Statutory Document No. 4 9 9/ 1 1 ROAD RACES ACT 1982 ROAD RACES (SUBARU SPEED TRIAL) ORDER 2011 INDEX 1 Title 2 Commencement 3 Interpretation 4 Authorisation of use of Course for racing 5 Suspension of right of way etc. 6 Regulation of traffic on side roads 7 Exemptions from articles 6 and 7 8 Temporary opening of Course to traffic 9 Footbridges 10 Restricted areas 11 Prohibited areas 12 Parking on ambulance access routes 13 Publicity for cancellation, postponements and suspensions. 14 Start of closure 15 End of closure 16 Erection of signage 17 Insurance 18 Restriction on road works 19 Interaction with the Road Races (Tourist Trophy Motorcycle Races) Order 2011 SCHEDULE 1 - The Course SCHEDULE 2 - Road closures SCHEDULE 3 - Crossing places SCHEDULE 4 - Prohibited areas and restricted areas SCHEDULE 5 - Ambulance access roads Statutory Document No. 4 9 9/ 1 1 ROAD RACES ACT 1982 ROAD RACES (SUBARU SPEED TRIAL) ORDER 2011 Coining into Operation: 6 June 2011 The Department of Infrastructure makes this Order under sections 1 and 2 of the Road Races Act 19821. 1 Title This Order is the Road Races (Subaru Speed Trial) Order 2011. 2 Commencement This Order comes into operation on 6 June 2011. 3 Interpretation In this Order — "ACUE" means ACU Events Limited; "Clerk of the Course" has the meaning given by the TT Order; "closure period" means any period during which an authorisation under article 4 is in force in relation to the Course or any part of the Course; "competing vehicle" means the motor car participating in the trial of speed authorised by this order; "Course" means the roads and property areas specified in Schedule 1; "Event Director" includes, in the absence of the Event Director, any Deputy Event Director appointed by the promoter; "motor car" has the meaning given by section 65 of the Road Traffic Act 19852; "organiser" means the Isle of Man Government Department of Economic Development; "pedestrian" includes a wheelchair user and any persons using a mobility aid other than a bicycle or motor vehicle; 1 1982 c.14 2 985 c. 23 2 "postpone", in relation to a race, includes annulling a race which has already begun; " prohibited area" means the areas listed in Schedule 4 that are not restricted areas; "promoter" means Automotive Events Incorporated (except in the expression "TT promoter"); "restricted area" means the areas listed in Schedule 4 that are indicated as being restricted; "senior police officer" means a member of the Isle of Man Constabulary (a) of the rank of sergeant or above; and (b) authorised by the Chief Constable to act as senior police officer for the purposes of this Order; "side road" means any part of a road that leads onto the Course; and "signage" includes any barrier, tape, sign, markings or structure which indicate restricted access to the Course, a side road, a prohibited area or a restricted area; "TT Order" means the Road Races (Tourist Trophy Motorcycle Racing) Order 2011; "TT promoter" means the promoter for the purposes of the TT Order; 4 Authorisation of use of Course for motor car racing (1) The promoter is authorised to use the Course for motor-car racing on the days and times specified in table 1 of Schedule 2. (2) The Event Director may for any reason— (a) cancel such racing, or any racing postponed under this paragraph; or (b) postpone such racing from a day and time specified in table 1 of Schedule 2 to a day and time specified in table 2 of that Schedule. If the Event Director cancels or postpones racing under paragraph (2) he or ( 3) she must notify the senior police officer. 5 Suspension of right of way etc. Subject to articles 7 and 8, during any closure period in relation to any part of the Course, the right of way over it is suspended and accordingly, no traffic may enter or remain on it. 6 Regulation of traffic on side roads Subject to articles 7 and 8, during the closure period, a person must not enter or remain, or cause or permit any vehicle or animal to enter or remain on a side road that is marked with signage without the permission of a constable or marshal. 3 7 Exemptions from articles 5 and 6 (1) Articles 5 and 6 do not apply to — (a) the Event Director; (b) persons appointed by the promoter as officials for the purpose of the race in question; (c) persons approved by the Event Director; (d) constables, fire officers, medical or veterinary persons, highway maintenance and recovery persons; (e) persons lawfully taking part in the race in question and any person authorised by the promoter to assist those persons; (f) Television crews and photographers appointed by the organiser. (2) Articles 5 and 6 do not apply to the competing vehicle and any vehicle approved by the Event Director. 