Minutes of Work Session
The Rostraver Township Board of Commissioners Work Session was called to order on this date by President, Donald M. Yoder, at 6:30 p.m. in the Rostraver Township Municipal Building, Rostraver, Pennsylvania.
Members present were: Nick Lorenzo AndrewS. Temoshenka George A. Martin Donald M. Yoder Brian L. Sokol
Secretaty Prentice was also in attendance.
ITEMS THAT WERE DISCUSSED:
1. John Maisch spoke on the Library Grant. Mr. Maisch would like the Commissioners to put a motion · on their March 22, 2000 meeting to approve the Chairman signing the grant application. 2. Wally Johnson said E-Bar Co., bought two lots at the airpmt. Tlus company makes solar panels. This will be the first industrial pre-treatment program the Sewage Authority will be involved in and will involve highly toxic waste. Wally said that the Eat N'Park can tie into the Gustine Sewage system. He also 1-epmted the Rostraver Sewage Authority will soon be taking over the Gustine Sewage System. 3. William J. Held, Duquesne Light; Phil Glogowski, GAl Consultants; Carl Wapiemlik and Bill Mellili both residents of Rostraver discussed the fly-ash at the ai1port. Letters submitted by Mr. Wapiemlik and Mr. George Wilson are made a part ofthese Minutes (Attachment A). 4. Bob Lorn· gave Chailman Yoder a report on several issues: 1. Coneybeer complaining about the Recreation Complex. The Soil Conservation District would be visiting the Recreation Complex along with DEP. 2. The holding tanks at the Main Course. 3. Concems regardil1g Republic Waste not dumping at Sanitary Landfill. 3. Mulch pile in Belle Vemon. There has been a citizens group formed concerning this mulch pile. 5. Chairman Yoder said a letter was received fi:om Rails to Trails about buying property near the trail. Rails to Trails needs a letter from the Board of Commissioners stating it is okay to buy this land. 6. Chailman Yoder spoke about Clem Gigliotti needing to put up a fence at Sanitary Landfill. 7. Chailman Yoder said Bob Bigi, who lives near SuperValu might complain about SuperValu havil1g a small oil leak. Tlus leak was repmted to DEP and the DEP said it was not even reportable. 8. Chairman Yoder said DEP took a look at the Todd Manor Sewage Facility, Howard Dum1 from DEP said everything is fine. Commissioners discussed Jim Kelly nmning the Robidoux Sewage Plant. 9. Metz Drive has been approved for a Community Block Grant water project. 10. ) As requested by Matt Winschel at KLH Engineers, I am providing this letter as --; documentation of confidence in the design of the sewer ejector pump for the Eat'nPark ) restaurant. This pump system is of proper capacity to perform its intended function of discharging all wastes generated by this restaurant under pressure into the forced-main of Gustine BV Associates and ultimately discharging into a gravity manhole that terminates the system at approximately 720ft away. Attached are record calculations.
It is further understood that Eat'nPark shall remain responsible for the condition, operation and maintenance of their on-site sewer ejector pump.

11. Chairman Yoder said the Belle Vemon Area School District would be hiring a new Superintendent. 12. Chainnan Yoder talked to Patty Brkybica who is in charge of taking the Census in Rostraver Township. She indicated that she is was not getting a good response back fiom the Township residents. Chairman Yoder said she requested the use of the Municipal Building on Tuesdays fi'om 1:00 p.m - 3:00p.m. for interviews and testing of people for taking the Census. 13. Chailman Yoder said there is a ground breaking ceremony at the Smithton Highlevel Bridge on March 27, 2000 at 10:00 a.m. 14. Chaimmn Yoder reported Ron Olschon has applications for Small Business and Homeowner loans for anyone involved in the recent flooding in Webster. Mr. Olschon will make sure they are distributed. 15. Chaitman Yoder reported that to date all employees were in agreement to stay with Cal-Ed Federal Credit Union instead of changing to the new Belle Vemon Area Credit Union. A letter would be sent to all participates stating we will be staying with Cal-ED. . 16. Commissioners are to let Darlene know if they will be attending the 25th FOtinders Day Dinner sponsored by the RBA. 17. Chailman Yoder said a letter has been sent to CXS conceming the railroad. CXS is to get in touch with the residents involved directly. . 18. Chaitman Yoder said there is insurance on the Rt. 51 and 201 red lights (by Peasant Village). Chairman Yoder said the Conunlsslin1ei·sshou1d consider getH!l.g-lnsut:ance on all th.e lights ill Rostraver Township. 19. Chairman Yoder repmted there was an invoice received from Coopers Electric for replacing the lights in the parking lot of the Municipal ,Building and also repairing the lights in the Police · Department. Federal Electric is no longer in business and Coopers was called in. The Township will need to find another elech·ical company for the Township work, since Coopers invoice was quite high. 20. Chairman Yoder repmted that AT & T Cable Company will be adding a travel channel.. 