The following meeting was held pursuant to the Governor’s Executive Orders N-08-21 and fully teleconferenced from various locations during the coronavirus disease (COVID-19) pandemic.

CALL TO ORDER

Chair Frost called the meeting to order at 5:02 p.m.

ITEM 1.B. STAFF UPDATES

Public Works Director DuBoux stated staff helped coordinate a site visit with Caltrans, Commissioner Gibbs, and Chair Frost to discuss project plans for the Malibu Public Safety Commission Regular Meeting Minutes of August 4, 2021 Page 2 of 6 ______

Pacific Coast Highway (PCH) intersections at Las Flores Canyon Road and Rambla Pacifico. He stated signal modifications would be submitted to the Caltrans design team. He discussed several meetings with Caltrans about PCH median replacement project from Webb Way to Puerco Canyon and the signal at Trancas Canyon Road. He stated the projects would go out to bid in the fall or winter.

Fire Safety Liaison Brossard discussed homeless encampment fires by Malibu Lagoon and in Las Tunas Canyon. He discussed critical fire weather and heat advisories expected in in the coming week, including in the Santa Monica Mountains. He stated fuel moisture levels were at 62 percent. He stated the Request for Qualifications/Proposals for the hazard tree removal program vendor would close this Friday. He announced Fire Safety Liaison Gabe Etcheverry started yesterday and would be working two days per week.

ITEM 1.C. COMMISSIONER COMMENTS

Commissioner Spiegel stated it was great to see Fire Safety Liaison Brossard working around town and in remote areas. He stated brush clearance on all City- owned properties was controlled by the Parks and Recreation Commission. He stated City properties in Trancas Canyon were overgrown and a fire hazard. He stated the Parks and Recreation Commission was hesitant to do clearance. He suggested weed abatement on City-owned properties be assigned to the Public Safety Commission. He stated he was excited to hear how the new Sheriff cars were doing. In response to Commissioner Spiegel, Executive Assistant Linden confirmed LexisNexis was approved by the City Council. She stated she would request that Public Safety Manager Dueñas provide him a status update.

In response to Commissioner Gibbs, Commissioner Spiegel described the properties in Trancas Canyon owned by the City. Commissioner Gibbs discussed different methods used to maintain the properties.

Commissioner Anneet commended Public Safety Specialist Kaplan for her work on the Public Safety Expo. She discussed emails from residents expressing concern about safety on Kanan Dume Road. In response to Commissioner Anneet, Public Works Director DuBoux stated an item could be brought back to discuss options to improve safety on Kanan Dume Road.

Commissioner Gibbs stated he and Chair Frost met with Caltrans and Public Works Superintendent Aladjadjian at the Las Flores and Rambla Pacifico project location. He thanked Public Works Director DuBoux and Public Works Superintendent Aladjadjian for coordinating the meeting. He stated the Commissioners’ biggest concern was with Caltrans’ plan to remove the left turn lane into the gas station. He stated people would continue to make the turn out of habit. He suggested the Commission send a letter to the City Council and Caltrans to express its Malibu Public Safety Commission Regular Meeting Minutes of August 4, 2021 Page 3 of 6 ______

disagreement with that proposal. Executive Assistant Linden stated an item would be added to the next agenda. Commissioner Gibbs stated he attended Malibu West Fire Brigade and Corral Canyon Fire Safety Alliance meetings.

Vice Chair Stewart asked for an update on the flock cameras and evacuation zone signs. He stated there needed to be more visibility on fire brigades. He thanked Commissioner Gibbs, Ex Officio Member Woodworth, Public Safety Manager Dueñas, Hans Laetz of KBUU, and Richard Garvey of CERT for meeting with the Indoor Emergency Warning System Ad Hoc Committee.

Chair Frost discussed the meeting he and Commissioner Gibbs had with Caltrans. He commended Commissioner Gibbs for the input he provided. He stated Caltrans expressed interest in redoing the crosswalk near Colony Liquor. Public Works Director DuBoux stated he would request Caltrans make a presentation to the Commission about its plans for that crosswalk. Chair Frost stated Abdi Saghafi, Caltrans, indicated there was no current discussion about a crosswalk near Malibu Seafood.

Commissioner Gibbs stated Mr. Saghafi told him they were considering underpass work in coordination with the Army Corps of Engineers.

Chair Frost stated something needed to be done about vehicles speeding down the hill and past the entry/exit from the Ralphs shopping center onto PCH. He stated Mark Russo advised him Volunteers on Patrol (VOP) were often first on scene at encampment fires. Chair Frost stated he suggested VOPs receive firefighting training He agreed with Commissioner Anneet about problems on Kanan Dume Road. He suggested working with the County to reduce speed limits on Kanan.

