, but is not part of a community described by Peake (2006) as Central Hunter Spotted Gum – Ironbark – Grey Box Forest and by Bell (2005) as Goulburn Valley Ironbark Woodland. This community also shares some characteristics with, but is not part of the Endangered Ecological

Community ‘Central Hunter Ironbark – Spotted Gum – Grey Box Forest in the NSW North Coast and Sydney Basin Bioregions (Scientific Committee 2010). 6. Central Hunter Grey Box – Ironbark Woodland has been recorded from the local government areas of Cessnock, Singleton and Muswellbrook but may occur elsewhere within the Sydney Basin Bioregion (sensu Thackway and Creswell 1995). 7. Central Hunter Grey Box – Ironbark Woodland is known to contain an Endangered Population of Cymbidium canaliculatum, the Vulnerable species Diuris tricolor and Eucalyptus glaucina, and the Endangered species Pterostylis gibbosa listed under the Threatened Species Conservation Act 1995. 8. Central Hunter Grey Box – Ironbark Woodland occupies an area of less than 2000 km2 based on 2 x 2 km grid cells, the scale of assessment recommended for species by IUCN (2008). 9. Land clearing, primarily for agriculture, has lead to a large reduction in geographic distribution of the community. The mapped area of the community is approximately 46,920 ha which is estimated to be 32% of the pre-European distribution (Peake 2006). Mapped occurrences of the community include 27 remnants greater than 100 ha and more than 1000 small remnants less than 10 ha indicating a high level of fragmentation (Peake 2006). 10. Central Hunter Grey Box – Ironbark Woodland has been subject to intensive livestock grazing and clearing which has made it vulnerable to weed invasions. The community has been invaded by a range of woody and herbaceous weed species including Olea europaea subsp. cuspidata (African Olive), Lycium ferocissimum (African Boxthorn), and Hyparrhenia hirta (Coolatai Grass) (Peake 2006). 11. Threats to Central Hunter Grey Box – Ironbark Woodland include, clearing and weed invasion. 'Clearing of native vegetation' and 'Invasion of native plant communities by exotic perennial grasses', are listed as Key Threatening Processes under the Threatened Species Conservation Act 1995. Collectively, the effects of these threats indicate a large reduction of the ecological function of the community. Continual clearing related to open-cut coal mining and rural sub-division are potential threats to this community. 12. Central Hunter Grey Box – Ironbark Woodland in the NSW North Coast and Sydney Basin Bioregions is not eligible to be listed as a Critically Endangered Ecological Community 13. Central Hunter Grey Box – Ironbark Woodland in the NSW North Coast and Sydney Basin Bioregions is eligible to be listed as an Endangered Ecological Community as, in the opinion of the Scientific Committee, it is facing a very high risk of extinction in New South Wales in near future, as determined in accordance with the following criteria as prescribed by the Threatened Species Conservation Regulation 2002: Clause 25 The ecological community has undergone, is observed, estimated, inferred or reasonably suspected to have undergone or is likely to undergo within a time span appropriate to the life cycle and habitat characteristics of its component species: (b) a large reduction in geographic distribution. Clause 27 The ecological community has undergone, is observed, estimated, inferred or reasonably suspected to have undergone or is likely to undergo within a time span appropriate to the life cycle and habitat characteristics of its component species: (b) a large reduction in ecological function, as indicated by any of the following: (g) invasion and establishment of exotic species (i) fragmentation of habitat. The shrub layer is typically sparse or absent in some cases, through to moderately dense. Common shrub species include Daviesia ulicifolia subsp. ulicifolia (Gorse Bitter Pea), Pultenaea spinosa (Grey Bush Pea), Breynia oblongifolia (Coffee Bush), Hakea sericea (Bushy Needlebush), and Bursaria spinosa subsp. spinosa (Native Blackthorn) (Peake 2006). Calotis cuneifolia (Purple burr-daisy), Hypercium gramineum (Small St. John’s Wort), Chrysocephalum apiculatum (Common Everlasting), Opercularia diphylla (Stinkweed), Paspalidium distans (Tufted Hedgehog Grass) Themeda australis (Kangaroo Grass), Stackhousia viminea (Slender Stackhousia) and Wahlenbergia communis (Tufted Bluebell) (Peake 2006). 