MINUTES

The Trumbull Police Commission meeting was called to order at 6:10p.m.

Members present: Angelo Magliocco, Chairman Raymond G. Baldwin, Jr. John Vazzano Lisa Labella, Vice Chairman Chris Trefz

Public Comment Opened Public Comment at 6:10p.m. There being none, public comment closed at 6:10 p.m.

Approval of the December 11, 2018 Police Commission Meeting Minutes Motion made to accept the Police Commission Meeting Minutes of December 11, 2018 as presented. Motion made first by Vazzano, seconded by Baldwin. There was no further discussion. Motion carried with two abstentions, Labella and Trefz.

Approval of the November 13, 2018 Police Commission Meeting Minutes Motion made to accept the Police Commission Meeting Minutes of November 13, 2018 as presented. Motion made first by Vazzano, seconded by Baldwin. There was no further discussion. Motion carried with two abstentions, Labella and Trefz. Approval of the October 9, 2019 Police Commission Minutes and the October 11, 25 and 30, 2018 Special Police Commission minutes Motion made to accept the October 9, 2019 Police Commission Minutes and the October 11, 25 and 30, 2018 Special Police Commission minutes as presented. Motion made first by Vazzano, seconded by Trefz. There was no further discussion. Motion carried unanimously.

Chiefs Report Correspondence Chief Lombardo received a letter from POST regarding the three police recruits that graduated in December.

Chief Lombardo received an email from a Trumbull resident thanking Officer Stephen for assisting her during an accident in November.

Chief Lombardo received an email from a Trumbull resident to Captain Golding thanking Officer Marino for following up on the trash and recycling disturbance that had been occurring early in the mornings.

Chief Lombardo reviewed an article in the Trumbull Times regarding a letter that was written to Rina Bakalar pertaining to testimony the Trumbull Police Union representatives had given at a recent P&Z meeting.

Chief Lombardo received a letter from a Trumbull Resident thanking Lt. Jones and Officer Siljamaki for their assistance during an accident.

Chief Lombardo received a letter from Fred Garrity of the CT United Ride Association with a $500 donation to the Trumbull Police Cadets.

Operations Chief Lombardo reviewed the Calls-for-Service report for the month of December. There was a total of 17,562 calls for 2018.

The Motor Vehicle Enforcement report showed the MV Warning, DUI Arrests, MV Complaints and MV Arrest. There was a total of 172 MV cases for the month of December.

Chief Lombardo reviewed the Criminal Incident report for the month of December which showed a total of 112 calls.

The Incident Statistics report showed 1391 calls for the month of December.

The Arrest Summary Report Adults showed there were 82 arrests for the month of December.

2 The K9 Incident Report showed there were 8 incidents for the month of December.

Traffic Report Chief Lombardo reviewed the Traffic Report for the month of December. There were 94 calls the Traffic Division worked on.

Detective Division Report Chief Lombardo reviewed the Detective Division Monthly Activity report for the month of December. The division opened 4 new cases, closed 1 cases and have 35 cases still open.

Chief Lombardo reviewed the Monthly Status report for December, which provides more detail on the cases detectives are working on.

Chief Lombardo reviewed the SRO Report for December.

Training Chief Lombardo reviewed the Training Report for the month of December. The report showed the type of training and the officers who attended the training. The report also showed the type of community policing events the officers attended.

Cadet Report Chief Lombardo reviewed the Cadet Activity Report for the month of December. The Cadet report detailed a variety of meetings and training.

Sick/Injury Report Chief Lombardo reviewed the sick/injury report for the department for December. Chief Lombardo reported that the number of sick time was down from 2017. The average sick time for 2018 was 6.3 days per officer.

Budget Chief Lombardo reviewed the 2018/2019 budget report. He reported that the department is half way through the year and they have spent 50.07% of the budget. He also mentioned that the overtime costs are higher. The department has spent 13% more in the overtime account. This is all due to being short staffed with officers and several new officers in training. There are currently six (6) vacancies.

AC Byrnes provided a budget proposal that will be presented to the First Selectman. Chief Lombardo reviewed the booklet. He reported that the department will be asking for a 5% increase.

Commissioner Baldwin asked about the Capital Outlay line item.

3 Chief Lombardo reported that is for the cost of new cars. The department will be asking for 5 new vehicles.

AC Byrnes referred to page 11. He mentioned that there were some underfunded line items and purchase of new vehicles are being added to the Capital Outlay.

Chief Lombardo shared that the department's mechanic does a lot and saves a lot of money in fixing the vehicles.

The department will be looking to purchase a new LPR (license plate reader). This helps read the license plates of vehicles, should the vehicle be stolen, not registered, etc. The cost is approximately $15,000.

