PETITION FILED UNDER SECTION 439 of Cr.P.C Offences punishable under Sections 366-A, 417, 420, 493, 496, 376 (2) (n) of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for Short “POCSO Act”) read with Section 5 (I) of POCSO Act, 2012. This petition is coming before me today i.e., on 11-12-2020 for hearing by Sri J. Satyanarayana Rao, Advocate for the petitioner/accused and the learned Additional Public Prosecutor for State and having heard them, this Court made the following :- ORDER 1. This is the second bail petition filed under Section 439 of Cr.P.C by the petitioner/accused in Cr.No. 190 of 2020 of P.S. Ellanthakunta for the offences under Sections 366-A, 417, 420, 493, 496, 376 (2) (n) of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for Short “POCSO Act”) read with Section 5 (I) of POCSO Act, 2012. De facto complainant notice served, none represented. 2. Heard both the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor for the State. 2 3. The petitioner/accused in Cr.No. 661 of 2020 of P.S. Ellanthakunta for the offences under Sections 366-A, 417, 420, 493, 496, 376 (2) (n) of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for Short “POCSO Act”) read with Section 5 (I) of POCSO Act, 2012 is remanded to judicial custody in the said crime on 09-10-2020 on the allegations that the petitioner/accused abducted the minor victim girl from legal custody of her parents by saying deceitful words that he loved her and would marry her, took her to Chityala village and mandal of Nalgonda district, married her unlawfully in a temple at Chityala village and mandal of Nalgonda district and took a rent on room in Chityala and committed rape on her from 05-09-2020 to 06-10-2020. 4. Heard the learned counsel for the petitioner/accused who submitted that the de facto complainant who is the mother of the victim girl has falsely implicated the petitioner/accused in this crime for the missing of the victim girl and the petitioner/accused is no way concerned with this crime nor he has kidnapped or committed any sexual assault on the victim girl after marrying her. It is submitted that the entire investigation in this crime is completed except filing of the charge sheet and therefore, the petitioner/accused may be enlarged on bail on any conditions. 5. The learned Additional Public Prosecutor, while referring to the contents of the counter has submitted that 164 Cr.P.C statement of the victim girl is yet to be recorded and if the petitioner/accused is enlarged on bail at this stage, he may threaten her not to depose her against him and as further investigation is in progress, sought for dismissal of this petition. 6. After hearing the submissions of both sides and on a perusal of the material on record, the allegations levelled against the petitioner/accused are that he has kidnapped the minor victim girl from Peddalingapur village, took her to Nalgonda and married her and thereafter sexually exploited her. As the 164 Cr.P.C statement of the victim girl is not yet recorded, at this stage as further investigation is stated to be in progress, if the petitioner/accused is enlarged on bail, it would hamper further course of investigation and the possibility of his threatening the victim girl not to depose against him and interfering with the further course of investigation may not be ruled out. Hence, this petition is liable to be dismissed. 3 7. In the result, this petition is dismissed. The biomedicines are collected from the plants, which are used as fencing plants to their agricultural fields. This work is being carried out in collaboration with local Lambada tribes of Manchya Naik Thanda of Nalgonda district. The documented ethno medicine information was indexed by plant name, family, local name and uses. Key Words: Lambada Tribe, Fencing plants, Nalgonda District, Andhra Pradesh. Introduction Nalgonda district lies between 170 50’ N latitude and 780 10’ and 800 5’ S longitude. The district is bounded on the north by Medak and Warangal districts, on the South by Mahabubnagar and Guntur districts, on the West by the Hyderabad and Ranga Reddy districts and on the East by Khammam and Krishna districts. The district has geographical area of 14,240 sq. km. With a total population of 30,80,000. The tribal population in the district is 10%. The forest occupies 83,000 hectares area; these are mostly of tropical thorny type. Two important tribal settlements are seen in this district. They are Lambada and Erukala. This work is concentrated on Lambada tribe living at Manchya Naik Thanda, Mattampally Mandal of Nalgonda District.
