That may be the most important contribution of the recent Iran-contra congressional hearings. —Theodore Draper, “The Rise of the American Junta,” New York Review of Books, October 8, 1987. In 1989 I published the following article, “Northwards without North: Bush, Counterterrorism, and the Continuation of Secret Power.” It is of interest today because of its description of how the Congressional Iran-Contra Committees, in their investigation of Iran-Contra, assembled documentation on what we now know as Continuity of Government (COG) planning, only to suppress or misrepresent this important information in their Report. I was concerned about the committees’ decision to sidestep the larger issues of secret powers and secret wars, little knowing that these secret COG powers, or “Doomsday Project,” would in fact be secretly implemented on September 11, 2011. (One of the two Committee Chairs was Lee Hamilton, later co-chair of the similarly evasive 9/11 Commission Report). Recently I have written about the extraordinary power of the COG network Doomsday planners, or what CNN in 1991 described as a “shadow government…about which you know nothing.”[1] Returning to my 1989 essay, I see the essential but complex overlap between this Doomsday Committee and the Iran-Contra secret “junta” or cabal described by Theodore Draper and Senator Paul Sarbanes within the Reagan-Bush administration. -
The National Security Council and the Iran-Contra Affair
THE NATIONAL SECURITY COUNCIL AND THE IRAN- CONTRA AFFAIR Congressman Ed Jenkins* and Robert H. Brink** I. INTRODUCTION Early in November of 1986, newspapers in the United States carried the first reports that the United States government, in an effort to gain release of United States citizens held hostage by terrorists in Lebanon, had engaged in a covert policy of supplying arms to elements within Iran.' Later in that month, following a preliminary inquiry into the matter, it was revealed that some of the funds generated from those arms sales had been diverted to support the "Contra" 2 forces fighting the Sandinista government in Nicaragua. The events giving rise to these disclosures became known collectively as the "Iran-Contra Affair." Both elements of the affair raised serious questions regarding the formulation and conduct of our nation's foreign policy. In regard to the Iranian phase of the affair, the Regan administration's rhetoric had placed the administration firmly in op- position to any dealings with nations supporting terrorism, and with Iran in particular.' And during the Watergate years it was interpreted again so as to reaffirm that no one—absolutely no one—is above the law.29 JAMES A. BAKER, III The case for pragmatic idealism is based on an optimis- tic view of man, tempered by our knowledge of human imperfection. It promises no easy answers or quick fixes. But I am convinced that it offers our surest guide and best hope for navigating our great country safely through this precarious period of opportunity and risk in world affairs.30 In their historic careers, Leon Jaworski and James A. Baker, III, ended up in the same place—the highest level of achievement in their respective fields as lawyers—though they didn’t start from the same place. Leonidas Jaworski entered the world in 1905 as the son of Joseph Jaworski, a German-speaking Polish immigrant, who went through Ellis Island two years before Leon’s birth and made a modest living as an evangelical pastor leading small churches in Central Texas towns. James A. Baker, III, entered the world in 1930 as the son, grand- son, and great-grandson of distinguished lawyers all named James A. -
Barr Will Not Be Independent of President Trump Or
Attorney General Nominee William barr President Trump announced that he intends to nominate William Barr to be attorney general. Barr served as attorney general under President George H.W. Bush from 1991-1993. Since then, he has been a telecommunications executive and board member, as well as in private legal practice. BARR WILL NOT BE INDEPENDENT OF PRESIDENT TRUMP OR RESTRAIN Trump’s ATTACKS ON THE RULE OF LAW Threat TO THE MUELLER INVESTIGATION Barr authored a controversial memo attacking part of the Mueller investigation. In June 2018, Barr sent the Department of Justice a lengthy memo arguing that Mueller shouldn't be able to investigate Trump for obstruction of justice. The memo, which Barr reportedly shared with the White House as well, raises serious concerns that Barr thinks Trump should be above the law. Barr has already been asked to defend President Trump in the Mueller investigation. President Trump repeatedly criticized Attorney General Jeff Sessions for failing to rein in Special Counsel Robert Mueller, and clearly a priority for the president is appointing an individual to lead the Justice Department who will protect him from investigations. President Trump has reportedly asked Barr in the past whether he would serve as Trump’s personal defense attorney and has inquired whether Barr, like Sessions, would recuse himself from the Mueller investigation. Barr is already on record minimizing the seriousness of allegations surrounding Trump and Russia. In reference to a supposed Clinton uranium scandal that gained traction in right-wing conspiracy circles, it was reported that “Mr. Barr said he sees more basis for investigating the uranium deal than any supposed collusion between Mr. -

Higdon, fundraiser and longtime Reagan family associate, dies at 58 by Matt Schudel June 21 at 5:51 PM Email the author Robert M. Higdon, a close associate of President Ronald Reagan and first lady Nancy Reagan, who became a leading fundraiser for the Reagan Presidential Library and Foundation and later led foundations associated with former British prime minister Margaret Thatcher and Britain’s Prince Charles, died June 19 at his home in Panama City, Fla. He was 58. The death was confirmed by Mr. Higdon’s partner, David Deckelbaum. The cause is undetermined and is pending an autopsy by the Florida Medical Examiner’s office. Mr. Higdon was a gregarious, well-connected figure in Washington who was adept at bringing people of different political backgrounds together. He began his career on Capitol Hill working for Democratic congressmen, then entered the Reagans’ orbit while working at a lobbying firm with Carolyn Deaver, the wife of Ronald Reagan’s deputy chief of staff, Michael Deaver. Mr. Higdon became, in effect, an organizer and assistant for the first family before joining the staff of Ronald Reagan Presidential Library Foundation in the mid-1980s. He was particularly close to Nancy Reagan and, after the Reagans left the White House, was often described as a “walker” who accompanied the former first lady to social events. “He stayed at my mother’s house, and she wasn’t usually one for house guests,” Patti Davis, the Reagans’ daughter, said in a telephone interview. -

Presidential Obstruction of Justice Daniel J. Hemel* & Eric A. Posner** Federal obstruction of justice statutes bar anyone from interfering with official legal proceedings based on a “corrupt” motive. But what about the president of the United States? The president is vested with “executive power,” which includes the power to control federal law enforcement. A possible view is that the statutes do not apply to the president because if they did they would violate the president’s constitutional power. However, we argue that the obstruction of justice statutes are best interpreted to apply to the president, and that the president obstructs justice when his motive for intervening in an investigation is to further personal, pecuniary, or narrowly partisan interests, rather than to advance the public good. A brief tour of presidential scandals indicates that, without anyone noticing it, the law of obstruction of justice has evolved into a major check on presidential power. McNeil testified before the Senate Foreign Relations Committee's subcommittee on terrorism, narcotics and international operations, chaired by Sen. John Kerry. McNeil, a 31-year Foreign Service officer, left the State Department in February 1987, due to "clashes" with Asst. Secretary of State for Inter-American Affairs Elliott Abrams. At the time of his resignation, McNeil held the position of Senior Deputy Assistant Secretary of State for Intelligence and Research. Among other posts in his career, McNeil served as US Ambassador to Costa Rica, and Deputy Asst. Secretary of State for Inter-American Affairs. McNeil's testimony on selected topics is summarized below. "Obsession with Nicaragua" Leads U.S. to Subvert Anti-Drug & Support for Democratization Policies In his testimony, McNeil argued that some US officials' "obsession with Nicaragua" precluded "rational decisionmaking" regarding other US policy objectives, particularly commitments to curb international drug trafficking and terrorism, and to support democratization in Latin America. -
