Zansbergt This debate will not be about censorship. I, for one, do not want to control television programming, but we should make certain the American taxpayers are getting what they are paying for, and not getting what their tax dollars should not be paying for. -Sen. Robert Dole (R-Kansas)I If we start coming into this chamber and seeking to review the editorial decisions made by those who decide what programming goes on, then it will not be long before we are seeing the rightwing insist that Mr. Rogers change his lesson plan to include a rightwing political agenda in "Mister Rogers' Neighborhood," or that "Sesame Street" come up with different characters because they did not meet the political or ideological litmus test. 2 -(then) Sen. Albert Gore (D-Tenn.) In the Spring of 1992, Congress debated whether to reauthorize funds for the Corporation for Public Broadcasting (the CPB).3 Congress had created the CPB, a private, nonprofit corporation, in 1967, as the mechanism to disburse federal funds to public broadcasting stations and program producers, and as a buffer or "heat shield" between Congress and the public broadcasters. In 1992, conservatives extended the "culture war" they had earlier declared against public funding for the arts,' and launched a full frontal assault upon public broadcasting, 5 seeking to withdraw all federal support for the CPB.6 Opponents of public broadcasting leveled four charges against the institution: t A shorter version of this Note received first prize in the 1994 Stephen G. "Objectivity and Balance" in Public Broadcasting (1) that public television had been rendered obsolete by the explosion of cable channels offering programming traditionally found on PBS; (2) that in an age of budgetary constraint, it was indefensible to expend federal funds on a system that served mostly elitist preferences; (3) that programming on public broadcasting stations was frequently "indecent," and such programming should not be paid for with tax revenues; and (4) that public affairs programming on public broadcasting stations evinced a consistently liberal bias.7 By far the most sustained criticism of public broadcasting focused on the alleged liberal bias of news and information programming. During the floor debates, several congressmen ridiculed specific programming choices of public television officials8 and accused public broadcasting of promoting a "left-wing ideolo- gy."' Typical of this sentiment was the opinion expressed by Senate Minority Leader Robert Dole (R-Kansas), that public television presented a "steady stream of documentary cheerleading for leftwing interests."10 Ultimately, in August 1992, Congress voted to reauthorize funding for the CPB for three years." However, the harsh criticism from conservative mem- bers of Congress12 cast a pall over the proceedings, and resulted in an amend- ment to the reauthorization legislation that requires the CPB to monitor and ensure that national programming on public broadcasting stations is "balanced" 7. Congress has authorized for the CPB $310 million in fiscal year 1994, $375 million in fiscal year 1995, and $425 million in fiscal year 1996. Public Telecommunications Act of 1992, Pub. L. No. 102-356, § 8, 106 Stat. 951. 12. Conservative criticism of public broadcasting was not limited to the congressional forum. For example, at the Republican National Convention in Houston in August 1992, delegates approved a platform with language deploring "the blatant political bias of the government-sponsored radio and television networks," and looking "forward to the day when public broadcasting is self-sufficient." Clark, supra note 7, at 826. Yale Law & Policy Review Vol. 12:184, 1994 and "objective."13 Under the amendment, the CPB is required to report annually to Congress on its policy and procedures for evaluating and promoting objectivity and balance.14 Not surprisingly, the acrimonious legislative battle and resulting "objectivi- ty and balance" amendment produced a dramatic chilling effect. The CPB has already signaled its intention to avoid further political battles by curtailing the coverage of controversial programming on public broadcasting stations. In May 1993, the CPB sent letters to public radio broadcasters urging them to publicize a new national toll free telephone comment line, because "[n]egative comments might vindicate a station's decision not to carry controversial program- ming."" 5 Furthermore, critics of public broadcasting have pointed to the Public Broadcasting Service's (PBS) refusal to air a number of documentaries critical of corporate America as a logical and foreseeable response to the 1992 congressional wrangling.' 6 13. Pub. L. 102-356, § 19, 106 Stat. 949, 955-56 (1992). The stated purpose of the amendment was "to promote programming objectivity and balance." 138 CONG. REC. S7341 (daily ed. June 2, 1992) (statement of Sen. Inouye) (introducing amendment for floor debate). The text of the amendment reads in pertinent part: Pursuant to the existing responsibility of the Corporation for Public Broadcasting under section 396(g)(1)(A) of the Communications Act of 1934 (47 U.S.C. 396(g)(1)(A)) "to facilitate the full development of public telecommunications in which programs of high quality, diversity, creativity, excellence, and innovation, which are obtained from diverse sources, will be made available to public telecommunications entities, with strict adherence to objectivity and balance in all programs or series of programs of a controversial nature," the Board of Directors of the Corporation shall: (1) review the Corporation's existing efforts to meet its responsibility under section 396(g)(1)(A); (2) after soliciting the views of the public, establish a comprehensive policy and set of procedures to- (A) provide reasonable opportunity for the members of the public to present comments to the Board regarding quality, diversity, creativity, excellence, innovation, objectivity and balance of public broadcasting services, including public broadcasting of a controversial nature, as well as any needs not met by

