You have requested the following information; 1) How many housing developments has your planning department approved, against the flood-related advice of the Environment Agency, in each of the following years: 2002-3, 2003-4, 2004-5, 2005-6, 2007-8, 2008-9, 2009-10, 2010-11, 2011-12, and so far in 2012-13? 2) Can you provide the name of the developments, the location of the developments and the name of the developer, in all these cases? 3) Of the above developments, in each year, how many of the homes were designated for affordable housing or social housing? Please find attached a list of applications since 2003 where the Council sent out a consultation to the Environment Agency. In respect of developments approved against advice from the Environment Agency, the Council will not be complying with this aspect of your request as it is considered to be manifestly unreasonable and the exception to disclosure contained at EIR Regulation 12 (4) (b) is engaged 24 December 2012 This exception applies as it is estimated that to confirm whether this information is held, each individual application would need to checked. To undertake this task is estimated to exceed the cost of compliance limits set in fees regulations made under Section 12 (5) of the Freedom of Information Act 2000, which also has effect with regard to the EIR. These Fees Regulations (SI 2004/3244 Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations) allow for a refusal where the cost of compliance, for local authorities such as the Council, would exceed £450. As a guide, staff time to identify and extract this information is charged at a rate of £25 per hour. In this instance it has been established that the Council does not hold this information in a readily available format. This is because any relevant response from the Environment Agency would be within the associated documentation or referred to within officer reports that are stored against each planning application. To undertake this task is estimated to exceed the cost of compliance limits set in the fees regulations. To advise and assist you further, in line with the Council's duty under EIR Regulation 9, the relevant listed applications can be viewed in their entirety on the Council's planning portal that can be accessed via: www.coventry.gov.uk/planning To search this, you should follow the above link and then use the relevant application reference number or property address details to search out the relevant application.