21. Chairman Yoder discussed with the Commissioners problems with Portnoff Law Associates concerning the garbage collection. Dean Korber and Greg Okonsky have called the Municipal Office complaining about the fees that Portnoff charges. Commissioners agreed that the 1999 delinquent garbage bills are not to be sent to Porhloff at this time. 22. Chairman Yoder said a letter was received from the Planning Commission regarding their Engineer. Chairman Yoder repmted that a backup engineer advettisement has been placed. 23. Conunissioners discussed the no left turn in or out of Eat N'Park. Chairman Yoder said he will ask Eat N' Park to send a letter requesting the Commissioners rescind the motion concerning no left turn in or out of Eat N' Park. Conunissioner Maltin said there should be a file cabinet in the meeting room that maps will be kept in, if the Commissioners need to review something they will have there own copy of the map. 24. Chaitman Yoder said LolTaine Quintier from the Rostraver/Nmth Belle Vernon Youth Commission asked if they could use the copier when they hold their meetings. Chairman Yoder said the policy is no one can use the copier. He said if the Youth Commission wants to purchase a copier they can put it in the conference room. 25. Chailman Yoder reminded Commissioner Lorenzo about Chief Resetar needing to talk to him regarding Personnel matter. 26. Chairman Yoder said the awarding of the contract for the traffic light for Rt. 51 and Concord Lane will be on the March 22, 2000 Agenda. 66
27. Chairman Yoder said he would like to have someone come into the Municipal Building and speak on ethics. 28. Commissioner Mmtin attended a meeting in Uniontown with PennDOT. The television meeting was conducted from HatTisburg. There are 950 acres behind Vals which could be developed like another Southpointe. 29. Commissioner Mmtin said the Road Department bought a trailer to haul the paver. The cost for the trailer was $400.00. 30. Commissioner Mattin said he is looking into the cheapest way to tar & chip the Township roads. 31. Commissioner Mattin repotted Steven Morgan had the lowest quote (under $10,000.00) for !eating down the Pollack Run Bridge. 32. Commissioner Lorenzo said he would like Joe Lagnese, KLH and JetTi Ramsier to talk to the Connnissioners separately. Chairman Yoder said he will set up a meeting on Monday, at 6:30 with Joe Lagnese and the Commissioners. A legal will be placed for the Work Session. 33. Commissioner. Lorenzo said there is no speed limit sign on Virginia Dr.. Commissioner Lorenzo said he spoke to Chief Resetar and the speed limit would be 15 mph. This item will be· on the Special Meeting agenda of March 22, 2000 to advettise an Ordinance for the speed limit. 34. Commissioner Lorenzo questioned Chairman Yoder on the pay raises for the Commissioners. 35. ···coinmiSsioner .Lorenio. spoke to -Atforney Mitchel regarding -the final onLight Dllty for Police Officers. 36. Commissioner Lorenzo discussed adopting a Resolution for the new Citizens Review Committee. 37. Commissioner Sokol would like a letter sent to PennDOT requesting a no tum on red at Bill's. 38. Connnissioner Sokol said the wall at the Fellsbmg Ballfield is collapsing. This needs to be tom - ! -~ down before someone gets hmt. 39. Commissioner Sokol reminded the Commissioners of the retirement patty for Ron Quinto on Friday, Mm·ch 25, 2000. 40. Commissioner Martin said he would like to have the nomination for the Road Supervisor on the March 22, 2000 agenda. 41. Conmtissioner Mmtin said he is looking into the possibility to add an outside assistant foreman in the summer to oversee a blacktop crew or a sealing crew. Commissioner Martin said that the Road Department would be naming a temporary tmck dtiver to replace Tom Backstrom. 42. Darlene said she spoke to Rick Matson, concerning the Hmtford Pension Plan. Chairman Yoder said he would like two men from the Police Department and the Road Department along with Darlene and Mmy Sue to meet wilh Rick Matson regarding the Pension Plan. 43. Commissioners discussed workers coming back to work after being on compensation and going to the doctors for follow up appointments on work tinte. 44. Commissioners discussed Tony Ercegovich' s going on compensation and whether he cmt go to the . doctors on work time.

Comments on DLC's responses to M.G. Forbecks ltr. dtd. 7/19/99.
1. The response doesn't address the Safety of the residents regarding Water and Air. In their
response to item 25 DLCo takes the position that if they ruin the residents water they will pay to
have city water hooked up. How about the ongoing , everlasting cost ot the city water? How
about the residents along Weddell Extension who have no access to city water? What remedy Is
there for the potential of contaminated water several years down the road?