5. Central Hunter Ironbark – Spotted Gum – Grey Box Forest has been described by Peake (2006) as Central Hunter Ironbark – Spotted Gum – Grey Box Forest (Map Unit 27) and as Map Unit 18 (NSW NPWS 2000; DECC 2008). It includes a part of a unit described by Thomas (1998) as Eucalyptus crebra – Eucalyptus moluccana – Eucalyptus glaucina/tereticornis woodland. It shares some characteristics with, but is not part of a community described by Bell (2005) as Narrabeen Residual Spotted Gum Forest from a small area near Bulga. It shares some characteristics with, but is not part of a community described by Peake (2006) as Central Hunter Grey Box – Ironbark Woodland, and also shares some characteristics with but is not part of the Endangered Ecological Community ‘Central Hunter Grey Box – Ironbark Woodland in the NSW North Coast and Sydney Basin Bioregions (Scientific Committee 2010). 6. Central Hunter Ironbark – Spotted Gum – Grey Box Forest has been recorded from the local government areas of Cessnock, Singleton and Muswellbrook but may occur elsewhere within the NSW North Coast and Sydney Basin Bioregions (sensu Thackway and Creswell 1995). 7. Central Hunter Ironbark – Spotted Gum – Grey Box Forest occupies an area of less than 2000 km2 based on 2 x 2 km grid cells, the scale of assessment recommended for species by IUCN (2008). It has been mapped as being recorded in Bellfield National Park and in the Singleton Military Area. 9. Land clearing, primarily for agriculture has lead to a large reduction in geographic distribution of the community. The mapped area of the community is approximately 18,300 ha which is estimated to be 29% of the pre-European distribution (Peake 2006). Mapped occurrences of the community include 34 remnants greater than 100 ha and more than 1000 small remnants less than 10 ha indicating a high level of fragmentation (Peake 2006). 10. Central Hunter Ironbark-Spotted Gum-Grey Box Forest has been subject to intensive livestock grazing and clearing which has made it vulnerable to weed invasions. The community has been invaded by a range of woody and herbaceous weed species including Olea europaea subsp. cuspidata (African Olive), Lantana camara (Lantana), Hyparrhenia hirta (Coolatai Grass), and Sporobolus africanus (Giant Parramatta Grass) (Peake 2006). Lantana (Lantana camara) has been demonstrated to increase following disturbances associated with fire or grazing (Gentle and Duggin 1997a). Lantana (Lantana camara) poses a threat through structural alteration, invasion and allelopathic suppression of tree seedlings (Gentle and Duggin 1997b). 11. Threats to Central Hunter Ironbark – Spotted Gum – Grey Box Forest include clearing and weed invasion. 'Clearing of native vegetation', 'Invasion, establishment and spread of Lantana (Lantana camara L. sens. lat.)', and 'Invasion of native plant communities by exotic perennial grasses', are listed as Key Threatening Processes under the Threatened Species Conservation Act 1995. Collectively, the effects of these threats indicate a large reduction of the ecological function of the community. Final Determination The Scientific Committee, established by the Threatened Species Conservation Act has made a Final Determination to list the Hunter Valley Footslopes Slaty Gum Woodland in the Sydney Basin Bioregion, as a VULNERABLE ECOLOGICAL COMMUNITY in Part 2 of Schedule 2 of the Act. Listing of Vulnerable Ecological Communities is provided for by Part 2 of the Act. The Scientific Committee has found that: 1. Hunter Valley Footslopes Slaty Gum Woodland in the Sydney Basin Bioregion is the name given to the ecological community that generally occurs at the interface of Narrabeen Sandstone and Permian sediments in the Hunter Valley and is characterised by the assemblage of species in paragraph 2. The community typically forms a low to mid-high woodland. All sites are within the Sydney Basin Bioregion. 