Pursuant to sections 105 and 105B of the Medicines Act 1981, His Excellency the Governor-General, acting on the advice of the Min- ister of Health tendered after consultation with the organisations or bodies appearing to the Minister to be representative of persons likely to be substantially affected, and acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations 1 Title These regulations are the Medicines (Designated Pharmacist Prescribers) Regulations 2013.

2 Commencement These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Purpose The purpose of these regulations is— (a) to authorise pharmacists who meet the specified re- quirements for competence, qualifications, and training to be pharmacist prescribers for the purpose of pre- scribing the specified prescription medicines; and (b) to set out the competence, qualifications, and training requirements applying to pharmacist prescribers; and (c) to prohibit pharmacist prescribers from prescribing spe- cified prescription medicines if they fail to comply with those requirements; and (d) to make non-compliance with those requirements an of- fence; and (e) to enable the Pharmacy Council— (i) to accredit appropriate training courses for pharmacist prescribers; and (ii) to ensure the ongoing competence of pharmacist prescribers.

4 Interpretation (1) In these regulations, unless the context otherwise requires,— Act means the Medicines Act 1981

pharmacist prescriber means a designated prescriber who— (a) is a pharmacist registered, or deemed to be registered, with the Pharmacy Council under the Health Practition- ers Competence Assurance Act 2003; and (b) is permitted by the Pharmacy Council to practise within the scope of practice of a pharmacist prescriber Pharmacy Council means the body corporate established under that name by section 114(5) of the Health Practitioners Competence Assurance Act 2003 prescription medicine means a medicine declared to be a pre- scription medicine by regulations made under the Act or by a notice given under section 106 of the Act specified prescription medicines means the prescription medicines listed in the Schedule. (2) A term or expression defined in the Act and used, but not de- fined, in these regulations has the same meaning as it has in the Act.

5 Authority to prescribe specified prescription medicines A pharmacist prescriber may prescribe a specified prescription medicine if he or she meets— (a) the requirements of regulation 6; and (b) the additional requirements (if relevant) of regulations 7 and 8 for prescribing the medicine.

6 Requirements for commencing to prescribe for first time Before prescribing a specified prescription medicine for the first time, a pharmacist prescriber must— (a) obtain the qualification required for pharmacists speci- fied by the Pharmacy Council by notice in the Gazette for the purposes of these regulations; and (b) successfully complete the training specified by the Phar- macy Council by notice in the Gazette for the purposes of these regulations; and (c) demonstrate to the satisfaction of the Pharmacy Council that he or she is sufficiently knowledgeable to safely prescribe the specified prescription medicines; and

(d) be permitted by the Pharmacy Council to practise within the scope of practice of a pharmacist prescriber.

7 Other training to be undertaken Before prescribing a specified prescription medicine, a pharmacist prescriber must— (a) successfully undertake training (if any) specified by the Pharmacy Council by notice in the Gazette for the pur- poses of these regulations; and (b) do so within the periods, or at the times, specified for the purpose in the notice, if the training is of an ongoing nature.

8 Assessment of competence to be completed Before prescribing a specified prescription medicine, a pharmacist prescriber must— (a) successfully complete any assessment of his or her com- petence to prescribe the specified prescription medicine as may be specified by the Pharmacy Council by notice in the Gazette for the purposes of these regulations; and (b) do so within the periods, or at the times, specified for the purpose in the notice, if the assessment is to be com- pleted at regular intervals.

9 Gazette notices (1) For the purposes of these regulations, a notice in the Gazette— (a) comes into force on the day after the date of its publi- cation or on a later date specified for the purpose in the notice; and (b) may provide that it expires, if not revoked sooner, with the close of a specified day. (2) Within 5 working days after the date of publication of a notice in the Gazette for the purposes of these regulations, and while the notice remains in force, the Pharmacy Council must ensure that an up-to-date version of the notice is available— (a) on the Internet; and (b) at the office of the Pharmacy Council during business hours, so that members of the public may— (i) inspect the notice free of charge:

(ii) obtain a copy of the notice for a reasonable fee.

10 Prohibition against prescribing specified prescription medicines (1) No pharmacist may prescribe a specified prescription medicine unless he or she— (a) complies with the requirements of regulations 6, 7, and 8; or (b) prescribes that medicine in accordance with another en- actment. (2) A person commits an offence if he or she contravenes or fails to comply with subclause (1). (3) The offence is punishable on conviction by a fine not exceed- ing $500.

Schedule r 4 Specified prescription medicines (excluding controlled drugs) The substances listed in this schedule are specified prescription medicines for the purposes of these regulations, but only— (a) if they are declared to be prescription medicines by regulations made under the Act or by notice given under section 106 of the Act; and (b) in the forms and for the purposes for which they are declared to be prescription medicines.

Explanatory note This note is not part of the regulations, but is intended to indicate their general effect. These regulations, which come into force on the 28th day after the date of their notification in the Gazette, permit certain pharmacists to prescribe the specified prescription medicines. To be permitted to do so, pharmacists must satisfy the requirements of the regulations relating to competence, qualifications, and training for pharmacist prescribers. The Pharmacy Council must specify details of the competence, quali- fications, and training requirements for pharmacist prescribers by no- tice in the Gazette. Persons not meeting those requirements must not prescribe the medicines listed in the Schedule. A person who does so (unless authorised to prescribe the medicine under another enactment) com-