2. DLCo failed to answer .
3. There's no explanation---- given as to the need_,______to interSIJ~S!l -- !xJttom ash-. with the. LPCmaterial.. .
·It seems it's only dependent on Plant Operations and the need to dispose of bottom ash. Does ·
anyone believe in the bulldozer operators ability to blend Bottom Ash and Fly Asli witti any
consistency? Will samples for consistency be taken at the job site?
4. DLCo's answer ignores the DEP's question regarding sampling after preparation (Blending).
5. The attached table indicates numerous items not listed In the MSDS. I believe the taped
minutes of the Commissioners meeting will show thai DLCo and Airport authorities staled that
there was no Arsenic or Lead. How about the other "Goodies" like Zinc, Mercury, Boron, Barium,
Chromium etc.?
6. Monthly testing is considered to be within a thirty day period. DLCo's test record exceeds
those parameters. Furthermore there's no production data shown to support the position that
they are under the 50,000 tons allowed. ..
7. The citizens group would like an Agenda prior to the meeting along with follow up reports on.
the previous meeting.
9. There were no calculations given to Indicate how DLCo arrived at the 6" max. pipe size.
10. Who's the authority on this issue? It appears that DLCo thinks they are. What other '· Beneficial Use project approached the magnitude of the Airport Dump Site?
11. It appears that there's no History of a project of this magnitude so they're not able to answer.
12. How could the Building Permit Officer and the Twp. Engineers have done a thcfrougn review
of the operation plan prior to issuance of a permit when the Operation Plan is still not finalized?
Where does the Paved road and parking area enter into this?
14. No response is given to Dust Migration or methods to monitor off site migration. They are ' obviously unwilling to do offsite monitoring.
16. Did the discussions and the narrative address emissions? Note Eugene Lakins attached response states ZERO emissions. If that were the truth there would be no reason for the Bureau of Air Qual itt to respond oiher ihan positive. I also beiieve that Mr. Lakin is being less than truthful when he states ZERO emissions and None for pollutants.
17.This information and any other Information that's available should be reviewed prior to the start of this project, not when it becomes available.
18. What do they consider "Reasonable Confidence" as regards background levels?
Construction Scheduling should not supercede Safety in a Beneficial Use Project. 19. Have the Twp. Commissioners been given a revised application? If so, when are they going
to vote on this revised application?
21. Have they done adequate research to determine Intermittent streams?
23. Weddell Drive Extension Is not shown on thier draWings.
25. DLCo's answers to this item are inadequate at best. They say that structural failure is highly
unlikly and dust migration simply won't occur. If you live Within a quarter of a mile radius of the
- site they'll replace a valuable well;-spring or cistem-Witli city watefhook-up. HowabOut the
migration of dust into cisterns outside of the quarter mile radius? DLCo. states there won't be
any migration of dust. ff that were true. wlw Is It that peoole who live along a dirt road have __, more dust than people who live along paved roads? Residents who live alongside of Rt.
51 have more dust than those along rural roads. It seems to me that anv housewife could
explain migrating dust to DLCo.

Enclosures: 1 COMMENTS PRESENTED AT THE COMMISSIONER'S MEETING ON MARCH 15, 2000, REGARDING THE PROPOSED SAFETY AREA AT THE ROSTRAVER AIRPORT.
I. A review of the maps submitted with the application for this
proposed project shows a contour plan that does not concur
with the current actual topography. The map showing the
contours (topography) of this area is not dated and
does not take into consideration a large, fairly level area
of land that currently extends beyond and around the
paved eastern end of the runway.
At the time Mr. Walter Williams and I, along with others,
toured the Elrama Duquesne Light power plant and the Fern
Valley dump site, we were also taken to the eastern end of
the Rostraver Airport rummy to view the hillside proposed
for development. While I was standing near the edge of the
hillside, a small aircraft was coming in for a landing. I
recall a gentleman in our party advising me to step back
to a safer distance from the aircraft's approach. As the
plane came in to land, I understood 1vhy I was told to move
back, The plane was already quite low when it passed us.
I also recall watching as the plane touched down and re
marking to the gentleman that advised me to step back that
apparently, large or small, all aircraft wheels "burn
rubber" the instant they go from standing still to turning
at the speed the aircraft is moving. If the contour map vms correct, I would have been standing many feet down a
steep hillside, far below any possible vantage point for
observing the aircrafts touchd01m. In fact a study of a US
Geological Survey photo dated 31 Oct. 1996 indicates that
I 1·1as standing about 300 ft. from the end of the paved runway.
