Sec. 2-76. - City marshal.

(a) Established, purpose and intent. There is hereby created the City of Grayson Marshal’s Office. The purpose of this section is to do all things necessary in order for the City of Grayson Marshal’s Office to be recognized as a agency/ of the state and certified within the standards of the Georgia Officer Standards and Training Act (POST Act), as provided in Chapter 8 of 35 of the Official Code of Georgia Annotated. (b) Requirements. The requirements for the city marshal's office shall be as follows: (1) All officers shall be and shall maintain POST Certification, or in the event a person is hired as City of Grayson Marshal who is not POST Certified on the date of hire, then he/she shall have 12 months from his/her hiring date in which to become POST Certified. (2) All officers must be at least 19 years of age, have a high school diploma or GED, and a valid state driver's license; (3) All officers must be of good moral character and standing in the community which shall require that no officer shall have any convictions of any misdemeanor involving moral turpitude and/or any convictions of any felony. (c) Powers of arrest. A City of Grayson Marshal shall have the power of arrest in the enforcement of all ordinances of City of Grayson, Georgia, and the laws of the state. (d) Duties and responsibilities. (1) To enforce all ordinances enacted by the and council of the city, including but not limited to ordinances involving alcohol, building codes, building guidelines, development regulations and codes, subdivision regulations, zoning and planning, roads and bridges. (2) To issue warnings, notices of violation, summons, and/or citations for the violation of laws and ordinances. (3) To serve warnings, notices of violation, summons, citations, subpoenas, orders, and other process issued by authority of the City of Grayson and the laws of the State of Georgia. (4) To investigate and collect evidence of ordinance violations. (5) To respond to complaints of alleged ordinance violations. (6) To appear and testify in court. (7) To do any follow-up work that may be necessary. (8) To ensure proper collection of fines. (9) To coordinate enforcement efforts concerning the building inspection, planning and zoning, public works and/or any other department or division of the city as may be deemed necessary. (10) To perform any other duties, including arrests for state law violations, which are permissible and allowed under O.C.G.A. § 36-8-5. (11) To work in connection with city attorney's office on behalf of the city. (e) Placement of position. All employees within the Marshal's Office shall be appointed by the city council, shall serve at the pleasure of the city council, and may be removed at any time for any reason without cause in the sole discretion of the city council. (f) Jurisdiction. The jurisdiction of the City of Grayson Marshal’s Office shall be the entire incorporated area of the City of Grayson, Georgia. (g) Chief marshal. (1) There is created in the City of Grayson Marshal’s Office a position as chief marshal, which position shall be appointed and approved by the city council. (2) With the prior approval of the council, the chief marshal shall be responsible for developing office policy and organization within the City Marshal’s Office and shall be responsible for supervising all other marshals or other employees within the City Marshal’s Office and shall also be responsible for the promulgation of all rules and regulations for the conduct, management and control of the City Marshal’s Office. GENERAL STATEMENT OF DUTIES: This position is responsible for providing part-time law enforcement services for the City. Work is performed in accordance with established City Ordinances, Policies, and Procedures. An employee in this class is required to exercise initiative and discretion when faced with emergency conditions. The work involves an element of personal danger. DUTIES: Enforces City Ordinances, State Laws, and issue citations. Make arrests of violators when necessary. Investigates suspicious conditions, activities, or persons, and takes appropriate action. Performs any related work as required by the Mayor or the Council or the City Administrator. DESIRABLE KNOWLEDGE, SKILLS, AND ABILITIES: Knowledge of modern police practices and methods; knowledge of weapons, vehicles, and equipment used in law enforcement and skill in their safe and proper use; skill in working and communicating with co-workers, other law enforcement personnel, and the public in a manner appropriate to the situation; skill in working under stress; ability to make decisions in accordance with laws, ordinances, regulations, and established procedures; ability to analyze situations quickly and objectively and to determine the proper course of action. DESIRABLE EXPERIENCE AND TRAINING: Experience as a police officer and completion of a standard high school course; or any combination of experience and training which provides the desired knowledge, skills and abilities. Must be POST Certified. NECESSARY SPECIAL REQUIREMENTS: O.C.G.A., Title 35-8-8, requires that any person employed in any of the police service classifications: (a) be at least 18 years old; (b) be a citizen of the United States; (c) have a high school diploma or its recognized equivalent; (d) not have been convicted by any State or by the Federal Government of any crime, the punishment for which could have been imprisonment in a Federal or State prison or institution; nor shall he have been convicted of sufficient misdemeanors to establish a pattern of disregard for the law; (e) be finger-printed and a search made of Local, State, and National finger- print files to disclose any criminal record: (f) possess good moral character as determined by investigation under procedures established pursuant to the Act; (g) have an oral interview with the hiring authority or its representative(s) to determine such things as the applicant’s appearance, background and ability to communicate.

Possession of a Class C Motor Vehicle Operator’s License issued by the State of Georgia.