Ex Officio Member Woodworth discussed his observations on PCH at Las Flores Canyon Road and Rambla Pacifico. He agreed with Chair Frost that people would likely still make the turn into the gas station. He stated it was 1.3 miles before there was a signal to make a legal U-turn. He agreed with Commissioner Gibbs that the Commission should take a position on what it believes is the correct mitigation. He discussed vegetation management issues leading to fire danger. He stated fires less than five acres were being quickly managed by the Fire Department but would be uncontrollable in Santa Ana wind conditions. He commended everyone who attended the fire brigade training in Corral Canyon. He thanked Vice Chair Stewart for his work on the indoor warning systems.

ITEM 1.A. PUBLIC COMMENTS

Meril May stated he contacted Los Angeles County Supervisor Sheila Kuehl’s office regarding brush clearance, striping and signage for Kanan Dume Road. He stated the City and Caltrans were doing a good job with brush clearance on highways. He asked who was responsible for brush clearance around fire hydrants. He discussed his previous work to make improvements on PCH at Las Flores Canyon Road and Rambla Pacifico. He stated he sent signage suggestions to Caltrans and the PCH Task Force. He suggested additional signs be added by the arrester bed on Kanan Dume Road.

ITEM 4 NEW BUSINESS

A. 2021 Public Safety Expo Recommended Action: Receive and file a report regarding plans for the 2021 Public Safety Expo and provide feedback to staff.

Public Safety Specialist Kaplan presented the report. She announced the event was scheduled for Saturday, October 2, 2021, from 10:00 a.m. to 1:00 p.m. She acknowledged Commissioner Anneet and the CERT team for their assistance.

Chair Frost thanked Public Safety Specialist Kaplan and Commissioner Anneet for their work on the Expo.

B. Community Wildfire Protection Plan (CWPP) Recommended Action: 1) Receive and file a report on the final Malibu Community Wildfire Protection Plan (CWPP); and 2) Provide a recommendation to the City Council to adopt the CWPP. Fire Safety Liaison Brossard presented the report.

Commissioner Gibbs asked what the CWPP brought to the City that it did not already know. Fire Safety Liaison Brossard stated the CWPP was a plan with actions identified by the consultant that should be addressed. He stated an adopted CWPP would improve the City’s chances to receive funding for projects.

Commissioner Gibbs stated it seemed like the City already knew or had experienced most of what was in the CWPP.

Fire Safety Liaison Brossard stated the CWPP included valuable information about vegetation management and approximately 15 other items he was actively implementing or working on.

Ex Officio Member Woodworth stated it had been requested to include in the CWPP a response to the after-event report from the Woolsey Fire. He suggested staff compare the CWPP with the Roadmap to Resiliency action items.

Fire Safety Liaison Brossard stated the CWPP was a living document. He stated amendments to the CWPP could be added in the future.

In response to Vice Chair Stewart, Fire Safety Liaison Brossard stated the City could move forward on some of the recommendations. He stated the projects could be reviewed annually to see which could be funded. He stated the CWPP helped prioritize projects to be targeted.

Vice Chair Stewart requested an item be brought back about what recommendations would be acted on first and what was needed to accomplish them.

Commissioner Spiegel discussed the community’s reluctance to evacuate in a fire. He discussed a lack of local knowledge in the responding fire departments. He suggested a brigade czar be appointed to communicate with all the brigades and the fire department. He stated the CWPP did not incorporate the brigades as resources.

Ex Officio Member Woodworth discussed proposals in the Roadmap to Resiliency. He stated the seven community brigades were a potential pilot program. He discussed what the brigades would do in a major fire. He thanked Commissioner Spiegel for recognizing the importance of addressing the brigades. He stated he would not expect the brigades to be in the CWPP at this point.

Fire Safety Liaison Brossard stated the CWPP included working with the County on the viability of neighborhood fire brigades. He stated several approvals were still needed from many agencies. Malibu Public Safety Commission Regular Meeting Minutes of August 4, 2021 Page 6 of 6 ______

In response to Commissioner Spiegel, Chair Frost discussed the addendum process.

Ex Officio Member Woodworth stated the ability to modify the CWPP over time should allow for adding more information about brigades. Fire Safety Liaison Brossard stated the CWPP focused on pre-fire and not what was done after a fire ignited.

Vice Chair Stewart stated the CWPP should be tracked regularly. Chair Frost stated progress could be provided in staff updates.

MOTION Chair Frost moved and Vice Chair Stewart seconded a motion to provide a recommendation to the City Council to adopt the CWPP. The question was called, and the motion carried unanimously.

C. Public Safety Agency Activity Recommended Action: Discuss recent Public Safety Agency activities and receive and file activity reports from the County of Los Angeles Sheriff’s Department, Fire Department and Lifeguard Division.

