Since the publication of John Rawls’ magnum opus A Theory of Justice in 1971, there has been a significant resurgence of philosophical work in the tradition of contractarianism. The distinguished bourgeois political philosopher Robert Nozick has argued that A Theory of Justice is one of the most important works in political philosophy since the writings of John Stuart Mill. “Political philosophers,” Nozick concludes, “now must either work within Rawls’ theory or explain why.”1 It is not far from the truth that Rawls single-handedly not only gave life to analytical political philosophy, but also resuscitated contractarianism, a philosophical tradition that — in many respects — had been lying dormant in a philosophical coma. In fact, social contract theory has become the hegemonic tradition in liberal social and political philosophy. It regards the author not as an heir or precursor to any given political tradition, but rather as a compelled syncretist whose primary philosophical concern was the moral significance of the democratic age. It suggests that Tocqueville devised his ‘new political science’ with a keen view to the existential implications of modernity. In order to support that suggestion, the essay explores the genealogy of Tocqueville’s moral and political thought and draws a relation between his analysis of democracy and his personal experience of modernity. Relatively few authors in the history of political thought have produced an intellectual legacy of such overarching resonance as Alexis de Tocqueville. Even fewer, perhaps, have so persistently eluded ordinary analytical and exegetical frameworks, presenting to each astute observer a face so nuanced as to preclude serious interpretive consensus. As writes Lakoff (Lakoff 1998), ‘disagreement over textual interpretation in the study of political thought is not uncommon’. However, ‘it usually arises around those who left writings of a patently divergent character’ (p. 437). When we thus consider the ‘extraordinarily coherent and consistent nature’ of Alexis de Tocqueville’s political philosophy, it appears somewhat odd that the academic consensus surrounding that author relates almost exclusively to the grandeur of his intellectual achievement (Lukacs 1959, 6). -

It often suffi ces to resolve minor collisions of interest, but beyond these it is not to be relied upon. A more precise and a less easily corrupted ritual is required to resolve the massive collisions which our manner of living is apt to generate and to release us from the massive frustrations in which we are apt to become locked. The custodian of this ritual is ‘the government’, and the rules it imposes are ‘the law’. One may imagine a government engaged in the activity of an arbiter in cases of collisions of interest but doing its business without the aid of laws, just as one may imagine a game without rules and an umpire who was appealed to in cases of dispute and who on each occasion merely used his judgment to devise ad hoc a way of releasing the disputants from their mutual frustration. -

History of American Democracy Course Syllabus Professor David Moss Fall 2015 HISTORY OF AMERICAN DEMOCRACY (USW 39, HBS 1139) Professor David Moss Harvard University, Fall 2015 Mondays and Wednesdays, 3:30-5:00 Location: HBS – Aldrich 207 Today we often hear that American democracy is broken—but what does a healthy democracy look like? How has American democratic governance functioned in the past, and how has it changed over time? This course approaches American history with these questions in mind. Based on the case method, each short reading will introduce students to a different critical episode in the development of American democracy, from the drafting of the Constitution to contemporary fights over same-sex marriage. The discussion-based classes will encourage students to challenge each other’s assumptions about democratic values and practices, and draw their own conclusions about what “democracy” means in America. This course is ideal for anyone interested in deepening his or her practical and historical understanding of the American political process, and for those interested in gaining experience with the case method of instruction frequently used in business and law schools. Note: This course, when taken for a letter grade, satisfies the General Education category of United States in the World, as well as the requirement that one of the eight General Education courses also engage substantially with Study of the Past. When taken for a letter grade, it also meets the Core area requirement for Historical Study A. COURSE ORGANIZATION AND OBJECTIVES The course content surveys key episodes in the development of democratic institutions and practices in the United States from the late 18th century to today. -

