Last Updated September 12, 2019 ASCAP/MPL Paul McCartney Scholarship for Best Arrangement Official Awards Rules and Regulations The specific rules and requirements of the ASCAP/MPL Paul McCartney Scholarship for Best Arrangement (the “Award”), including but not limited to, eligibility, winner selection process, and award criteria, are set forth below (the “Award Requirements”). The Award Requirements are supplemented by the general rules and regulations attached as Schedule A (the “General Terms” and collectively with the “Award Requirements”, the “Official Rules”), which are incorporated by reference. By participating in the Award process and Award Celebration, all entrants (“Entrants”) agree to be bound by these Official Rules and the decisions of MPL Communications, Inc. (“MPL”) and the American Society of Composers, Authors and Publishers (“ASCAP”), which are final and binding in all respects. To the extent not specifically defined below, all capitalized terms have the meaning set forth in the General Terms. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SCHOLARSHIP COMPETITION. Void where prohibited by law and outside the fifty (50) United States and District of Columbia and Puerto Rico. This Program is subject to all federal, state and local laws, regulations, and ordinances. About the Award MPL and ASCAP seek to recognize talented young arrangers. Eligibility The Award is open to young composers and arrangers (each, an “Entrant”) who are not yet 30 years of age Requirements as of December 31, 2019. To be eligible to enter, Entrants must be, at the time of entry: (a) enrolled in college, university, music conservatory or other similar educational institution; and (b) a U.S. citizen, U.S. permanent resident or the holder of valid current U.S. student visa; and (c) at least 18 years of age (or the age of majority in their jurisdiction of permanent legal residence). Application Period The “Application Period” begins at 9:00 a.m. on June 10, 2019 and ends at 5:00 p.m. and January 15, 2020. Hard copy materials must be postmarked no later than January 15, 2020. Submission To be considered for the Award, Entrants must create an original arrangement (the “Arrangement”) of one Requirements of the 48 musical compositions (each, an “Eligible Composition”) written or co-written by Paul McCartney and made available by MPL at https://www.mplcommunications.com/ascap-mccartney-contest (the “MPL Competition Page”). The Arrangement must be entirely Entrant’s original work (i.e., no sampling). Entrants may select only one Eligible Composition for their Arrangement. The Arrangement must include a minimum of three parts. The Arrangement is not required to include lyrics, but if lyrics are included, the Arrangement may only include original lyrics of the Eligible Composition selected by the Entrant. MPL has made available to Entrants, solely for the purposes of entering into the Award process and for no other purposes, (a) a playlist comprised of the sound recordings of the Eligible Compositions, which playlist shall be available for streaming via the MPL Competition Page, and (b) the sheet music for the Eligible Compositions, which shall be available for download via a link on the MPL Competition Page (sub-sections (a) and (b), collectively, the “MPL Materials”). Entrant may use the MPL Materials solely for purposes of entering into the Award process during the Application Period in accordance with the Official Rules, except as otherwise agreed by MPL in writing. Except for Entrant’s limited right to use the MPL Materials as set forth in the immediately preceding sentence, MPL (and/or its licensors, suppliers and/or partners) retains all right, title and interest in and to the MPL Materials, including, without limitation, all intellectual property rights therein and thereto. For the avoidance of doubt, Entrant shall have no right to use the MPL Materials in any manner (including, without limitation, as incorporated in any Arrangement, parody or other derivative works based upon or derived from the MPL Materials by Entrant for purposes of entering the Awards process) after the expiration of the Application Period, except as otherwise agreed by MPL in writing. Any inquiries or requests regarding additional usage rights to the MPL Materials should be directed to MPL at [email protected]. For the avoidance of doubt, MPL is not obligated to respond to any such request and may refuse any such request in its sole discretion. Entrants must: (y) complete and electronically submit an application (the “Online Application”) available at https://www.ascap.com/music-career/Competitions/paul-mccartney, which must include a URL for an electronic realization