CONSENSUS By consensus, the Commission agreed to receive and file activity reports from the County of Los Angeles Sheriff’s Department, Fire Department and Lifeguard Division.

MOTION Commissioner Gibbs moved and Chair Frost seconded a motion to adjourn the meeting.

FRIENDLY AMENDMENT Chair Frost requested the meeting be adjourned in memory of firefighters lost in the recent months. The amendment was accepted by the Maker.

DISCUSSION: At its Regular meeting on July 7, 2020, the Public Safety Commission received a report from the City’s consultant, Mission Critical Partners, regarding options for an emergency warning system that would notify residents in their homes of an impending disaster situation.

The consultant’s report described five system options:

• Tone Alert Radios • Frequency Modulation (FM) Alerting • Integrated Public Alert and Warning System (IPAWS) • National Oceanic and Atmospheric Administration (NOAA) Weather Radios using Specific Area Message Encoding (SAME) • National Weather Radio (NWR) Transmission Interrupt

The Commission formed an Indoor Emergency Warning System Ad Hoc Committee (Committee) of Vice Chair Stewart and Commissioner Gibbs to work with City staff and members of the public to analyze the options presented.

On July 26, 2021, the Committee held a meeting also attended by Ex Officio Member Woodworth, Public Safety Manager Dueńas, Richard Garvey, communications coordinator for the Malibu Community Emergency Response Team (CERT), and Hans Laetz, General Manager of KBUU-FM Malibu. A summary of that meeting, including potential recommendations and possible near- and long-term future projects is attached.

The Commission may provide a recommendation to the City Council concerning a system to notify residents in their homes of an impending disaster situation or suggest that the Council take no further action at this time.

Meeting Report (Final) Ad Hoc Committee of the Public Safety Commission (“PSC”) to review Indoor Alerting Options based upon the Mission Critical Partners Report of June 2021 as authorized by the Commission at its July 7, 2021, meeting. The Ad Hoc meeting was held at City Hall, July 26, 2021.

MEETING ATTENDEES: Richard Garvey – CERT, Han Laetz – KBUU, Brent Woodworth -Ex Officio Member of Public Safety Commission, Keegan Gibbs and Doug Stewart – Public Safety Commission Members, and Susan Duenas – Malibu Public Safety.

MEETING OBJECTIVE: The Mission Critical Partners Report presented five options for providing an indoor warning system in Malibu. These five options are all radio-based and are, Tone Alert Radio (TAR), FM Alerting using the Radio Broadcast Data Systems (RBDS), Integrated Public Alert and Warning System (IPAWS), and two versions both using the NOAA Weather Radio system one with Specific Area Message Encoding (SAME) and the other Transmission Interrupt. The Committee’s charge is to evaluate these options to develop a response that can be reviewed by the PSC for submission to the City Council. This evaluation is to include how these options might fit within the existing notification systems such as Reverse 9-1-1, text messages, and social media as well as the possible outdoor sirens. Please refer to the Mission Critical Report which was included in the July 7, PSC meeting agenda for more detail on these options.

SUMMARY OF MEETING FINDINGS: The Committee determined that all the five options in the Mission Critical Report had drawbacks and by themselves were not a stand-alone solution to provide the sought after capability to Alert and Advise the public indoors. The ideal solution would be low cost, operate regardless of public utility status, broadly cover all of Malibu, and could be operated by the Malibu Emergency Operations Center (“EOC”) staff without dealing with external constraints. Of the five options, the three utilizing IPAWS and the NOAA platforms are deemed not capable now or even in the near term to reasonably meet these requirements. The remaining two options of Tone Alert Radio and FM Alerting do have merit worthy of future consideration. For the Tone Alert Radio (TAR), the Committee was mainly concerned about the limited availability of the end-user units and the current cost per unit. Each receiver is currently $300 to $450 for example. Furthermore, the operation and maintenance would be the City’s responsibility. There may be an opportunity to better price the end receivers if a source other than high end commercial equipment such as Motorola is used. Presently, there is not such a supplier known to the Committee. For future evaluation, the CERT/City repeater should be investigated as to its possible use as a base station for such a system provided lower cost

receivers would be available. For these reasons, the Tone Alert option was determined to be a second-tier option. The FM Alert option has many desirable features, but its actual deployment and use is still in a formative stage. Willing to participate FM radio stations, end-user receivers, and the actual management of the system by a city such as Malibu are all yet to be finalized. This system has the potential to be our first-tier option when these issues are resolved. For the time being, deployment is most likely to occur with the eventual rollout of the “Shake Alert” notifications (similar to Japan and Mexico) which will utilize the FM Alert platform. It was determined that while the FM Alert is a future solution, improving radio coverage and operations now would be a substantial upgrade to our existing situation. These improvements would be essential to operate an FM Alert system when it becomes available. The ability to deliver the emergency Alert and/or Advisories by whatever radio, siren or other notification system is 100% dependent upon the City’s ability to operate the system in an emergency. This would require the ability and people to deliver the notifications, updates, and advisories quickly and accurately. Such a foundational underpinning could be enhanced even with the existing small staff..