Freedom and the State: The Social Contract This course aims to introduce students to central questions in political philosophy, through engagement with the work of several significant political philosophers: Thomas Hobbes, John Locke, Jean-Jacques Rousseau, Immanuel Kant and John Rawls. The topics with which we will be most deeply concerned include the legitimacy of the state; the limits of the state’s authority; the basis of rights of resistance or rebellion; the relevance of consent to political authority; the nature and value of freedom; the relationship between politics and human nature; and social justice. We will also, as often as we can, attempt to relate the views of these philosophers to contemporary debates. Social liberty is the fundamental social ethics of the modern world – it has been for the last two centuries. In particular, it is the basis of our Constitutions (as basic rights) and of our law. Therefore, it is surprising that its very numerous but always partial presentations were so wanting in rigor and scope. This applies to the theory of social liberty in the strict sense, but also to its natural extensions. As a result, this complete analysis concludes that the implication of social liberty as regards issues such that the scope of the public sector and the distribution of income and welfare are very different from what it is usually said they are. It shows what the actions of the public sector and the distribution should be from this basic principle. In these studies, “liberal” means “liberty-based” in the sense of based on the principle of full social liberty rationally understood and applied. One can thus derive, notably, the liberal distributive justice in general and the liberal social justice (at the macro level), the liberal public economics, the liberal public services, taxes, and State, and so on. In particular, the liberally just distribution results from the following facts. (1) The effects of free actions, exchanges, and agreements. (2) The distribution of the value of the given resources (including people’s capacities). -

Berkeley Undergraduate Journal 1 DEMOCRATIC CULTURE IN AMERICA By Joseph Gordon s Rogers Smith articulates in his book, Civic Ideals, America is a nation that blends multiple political traditions in its civic community. Smith argues that the political elite in America create “civic myths,” Aor stories based upon falsehoods that combine liberal and illiberal ideals. These illiberal ideals fill in the blanks left in America’s liberal civic foundation. So, in a nation that conflates liberal and illiberal ideals, is it possible to have a commonly understood “democratic culture”? In the Inclusion of the Other, Jurgen Habermas argues that the rights individuals enjoy in the “private life” (liberalism), must be fought for in the “public life” (non-liberal republicanism). In other words, for individuals to live the life they see fit for themselves, individuals must speak up and have their needs and desires heard in the civic community. While Americans have competing understandings of what should be pursued in the private life and who should be allowed to participate in the American civic community, most Americans believe that their own needs and concerns should be heard and considered. To illustrate this, I conduct an analysis of a presidential campaign speech made by David Duke, a right-wing extremist and former Ku Klux Klan Grand Wizard. While he does not believe that all should be allowed to participate in the civic community, he believes that he and his supporters should have their concerns heard and considered. This example demonstrates that America does have a commonly understood “democratic culture,” even though some believe that it should not be afforded to each equally. -

STILL A ROCK PARTY In the 2000 film The Contender, Senator Lane Hanson, por- trayed by Joan Allen, explains what catalyzed her switch from the Grand Old Party ("GOP") to the Democratic side of the aisle. During her dramatic Senate confirmation hearing for vice-presi- dent, she laments that "The Republican Party had shifted from the ideals I cherished in my youth." She lists those cherished ideals as "a woman's right to choose, taking guns out of every home, campaign finance reform, and the separation of church and state." Although this statement reflects Hollywood's usual penchant for oversimplification, her point con- cerning the recession of moderation in Republican ranks is still ap- ropos. -

Stanford, California: Stanford University Press, 1994. viii + 280 pp. "I was born in London, on the 20th of May, 1806," wrote John Stuart Mill in his autobiography, "and was the eldest son of James Mill, the author of the History of British India." James Mill had acquired considerable fame as a philosopher of utilitarianism and as an authority on India; and if it is remarkable that John Stuart Mill, who would eclipse his father, described himself, on the opening page of his autobiography, as the son of the "author of the History of British India", it is just as revealing that he virtually obscured his own life-long association with India. It is not commonly known that John Stuart Mill, philosopher of classical liberalism, theorist of political economy, proponent of women's rights, and one of the shapers of modern English prose, spent nearly the entirety of his adult working life drafting "despatches" or official documents on British policy in India. A few terse lines, to which he had practically nothing else to add in his autobiography, describe his association with India: "In May, 1823, my professional occupation and status for the next thirty-five years of my life, were decided by my father's obtaining for me an appointment from the East India Company. immediately under himself." Thus was John Stuart Mill's connection with India assured until the demise of the East India Company in 1858.
