PETITION FILED UNDER SECTION 439 of Cr.P.C Offences punishable under Sections 366-A, 417, 420, 493, 496, 376 (2) (n) of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for Short “POCSO Act”) read with Section 5 (I) of POCSO Act, 2012. This petition is coming before me today i.e., on 11-11-2020 for hearing by Sri J. Satyanarayana Rao, Advocate for the petitioner/accused and the learned Additional Public Prosecutor for State and having heard them, this Court made the following :- ORDER 1. This is the first bail petition filed under Section 439 of Cr.P.C by the petitioner/accused in Cr.No. 190 of 2020 of P.S. Ellanthakunta for the offences under Sections 366-A, 417, 420, 493, 496, 376 (2) (n) of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for Short “POCSO Act”) read with Section 5 (I) of POCSO Act, 2012. De facto complainant notice served, none represented. 2. Heard both the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor for the State. 2 3. The petitioner/accused in Cr.No. 661 of 2020 of P.S. Ellanthakunta for the offences under Sections 366-A, 417, 420, 493, 496, 376 (2) (n) of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for Short “POCSO Act”) read with Section 5 (I) of POCSO Act, 2012 is remanded to judicial custody in the said crime on 09-10-2020 on the allegations that the petitioner/accused abducted the minor victim girl from legal custody of her parents by saying deceitful words that he loved her and would marry her, took her to Chityala village and mandal of Nalgonda district, married her unlawfully in a temple at Chityala village and mandal of Nalgonda district and took a rent on room in Chityala and committed rape on her from 05-09-2020 to 06-10-2020. 4. Heard the learned counsel for the petitioner/accused who submitted that the date of birth of the minor victim girl is wrongly shown and she was major as on the date of lodging the complaint which is on 01-09-2020, the petitioner/accused never kidnapped the victim girl nor married her or sexually exploited her as alleged but, he is falsely implicated due to family disputes, and as investigation is completed except filing of the charge sheet, he may be enlarged on bail on any conditions. 5. The learned Additional Public Prosecutor, while referring to the contents of the counter has submitted that 164 Cr.P.C statement of the victim girl is to be recorded, some more witnesses have to be examined and as investigation is in progress, sought for dismissal of this petition. 6. On a careful perusal of the material on record and after hearing the submissions of both sides, it is alleged that on 31-08-2020, the accused went to Peddalingapur village, induced the minor victim girl and took her to Ellanthakunta village on his bike on the pretext of love and marriage, and took her to Chityala village of Nalgonda, got her married on 05-09-2020 and sexually exploited her thereafter. Though it is contended that the age of the minor victim girl was 19 years as on the date of lodging the report, but, this is not the stage of conducting any eqnuriy on this aspect since it is the case of the investigating agency that the date of birth of the missing girl is 25-09-2002 and she was a minor on the date of lodging the report, which shows that prima facie she is a minor on that date. Since it is submitted that further investigation is in progress and the 164 Cr.P.C statement of the victim girl is yet to be recorded, if the petitioner/accused is enlarged on bail at this stage, it 3 would cause prejudice to the investigating agency and the prospect of the petitioner/accused interfering with the course of investigation may not be ruled out. Hence, this petition is liable to be dismissed. 7. In the result, this petition is dismissed.