or recording of the Arrangement, and (z) submit the following materials in hard copy to ASCAP: (i) a bound score (copy, not original manuscript) of the Arrangement (the “Score”); (ii) a biography and list of other works; and (iii) a print-out of the Online Application (clauses (y) and (z), collectively, the “Submission”). All Submission materials must separately bear the Entrant’s name. Entrants can submit only one Submission. Additional Submissions will not be considered. Return of hard copy materials: If you wish to have Submission materials returned to you, the Submission must be accompanied by a self‐addressed envelope with an official postage meter stamp from the U.S. Post Office with sufficient postage. Regular postage stamps will not be accepted. Depending on the number of Submissions, ASCAP and MPL reserve the right to appoint a preliminary panel consisting of ASCAP composer members to conduct an initial screening of Submissions. Arrangements will be evaluated based on the significance and overall artistry and compositional elements of the Arrangement, with the weight of the judging on the merits of the instrumental components of the Arrangement. The Panel (including any preliminary panel) is selected by ASCAP and the MPL in their sole discretions. Decisions of the Panel (including the selection of Award Recipient(s)) or any preliminary panel will be final and binding in all respects. Prize In accordance with the Judging Procedures and Criteria above, one eligible Entrant will be selected as the award recipient (the “Award Recipient”) and will receive a monetary Prize totaling $5,000.00 U.S.D., to be awarded in the form of a check payable to the winning entrant by MPL. ACCEPTANCE OF TERMS & CONDITIONS: By participating in the ASCAP/MPL Paul McCartney Scholarship for Best Arrangement (the “Award”), you (“you” or “Entrant”) hereby agree to be bound by and comply with: (a) the Official Rules, (b) the interpretation of the Official Rules by the American Society of Composers, Authors and Publishers (“ASCAP”) and MPL Music Publishing, Inc. (“MPL”), and (c) any decisions by ASCAP, MPL or the judges of the Award, which are final and binding in all respects. Entrant hereby acknowledges that he/she is bound to comply with the Official Rules, that any conduct not in compliance with the Official Rules will result in disqualification, and that ASCAP and/or MPL may take any legal action associated with such misconduct. Participation in the Award process, including the submission of any information and materials in connection with an Application and the collection, use and disclosure of such information and materials, is subject to the terms and conditions relating to the access to and use of the ASCAP website as set forth at https://www.ascap.com/help/legal/terms-of-use (the “ASCAP Terms of Use”), including ASCAP’S privacy policy available at https://www.ascap.com/help/legal/privacy-policy (the “ASCAP Privacy Policy”). Without limiting the foregoing, Entrant’s access to and use of the materials made available to entrants via the MPL Competition Page (as further described in the Award Requirements) in these Official Rules are also subject to the terms and conditions relating to the access to and use of the MPL website as set forth at https://www.mplcommunications.com/legal (the “MPL Terms of Use”), including MPL’s privacy policy available at https://www.mplcommunications.com/legal (the “MPL Privacy Policy”). Capitalized terms used but not defined herein shall have the meanings set forth in the Award Requirements. 2. ADDITIONAL ELIGIBILITY REQUIREMENTS: Judges of the Award or anyone involved in the Judging Procedure as set forth in the Award Requirements are not permitted to enter or win the Award. Employees, officers and directors of ASCAP or MPL respectively, and any affiliated company, organization or entity, and their immediate family members, are not eligible to participate in the Award. For purpose of the foregoing, “immediate family” means parents, spouses, children, siblings or any members of the same households of such employees, officers and directors. ASCAP and MPL reserve the right to verify the eligibility of Award Recipients. 3. SUBMISSIONS & JUDGING. Entrants must provide all required information as set forth the Award Requirements in order to be considered for the Award. Unless expressly set forth in the Award Requirements, submissions will not be returned to Entrants. Any attempt by any Entrant to submit more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses (postal or email) or any other method may void all of that Entrant’s entries and that Entrant may be disqualified at ASCAP and MPL’s sole discretions.
