Fromer** When we think about people seeking relief for infringement of their intellectual property rights under copyright and trademark laws, we typically assume they will operate within an overtly legal scheme. By contrast, creators of works that lie outside the subject matter, or at least outside the heartland, of intellectual property law often remedy copying of their works by asserting extralegal norms within their own tight-knit communities. In recent years, however, there has been a growing third category of relief-seekers: those taking intellectual property into their own hands, seeking relief outside the legal system for copying of works that fall well within the heartland of copyright or trademark laws, such as visual art, music, and fashion. They exercise intellectual property self-help in a constellation of ways. Most frequently, they use shaming, principally through social media or a similar platform, to call out perceived misappropriations. Other times, they reappropriate perceived misappropriations, therein generating new creative works. This Article identifies, illustrates, and analyzes this phenomenon using a diverse array of recent examples. Aggrieved creators can use self-help of the sorts we describe to accomplish much of what they hope to derive from successful infringement litigation: collect monetary damages, stop the appropriation, insist on attribution of their work, and correct potential misattributions of a misappropriation. We evaluate the benefits and demerits of intellectual property self-help as compared with more traditional intellectual property enforcement. Data come from 63 in-depth interviews, media texts, labor market statistics, and observation at Toronto’s fashion week. The three articles comprising this sandwich thesis address: (1) processes through which femininity and feminized labor are devalued; (2) the gendered distribution of symbolic capital among fashion designers; and (3) the gendered organization of the fashion industry and the “ideal creative worker.” In chapter two, I apply devaluation theory to the fashion industry in Canada. This chap- ter makes two contributions to literature on the devaluation of femininity and “women’s work.” First, while devaluation is typically used to explain the gender wage gap, I also address symbolic aspects of devaluation related to respect, prestige, and interpretations of worth. Second, this paper shows that processes of devaluation vary and are heavily shaped by the context in which work is performed. I address five processes of devaluation in fash- ion: (1) trivialization, (2) the privileging of men and masculinity, (3) the production of a smokescreen of glamour, (4) the use of free labor and “free stuff,” and (5) the construction of symbolic boundaries between “work horses” and “show ponies.” In chapter three, I use media analysis to investigate male advantage in the predomi- nantly female field of fashion design.

Second City became the parent of improvisation more than 25 years ago and, in doing so, changed the face of American comedy. Since then, each decade has brought a wave of such notables as Mike Nichols, Elaine May and Ed Asner, followed by Jerry Stiller, Joan Rivers, Shelly Berman, Anne Meara and Alan Arkin, and later by Dan Aykroyd, Gilda Radner and the brothers Belushi. From Second City in Chicago and (later) Toronto came the first headliners for the television show "Saturday Night Live": John Belushi, Bill Murray, Aykroyd and Radner. Second City also fueled the television series "SCTV Comedy Network," produced by the Toronto chapter. The show was aired by NBC in the late-Friday-night slot. Movies also felt the influence of Second City theatre, with such films as "Animal House," "Meatballs," "Stripes," and "Caddyshack." Second City member Harold Ramis, who was a regular from 1969 through the mid-1970s, co- wrote "Animal House" which featured John Belushi. Second City stars also made the cast of other projects. Joyce Sloan, Second City's producer for its entire history, said the touring company's performers will eventually become the people who perform in the resident company.
