Nine members of the public attended (four part). 1907/2 Apologies None 1907/3 Declarations of Interest and consideration of dispensations: Cllr S Welch declared an interest in Planning Application 19/02389/FUL as Chairman of the Menwith Hill British American Committee and took no part in the discussion or vote. 1907/4 Approval of Minutes: Minutes of the meeting held on 24 June 2019 were approved. 1907/5 Public Statements: These are included with the relevant items below. 1907/6 Planning a. 19/02530/OUT Outline application for the erection of 1 no. dwelling with access considered. (Revised Scheme) Land Comprising Os Field 0067 (access next to Tvonnay, Main St) Darley Head Darley.

A parishioner spoke in relation to this Planning Application and raised concerns the current Planning Application might lead to further development of the area indicated with a blue border on the location plan. Concern was also expressed that the coordinates given for the development were within this area (rather than the site of the Planning Application).

It was clarified that an area bordered in blue usually indicates common ownership with the site within a Planning Application. The Parish Council commented that the size of the proposed dwelling might be out of scale in relation to neighbouring properties (which are bungalows) and that it was not particularly clear how the reasons for the refusal of the prior Planning Application (18/02668/OUT) had been addressed, especially in relation to access. c. Planning Appeals: Planning Appeal: 19/00040/HOUSER Erection of single and two storey extensions, alterations to fenestration and demolition of conservatory and existing extensions (Revised Scheme) Sheepcote Cottage Sheepcote Lane Darley was noted. The Parish Council did not wish to withdraw its representation on the original application (19/00180/FUL).

d. Planning Enforcement: 19/00367/BRPC15 Silverdale Farm Silverdale Close Darley ALLEGED BREACH: Mud on highway in Breach of Condition 2 of 19/01437/DVCON (Planning Applications 19/01437/DVCON; 16/05471/FUL) was noted.

Several parishioners spoke in relation to this development. Concerns raised included:

- the apparent raised height of the site relative to neighbouring properties and its potential impact on drainage into those properties. It is not clear whether the final level of the site will be similar to neighbouring properties or in line with the approved Planning Application; - breach of conditions through soil being piled up against the boundary of neighbouring properties (now removed) and not taking steps to control dust during construction; - confusion regarding which of the various different plans submitted have been formally approved; - construction of buildings which differ in design (model and size) and location from the plans understood to have been approved (including additional patio doors and windows overlooking neighbouring properties); - uncertainty as to whether the construction of garages has been approved; - occurences of flooding and spreading of waste from the construction site into neighbouring properties to date; and - pruning and removal of tree branches of trees subject to Tree Preservation Orders. It was agreed that the Parish Council would write to Borough Council citing the above concerns and asking for regular inspections in order to deal with any Planning Enforcement issues as they occur. e. Correspondence received regarding position and use of multiple estate agent boards was noted. f. Update on current Planning Applications Chairman confirmed that Harrogate Borough Council’s Local Plan has been amended and the major modifications made are now subject to consultation (26 July to 6 September). Areas DR14 and DR1 have been removed from the plan. Further modifications have been made to recognise the viability of transport routes, to confirm that major development should only be permitted in the Area of Outstanding Natural Beauty in exceptional circumstances and recognising that an adequate supply of development housing has been obtained. The Parish Council agreed to submit a letter supporting the proposed modifications; Chairman to action.

The Parish Council also recommended that parishioners also support these as being legally-compliant and sound. A single letter representing a group of people with the same view is encouraged by Harrogate Borough Council; Chairman to circulate details of how to access the consultation and to respond.

1907/7 County and Borough Councillors’ Reports: County Cllr Lumley confirmed that County Hall, will be vacated by the end of July in order to refurbish the building. Other offices will be used for the period of renovation (expected to be around 12 months). The Winter Bus Service has met targets and is in its second year of a two year plan. It is currently exploring sponsorship for a third year. A feasibility study by Sustrans and local cycling groups to extend the Cycle Route from Clint to (through Darley and Dacre) is encouraging. County Cllr Lumley recently chaired a cross-party meeting exploring how best for County Council to address the challenges faced by climate change. The intention is to produce a carbon dioxide reduction plan and to consider all areas that can contribute to emissions (including Waste & Recycling, use of plastics and transport). Borough Cllr Watson confirmed that recent changes to Waste & Recycling collection have led to issues for some residents and that catch-up services are operate for missed collections. If parishioners are experiencing any problems please contact Borough Cllr Watson. Harrogate Borough Council serves approximately 160,000 residents in an area of 505 square miles. It built 259 affordable homes in the year ending 31 March 2019 (against 161 in the year ending 31 March 2018). There remains significant need for affordable homes, particularly for families in Nidderdale and a further increase is required in order to meet this demand.