SUMMARY OF RECOMMENDATIONS: Rather than recommend the deployment of one of the five options identified by the Mission Critical Report, the Committee is suggesting that the City implement improvements to what was referred to as the Malibu Emergency Alert Notification System (MEANS) in a phased approach. This would limit the acquisition of unproven or high cost technologies in favor of foundational structures that can be built upon when these better delivery systems become firmly available. In the meantime, the City will have the best capabilities that are available as well as being confidently operational.

POSSIBLE IMPROVEMENT PROJECTS: NEAR TERM - (next 12 months) 1. Enhance FM Radio coverage in Malibu by upgrading the transmitter(s) or boosters for KBUU. Also, evaluate if it is possible to have non-commercial and commercial FM stations that have strong coverage in Malibu to allow for emergency broadcasting in association with KBUU in the event of a Malibu emergency. (Cost estimate of $50,000 or less.) 2. Investigate the possibility of utilizing the City’s existing but dormant AM transmitter(s) and licenses from the late ’90s for updating to current equipment and emergency broadcast authority. i.e., the ability to temporarily boost emergency output power to 100 watts vs. 10 watts during standard conditions and/or obtain a better operating frequency. While this is not part of the Mission Critical Study, this is a system that the City has spent considerable money on and if workable would be a second tier advisory

option vs the first tier option of FM. The Malibu CERT Communications team has offered to see if this AM system can be utilized going forward. However, there are many constraints today that were not present two decades ago. Among these are now more powerful AM commercial stations with nearby frequencies that may interfere with the Malibu signal, the lack of AM radios in electric vehicles due to in-car interference, the impact of more household electronics that produce AM radio interference, and the inherently limited coverage of the current low power AM. There also may be improvements to equipment and FCC attitudes that may offer benefits as well. Any proposal to revive and upgrade would be separate from the FM improvements cited above. (Cost estimate of $10,000 to $20,000 or less but cost estimates will require additional study.) 3. Evaluate the use of the CERT/City UHF repeater and license to operate a Tone Alert Radio system, provided the end-user receivers can be cost justified. (Cost estimate is minimal.) 4. Contact the one vendor for the FM Alert system (Page 7 of the Mission Critical Report) to begin the FM Alert process as it develops and to incorporate the FM radio platforms of item 1 into the alert network for eventual Malibu coverage. (Cost estimate is minimal.)

5. Incorporate the action of referring people to KBUU for more information into the annual test of the City’s disaster notification system and publicize to the community. (Cost is staff time only)

MID-TERM-(Years 2 to 4) 1. Support the FCC rulemaking known as Simple 250 for a second class of low power FM stations for up to 250 watts. This would be a significant upgrade for KBUU and the other non-commercial stations providing the foundation for the future FM Alert. (Page 7 of Mission Critical Report) 2. Implement the Tone Alert and/or FM Alert system as possible and feasible utilizing the FM, AM, UHF capabilities developed in the near term. This may involve the residents buying and installing their own personal low cost receivers as envisioned in the Shake Alert program. 3. Enhance the City’s EOC capabilities to match the expanded notification systems.

RECOMMENDED ACTION: Receive and file a report regarding National Preparedness Month activities in Malibu.

DISCUSSION: September is National Preparedness Month, and the Public Safety Office is hosting numerous events to encourage the public to get prepared. Due to the COVID-19 pandemic, all training, seminars, and briefings will be held online through a virtual meeting platform. All residents will be able to RSVP for any event on www.MalibuSafety.Eventbrite.com.

The City will host the following presentations, seminars, and classes:

PSPS Training for Seniors and Older Adults

The City will provide a free training for seniors 55 years and older and at-risk adults about how to prepare for and respond to Public Safety Power Shutoffs (PSPS). A free back-up battery will be given to participants who complete the training and a quiz, and provide a copy of their photo ID (limit one per household, while supplies last). The training will be offered three times: Thursday, September 2, at 2:00 p.m.; Monday, September 13, at 6:30 p.m.; and Thursday, September 16, at 10:00 a.m.

Test of Disaster Notification System The City will send a Citywide test message using the City’s Everbridge Disaster Notification system on Tuesday, September 7, at 4:00 p.m. Residents do not have to register to participate or take any special action prior to the system test.