I believe a current and correct contour map should be sub
mitted and reviewed before this proposed project is given
any further consideration.
At this time I would like to pause in my presentation and
ask Mr. William Melilli, enviornmental consultant and
engineer, who also plaYis to address you on other technical
matters later, to present and discuss the contour map in
question.
2. In the "Request for Determination of Requirement for Plan '
Approval/Operating Permit (RFD) submitted by Mr. Eugene A.
Lakin, Airport Manager, on 8/18/99, section "L. Estimated
Emissions" states "Pollutants None, Emissions (lbs/hr.) 0
and Emissions (tons per year) O". This statement should be
revie1~ed for accuracy, particularly since even a DEP official
stated at a hearing on June 6, 1999, ''lets face it, there's
going to be dust".
3. There is cause to question the operating integrity of the
truck ~~ash requirements. On February 15, 2000, beb1een 9:30
A.M. and 10:00 A.M., Mr. Walter Williams and I obersved three trucks leaving the Fern Valley site \vi thout getting \vashed.
We also observed three other trucks heading to the dump site,
whose \vheels were not washed. l'lho is going to enforse this
regulation and guarantee Rostraver Township that this will
not happen at the Airport site?
4. The Rostraver Ordinance that prohibits increased rain water
run-off into a stream after a project is completed, as opposed
to the run-off prior to the undertaking of the project, has
not been correctly responded to by Duquesne Light Co. and
its' agents. Specifically, Duquesne Light Co. states that
all the proposed area will be covered with 2 feet of soil,
therefore the Rostraver Ordinance does not apply. As
stated at the DEP's Rostraver hearing on 6/9/99, there are
significant paved areas proposed for this project.
Specifically a paved road to the mid-point on the embankment
and a paved parking area at the mid-point is proposed.
Hence there WILL BE SURFACE WATER RUN-OFF from these paved
areas that is not present at this time. In addition after
rainwater percolates through the two feet of soil cover,
it will interface with the LPC material, which has a very
low rate of permeability to water. Due to the decrease in
absorbtion at this interface, the potential exists for an
INCREASE in the flow of water to the stream below the
embankment, over the water flm1 prior to the placing of
the LPC material, particularly during a time of sustained
heavy rains. Inquires should be made regarding what, if any, tests have been made in these regards, including any interface
friction tests that may have been performed.
5. Duquesne Light Co. has not surveyed the residents to determine
their private sources of water, whether they be \qells, springs
or cisterns. Cisterns particularly are vulnerable to fugitive
dust during the construction phase of the project.
6. Duquesne Light Co. states that all of the residents that
could be affected, water wise, by this proposed project have
access to municipal water, and· have merely chosen to -keep
their private ~later sources. THIS IS NOT TRUE. Municipal
water lines DO NOT exist on Barella Lane or on \'leddell
Drive Extension. '·
7. Rostraver Twp. has, in the past, made substantial investments
in time and financial resources to protect the quality of
\•1611 and spring water in this area. Guarding against any
invasion of contaminants to this areas' natural water
resources deserves not only the Department of Enviornmental
Protection's, but also Rostraver Township's, utmost dilligence
and protection. Not just for the well being of the residents,
but also in order to protect the inestimable value to
Rostraver Township of the remaining farms.
8. Evidence of any definitive studies on the affect of fugitive dust on animal, plant and insect life (particularly bees)
is still lacking. The threat of contamination to· cisterns
that supply both humans and animals with drinking water
deserves attention and investigation also.
9. The plans call for placing a drainage pipe under the fill
area to carry off any spring water. Airport personnel said
at the Department of Environmental Protection's hearing
on June 29, 1999, that if such a pipe is required they would
monitor same for fl01~ and openness. In the event this pipe,
or pipes, should eventually become clogged, or should break
or separate due to the weight of ·the material above,· \~ho
\~ill be responsible to restore the system to full operation
again?
10.Details about the construction of the paved road from Route
51 to the proposed dump site are ambiguous. This part of
the proposed project also deserves further scrutiny, since
the road will have a fly-ash base, and will apparently cross
over two ravines, which I assume will also require at least
some fly ash fill.
11.Since Duquesne Light Co. has acknowledged (in their response
to the DEP dated August 19, 1999) a revision of their
application and operation plan v10uld be submitted, copies
of this revised plan should be made available for review
and comment by the residents in the Airport area and Rostraver Township.
12.At the present time one hears on the radio that Duquesne
Light Co. will soon be going out of the electrical generation
business. Who will the new owner/operator be, and what affect
could this change in ownership bave on this proposed project?
Rostraver Township deserves ans\·Ters from, and a meeting with,
any proposed new owners. Such a meeting, hm1ever informal,
should be held \vi th the presence of DEP personnel.