1907/8 Updates for information a. Possible purchase of paediatric defibrillator electrodes: Clerk confirmed that the model of defibrillator owned by the Parish Council did not support the use of children’s defibrillator pads. Adult electrodes supplied with the defibrillator can be used for children. 1907/9 Highways a. The planned road closure at Priest Lane Ford, Ripon, 23 September – 25 October 2019 was noted. North Yorkshire County Council is returning to a system of notifying all Parish Clerks of planned road

County Cllr Lumley noted that it is more difficult to notify emergency road closures (i.e. emergency utilities works) but that North Yorkshire County Council is working to improve the efficiency of roadworks generally. b. Correspondence received regarding parking on Main Street near to Darley Community Primary School (the School) was discussed. It was noted that parking along Main Street (from Fringill Lane past Sheepcote Lane) made the road difficult to navigate and potentially dangerous. A parishioner clarified that the most severe problems were experienced at the time of two specific events at the School but problems at school pick-up times were also noted. Use of Darley Memorial Hall car park for such events was suggested as a possible solution. Idling of vehicles was also noted as a problem at pick-up times. It was agreed that the Parish Council would check regarding the availability of Darley Memorial Hall car park to alleviate parking problems for events at the School. If this is available, the Parish Council will write to the Headteacher at the School asking that it is considered to help reduce parking issues associated with events and pick-up and that anyone picking up children is reminded to switch their engine off whilst waiting to help manage pollution in the area; Clerk to action. c. Darley and Menwith Safe Speed: It was confirmed that one parishioner has volunteered to joing the working group to date. A number of parishioners attending the meeting agreed to join the working group, together with Councillor McQueen. A meeting is to be organised to discussed the speed and road safety issues highlighted to date; Clerk to arrange. The Parish Council agreed to purchase a Vehicle-Activated Sign for Darley and Menwith Parish. A copy of the general guidelines governing where these can be sited to be circulated to Councillors and members of the working group; Clerk to action. d. It was noted that patching repairs have been made to the surface of Sheepcote Lane. 1907/10 Footpaths a. Clerk confirmed that the suspension bridge at the bottom of Lane has been carried out but waste materials were reported to have been left in the river. This has been reported to North Yorkshire Rights of Way. b. Clerk confirmed that there was a report of possible contamination of Fringill Beck in May. This was not reported on that basis that subsequent monitoring of this suggests no further contamination. c. It was noted that no plan is in place to replace the moved stepping stones on the in Darley and funding for a bridge in place of the stones is not currently available. Three further footpath issues outside of the Parish were reported (a fallen tree blocking the path in Dacre Parish and over-grown paths at Stripe Lane and on the approach to Birchfield Farm, Hartwith cum Winsley Parish); Clerk to notify relevant Parish Clerks and North Yorkshire Rights of Way. 1907/11 Village Maintenance a. It was confirmed that in addition to the usual grass-cutting, footpaths on Green Lane and Daleside have been strimmed. b. Problems with the laurel hedge overhanging the pavement on Sheepcote Lane were noted. It was agreed that the Parish Council would contact the occupants of the relevant property asking for the hedge to be cut back within four weeks; Clerk to action. c. No other essential village maintenance needs were reported. 1907/12 Reports / Meetings / Events a. The Charity of Isabel Day 26 June: it was reported that the meeting had been held to discuss a number of issues, including the ongoing investigation into the feasibility of constructing two almshouses and the possibility of Clerk assisting as administrator for the charity. No decision has been made on these issues. b. Harrogate Borough Council Ethical Standards Training, 8 July: Cllr Welch confirmed that this was a useful event. One point highlighted was that the failure of a Councillor to declare a pecuniary interest in any matter is treated as a criminal offence and notified to police in all cases. The importance of updating business interests was also stressed. c. YLCA Joint Annual Meeting 13 July: Cllr Butler attended the event, at which members were re- elected and the budget was approved. d. Nidderdale Strategic Partnership – Executive Group 19 July: in addition to the update on the Nidderdale Greenway (reported by County Cllr Lumley above), discussions were held regarding the planned closure fo the Grange Medical Centre, Dacre Banks. e. The First Aid course held on 6 July was a very useful event attended by 14 people. The Darley Playing Fields Assocation Annual General Meeting will be held on 5 August at the playing fields.

Payments - £237.38 Clerk Salary; £5 npower – electricity for Christmas Lights (June); £110 Darley Memorial Hall – Room hire to July 2019; £356.26 Directions Planning Consultancy advice to July 2019. b. The budget to July 2019 was approved. c. A letter to change the bank account principal user to Clerk in order that he can receive bank statements directly was approved and signed. d. No other financial matters were discussed. 1907/14 Review of Parish Council policies: The following policies were agreed and adopted with minor corrections: - Code of Conduct; - Complaints Procedure; and - Management of Information. Clerk to publish final revised policies on the Parish Council website. 1907/15 Correspondence received by the Clerk a. YLCA – CELEBRATING THE 75TH ANNIVERSARY OF VE DAY – 8 MAY, 2020: a number of celebrations are planned over the period 8-10 May 2020 and a website has been set up (www.veday75.org) with full details; Clerk to circulate correspondence to Councillors. 1907/16 Minor Items for Information and next Agenda: None.
