Penerapan Kebijakan Penegakan Hukum Terhadap Kasus-Kasus Hukum Terkait Pemberitaan Pers Di Indonesia PENERAPAN KEBIJAKAN PENEGAKAN HUKUM TERHADAP KASUS-KASUS HUKUM TERKAIT PEMBERITAAN PERS DI INDONESIA Pri Pambudi Teguh1 1Program Studi Fakultas Hukum, Universitas Nasional ([email protected]) Abstract This research is based on the existence of a disagreement on the application of press law and a lack of understanding of law enforcement officials regarding legal cases related to press coverage. This kind of situation must be guarded and extended to other law enforcement officials so that law enforcement efforts do not have to conflict with the will of the people in maintaining and maintaining press freedom that has been guaranteed by the UUD 1945 and its amendments. By using juridical methods of format and approaches to several theories, namely Grand theory, Middle Range Theory and Applied Theory (as Grand Theory uses Materiel Law State Theory, Middle-Range Theory uses Development Law Theory and Applied Theory uses Criminal Law Political Theory supported by Systems Theory. Criminal Justice), this study aims to determine the application of law enforcement policies to legal cases related to press coverage in Indonesia. The conclusions obtained are as follows: 1. Law No. 40 of 1999 concerning the Press is not a lex specialis against the Criminal Code (KUHP), therefore the Criminal Code remains valid in enforcing press offenses, while civil charges resulting from press coverage can use Article 1365 and / or Article 1367 of the Civil Code. 2. Law enforcement policies in the press sector are formulated and implemented in a balanced manner between the need to maintain press freedom based on the 1945 Constitution and legal guarantees of individual rights to press coverage. -

Soedarsono Guru Besar Universitas Gadjah Mada Victor Ganap Guru Besar Institut Seni Indonesia Yogyakarta ABSTRACT The main objective of this paper is to analyze function of “heroic” Indonesia songs related to the struggle for Indonesian independence ( from 1945 to 1949) from a historical perspective. Through this analysis it is hoped that the process of the past, particularly the history of music development in Indonesia and the background of the use of the “heroic”Indonesia songs, can be reconstructed. Important aspects of Indonesian songs, as this paper shows, include a constructive function for ceremonies and advice for development. The ceremonial character is shown in the song of “Indonesia Raya”. the national anthem. Key words: National anthem ABSTRAK Objek utama dari tulisan ini adalah menganalisis fungsi dari lagu perjuangan Indonesia sehubungan dengan kemerdekaan Indonesia 1945- 1949 dilihat dari perspektif sejarah. Analisis ini diharapkan bahwa proses sejarah masa lalu dapat direkonstruksi, khususnya sejarah perkembangan music di Indonesia, latar belakang penggunaan lagu-lagu perjuangan Indonesia. Salah satu aspek terpenting dalam penulisan ini adalah fungsi dari lagu perjuangan Indonesia yang terbagi dalam satu bagian, terutama adalah fungsi konstruksi dari lagu untuk upacara meliputi saran dari pembangunan. Karakter seremonial ditampilkan dalam lagu “ Indonesia Raya” yaitu lagu kebangsaan. Another Look at the Jakarta Charter Controversy of 1945 R. E. Elson* On the morning of August 18, 1945, three days after the Japanese surrender and just a day after Indonesia's proclamation of independence, Mohammad Hatta, soon to be elected as vice-president of the infant republic, prevailed upon delegates at the first meeting of the Panitia Persiapan Kemerdekaan Indonesia (PPKI, Committee for the Preparation of Indonesian Independence) to adjust key aspects of the republic's draft constitution, notably its preamble. The changes enjoined by Hatta on members of the Preparation Committee, charged with finalizing and promulgating the constitution, were made quickly and with little dispute. Their effect, however, particularly the removal of seven words stipulating that all Muslims should observe Islamic law, was significantly to reduce the proposed formal role of Islam in Indonesian political and social life. Episodically thereafter, the actions of the PPKI that day came to be castigated by some Muslims as catastrophic for Islam in Indonesia—indeed, as an act of treason* 1—and efforts were put in train to restore the seven words to the constitution.2 In retracing the history of the drafting of the Jakarta Charter in June 1945, * This research was supported under the Australian Research Council's Discovery Projects funding scheme. PEMBANGUNAN KEMARITIMAN DAN PESISIR Studi Kasus: Analisis Kebijakan Jembatan Selat Sunda Peraturan Presiden Nomor 86 Tahun 2011 Oleh : Alim Bathoro1 Abstract The process of development are two sides of the same coin, one side is the physical development and the other side is human development. However, in the development process, usually prefer the physical development, and less attention to human development. Therefore, people as objects, not subjects of development. The political authorities see development only in terms of economic benefits, the development of socio-political side ignored. Therefore, the development has a problem. Maritime development in the coastal areas and archipelago are also experiencing the same dilemma. In order to obtain an understanding of maritime development, this study will analyze the policy of the Sunda Strait bridge. Therefore, this study will analyze, who benefited from the Sunda Strait Bridge project, and who was defeated in the Sunda Strait Bridge project. If we read Peraturan Presiden (Perpres) No 86 Tahun 2011 related to the Sunda Strait Bridge, the actors had been found, they are government officials (local and central) and national enterprises. This research found that conflicts of interest between the central and local elite, has resulted in making the Sunda Strait bridge construction was delayed several times. Clearly, national enterprises seems to be the main actor in the local policy, both in Lampung and Banten. That is in local policies, local governments easily become part of the national enterprises interests.
