Box 31965, Lusaka Zambia ‘CSEC: Promoting transparent and credible elections through monitoring all stages of the 2011 electoral process in Zambia’ 1 FOREWORD Civil society in Zambia has a long history of contributinG to the democratic process throuGh a number of activities carried out by individual orGanisations. As the civil society in the country Geared up to be part of Zambia’s 2011 tripartite elections, the idea and viability of coming up with a coordinated and structured coalition such as CSEC 2011 was unforeseen until about May 2011. Eight (8) civil society orGanizations came toGether, believing in their unique capacities but also acknowledging the Great enerGy that would be realised if the orGanisations worked toGether. CSEC thus provided a unique experience of election monitoring. The CSEC experience has Gave the participatinG civil society orGanisations an opportunity to learn many lessons from the challenges and successes of working for a common purpose in a coalition. While the challenges that CSEC faced (limited time, limited resources and varying orGanisational cultures) made it a not so easy task, such challenges were not insurmountable. It was remarkable thouGh to note that partner orGanizations remained committed to the cause and hence the achievements that were realised by the coalition. For instance the contribution made to Zambia’s 2011 elections by CSEC’s Rapid Response Project (RRP) was just phenomenal. Amidst harassment, threats and denunciations arisinG from an ill informed debate on Parallel Vote Tabulation (PVT), CSEC was able to verify official election results using RRP as alternative concept to PVT. -

D. Cornell University 2012 Under what conditions does the rule of law, especially with regards to the constraining of executive power, become institutionalized in newly liberalized countries where presidential authority has historically been greatly unchecked? This dissertation explores this puzzle by exploring two inter-related questions: first, why would a longtime ruling party acquiesce to institutional constraints being placed on the executive in the first place, and second, once implemented, why are these institutional rules able to successfully constrain leaders in some sub-Saharan states but not others? To address both questions, my dissertation investigates variation in the adoption of, and later adherence to, executive term limit laws and other constraints on presidential power across Africa. Based on both a medium-n quantitative analysis and extensive qualitative interview and archival data collected during eleven months of fieldwork in Uganda and Zambia, I construct an explanation that challenges previous assumptions about the development of constitutionalism in liberalizing countries. I argue that, due to the rarity of divided governments across sub-Saharan Africa, members of parliament from the ruling party ultimately choose whether or not to restrain executive tenure based on their perceptions of their party’s (and, therefore, their own) electoral competitiveness. -

Edwin Odhiambo Abuya* Asiyekubali kushindwa si msihindani.1 I. INTRODUCTION ¶1 Can African States hold free and fair elections? To put it another way, is it possible to conduct presidential elections in Africa that meet internationally recognized standards? These questions can be answered in the affirmative. However, in order to safeguard voting rights, specific reforms must be adopted and implemented on the ground. In keeping with international legal standards on democracy,2 the constitutions of many African states recognize the right to vote.3 This right is reflected in the fact that these states hold regular elections. The right to vote is fundamental in any democratic state, but an entitlement does not guarantee that right simply by providing for elections. -

The Zambian businessman turned farmer planted 22 acres of burley tobacco. He expected huge profits in the new free-market agricultural economy, so he figured more acres meant more money. Maybe. But it also meant a tobacco glut of horror film proportions. Now, at harvest time, the brown leaves are tied into clumps and not only packed into two huge thatch-roofed barns at his farm in Zambia's Eastern Province. Stacks of drying tobacco fill the tractor sheds, displace cars from the carport and rise to the rafters of his guest house. Inside Chioza's home, leaves hang from ceiling lights. Behind a little pass window opening onto the kitchen, densely packed tobacco ascends to the ceiling. Last year, Chioza was a wheeler-dealer selling imported South African goods at a 500 percent mark-up in the capital, Lusaka. This year, he lives in a newly built house in the countryside, where he is watching his tobacco harvest fill every available space. "I may be a farmer bearing an 'L' badge for 'learner' on my back, but I believe there is a lot of future in farming now," he said. Chioza's change in attitude underscores a dramatic transformation of agriculture taking place in Zambia. For decades, many Zambians thought of farming as the demeaning and unremunerative toil of a peasant or as the unattainable economies of scale of huge, white-owned commercial farms. -
Conflict Prevention in the Greater Horn of Africa
UNITED STATES INSTITUTE OF PEACE Simulation on Conflict Prevention in the Greater Horn of Africa This simulation, while focused around the Ethiopia-Eritrea border conflict, is not an attempt to resolve that conflict: the Organisation of African Unity (OAU) already has a peace plan on the table to which the two parties in conflict have essentially agreed. Rather, participants are asked, in their roles as representatives of OAU member states, to devise a blueprint for preventing the Ethiopian-Eritrean conflict from spreading into neighboring countries and consuming the region in even greater violence. The conflict, a great concern particularly for Somalia and Sudan where civil wars have raged for years, has thrown regional alliances into confusion and is increasingly putting pressure on humanitarian NGOs and other regional parties to contain the conflict. The wars in the Horn of Africa have caused untold death and misery over the past few decades. Simulation participants are asked as well to deal with the many refugees and internally displaced persons in the Horn of Africa, a humanitarian crisis that strains the economies – and the political relations - of the countries in the region. In their roles as OAU representatives, participants in this intricate simulation witness first-hand the tremendous challenge of trying to obtain consensus among multiple actors with often competing agendas on the tools of conflict prevention. Zambia Page 1 of 16 Zambia Country Reports on Human Rights Practices - 2002 Released by the Bureau of Democracy, Human Rights, and Labor March 31, 2003 Zambia is a republic governed by a president and a unicameral national assembly. Since 1991 generally free and fair multiparty elections have resulted in the victory of the Movement for Multi -Party Democracy (MMD). In December 2001, Levy Mwanawasa of the MMD was elected president, and his party won 69 out of 150 elected seats in the National Assembly. The MMD's use of government resources during the campaign raised questions over the fairness of the elections. Although noting general transparency during the voting, domestic and international observer groups cited irregularities in the registration process and problems in the tabulation of the election results. Opposition parties challenged the election result in court, and court proceedings remained ongoing at year's end. The Constitution mandates an independent judiciary, and the Government generally respected this provision; however, the judicial system was hampered by lack of resources, inefficiency, and reports of possible corruption. The police, divided into regular and paramilitary units operated under the Ministry of Home Affairs, had primary responsibility for maintaining law and order. The Zambia Security and Intelligence Service (ZSIS), under the Office of the President, was responsible for intelligence and internal security. Members of the security forces committed numerous, and at times serious, human rights abuses. Approximately 60 percent of the labor force worked in agriculture, although agriculture contributed only 22 percent to the gross domestic product. Economic growth slowed to 3 percent for the year, partly as a result of drought in some agricultural areas.