8 Temporary opening of Course to traffic (1) This article has effect despite anything in articles 4 to 6. (2) If racing authorised by this Order is temporarily postponed or suspended during a closure period, the senior police officer may, with the consent of the Event Director, authorise traffic, in accordance with the directions of a constable, to cross or proceed along such part of the Course, and at such times, as the constable may specify. (3) Nothing in paragraph (2) permits traffic to proceed in the reverse direction of the Course, except with the express authorisation of the Event Director. (4) In any interval between racing during a closure period, the senior police officer may, with the consent of the Event Director — (a) authorise pedestrians, in accordance with the directions of a constable, to cross or proceed along the Course at such places, and at such times, as that officer may specify; or (b) authorise pedestrian or vehicular traffic, in accordance with the directions of a constable, to cross or proceed along the Course at the places specified in Schedule 3, at such times as that officer may specify. (5) No person must during a closure period, drive any vehicle or cause or permit any vehicle to be driven, on any part of the Course which is the subject of any authorisation under paragraph (2) or (4), otherwise than pursuant to that authorisation and in accordance with the directions of a constable. 4 9 Footbridges (1) Nothing in articles 4 to 6 prevents a pedestrian crossing the Course by means of a footbridge erected for the purpose, unless forbidden to do so by a constable, (2) During a closure period no person may stop or loiter on any footbridge referred to in paragraph (1). 10 Restricted areas (1) During a closure period no person or vehicle may enter or remain on a restricted area. (2) Paragraph (1) does not apply to — (a) race officials, marshals or police officers in the course of their duty; or (b) photographers, television crew or other persons or vehicles approved by the Event Director. (3) The extent of the restricted area must be clearly marked and indicated by signs bearing the words "Restricted Area". 11 Prohibited areas (1) No person or vehicle may, during a closure period, enter or remain on a prohibited area, except to go to the aid of a person or to prevent further danger or risk to the competitors or any other person. (2) The extent of the prohibited area must be clearly marked and indicated by signs bearing the words "Prohibited Area". 12 Parking on ambulance access routes Without the permission of a constable or marshal, a person must not cause or permit a vehicle to wait within 100 metres, or less as indicated by road sign, or any road closed barrier, in accordance with article 15, on a road specified in Schedule 5 — (a) during a closure period; and (b) on the side of the road as indicated by road sign. 13 Publicity for cancellation, postponements and suspensions. (1) If the senior police officer is notified of the cancellation or postponement of racing under article 4(3), he or she must take such measures (if any) as he or she considers appropriate to inform the public of the effect of it. (2) The senior police officer must take such measures (if any) as he or she considers appropriate to inform the public of any authorisation under article 8(4)(b). 5 (3) The Department must cause public notice of— (a) the location of crossing places and access corridors specified in Schedule 3 to be printed in one or more newspapers published and circulating in the Island; and (b) the opening of crossing places and access corridors specified in Schedule 3 to be announced on radio stations broadcasting in the Island. 14 Start of closure under this Order (1) The closure period under this Order commences when, in accordance with arrangements made by — (a) the Clerk of the Course; or (b) the senior police officer, after consulting the Clerk of the Course, a motor vehicle containing a person approved by the Event Director has travelled the Course to inspect it and that person has certified to the Event Director that the Course is fit for racing authorised by this Order. (2) When the certificate under paragraph (1) is given— (a) the TT promoter ceases to be responsible for the Course; and (b) the promoter becomes responsible for it. 15 End of closure under this Order (1) At the end of the closure period for which an authorisation under article 4 is in force— (a) the Event Director; or (b) the senior police officer, after consulting the Event Director, must arrange for a motor vehicle to travel the Course to inspect it.
