© Tracy Ames, 2012 COMPOSITIONAL COMPLEXITY IN THE PALESTINIAN TALMUD AGGADAH, TRACTATE BERAKHOT by Tracy Ames A THESIS SUBMITTED IN PARTIAL FULFILLMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY in The Faculty of Graduate Studies (Religious Studies) THE UNIVERSITY OF BRITISH COLUMBIA (Vancouver) December 2012 © Tracy Ames, 2012 Abstract The goal of this thesis is to contribute to the scholarship investigating the Aggadah in the Palestinian Talmud. This study confirms the presence of carefully constructed and deliberately redacted portions of the Palestinian Talmud within the first chapter of tractate Berakhot (Blessings). Contrary to claims that the Palestinian Talmud has a very thin redactional layer, this dissertation argues that earlier traditions were subjected to an active interventionist editorial process by the Amoraic composers/redactors. The results of this study are that creative composition and a high degree of literary sophistication can be ascertained within the Amoraic layers of the Palestinian Talmud in the portions of tractate Berakhot that I analyze. The complexity of aggadot within the first chapter of tractate Berakhot is confirmed with the application of literary and genre based analysis which reveals that literary constructs widespread throughout the Greco-Roman world were adapted by the composers/redactors of the Palestinian Talmud. The Greco-Roman literary constructs that are employed in these narratives serve to thematize efforts by sages to establish rabbinic prayer practices—and establish their own leadership— in the aftermath of the vacuum left by the destruction of the Second Temple. Furthermore, contextual/historical analysis indicates that these aggadot reveal a nuanced and varied set of responses to the Roman Empire, demonstrating that these narratives were produced by a highly sophisticated compositional and editorial hand. Paying special attention to the discursive forms of the Talmud, I show how juxtapositions of narrative and legal dialectics cooperate in generating the Talmud's distinctive ethics, which I characterize as an attentiveness to the “exceptional particulars” of life. To demonstrate the features and rewards of a literary approach, I offer a sustained reading of a single tractate from the Babylonian Talmud, ʿAvoda Zara (AZ). AZ and other talmudic discussions about non-Jews offer a rich resource for considerations of ethics because they are centrally concerned with constituting social relationships and with examining aspects of human experience that exceed the domain of Jewish law. AZ investigates what distinguishes Jews from non-Jews, what Jews and non- Jews share in common, and what it means to be a human being. I read AZ as a cohesive literary work unified by the overarching project of examining the place of humanity in the cosmos.

    The Gender of Shabbat Aryeh Cohen Introduction “Women are like men in regards to Shabbat …”1 There are several specific ways in which Shabbat itself, the day, not the tractate, is gendered. Shabbat is called a “bride” (bShab 119a). At the onset of Shabbat, the sunset on Friday evening, the Bavli relates that sages would go out to greet the bride, Shabbat the Queen. Shabbat is “brought in” on command of the man of the house. He interro- gates the woman: “have you tithed?” “Have you made an eruv?” Upon receiving the correct answers he commands: “Light the candles,” (mShab 2:7).2 The Mishnah distinguishes between what a man is allowed to wear out of the house on Shabbat and what a woman is allowed to wear out of the house on Shabbat. The discussions center on jewelry and other “accessories” for a woman and body armor and weapons for a man (mShab 6:1-3). The prohibitions serve to construct the masculine and the feminine.3 However, I want to look elsewhere. mShabbat starts with distinguishing be- tween inside and outside. This should be familiar terrain for feminist theory. However, when we look at mShab 1:1, there is no distinction drawn between a man and a woman. A collection of halakhic and aggadic texts, classic and contemporary, dealing with the sun, Massekhet HaHammah was prepared as a companion to the ritual for Birkat HaHammah. Our hope is that rabbis and communities will study this text in advance of the Fast and use it both for adult learning about this fascinating ritual and as the text around which to build a siyyum, a celebratory meal marking the conclusion of a block of text study and releasing firstborn in the community from the obligation to fast on the eve of the Passover seder.1 We are also struck this year by the renewed importance of our focus on the sun given the universal concern with global warming and the need for non-carbon-based renewable resources, like solar energy.

    English Abstract Sugya 1: Point of Departure (Berakhot 2a) Sugya 1 has been attributed by scholars to the sabora'im, sixth or seventh century Babylonian sages who added a post-editorial layer to the Talmud, predominantly in the form of introductory sugyot at the beginnings of tractates and chapters. Mishnah Berakhot 1:1, the first in the entire mishnaic corpus, opens with a question: "When do we begin reciting the Shema in the evenings?" Our sugya consists of a series of questions regarding the wording and "missing" context of this question. Close reading indicates an element of artificiality in these questions: they single out our mishnah either because it opens with a question, or because it does not define its terms, and because it assumes that day follows night - phenomena that are not in the least surprising, and in fact reflect standard mishnaic or rabbinic usage. The proposed answers are respectively either obvious or equally artificial, or they make use of selective citation in order to establish a chiastic structure in the mishnayot of the first chapter of Berakhot. Analysis indicates that each and every question and type of answer found in the sugya is found elsewhere in the Talmud, in other sugyot that have been attributed by scholars to the sabora'im. In each and every case the saboraic question or answer or formulation is less artificial and more appropriate in its other locus than it is in our sugya. It would thus seem that this entire sugya is the work of single late saboraic author, who pieced together a collection of typical saboraic comments from other places and applied them to the very first mishnah, in order create a "flagship" saboraic introductory sugya at the very beginning of the Talmud.

According to many scholars, this kabbalistic creation story as portrayed in the Zohar is a reaction to the earlier rabbinic concept of God qua creator, which emphasized divine transcendence over divine immanence. The medieval Jewish philosophers, particularly Maimonides influenced by Aristotle, placed particular emphasis on divine transcendence, seeing a radical separation between Creator and creation. With this in mind, these scholars claim that one of the goals of the Zohar’s creation story was to emphasize God’s immanence within creation. Similar to the Zohar, the process metaphysics of Alfred North Whitehead and his followers was reacting to the substance metaphysics that had dominated Western philosophy as far back as ancient Greek thought. Whitehead adopts a very similar narrative to that of the Zohar.

He reads and writes the holy language (Hebrew) and is attended by many belonging to the people of Israel. He will not partake of anything unless he has earned it by the work of his own hands. On arrival the Caliph rises and puts him on a throne, opposite him, which the prophet Mohammed had ordered to be made for him.