Home Wildfire Hardening Seminar The Fire Safety Liaison will provide information to residents about the dangers of flying embers that can rain down on a home and property during a wildfire, a leading cause of home ignition during wildfires. If these embers land in receptive fuels or become lodged in something easily ignited on or near a house, the home may be in jeopardy of burning. There are often simple and inexpensive ways to harden a home against flying embers, and taking action ahead of time can substantially reduce the ember threat. The seminar will be offered two times: Thursday, September 9, at 10:30 a.m., and Thursday, September 23, at 3:30 p.m.

Spanish Language Emergency Preparedness Training The City is partnering with the Malibu Foundation and the Malibu Labor Exchange to provide free Spanish language emergency preparedness training on Saturday, September 11, from 9:00 a.m. to 12:00 p.m. at the Malibu Labor Exchange parking lot. Ensuring that non-English speaking people who live or work in Malibu have access to the City’s emergency information and emergency preparedness efforts is an important part of the City’s whole-community approach to emergency planning, and is required under California law. Trainings will include emergency alerting systems, fire extinguisher use, assembling an emergency go-kit, bleeding control, and heat illnesses. Attendees will receive a free emergency hand-cranked radio and a first aid kit.

Firescaping Workshop The City is partnering with Los Angeles County Waterworks District 29 and West Basin Municipal Water District to host a free, virtual firescaping workshop on Wednesday, September 15, at 6:00 p.m. Participants will learn landscaping and property maintenance best practices that can help protect their properties from wildfires and improve resilience while reducing water use and benefiting the environment. The workshop is specifically geared toward the Santa Monica Mountains.

Annual Community Fire Season Briefing All residents, employees, business and organization leaders, students and other Malibu community members are urged to attend the annual Community Fire Season Briefing being held virtually on Thursday, September 23, at 6:00 p.m. Los Angeles County Fire Department Assistant Fire Chief Drew Smith, a Fire Behavior Analyst, will provide a presentation on local live fuel moisture, expected weather patterns, and what that means for fire conditions in Malibu. The meeting can be viewed live or later on-demand, and questions can be submitted in advance or during the briefing. Meeting details will be posted on the City website in advance.

Public Safety Expo Preparedness Month ends with the City's annual Public Safety Expo on Saturday, October 2, from 10:00 a.m. to 1:00 p.m. At the Expo, participants can attend trainings, including Crisis First Aid, see presentations, ask questions, find volunteer opportunities, learn about emergency preparedness services and products, and more. Participating organizations include public safety and emergency response partner agencies, volunteer organizations, and emergency services and products vendors.

In addition to the community events, various City Emergency Operations Center (EOC) training classes and drills will be held each week for City staff.

The full schedule of activities, as well as each individual event, will be heavily promoted through all of the City’s usual media channels, including the website, City TV, social media, and Nextdoor. RECOMMENDED ACTION: Receive and file a report regarding the speed limits on Kanan Dume Road and provide feedback to staff.

DISCUSSION: At the August 4, 2021 Public Safety Commission meeting, the Commissioners requested an agenda item to discuss the speed limits on Kanan Dume Road. This staff report provides a brief discussion about Kanan Dume Road and how speed limits are set on public roads within the City.

Background Kanan Dume Road (County Highway N9) is an important regional collector road that connects Pacific Coast Highway (PCH/State Route 1) to U.S. Route 101 (US 101). It is identified on Metro's Countywide Significant Arterial Network and is also categorized as a Major Collector by Caltrans. It is one of the few regional roads that traverses the Santa Monica Mountains and connects the valley and coastal cities of Los Angeles County. Kanan Dume Road runs north and south and is approximately 12 miles between PCH and US 101. However, the segment within Malibu city limits is approximately 1.4 miles from PCH before transitioning to the unincorporated portion of Los Angeles County.

The City of Malibu and County of Los Angeles prohibit vehicles over 8,000 pounds or more than two axles, except for local deliveries. Kanan Dume Road is enforced by the California Highway Patrol (CHP) and the Los Angeles County Sheriff's Department (LASD).

In 2014, the City completed construction of the Kanan Dume Road Arrester Bed Improvement Project. The project consisted of removal and replacement of the existing

Page 1 of 3 Agenda Item # 4.B. gravel arrester bed, and the addition of new sub-drains, concrete curb and driveway, asphalt paving, crash cushions, and new signing and striping. This project significantly reduced the possibility of runaway trucks entering the intersection at PCH. It also addressed the inefficient right and left turn lanes and helped increase the capacity of the intersection, minimizing delays along PCH and increasing regional mobility.

Future improvements expected for Kanan Dume Road include widening the northbound lane adjacent to the arrester bed and providing a dedicated pedestrian pathway and bike lane, as feasible, within the existing available public right-of-way.

