Stellenbosch University https://scholar.sun.ac.za iii SUMMARY In apartheid-era South Africa protests were a mechanism through which the dispossessed and marginalised could challenge their exclusion. These characteristically confrontational and violent protests influenced the framework adopted to regulate demonstrations during the democratic transition and in the new constitutional dispensation, namely the Regulation of Gatherings Act 205 of 1993 (“Gatherings Act”). In the new constitutional dispensation the right to assemble and demonstrate is guaranteed in section 17 of the Constitution. South Africa has been labelled the “protest capital of the world”. Protests are a regular occurrence and are a vital part of democratic participation and dissent. This is because the people, on whose will government is based, need an avenue outside of existing institutions to form and express their views and show their dissent. The question arises as to how certain types of dissent fit within different conceptions of democracy. This thesis attempts to determine whether and to what extent different understandings of democracy allow us to make sense of the nature and importance of protest action. The thesis examines the regulatory framework of the Gatherings Act, with reference to its implementation by the executive and state administration. It also examines case law in which section 17 of the Constitution has been interpreted. It argues that some of the provisions of the Gatherings Act, the implementation of the Act by the executive, and some court judgments reveal an impoverished understanding of democracy and unduly limit the rights of the citizenry to participate and dissent. The thesis examines various conceptions of democracy. It argues that, while the institutional models of representative, participatory and deliberative democracy may help to illuminate certain aspects of freedom of assembly, they do not adequately address the inherent tensions in democracy which are illustrated in contentious and disruptive protests. Representative models of democracy tend to offer a restrictive view which assumes that the will of the people is identical to the decisions of representatives, and minimises the role of participation beyond and between elections. Participatory and deliberative models of democracy attempt to eliminate tensions and conflict by creating a platform for a possible rational consensus. These models place a great deal of reliance on the power of representatives to establish spaces for democratic interaction. This type of extra-institutional politics can be linked to the model of agonistic pluralism. Rather than attempting to eliminate and exclude conflict from democratic thought, it recognises that these conflicts are fundamental to democracy. The thesis argues that this model could help enable an understanding of protest action which recognises the centrality of protests to democracy and transformation under the South African Constitution. Hierdie konfronterende en gewelddadige proteste het ‘n invloed gehad op die raamwerk wat aanvaar is om betogings tydens die demokratiese oorgang en in die nuwe grondwetlike bedeling te reguleer, naamlik die Wet op die Regulering van Byeenkomste 205 van 1993 ("Byeenkomstewet"). In die nuwe grondwetlike bedeling word die reg om te vergader en te betoog in artikel 17 van die Grondwet gewaarborg. Suid-Afrika word gebrandmerk as die "protes hoofstad van die wêreld”. Protes is ‘n gereelde verskynsel en is 'n noodsaaklike deel van demokratiese deelname en meningsverskil. Dit is omdat die burgers, op wie se wil die regering gebaseer is, 'n meganisme buite die bestaande instellings benodig om hul standpunte te lug en om uitdrukking te gee aan hul meningsverskille. Die vraag ontstaan hoe sekere tipes protes binne verskillende opvattings van demokrasie inpas. Hierdie tesis poog om te bepaal of, en in watter mate verskillende begrippe van demokrasie ons toelaat om sin te maak van die aard en belangrikheid van protesaksie. Die tesis ondersoek die regulerende raamwerk van die Byeenkomstewet, met verwysing na die implementering van die Wet deur die uitvoerende gesag en staatsadministrasie. Dit ondersoek ook regspraak waarin artikel 17 van die Grondwet uitgelê word. Die tesis voer aan dat sommige van die bepalings van die Byeenkomstewet, die implementering van die Wet deur die uitvoerende gesag, en sommige van die hofuitsprake op ʼn verarmde opvatting van demokrasie berus en die regte van burgers om deel te neem en te verskil, te veel beperk. Die tesis ondersoek verskillende opvattings van demokrasie. As part of the research objectives, this study is concerned with investigating how and why youth activists in Zimbabwe and South Africa use the popular corporate social network site for political purposes. The study explores the discursive interactions and micro- politics of participation which plays out on selected Facebook groups and pages. It also examines the extent to which the selected Facebook pages and groups can be considered as alternative spaces for political activism. It also documents and analyses the various kinds of political discourses (described here as digital hidden transcripts) which are circulated by Zimbabwean and South African youth activists on Facebook fan pages and groups. Methodologically, this study adopts a predominantly qualitative research design although it also draws on quantitative data in terms of levels of interaction on Facebook groups and pages. Consequently, this study engages in data triangulation which allows me to make sense of how and why politically engaged youths from a range of six social movements in Zimbabwe and South Africa use Facebook for political action. In terms of data collection techniques, the study deploys social media ethnography (online participant observation), qualitative content analysis and in-depth interviews.

