In the late 1940s and early 1950s, a new industry of community an- tenna television (CATV) exploded.1 By placing an antenna on top of a hill above a community and transmitting signals to subscribers’ houses via coaxial cables, CATV companies provided television to areas where hilly terrain made receiving traditional broadcast signals difficult.2 Af- ter the Supreme Court held that such systems did not violate copyright holders’ exclusive rights to public performance,3 Congress revised the copyright law in 1976 and, among other things, enacted the Transmit Clause to supersede those decisions and make such transmissions an infringement of copyright. Last Term, in ABC, Inc. v. Aereo, Inc.,4 the Supreme Court held that a company that transmitted broadcast televi- sion to users via the Internet violated the Transmit Clause, even though the user selected what content to watch, and even though each user had a dedicated antenna that produced a “personal” copy of the broadcast.5 The Court employed a functionalist approach, relying on analogical reasoning rather than analyzing the underlying technical operations of the system — the method that Justice Scalia adopted in his dissent. In doing so, the majority introduced unpredictability into the law by leaving important doctrinal questions unanswered and adopting an approach that lacks clear boundaries. Prior to the Copyright Act of 1976,6 the Court read the public per- formance right narrowly. In 1968, in Fortnightly Corp. v. United Art- ists Television, Inc.,7 the Court held that a CATV operator is more analogous to a “viewer” than a “performer,” and thus cannot face lia- bility under the Copyright Act.8 The Court affirmed Fortnightly in Teleprompter Corp. -

Because of the COVID-19 pandemic, there were no live network presentations to the industry, and for the first time since I’ve been evaluating television programming, I did not watch any of the fall pilots before the shows aired. Many new and returning series experienced production delays, resulting in staggered premieres, shortened seasons, and unexpected cancellations. The big San Diego and New York comic-cons were canceled. There was virtually no pre-season buzz for new broadcast or cable series. Stuck at home with fewer new episodes of scripted series than ever to watch on ad-supported TV, people turned to streaming services in large numbers. Netflix, which had plenty of shows in the pipeline, surged in terms of both viewers and new subscribers. Disney+, boosted by season 2 of The Mandalorian and new Marvel series, WandaVision and Falcon and the Winter Soldier, was able to experience tremendous growth. How Are the Major Streaming Services Reshaping the Film Industry Master Thesis MSc Strategy, Organization and Leadership Submission: May 9th, 2018 Normal pages: 106 (237.228 characters incl. spaces) Supervisor: Mehran Moghaddas (DVIP, INT) Students: Viktoria Vas & Gerda Binkyte Copenhagen Business School 2018 Abstract The paper examines the effects major streaming services, such as Netflix, Amazon, HBO have on the Danish film industry, and seeks to identify how individual producers and independent production companies in the country can exploit the rising opportunities. The research used a mix of deductive and inductive reasoning in the analysis, for which twelve semi-structured in-depth interviews were conducted with industry professionals from Denmark over the course of five weeks. This led to insightful findings that can be used for further researches for both academics and professionals. The analysis built on theories discussed in the literature review; Porter’s five forces (Porter, 1979), supply chain, emerging strategy (Mintzberg, 1987), marketing mix, four trajectories of change (McGahan, 2004). The findings include changes in certain links in the supply chain of film production, such as; affects on producers and film financing, changes in sales and distribution. While for producers SVOD services mainly bring additional financing opportunities, decreasing the power of DFI and the national broadcasters, sales agents and distribution is highly affected. Sales agents will need to adapt to the changing conditions, and transform themselves from traditional sales agents to agents who offer extra services for their clients. Distribution is affected in a way that its release windows system is disrupted and shortening some of these windows might not be avoided in the future. -