Speed Limits The Kanan Dume Road speed limit is currently posted with 50 miles per hour (mph) within the City limits, changing to 55 mph when entering the unincorporated portion of Los Angeles County. In the northbound direction, a speed limit sign is posted approximately 1,000 feet north of PCH indicating the 50 mph posted speed. In the southbound direction, a 50 mph speed limit sign is posted approximately 200 feet north of Cavalleri Road.

Speed limits within the city limits on Kanan Road were established based upon a 2016 Engineering and Traffic Survey (E&TS), more commonly referred to as a speed survey. The 2016 E&TS was adopted by the City Council on June 27, 2016. E&TS for speed limits are conducted once every five years, with certain exceptions, by governing municipalities in order to comply with Section 40802(a) of the California Vehicle Code (CVC) and the national Uniform Vehicle Code. The City is currently in the process of performing a new E&TS.

Speed limits are established based upon the following factors: • Speed zoning regulations • Recent three-year collision records • Radar speed survey results for prevailing speeds • Highway, traffic and roadside conditions not readily apparent to the driver

Speed zones are primarily established to protect the public from the unreasonable behavior of reckless, unreliable, or otherwise dangerous drivers. Speed limits are generally established at or near the 85th percentile speed, which is defined as the speed at or below which 85 percent of traffic is moving. Speed limits established on this basis conform to the consensus of those who drive on the roadways as to what speed is reasonable and safe, and are not dependent on the judgment of one or a few individuals.

The E&TS, as defined in Section 627 of the CVC, must consider the prevailing speeds, collision records, pedestrian and bicycle activity, and roadway traffic and roadside conditions not readily apparent to the driver. Speed zones are also established to advise motorists of road conditions or hazards, which may not be readily apparent to a reasonable

For this reason, a field review of related road/traffic variables is conducted, which is considered in combination with the statistical data and collision history of a particular roadway segment to determine a safe and reasonable speed limit. The specific procedures used in the performance of an E&TS are outlined in the California Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD).

Speed data on Kanan Dume Road was collected using manual radar surveys that were performed during “off-peak” hours on a weekday (Monday through Friday). The radar speed checks were made from an inconspicuously parked, unmarked vehicle. An effort was made to ensure that the presence of the vehicle in no way affected the speed of the traffic being surveyed. Field information from these speed surveys and other roadway characteristics were recorded on field data forms and later coded into spreadsheet-based software for analysis purposes.

The data for Kanan Dume Road showed an 85th percentile speed of 49 mph. The calculated collision rate was 0.40 per million vehicle miles compared to an expected collision rate for a similar type of roadway of 1.06 per million vehicle miles based on the 2009 Collision Data on California State Highways. On-street parking is available and there was minimal pedestrian activity. Road curvature (vertical and horizontal) exists along portions of Kanan Dume Road but does not result in restricted sight distance/visibility. Pursuant to the California MUTCD and the CVC, the speed limit should be established at the first five-mile nearest to the 85th Percentile and, therefore, a speed limit of 50 mph was established for Kanan Dume Road.

During Fiscal Year 2021-2022, staff will perform a new E&TS on various streets within the City, including Kanan Dume Road. This new E&TS may result in modifications to the current speed limits.

RECOMMENDED ACTION: Provide a recommendation to the City Council to authorize a letter to be sent to Caltrans opposing its plans to remove the left turn lane from westbound Pacific Coast Highway (PCH) at Rambla Pacifico into the gas station as part of its Pacific Coast Highway at Las Flores Canyon Road/Rambla Pacifico Street Safety Improvement Project.

DISCUSSION: At its Regular meeting on June 2, 2021, the Public Safety Commission received a presentation from Caltrans regarding its Pacific Coast Highway at Las Flores Canyon Road/Rambla Pacifico Street Safety Improvement Project. Caltrans representatives described a feature of the project that proposed to remove the left turn lane from westbound PCH into the gas station in order to allow for the eastbound left turn lane at PCH and Rambla Pacifico to be lengthened. During the discussion, several Commissioners expressed concern that motorists would make illegal turns to get to the gas station.

At the request of Commissioner Gibbs, Public Works staff, Commissioner Gibbs, and Chair Frost met with Caltrans representatives at the location on June 8, 2021 to discuss their concerns and potential alternatives for removal of the turn lane.

