O C A U H O L S T L E A C N O N I T A A I N R L E T L N I A R E E M C E M B R A N A Matter Of Comparison: The Holocaust, Genocides and Crimes Against Humanity An Analysis And Overview Of Comparative Literature and Programs Koen Kluessien & Carse Ramos December 2018 International Holocaust Remembrance Alliance A Matter of Comparison About the IHRA The International Holocaust Remembrance Alliance (IHRA) is an intergovernmental body whose purpose is to place political and social leaders’ support behind the need for Holocaust education, remembrance and research both nationally and internationally. The IHRA (formerly the Task Force for International Cooperation on Holocaust Education, Remembrance and Research, or ITF) was initiated in 1998 by former Swedish Prime Minister Göran Persson. Persson decided to establish an international organisation that would expand Holocaust education worldwide, and asked former president Bill Clinton and former British prime minister Tony Blair to join him in this effort. Persson also developed the idea of an international forum of governments interested in discussing Holocaust education, which took place in Stockholm between 27–29 January 2000. The Forum was attended by the representatives of 46 governments including; 23 Heads of State or Prime Ministers and 14 Deputy Prime Ministers or Ministers. The Declaration of the Stockholm International Forum on the Holocaust was the outcome of the Forum’s deliberations and is the foundation of the International Holocaust Remembrance Alliance. The IHRA currently has 31 Member Countries, 10 Observer Countries and seven Permanent International Partners. -

ISSN 1020-7473 Introduction The classical definition of refugee contained in the 1951 Refugee Convention was ill- suited to the majority of African refugees, who started fleeing in large numbers in the 1960s and 1970s. These refugees were by and large not the victims of state persecution, but of civil wars and the collapse of law and order. Hence the 1969 OAU Refugee Convention expanded the definition of “refugee” to include these reasons for flight. Furthermore, the refugee-dissidents of the 1950s fled mainly as individuals or in small family groups and underwent individual refugee status determination: in-depth interviews to determine their eligibility to refugee status according to the criteria set out in the Convention. The mass refugee movements that took place in Africa made this approach impractical. As a result, refugee status was granted on a prima facie basis, that is with only a very summary interview or often simply with registration - in its most basic form just the name of the head of family and the family size.1 In the Somali context the implementation of this approach has proved problematic. -

We also ask that this important and relevant information be circulated with Mr. Faruk’s report and placed in his Website along with his report. While we agree that 2011 was a difficult year for Journalist in Somalia, the report makes claims and accusations that are not factual with regard to the roles of the TFG, The Ministry of Information, Posts & Telecommunications, Radio Mogadishu and the Somali National Television. Some facts first: 1. Since February 2011, NUSOJ removed its Secretary General Omar Faruk from his post for mismanagement and the misappropriation of funds. NUSOJ then appointed an interim leadership. 2. In May 2011 NUSOJ held a well-attended conference in Mogadishu and elected new leadership in free and fair elections, according to their own rules and regulations. THE DOCTRINE OF VIRTUAL REPRESENTATION IN TEXAS Of universal application in the United States is the rule that judg- ments and decrees are binding only upon the parties to the con- troversy. Like many legal rules, equity has developed exceptions to alleviate what in some instances would be an intolerable result. The doctrine of virtual representation, more popularly known as the class suit, is such an exception. Developed in the equity courts of England, this rule has been generally accepted in varying forms throughout the country,1 and several states have adopted the doc- trine by statute.! Texas, at one time or another, has applied almost all facets of the rule, although only part of it has been codified.' ELEMENTS OF THE DOCTRINE The doctrine of virtual representation recognizes that there are situations where all requisite parties cannot appear before the court, and therefore provides that the absent proper parties can be repre- sented by persons present who hold the same interest in the con- troversy and who will therefore adequately protect the absent proper parties' interest. -

Violence restricts journalistic access to large areas of the country, and retaliatory attacks against reporters are common. The government actively engages in censorship and prosecution of critical voices, while those who commit crimes against journalists enjoy impunity. Key Developments • Officials harassed the independent Shabelle Media Network on several occasions in 2015, including by fining the company’s owner $10,000 for public incitement and raiding the offices of two of its radio stations. • A controversial new media law passed in December requires reporters to have a university degree in journalism and pass a state test, includes heavy fines for libel, and empowers authorities to block websites as punishment for media offenses despite a provision explicitly prohibiting censorship. https://freedomhouse.org/print/48427 10/4/2016 Somalia Page 2 of 5 • Daud Ali Omar, a producer for the progovernment Radio Baidoa, and Hindia Haji Mohamed, a reporter for the state-run outlets Radio Mogadishu and Somali National TV, were killed in retaliation for their work in April and December, respectively. 7|2011 KAS INTERNATIONAL REPORTS 79 SOMALILAND – A WALK ON THIN ICE 1 Harriet Gorka “Northerners can in no way claim that the 1960 merger with the South was a shotgun wedding – by all accounts unification was wildly popular. Northerners could argue, however, that they asked for an annulment of the union prior to the honeymoon and that their request was unjustly denied.”2 This statement by a legal scholar reflects the prevailing balancing act of the conflict in Somaliland, which some might say started with the voluntary unification of Harriet Gorka worked Somaliland and the Italian Trust Territory of Somalia. Yet from February to April 2011 at the Konrad- the conflict goes deeper and is more far reaching than Adenauer-Stiftung in “just” the desire to secede from the Somali state. It is Windhoek, Namibia. an ongoing debate whether the right to self-determination should prevail over the notions of territorial integrity and sovereignty. May 2011 marked the 20-year anniversary of Somaliland’s proclamation of independence. However, its status has not officially been recognised by any state, even though it has a working constitutional government, an army, a national flag and its own currency, which should make Somaliland a stand out example for other entities seeking independence. The territory also sets itself apart from the rest of Somalia because it is stable and peaceful, which has been achieved by integrating clan culture into its government.