Pass the Community Access Preservation Act (CAP Act) to preserve public, educational, and governmental (PEG) non-commercial cable channels for local communities. OVERVIEW—PUBLIC AND COMMUNITY MEDIA Public media consists of the Public Broadcasting Service (PBS), National Public Radio (NPR), and more than 1,000 local public broadcasting stations. Community media is comprised of public, educational, and government (PEG) cable access TV and community radio stations. Both public and community media have a long history of presenting local, regional, and national nonprofit arts programming, a great majority of which is not available on commercial channels. These organizations play a unique role in bringing both classics and contemporary works to the American public. All of these systems exist because of federal funding or legislation. TALKING POINTS— CORPORATION FOR PUBLIC BROADCASTING In creating America’s unique public broadcasting system, Congress acknowledged public broadcasting’s role in transmitting arts and culture: “It is in the public interest to encourage the growth and development of public radio and television broadcasting, including the use of such media for instructional, educational, and cultural purposes.” And Corporation for Public Broadcasting (CPB) is the vehicle through which Congress has chosen to promote noncommercial public telecommunications. CPB does not produce or broadcast programs. The vast majority of funding through CPB goes directly to local public broadcast stations in the form of Community Service Grants. The dissertation's meta-subjects are mediation, classification, and patronage in the presentation of music via distribution channels capable of reaching widespread audiences. The dissertation also addresses questions of race in the representation of jazz on radio. A central claim of the dissertation is that a given direction in jazz radio programming reflects the ideological, aesthetic, and political imperatives of a given broadcasting entity. I further argue that this ideological deployment of jazz can appear as conservative or progressive programming philosophies, and that these tendencies reflect discursive struggles over the identity of jazz. The first chapter, "Jazz on Noncommercial Radio," describes in some detail the current (circa 2013) taxonomy of American jazz radio. The remaining chapters are case studies of different aspects of jazz radio in the United States. Chapter 2, "Jazz is on the Left End of the Dial," presents considerable detail to the way the music is positioned on specific noncommercial stations. Introduction Out of concern that common ownership of media may stifle diversity of voices and viewpoints, the Federal Communications Commission (“FCC”) has historically placed limits on the degree of common ownership of local radio stations, as well as on cross-ownership among radio stations, television stations, and newspapers serving the same local area. The 1996 Telecommunications Act loosened local radio station ownership restrictions, to different degrees across markets of different sizes, and it lifted all limits on radio station ownership at the national level. Subsequent FCC rule changes permitted common ownership of television and radio stations in the same market and also permitted a certain degree of cross-ownership between radio stations and newspapers. These changes have resulted in a wave of radio station mergers as well as a number of cross-media acquisitions, shifting control over programming content to fewer hands. For example, the number of radio stations owned or operated by Clear Channel Communications increased from about 196 stations in 1997 to 1,183 stations in 2005; the number of stations owned or operated by CBS (formerly known as Infinity) increased from 160 in 1997 to 178 in 2005; and the number of stations owned or operated by ABC increased from 29 in 1997 to 71 in 2005.

SCOPE AND PURPOSE This specification defines uplink performance requirements for the Public Television Interconnection System. These parameters will address the settings for uplink MPEG-4 and MPEG-2 encoders, multiplexer, DVB-S and DVB-S2 modulators, and any redundant systems. The goal is to provide consistent quality performance among multiple uplink providers serving the Public Television Satellite Interconnection System. It is essential that all parameters be set correctly. It is vital that all uplink operators meet these performance requirements and protocols. Most stations rely on consistent signals from the satellite system and member stations do not have the manpower or means to compensate for variations. This specification prescribes standards that uplink operators must meet, and informs receiving stations what signal standards they should expect. This document is especially important for uplink operators working with other satellite services, since some of these specifications are unique to the PBS system. 2. SYSTEM INFORMATION PBS currently uses transponders on satellite AMC-21 for Ku service to member stations and on satellite AMC-1 for C-Band service for home consumers. The modulation formats in use are DVB-S2 for all MCPC services and HD SCPC services and either DVB-S or DVB-S2 for all SD SCPC services. Users are encouraged to utilize DVB-S2 modulation on SD transmissions whenever possible. Public Service Broadcasting in Transition: A Documentary Reader Abstract This is a book of documents, comments, and cases that has been prepared, at the request of the European Institute for the Media, for the use of government officials and citizens interested in strengthening public service broadcasting in transition societies. In this book we try to provide a small chest of tools and background information that will be of assistance. We start, in Chapter 1, with an overview of some of the general principles of public service broadcasting, and include pertinent comments on each of them. Here, as throughout the book, we concentrate on issues of governance and financing, with some attention as well ot issues surrounding programming. In Chapter 2, we turn to current issues in the European-level debate, partly from the perspective of European expectations and standards that are employed in evaluation and accession processes.