2. Hunter Valley Footslopes Slaty Gum Woodland in the Sydney Basin Bioregion is characterised by the following assemblage of species: Acacia cultriformis Acacia decora Acacia salicina Allocasuarina luehmannii Aristida ramosa Brachychiton populneus subsp. populneus Brunoniella australis Bursaria spinosa subsp. spinosa Callitris endlicheri Canthium odoratum Cheilanthes sieberi subsp. sieberi Cymbopogon refractus Desmodium brachypodum Dichondra repens Dodonaea viscosa subsp. cuneata Eremophila debilis Eucalyptus crebra Eucalyptus dawsonii Eucalyptus moluccana Eucalyptus punctata Fimbristylis dichotoma Geijera salicifolia var. salicifolia Glycine latifolia Lomandra multiflora subsp. multiflora Myoporum montanum Notelaea microcarpa var. microcarpa Olearia elliptica Sida corrugata Solanum brownii 3. The total species list of the community is considerably larger than that given above, with many species present in only one or two sites or in low abundance. The species composition of a site will be influenced by the size of the site, recent rainfall, drought condition and by its disturbance (including fire and grazing) history. The number of species, and the above ground relative abundance of species will change with time since disturbance, and may also change in response to changes in disturbance regime (including changes in fire frequency). At any one time, above ground individuals of some species may be absent, but the species may be represented below ground in the soil seed banks or as dormant structures such as bulbs, corms, rhizomes, rootstocks or lignotubers. The list of species given above is of vascular plant species, the community also includes micro-organisms, fungi, cryptogamic plants and a diverse fauna, both vertebrate and invertebrate. These components of the community are poorly documented. 4. Hunter Valley Footslopes Slaty Gum Woodland typically forms a woodland or occasionally forest, comprising a sparse to moderately dense tree stratum, occasional low tree stratum, and moderately dense to dense shrub stratum. The tree canopy is typically dominated by Eucalyptus dawsonii (Slaty Gum) and/or Eucalyptus moluccana (Grey Box). Acacia salicina (Cooba) and Allocasuarina luehmannii (Buloke) may form a low tree stratum or may be part of the upper-most canopy. Other trees which may be present include Brachychiton populneus subsp. populneus (Kurrajong), Callitris endlicheri (Black Cypress Pine), Eucalyptus crebra (Narrow-Leaved Ironbark) and Eucalyptus punctata (Grey Gum). The shrub layer may include Olearia elliptica (Sticky Daisy Bush), Acacia cultriformis (Knife-leaved Wattle), Canthium odoratum (Shiny-leaved Canthium), Notelaea microcarpa var. microcarpra (Native Olive), Dodonaea viscosa subsp. cuneata (Wedge-leaf Hopbush), Acacia decora (Western Golden Wattle), Bursaria spinosa subsp. spinosa (Native Blackthorn), Myoporum montanum (Water Bush) and Solanum brownii (Violet Nightshade). The groundcover is typically sparse to very sparse and is relatively species poor. It may include Dichondra repens (Kidney Weed), Lomandra multiflora subsp. multiflora (Many-Flowered Mat-rush), Aristida ramosa (Wire Grass), Brunoniella australis (Blue Trumpet), Cymbopogon refractus (Barbed Wire Grass), Desmodium brachypodum (Large Tick-trefoil), Eremophila debillis (Winter Apple), Fimbristylis dichotoma (Common Fringe-rush) and Sida corrugata (Corrugated Sida) (Peake 2006). 5. Hunter Valley Footslopes Slaty Gum Woodland typically occurs in colluvial soils on exposed footslopes associated with the interface of Triassic Narrabeen sandstone and Permian sediments. Hunter Valley Footslopes Slaty Gum Woodland has been described by Peake (2006) as Narrabeen Footslopes Slaty Box Woodland (Map Unit 7). It is also included in vegetation types described by Fallding et al. (1999) as Dawson's Box Woodland on Permian Sediments (Map Unit P1), by Bell (1998) as Permian Widden Talus Woodland (Map Unit W23), by Hill (1999) as Slaty Gum Open Forest (Map Unit OF8), and by McRae and Cooper (1985) as Woodland in Sandstone Gullies (Map Unit 4). It shares some characteristics with, but is not part of a community in the Western Blue Mountains called Capertee Slopes Slaty Gum – Grey Gum – Mugga – Callitris Open Forest (DECC 2006), nor is it part of the Narrabeen Grey Box Forests of Wollemi National Park (Bell 2005). 6. Hunter Valley Footslopes Slaty Gum Woodland has been recorded from the local government areas of Singleton and Muswellbrook but may occur elsewhere within the Sydney Basin Bioregion (sensu Thackway and Creswell 1995).