As requested at its Regular meeting on August 4, 2021, the Commission may provide a recommendation to the City Council authorizing a letter to be sent to Caltrans opposing

II. NOTEWORTHY INCIDENTS

A Malibu transient was arrested for robbery in the 23300 block of Pacific Coast Highway. The suspect had stolen some items from the victim, who is also a transient. The victim went to the location (camp) looking for the suspect to get his items back. The suspect was not at the location and the victim was able to recover some of his stolen items. The suspect arrived and chased the victim with a stick. He then punched the victim and took the items from the victim. (21-04253)

A resident of Inglewood was arrested for a residential burglary which occurred in the 20700 block of Las Flores Canyon. The suspect entered the location via an unlocked rear sliding glass door. The victim was in her bedroom when her bedroom door opened and began to yell. The victim recognized the voice of the suspect as her gardener when the suspect said sorry and left the location via the front door. The victim then heard a noise coming from the backyard. She saw the suspect near the storage container holding the victim’s stolen property and left the location. The padlock was missing from the storage container. (21-04430)

A Los Angeles resident was arrested for possession of a stolen vehicle, burglary tools and narcotic paraphernalia in the 23000 block of Pacific Coast Highway. Deputies made contact with the suspect during a traffic violation investigation. The vehicle showed registration that had expired in November 2020. During the investigation, the license plate on the vehicle driven by the suspect did not match the VIN to the vehicle. Numerous burglary tools were found, such as, a slim jim, walkie talkies, binoculars, multiple sets of vehicle keys/fobs and gloves. Additionally a vehicle, 2019 Toyota Tacoma truck, was stolen from the area during the same date and time. It was later recovered by the Long Beach Police Department who arrested one of their resident’s in the vehicle. (21-03918)

An arson occurred in the 3800 block of Cross Creek. Suspect(s) unknown set a brush fire at the location. The investigation is on-going. (21-04116)

Five incidents of vehicle burglary occurred this month while the victims were surfing. The incidents occurred in the 23000, 30000 and 33800 blocks of Pacific Coast Highway. The victims hid their vehicle key near or on the vehicle and went surfing. When they returned, the vehicle key was missing and property was stolen from inside their vehicle. Stolen property consisted of vehicle keys/fobs, cell phones, wallets and credit/debit cards. Some of the victims credit cards were used by unknown suspects at Bloomingdale’s and the Apple Store in , Ralph’s Market and Chevron Gas in Malibu and Best Buy in Canoga Park. We also address the specific concerns relating to the minor’s behavior. We educate the minor and their parents of possible criminal behavior and the legal consequences. We offer suggestions and make recommendations to improve the minor’s quality of life.

2. Spoke with numerous citizens and parents who called to question various juvenile concerns and issues in the community. We also provide the parents with various juvenile resource programs within our community.

3. We met with the Sylmar Juvenile Court District Attorney regarding the investigation and filing of criminal charges against juvenile offenders.

4. Met with Captain Salvador Becerra throughout the month in order to keep him up to date regarding our unit’s investigations and current juvenile issues within our city.

5. Entered juveniles into the Juvenile Automated Index system for various violations.

6. Made court appearances to testify as witnesses on the part of the People of the State of California and attended court proceedings in cases generated from the City of Malibu. We also investigated, prepared, and filed cases with the District Attorney’s office. We additionally assisted other investigators in the preparation of cases for court.

7. We met with station narcotic detectives on a regular basis to exchange information regarding juvenile and drug related issues. We have worked with the narcotic detectives on several narcotic cases directly and indirectly involving juveniles.

8. Handled the processing and follow-up of various juvenile referrals brought to the attention of this unit (i.e., Juvenile Information Forms, Field Interview Cards, Juvenile Automated Index, and citations for various juvenile contacts with uniform personnel).

9. Conducted our normal checks of juvenile problem areas in the city during weekend evenings and responded to juvenile related calls for service. 10. Updated the Gang Book and briefed the captain on criminal activity trends.

11. Registered 4 sexual predators and updated information in database.

• Provided a courtesy transport across PCH for an adult with disabilities who has severe anxiety crossing the street.

• Assisted Malibu Units regarding a traffic collision on PCH/Paradise Cove. Party 1 of the collision was arrested for driving under the influence.

• Assisted Malibu Unis regarding a call for a possible domestic violence. Located the suspect’s vehicle and detained him pending an investigation. Suspect was arrested for driving under the influence.

• Assisted Malibu Units with multiple calls for service regarding illegal fireworks.

• Handled a call for service in Malibu regarding a bonfire on Escondido beach. Contacted the individuals who were cooperative and put out the fire immediately. Counseled the individuals on Malibu’s devastating wildfire history and community’s concern.

• Handled a call for service in Malibu regarding loud music off of Birdview Drive. Homeowner was cooperative and stated they would turn the music off.

• Handled a call for service in Malibu regarding multiple juveniles loitering outside of the location. Contacted the juveniles who stated they were just waiting for their ride home. No crime at location.

• Assisted Malibu units with a call for service regarding a possible DUI driver.

Arrests / Citations:

• Conducted a traffic stop for expired registration and false tabs on a vehicle. Driver stated he just purchased the vehicle and was unaware of the false tabs. Warned and advised regarding the registration and removed the false tabs.

• Arrested local transient for possession of methamphetamine.

