General 1. The purpose of this Notice of Proposed Amendment (NPA) is to envisage an amendment to Decision 2005/07/R of the Executive Director of 19 December 2005 on acceptable means of compliance (AMC) to Part-66 Appendix I Aircraft type ratings for Part-66 aircraft maintenance licence (hereinafter referred to as Part-66 AMC Appendix I) of Commission Regulation (EC) No 2042/2003 of 20 November 2003 on the continuing airworthiness of aircraft and aeronautical products, parts and appliances, and on the approval of organisations and personnel involved in these tasks (Commission Regulation (EC) No 2042/2003)1. The scope of this rulemaking activity is outlined in ToR 66.003 and is described in more detail below. 2. European Aviation Safety Agency (hereafter the Agency) is directly involved in the rule-shaping process. It assists the Commission in its executive tasks by preparing draft regulations, and amendments thereof, for the implementation of Regulation (EC) No 1592/2002 of the European Parliament and of the Council of 15 July 2002 on common rules in the field of civil aviation and establishing a European Aviation Safety Agency (the Basic Regulation)2, which is adopted as “Opinions” (Article 14(1) of the Basic Regulation). It also adopts Certification Specifications, including Airworthiness Codes and Acceptable Means of Compliance and Guidance Material to be used in the certification process (Article 14(2) of the Basic Regulation). 3. When developing rules, the Agency is bound to follow a structured process as required in Article 43(1) of the Basic Regulation. Such process has been adopted by the Agency Management Board concerning the procedure to be applied by the Agency for the issuing of opinions, certification specifications and guidance material (hereafter the Rulemaking Procedure)3. 4. This rulemaking activity is included in the Agency’s rulemaking programme for 2006. It implements the rulemaking task 66.003 Part-66 AMC Appendix I. 5. The text of this NPA has been developed by the Agency. Page 3 of 14 NPA No 03-2006 20/04/2006 II. Consultation 6. To achieve optimal consultation, the Agency is publishing the draft decision on its internet site. Comments should be provided within 6 weeks in accordance with Article 6(5) of the EASA the Rulemaking Procedure. The reasons for the reduced comment period are outlined below. 7. Part-66 AMC Appendix I has been updated once by the Decision No 2005/07/R of the Executive Director of the Agency of 19 December 2005 on acceptable means of compliance and guidance material to Commission Regulation (EC) No 2042/2003 of 20 November 2003 on the continuing airworthiness of aircraft and aeronautical products, parts and appliances, and on the approval of organisations and personnel involved in these tasks. This is the second amendment to the Appendix. Task 66.003 is a permanent rulemaking task for the Agency and subject to an accelerated rulemaking procedure. This had been agreed with AGNA/SSCC at the meetings on the 21st and 29th June 2005. The list will be updated three to four times per year. The consultation period will be reduced to 6 weeks and no regulatory impact assessment will be carried out. All comments received in time will be responded to and incorporated in a comment response document (CRD). This may contain a list of all persons and/or organisations that have provided comments. The CRD will be widely available on the Agency’s website. IV. Content of the draft decision 9. The objective of Part-66 AMC Appendix I on Aircraft type ratings for Part-66 Aircraft Maintenance Licence is to propose a list of aircraft type ratings (aircraft /engine combinations) to promote a common standard throughout Member States. This requires frequent amendment of the Appendix to keep it up to date. Page 4 of 14 NPA No 03-2006 20/04/2006 10. Appendix I to AMC-66 has been updated once by NPA 13/2005.