    A word of welcome from the conference organizer Dear conference delegates, Welcome to the Nordic Africa Days 2014 in Uppsala! The Nordic Africa Days (NAD) is the biennial conference which for the past six years has been organized rotatively in each of the Nordic countries. Already since 1969 the Nordic Africa Institute has organised this regular gathering of Nordic scholars studying African issues, and the event has for the past 15 years been formalized under the name of the Nordic Africa Days. The theme of this year’s conference is Misbehaving States and Behaving Citizens? Questions of Governance in African States. We are proud to host two distinguished keynote speakers, Dr Mo Ibrahim and Associate Professor Morten Jerven, addressing the theme from different angles in their speeches entitled “Why Governance Matters” and “Africa by Numbers: Knowledge & Governance”. The conference is funded by long-standing and committed support from the Swedish, Finnish, Norwegian and Icelandic governments. This year, we are also particularly pleased to be able to facilitate participation of about 25 researchers based on the African continent through a generous contribution from Sida (The Swedish International Development Cooperation Agency). Providing a platform for Nordic and African researchers to meet and cooperate at NAD is becoming ever more important, in addition to creating a prime meeting place for researchers on Africa within the Nordic region. The main conference venue is Blåsenhus, one of the newest campuses within Uppsala University, situated opposite the Uppsala Castle and surrounded by the Uppsala Botanical Gardens.     The Current State of the Struggle The African National Congress (ANC) and the United Democratic Front (UDF), along with the in­ dependent black labor unions, are currently leading the struggle against apartheid in South Africa. The ANC, which has spearheaded the liberation struggle in South Africa ever since its inception in 1912 has been banned or outlawed since 1960 and now operates as an exile organization with headqu<h'"ters in Lusaka, Zambia. Despite the ANC's outlawed status,_ due to which it cannot even be legally quoted inside South Africa, the recent upsurge bas witnessed a massive increase in its support. Polls show that it is easily the most popular liberation organization in the country. The UDF, a coalition of over 600 organizations, has emerged over the last two years as the major legal force of internal resistance_ to apartheid inside South Africa. Most of the current protests in South Africa were organized by the UDF. Finally, the growing black labor unions, often working in collaboration with the UDF, have shown through strikes and work stoppages that they now have the power to cripple the ap4rlheid economy. The ANC was formed in 1912 and its program of demands is contained in the Freedom Charter which was adopted in 1955 by the ANC, the South African Congress of Trade Unions, the South African Indian Congress, the Coloured People's Congress, and the Congress of Democrats. The Charter basically calls for the creation of a non-racial democratic South Africa in which the land and the wealth of the country is controlled by the people.

Introduction Because of its sheer scale, terrorism is seen as the kind of crime which states should prevent rather than prosecute. Many therefore accord the state special leeway against it. Anti-terrorism legislation accordingly cur- tails individual rights, allowing action against terrorist suspects before their guilt is proven. It may also relax the requirements for proving guilt if the suspect gets to court. Proponents of this view argue that any harsh treatment which may result is the price which society has to pay to protect the general public. H e r e w e f nd a paradox of the anti-terrorism debate, because a second argument sees, in this same legislation, protection for the terrorist sus- pects . T is argument accepts that additional powers, beyond those in ordinary criminal and procedural law, may be needed in order to com- bat terrorism. However, it then demands that the government articulate exactly when these powers will arise and what their extent will be. Under such an argument, legislation must def ne clearly what terrorism is and establish the limits of executive action against it. In this way, the govern- ment will be constrained by the anti-terrorism legislation, rather than acting extra-legally, and its exercise of power will be subject to review. It is not a comprehensive survey of all student activities, merely a summary.' An outline of student campaigns introduces the topic, and we then concentrate on the two types of universities, 'historically White' (HWU's) and 'historically Black' (HBU's). This may appear to be an artificial classification of the university sector. Nevertheless, for convenience, we shall use the classification (HWU/HBU's) to organise our data of resistance during the 1980s. This resistance was obviously much more concentrated at the HBU's. Historically too, there was a wealth of political and other kinds of resistance at the HBU's to aspects of the tertiary system, the social structure, and specifically to apartheid's Bantustan system. Finally, the distinction between 'historically White .u~iversities' and 'historically Black univers!ties' is made in the li~ht of an educational system that was the product of a colomallegacy and apartheid. I wish to categorize resistance data in terms of four specific aspects: .Political resistance. This includes resistance within the university but primarily against the state or Bantustan concerned. .Resistance specifically regarding financial issues including corruption and the abuse of power. This is done for logistical convenience, due to the intensity and pervasiveness of politics in all areas of resistance. .Academic resistance and access related issues. These include all aspects of resistance by students in the academic sphere, whether against graduation ceremonies or such concerns as access to universities or residences.

