Your PLANNING AND LAND USE MANAGEMENT Committee reports as follows:

PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to proposed Development Agreement by and between the City of Los Angeles and Westfield U.S. Holdings, LLC and proposed amendments to the North Specific Plan for property at 10250 , 1801 Avenue of the Stars, and 1930 Century Park West (known as the New Century Plan Project).

Recommendations for Council action:

1. REQUEST City Attorney to prepare and present a final draft Ordinance authorizing the execution of a proposed Development Agreement by and between the City of Los Angeles and Westfield U.S. Holdings, LLC relating to real property in the Century City Community of the City of Los Angeles located at 10250 Santa Monica Boulevard, 1801 Avenue of the Stars, and 1930 Century Park West.

2. REQUEST City Attorney to prepare and present a final draft Ordinance proposing to amend the Century City North Specific Plan relating to real property in the Century City Community of the City of Los Angeles located at 10250 Santa Monica Boulevard, 1801 Avenue of the Stars, and 1930 Century Park West.

Fiscal Impact Statement: The City Planning Commission reports that there is no General Fund impact, as administrative costs are recovered through fees.

Community Impact Statement: None submitted.

Summary:

At its meeting held March 24, 2009, the Planning and Land Use Management (PLUM) Committee continued the following matters to May 5, 2009 in PLUM Committee and May 12, 2009 in Council:

• Appeals filed by Mike Eveloff (Beverly Palmer - Strumwasser & Woocher LLP, Representative), and Westwood South of Santa Monica Association and Beverlywood Homes Association (Barbara Broide, Representative), from the entire decision of the City Planning Commission in approving the following: (1) certification of an Final Environmental Impact Report (FEIR); (2) Project Permit Compliance with the Century City North Specific Plan; (3) Site Plan Review; (4) Conditional Use Permit of a full line of alcoholic beverages for on-site consumption in connection with restaurant uses; (5) Zoning Administrator’s Determination for shared parking; and (6) a report from the City Planning Commission and Ordinances relative to: (a) approval of a proposed amendment to the Century City North Specific Plan; and (b) authorizing the execution of a proposed Development Agreement between Westfield

-1- U.S. Holdings, LLC and the City of Los Angeles. The proposed project consist of a mixed-use development (also known as the New Century Plan Project) with approximately 358,881 square feet of net new shopping center space, a reduction in office uses from 360,964 square feet to 106,523 square feet, and approximately 262 multi-family residential units, for property at 10250 Santa Monica Boulevard, 1801 Avenue of the Stars, and 1930 Century Park West, subject to Conditions of Approval, as modified; and the related case.

• Appeals filed by Mike Eveloff (Beverly Palmer-Strumwasser & Woocher LLP, Representative), and Westwood South of Santa Monica Association and Beverlywood Homes Association (Barbara Broide, Representative), from the entire decision of the City Planning Commission in sustaining the Advisory Agency’s decision in approving: (1) certification of an Final Environmental Impact Report; and (2) Vesting Tentative Tract 65059 composed of 18 lots (3 master and 15 airspace lots) in the C2-2-O Zone for the development of a maximum of 262-unit residential condominium for property at 10250 Santa Monica Boulevard, 1801 Avenue of the Stars, and 1930 Century Park West, subject to Conditions of Approval. In the interim, the PLUM Committee requested the City Attorney to prepare the following for consideration at the May 5, 2009, PLUM Committee hearing:

• The City Attorney was requested to prepare and present a final draft Ordinance authorizing the execution of a proposed Development Agreement by and between the City of Los Angeles and Westfield U.S. Holdings, LLC relating to real property in the Century City Community of the City of Los Angeles located at 10250 Santa Monica Boulevard, 1801 Avenue of the Stars, and 1930 Century Park West.

• The City Attorney was requested to prepare and present a final draft Ordinance proposing to amend the Century City North Specific Plan relating to real property in the Century City Community of the City of Los Angeles located at 10250 Santa Monica Boulevard, 1801 Avenue of the Stars, and 1930 Century Park West.