• Towed a vehicle from Pacific Coast Highway/Coastline due to expired registration in excess of 6 months. Owner has been warned multiple times and has failed to register vehicle.

• Arrested suspect for an outstanding felony grand theft vehicle warrant.

• Arrested suspect for an outstanding failure to appear misdemeanor warrant for driving without a license.

• Arrested suspect for driving without a license.

• Issued multiple parking citations for various violations.

• Conducted a foot patrol check of Malibu Lagoon. Checked the various encampments regarding accumulation of trash and property.

• Conducted a foot patrol of Malibu Lagoon under the bridge. Surveyed the area due to a brush/encampment fire.

• Contacted a local transient in the Ralph’s parking lot regarding the accumulation of trash outside of his vehicle, which appeared to be broken down. The subject returned with an active probation status. A search of his vehicle was conducted and drug paraphernalia was recovered. The subject was warned and advised.

• Contacted local transient laying on the side of the road on PCH/Topanga Canyon. Transient stated he did not want to move and was going to sleep on the shoulder (south side of PCH).

• Conducted a foot patrol check of PCH/Topanga “old rodeo grounds”. No crime at location.

• Conducted multiple foot patrol checks to contact the new and established transients, assess the increase in homeless encampments, accumulation of trash, and over-sized vehicles/trailers/buses in the following areas:

• Assisted Malibu Units with a call regarding a transient who locked himself in the CVS bathroom on Malibu Road. Individual left the location prior to our arrival.

• Assisted Lost Hills Station unit regarding a use of force involving a Malibu transient.

• Assisted Malibu Units with a call regarding a female who was under the influence and no longer wanted at the location. The female was refusing to leave and becoming aggressive. The female’s mother arrived on scene and provided a ride home for her daughter.

• Assisted Malibu Units with a call regarding a person who was under the influence of alcohol and narcotics. We located the individual, who was transported to the hospital for further evaluation.

• Assisted Malibu Units with a call regarding a possible attempt suicide.

• Assisted Malibu Units with a call regarding a transient who was becoming aggressive with customers at “Duke’s”. Manager advised individual he is not welcome at the location. Disturbing party was gone prior to our arrival.

• Issued a citation for smoking marijuana in public (Topanga State Beach).

• Arrested a local transient for multiple outstanding misdemeanor warrants.

• Contacted transient sitting on bench across from Legacy Park. Subject ok, just taking a break from walking. Subject refused medical treatment and services. • Assists / Calls for Service:

• Assist Malibu units with an assault with a deadly weapon call in the Malibu Mart shopping center. Transient suspect arrested.

• Assisted Malibu units regarding a burglary to a vehicle. Individual was detained, however, later determined to be the registered owner of the vehicle.

• Assisted Malibu units with a call regarding a vehicle parked for numerous at Surf rider beach. Registered owner was found deceased inside the vehicle.

• Assist Malibu units regarding a call for a missing elderly person. Person located and safe.

• Handled a call for service regarding possible transient fires in the brush area near Winter Canyon.

• Assisted Malibu units regarding a charter bus which was stopped in the number two lane on PCH/Zumirez. Vehicle stated he needed help turning around. Bus was able to move out of the roadway.

• Arrested local transient regarding an outstanding misdemeanor warrant for trespassing.

• Arrested local transients (2) for multiple outstanding felony and misdemeanor warrants. Additionally charged them with felony and misdemeanor possession of methamphetamine, and possession of drug paraphernalia.

• Arrested local transient for an outstanding felony and misdemeanor warrant, possession of methamphetamine, possession of a dirk/dagger, and possession of a Taser by a convicted felon.

• Contacted transient sleeping in Legacy Park on bench. Warn and advised regarding camping in the park. Arrested regarding numerous outstanding misdemeanor warrants.

• Contact transient regarding an outstanding felony warrant. Arrested him for the warrant. Additionally arrested him for possession of meth and possession of drug paraphernalia.

• Conducted a traffic stop for expired registration. Observed multiple open containers of marijuana. Cited the driver for expired registration and open container of marijuana. Cited the passenger for open container of marijuana as well.

• Conducted multiple traffic stops for several miscellaneous vehicle code violations and issued citations.

The suspect is an admitted drug addict and advised us he owns several firearms at his residence in MonteNido. We conducted a roll back to the suspect’s residence and additionally arrested the suspect for an addict in possession of (9) firearms including:

(1) AR-15 style rifle (2) 357 magnum with scope revolvers

(3) Shotguns (1) 9mm Glock semi- automatic (1) Bolt-action rifle handgun

(1) lever-action rifle

***The suspect additionally possessed a copious amount of ammunition to be utilized in each different caliber of weapon and possessed an armor plated tactical vest which was pre-arranged with two handguns and several loaded magazines***