7. Hunter Valley Footslopes Slaty Gum Woodland in the upper Hunter Valley occupies an area of less than 2000 km2 based on 2 x 2 km grid cells, the scale of assessment recommended for species by IUCN (2008). Mapped occurrences of the community include a few remnants greater than 100 ha and many small remnants less than 10 ha indicating a high level of fragmentation (Peake 2006). 8. Hunter Valley Footslopes Slaty Gum Woodland is known to contain an Endangered Population of Acacia pendula in the Hunter Catchment listed under the Threatened Species Conservation Act 1995. 9. Threats to Hunter Valley Footslopes Slaty Gum Woodland include clearing, inappropriate fire regimes, and weed invasion. Clearing for agriculture, expanding hobby farms, and mining has reduced the extent of this community (Peake 2006). Fire frequency has also increased with increased hazard reduction to reduce risk to farms and other community infrastructure in parts of the Hunter Valley (Peake 2006). Lantana (Lantana camara) has been demonstrated to increase following disturbances associated with fire or grazing (Gentle and Duggin 1997a). Lantana(Lantana camara) poses a threat through structural alteration, invasion and allelopathic suppression of rainforest seedlings (Gentle and Duggin 1997b). African Olive (Olea europaea subsp. cuspidata) also poses a significant threat through invasion (Peake 2006) as well as exotic perennial grasses (Peake 2006). 'Clearing of native vegetation', 'Invasion, establishment and spread of Lantana (Lantana camara L. sens. lat.)', 'High frequency fire resulting in the disruption of life cycle processes in plant and animals and loss of vegetation structure and composition', and 'Invasion of native plant communities by exotic perennial grasses', are listed as Key Threatening Processes under the Threatened Species Conservation Act 1995. Collectively, these threats indicate a moderate reduction of the ecological function of the community. 10. Hunter Valley Footslopes Slaty Gum Woodland in the Sydney Basin Bioregion is not eligible to be listed as an Endangered or Critically Endangered Ecological Community. 11. Hunter Valley Footslopes Slaty Gum Woodland in the Sydney Basin Bioregion is eligible to be listed as an Vulnerable Ecological Community as, in the opinion of the Scientific Committee, it is facing a high risk of extinction in New South Wales in the medium-term future, as determined in accordance with the following criteria as prescribed by the Threatened Species Conservation Regulation 2002: Clause 26 The ecological community’s geographic distribution is estimated or inferred to be: (c) moderately restricted, and the nature of its distribution makes it likely that the action of a threatening process could cause it to decline or degrade in extent or ecological function over a time span appropriate to the life cycle and habitat characteristics of the ecological community’s component species. (b) The lessee shall ensure that any access tracks must be arranged in such a manner as to minimise the disturbance of any land surface. (58) The lessee shall not destroy populations of any endangered species, damage the critical habitat of endangered species, populations and ecological communities or damage the habitat of any threatened species, populations or ecological communities scheduled in the Threatened Species Conservation Act 1995 on any part of the lease whilst using the land for the purpose of farm tourism and shall prevent any other person from doing the same. (59) The lessee shall ensure that any European heritage sites, artefacts, buildings or other areas of signifi cance will not be damaged, destroyed or defaced by either the lessee or other persons present on the leased land.