Chief Lombardo also indicated that three (3) defibulator, AEDs will be added to the Capital Outlay.

Chief Lombardo reported that he will be asking for $100,000 increase in the Overtime Account. This is due to shortage in staff and there are approximately 16 officers with more than 25 years of service that could retire.

Chief indicated should there be any other questions, the Commissioners can contact him at any time.

Question was asked when the Chief will be presenting to the First Selectman. Chief responded that the date has changed and he is not sure of the new date.

Old Business Update on Park lane and Elliott Drive Chief Lombardo reviewed the memo from Sgt. Coutinho regarding the recommendation of the stop sign for the westbound lane of Park lane and Elliot Drive. The stop sign was a recommendation only and is not a required action that was the result of a traffic study conducted by Road Construction Inspector Michael Silva.

The Chairman allowed Public Comment from Mr. Shelby leVine of Park Lane.

Shelby LeVi no indicated that after speaking with the officer, the officer confirmed the sight line distances are insufficient for a safe left turn. One recommendation was to install a stop sign. He asked "If the Engineering department is indicating the sight line is insufficient, why the stop sign is not being installed?"

Chief Lombardo indicated that there is no history of accidents occurring in the past 3 years in that area.

4 Chairman Magliocco informed Mr. LeVi no that at this time the police department is not recommending a stop sign to be installed.

Update on Route 108, Huntington Turnpike Chief Lombardo spoke about the dedicated turn only lanes on Rt 108 at Rt 15 and Huntington Turnpike. The state was contacted about 2 weeks ago and they will look into their history to see if there was a recent study (possibly in 2015}. They will forward the results to the department. The state indicated if the study is outdated, a new one will be conducted.

Update on Church Hill Road and Daniels Farm Road The right turn only lane from Daniels Farm Road to Church Hill Road is currently being studied by CT DOT. They have not decided if it will be a no turn on red. They would like to monitor the construction phases for the 965 White Plains Road project.

Mr. LeVina mentioned that back in August or September there was a proposal by the Commission for a no turn on red. He asked if that endorsed by the Commission.

Chief Lombardo responded that he recalls it being recommended the no turn on red and the removal of the cross walk on Church Hill Road. It was sent to the State and the State has indicated there has been no decision and they would like to wait for the construction phase as indicated earlier.

Mr. LeVina indicated he did not see that action being decided by the Commission.

It was mentioned that the minutes will be reviewed regarding the no turn on red recommendation to the state.

Update on Church Hill Road to Edison Road Chief Lombardo reported that the request was made for a left turn only lane. The State indicated it does not meet guidelines. There will be painting on the road to warn motorists of traffic merging.

New Business Discussion and Consideration of Promotions Chief Lombardo indicated there is one Lieutenant position open. He reviewed the list which showed the next three (3) Sergeants that were eligible to be promoted, Sgt. Allen, Det. Sgt. Falkenstein and Sgt. Hadden. Chief recommended Sgt. Allen to be promoted to Lieutenant. He has been with the department for 18 years, currently assigned to the Patrol Division and is an instructor for Firearms.

Motion was made by Baldwin to promote Sgt. Allen to the rank of Lieutenant, seconded by Trefz.

5 Chairman Magliocco opened the matter up for discussion. He asked if Sgt. Allen would stay in the Patrol Division.

Chief Lombardo indicated that he would be for the time being. There are 5 lieutenants, one does policies (accreditation), Internal Affairs, one oversees Detective Division and three {3) are in the Patrol Division. Should Sgt. Allen be promoted the other Sergeants in the other Divisions could request to return to the Patrol Division.

Chairman Magliocco commented in promoting a lieutenant this would open a Sergeant position. How soon does the Sergeant vacancy need to be filled?

Chief Lombardo suggested that the Sergeant vacancy be filled at the same time as the lieutenant.

There were no other comments or questions.

Motion was made by Baldwin to amend his previous motion to promote Sgt. Allen to the rank of lieutenant with a start date to be determined by Chief Lombardo, seconded by Trefz. There was no further discussion. Motion carried unanimously.

Chief Lombardo reviewed the Sergeant list which showed the next three (3) Officers that would be able to be promoted to Sergeant, Officers Harry, Perkowski and Pysz. Chief reported that Officer Harry has 11 ~ years on the department, Perkowski has 7 and Pysz has 6 years. Chief Lombardo recommended that the Commission promote Officer Perkowski to the rank of Sergeant.

Motion was made by Trefz to promote Officer Perkowski to the rank of Sergeant with a start date to be determined by the Chief of Police, seconded by Baldwin.

