D., UNIVERSITY OF MASSACHUSETTS Directed by: Professor Robert Paul Wolff The thesis of my dissertation is that Kant’s theory of the social contract, which is the central concept of his political philosophy, provides, when suitably reconstructed, an adequate theoretical foundation for liberal democracy. I take liberal democracy to consist of three components: first, the rule of law; second, democratic self-rule (either representative, direct, or some combination of the two); and third, the recognition and institutional guarantee of the rights of individuals. In the dissertation, I take as my starting point Kant’s conception of autonomy. For Kant, the idea of the social contract explains how individual moral agents can maintain their autonomy in the context of community. The social contract resolves the conflict between moral autonomy and political authority by defining a model of civil society in which free, equal, and independent rational agents collectively legislate the public laws that are to govern their external relations, which are essentially property relations. While Kant's stature as a political theorist does not yet rival that of Hobbes or Rousseau in the English-speaking world, we are finally beginning to recognize his contributions to political philosophy. For far too long, commentators slighted Kant's politics in favor of his many other contributions to philosophy, and while this was understandable, it nonetheless did a great injustice to Kant's rich and sophisticated thinking on the moral foundations of politics. With the publication of several studies of Kant's political theory over the last two decades, this injustice has now been rectified.^ As yet, however, no commentator on Kant's political theory has focused on the all-important idea of the social contract and provided us with a comprehensive account of Kant's thought about this notion. Given the centrality of the concept of the social contract to Kant's theory (and those of Hobbes, Locke, and Rousseau), this is somewhat surprising. A clear and comprehensive account of Kant's thinking on this matter is essential to an understanding of his politics, and this is what I propose to provide in my dissertation. Kant's theory provides the most cogent and philosophically sophisticated version of classical social contract theory. I take liberal democracy to consist of three components: first, the rule of law; second, democratic self-rule (either representative, direct, or some combination of the two); and third, the recognition and institutional guarantee of individual rights. Thus, any defense of liberal democracy must provide some account and justification of the rule of law, democracy, and human rights. Of these three notions, I take it that the third is logically prior to the first and second. The task of law in a liberal democracy is to define and protect the rights of individuals within civil society. The most fundamental of these rights is the right to participate as a free and equal citizen in the collective decisions of that society. Thus, the concept of right is the basic concept of Kant's politics. Kant's political theory, however, is rooted in his ethics, and thus the concept of right is in turn grounded in the autonomy of the will, which Kant declares in the Grundlegung to be "the supreme principle of morality." Now the three components of liberal democracy appear to be incompatible in practice. For example, a majority may democratically enact a law that violates the rights of individuals within civil society. Kant's theory, however, provides a satisfactory resolution of this problem. According to Kant, an individual is autonomous when she obeys no laws except those she has given to herself, that is, when she is self- legislating. Obedience to external legislation is heteronomy. This poses a rather tricky issue in the justification of civil society. A law is essentially a command, and political authority is the right to issue those commands 2 and enforce thenn through the use of force. When one enters into civil society, one subjects oneself to some authority. But this submission to authority would appear to place us in a condition of heteronomy and be in conflict with our own autonomy. How can we reconcile the right to issue commands with the right to obey only those commands we have given to ourselves? The reconciliation of these two conflicting requirements is central to my project. If Kant's attempted reconciliation of these two conflicting demands fails, then he cannot justify the moral legitimacy of the rule of law and civil society itself; authority must give way to autonomy. For a utilitarian, the conflict between autonomy and authority never arises. The rule of law is justified by its consequences for the social balance of pleasure over pain (or whatever other standard a particular variant of utilitarianism may employ). The autonomy of the individual need not be considered, except insofar as it has consequences for that social balance. Though utilitarian theories may be capable of grounding the rule of law, they are incapable of providing an adequate foundation for democratic self-rule and the rights of individuals. Because utilitarian theories are teleological in nature, democratic self-rule and individual rights can be justified only in instrumental terms. That is, the rights of individuals and democratic self-rule are justified only if they promote the end specified by utilitarian theory. Let us consider the theory elaborated by John Stuart Mill in Utilitarianism as an example.2 The fundamental problem with Mill's 2- John Stuart Mill, Utilitarianism. (Indianapolis: Bobbs-Merrill, 1983). 3 theory in this regard is shared by all utilitarian theories, despite their variations. Therefore, a brief discussion of Mill will enable us to examine this difficulty with sufficient clarity and generality. In simplest terms. Mill maintains that one should act so as to produce the greatest amount of happiness in society at large.

All themes in the philosophy of chemistry can be classified in one of these three clusters or make contributions to general philosophy of science that, as yet , are not particularly different from similar contributions from other sci- ences (Section 3). I do not exclude the possibility of there being more than three clusters of philosophical issues unique to philosophy of chemistry, but I am not aware of any as yet. Moreover, highlighting the issues discussed in Sections 5-7 does not mean that issues reviewed in Section 3 are less im- portant in revising the philosophy of science.