A core premise of this study is that there exists, in post-apartheid South Africa, a stark discursive disjuncture between what has emerged as a hegemonic liberal democratic constitutional discourse and the discourse of liberation that served as the ideological pivot of the anti- colonial struggles. Animated by this premise, this study asks why it is that liberation as a framing set of ideas has either played no part or exerted so little obvious influence on how post-apartheid South Africa self-comprehends and organises itself in constitutive terms? Recognising that the formal end of colonial-apartheid as a system in 1994 inaugurated a seismic shift in the country’s constitutional discourse as the notion of constitutionalism took centre stage, this study seeks to problematize this idea by examining its underlying assumptions, connotations and import as deployed in mainstream South African academic and public discourses.

Protestors claim that they protest over lack of ‘service delivery’ and water is one of the elements of service delivery. In 2012 the frequency, geographical spread and violence of service delivery-related social protests in post-apartheid South Africa reached unprecedented levels. Water service delivery issues rose in prominence among various reasons cited for protests. While this ascendance is remarkable, grievances over water services are not new. Water service delivery issues have been (and still are) a part of a range of conflated grievances that masquerade under the general rubric of ‘service delivery’ issues and underpin many rallying calls for social protest action.

    1 Privilege, Solidarity and Social Justice Struggles in South Africa This paper is work in progress. Feel free to contact me later for an updated version. Email [email protected]. Abstract The last decade has seen a noticeable increase in the number and prominence of social justice movements in South Africa. Many of these movements have received the support of relatively privileged individuals who are not members of the oppressed group represented by the movement. In this paper, I draw out some of the possibilities, ambiguities and limitations of the role of privileged individuals in South African social justice movements. The paper takes as its particular focus the relationship between one such movement, the Unemployed People’s Movement (UPM), and a student organization, the Students for Social Justice (SSJ), both of which are based in Grahamstown, South Africa. I argue that while privileged supporters of such movements can play a constructive role in social justice struggles, the experiences of the SSJ and UPM illustrate some of the tensions that are likely to emerge and need to be addressed when privileged people participate in popular struggles. Popular protest was a key feature of the struggle against apartheid. When apartheid ended in 1994, it was expected that frequent political protest would cease to be a characteristic feature of South African politics as the reasons for such protests – injustice, lack of democracy, racism, oppression and the like – had come to an end, or would shortly be addressed, with the democratic election of the African National Congress (ANC). Thus the wave of popular protests that gained momentum in the early to mid-2000s and the social justice movements that emerged at this time took many by surprise.

These effects are particularly pronounced in African countries where small changes in resource allocation can lead to large changes in a local government’s ability to provide public services, which in turn can positively or negatively affect the future welfare of citizens (Miguel and Zaidi 2003). Local governments in Africa depend mainly on the central government to provide the necessary funds in order to provide services such as healthcare, education, and water and electricity to their constituents. If the central government diverts funds disproportionally to its supporters, other citizens have to forgo these necessities. This, in turn harms economic development and growth. The same is true, albeit on a smaller scale, at the level of local government. If one area within a district continually receives fewer public services, the residents of that area will face higher costs in acquiring goods such as water, health, and education, leaving less time and resources to pursue economically productive endeavors. It is thus critical to understand how governments choose to distribute resources, in order to identify potential issues that could hamper the growth potential in Africa.