    History and Theory, Virtual Issue 1 (August 2012) © Wesleyan University 2012 ISSN: 1468-2303 INTRODUCTION: THE NEW METAPHYSICS OF TIME ETHAN KLEINBERG Over the last several years, the editors of History and Theory have tracked a growing trend evident not only in the articles published in our pages but also in manuscripts submitted to the journal as well as articles published in other venues. In the broadest strokes, this trend can be described as a response to the perceived limitations of a discourse predicated on language, rhetoric, and the question of representation. Whether one subscribes to the idea that historians and theorists of history took a “linguistic turn” in the 1980s,1 an increasing number of articles and monographs have taken issue with the general influence of French “post- structuralism” or “postmodernism,” with constructivism, and specifically with the work of Hayden White. These works seek to address the perceived faults of an overemphasis on the issues of “language” and representation that has obscured or misdirected the goal of actually addressing the past by perpetually worrying over how we might go about that task. Combined with the growing interest in material culture, the ways of science, and the nature of the body, it is hard to doubt the return to the real. But what strikes us as most interesting about this trend is the way that some of these theorists have sought to move beyond the emphasis on language and representation not by returning to a crude variant of objectivism or empiricism but by re-examining our relationship to the past and the past’s very nature and by attempting to construct a new metaphysics of time.

Since the publication of John Rawls’ magnum opus A Theory of Justice in 1971, there has been a significant resurgence of philosophical work in the tradition of contractarianism. The distinguished bourgeois political philosopher Robert Nozick has argued that A Theory of Justice is one of the most important works in political philosophy since the writings of John Stuart Mill. “Political philosophers,” Nozick concludes, “now must either work within Rawls’ theory or explain why.”1 It is not far from the truth that Rawls single-handedly not only gave life to analytical political philosophy, but also resuscitated contractarianism, a philosophical tradition that — in many respects — had been lying dormant in a philosophical coma. In fact, social contract theory has become the hegemonic tradition in liberal social and political philosophy. Hunter (ABSTRACT) The following is a study of what may be the most puzzling and yet, at the same time, most significant aspect of Kant’s system: his theory of schemata. I will argue that Kant’s commentators have failed to make sense of this aspect of Kant’s philosophy. A host of questions have been left unanswered, and the doctrine remains a puzzle. While this study is not an attempt to construct a complete, satisfying account of the doctrine, it should be seen as a step somewhere on the road of doing so, leaving much work to be done. I will contend that one way that we may shed light on Kant’s doctrine of schemata is to reconsider the manner in which Kant employs schemata in his mathematics. His use of the schemata there may provide some inkling into the nature of transcendental schemata and, in doing so, provide some hints at how the transcendental schemata allow our representations of objects to be subsumed under the pure concepts of the understanding. In many ways, then, the aims of the study are modest: instead of a grand- scale interpretation of Kant's philosophy, a detailed textual analysis and interpretation are presented of his doctrine of schemata.

Social liberty is the fundamental social ethics of the modern world – it has been for the last two centuries. In particular, it is the basis of our Constitutions (as basic rights) and of our law. Therefore, it is surprising that its very numerous but always partial presentations were so wanting in rigor and scope. This applies to the theory of social liberty in the strict sense, but also to its natural extensions. As a result, this complete analysis concludes that the implication of social liberty as regards issues such that the scope of the public sector and the distribution of income and welfare are very different from what it is usually said they are. It shows what the actions of the public sector and the distribution should be from this basic principle. In these studies, “liberal” means “liberty-based” in the sense of based on the principle of full social liberty rationally understood and applied. One can thus derive, notably, the liberal distributive justice in general and the liberal social justice (at the macro level), the liberal public economics, the liberal public services, taxes, and State, and so on. In particular, the liberally just distribution results from the following facts. (1) The effects of free actions, exchanges, and agreements. (2) The distribution of the value of the given resources (including people’s capacities).

In his mind were gathered up the major interests of the Enlightenment: science, epistemology, and ethics; and all of these were given a new direction which he himself described as another Copernican revolution. As Copernicus had shown that the earth revolved around the sun, rather than the sun around the earth, so Kant showed that the knowing subject played an active and creative role in the production of his world picture, rather than the static and passive role which the early Enlightenment had assigned him.

Cheng I would like to argue that humans, and perhaps all species capable of flex- ibly adaptive goal-directed actions, are born with a conviction that they use for inferring cause-and-effect relations in the world.This conviction— that entities and events may have causal powers with respect to other enti- ties or events—provides a simple framework that enables reasoners to incrementally construct a picture of causal relations in a complex world. In the reasoner’s mind, causal powers are invariant properties of relations that allow the prediction of the consequences of actions regardless of the context in which the action occurs, with “context” being the background causes of an effect (those other than the candidate causes) that happen to occur in a situation. The reasoner’s goal is to infer these powers. The causal power scheme, however, is coherent only if the inferred powers can be tested in contexts other than the one in which they are inferred. When predictions based on simple causal powers fail, reasoners may be motivated to evaluate conjunctive causal power. All conventional statistical measures of independence, none of which is based on a causal power analysis, contradict measures of conjunctive causal power (Novick and Cheng 1999).