Commissioner Vazzano asked "Why not officer #1 on the list?"

Chief Lombardo indicated that officer #2 on the list is currently working the Detective Bureau in a temporary assigned and worked in the Patrol Division. Chief Lombardo feels that officer #2 is a better choice.

Commissioner Baldwin asked if the commission could enter into Executive Session to discuss Personnel Matters.

Vice Chairman Labella indicated they cannot enter Executive Session if the discussion is about the performance review on a specific officer. The officer needs to be informed. She recommended that the motion be tabled.

Commissioner Baldwin agreed.

6 Trefz withdraw the motion.

A motion was made by Labella to table the promotion of Sergeant, seconded by Baldwin. There was no further discussion. Motion carried unanimously.

Discussion and Consideration of New Appointment of Chairman, Vice Chairman and Secretary to the Trumbull Police Commission

Chairman Maglicco indicated it has been an honor to be the Chairman of the Trumbull Police Commission for the past 2 years. He looks forward to continue working with the Commission.

A motion was made by Labella to nominate Raymond Baldwin as the Chairman of the Trumbull Police Commission, seconded by Vazzano. There was no further discussion. Motion carried unanimously.

A motion was made by Baldwin to nominate Angelo Magliocco as the Vice Chairman of the Trumbull Police Commission, seconded by Labella. There was no further discussion. Motion carried unanimously.

Vice Chairman Labella thanked Chairman Magliocco for his service, dedication, and said he Is extremely committed. She sincerely appreciates his input and his commitment to the Police Station Building Committee.

Commissioner Baldwin also commended Chairman Maglicco for his direction and leadership to the commission. He has done an excellent job. He is looking forward to having him as the Vice Chairman of the Trumbull Police Commission.

A motion was made by Labella to nominate John Vazzano as the Secretary of the Trumbull Police Commission, seconded by Baldwin. There was no further discussion. Motion carried unanimously.

There being no further business, a motion was made by Labella and seconded by Magliocco to adjourn the meeting at 6:50 p.m. The motion passed unanimously.

To: Deputy Chief Scinto From: Sergeant Coutinho Date: January 11,2019 Re: Monroe Turnpike/Trefoil Drive Left Tum Arrow

1 conducted a study on the green left arrow from Monroe Turnpike (RT Ill) to Trefoil Drive subsequent to the complaint from Michael Pavia that the light cycle is too fast. In this study 1 discovered that the green left arrow from the northbound lanes of Monroe Turnpike onto Trefoil Drive is only cycled when prompted by motorists driving over the roadway sensor(s) in that extreme left turning lane. When the sensor is triggered the cycle is as follows:

• Red Light (motorist waiting to tum left)- an average of 60 seconds but also depends on traffic signal cycle already underway • Green Left Arrow- approximately 6 seconds • Yellow Left Arrow- approximately 3 seconds • Red Light- until triggered again

During my approximate hour ( 11 :OOam - noon) of monitoring this traffic cycle I observed that it does not appear to be effected by the number of vehicles in the left tum lane of Monroe Turnpike. That is that I calculated similar timing for one motorist waiting to tum left as I did three motorists waiting to tum left (three was the most observed). During the times when three motorists were waiting the third car almost always entered the intersection as the light was turning from yellow to red.

With this data in mind and being aware that the peak hours of this intersection are during the evening Monday-Friday and all day on Saturdays (Insports and cut through for Spring Hill Road) it is conceivable as to how traffic could get backed up in the left turning lane of Monroe Turnpike. For this reason I recommend that a request to the Office of the State Traffic Administration be submitted to either add time to the existing green and yellow left arrows to allow for more vehicles to safely tum left or add another sensor to gauge the amount of traffic to adjust the timing of the light cycle to the traffic volume.

Subject: Commendation- Twin Brooks Assault- Case 18·15884

Lieutenant Brian Weir has submitted a recommendation that each of you be commended for your outstanding work on this incident. I couldn't agree more.

On November 24, 2018, a report of an assault and attempted robbery occurred just outside of Twin Brooks Park in a secluded area. The victim reported that he had been assaulted by several males as he was walking on a sidewalk alone.

From the start, an extensive search for evidence, leads and identification of the parties responsible began. The identity of the vehicle used by the assailants was also initiated. The victim, however, was only able to provide a partial registration. This required a search through Department of Motor Vehicle files of all registered vehicles within Connecticut matching the make and model provided so that the search could be narrowed.

After extensive research the identity of the vehicle in question was made. The investigation continued, which lead to surveillance, interviews and a search warrant being executed. Quickly the assailants were identified and both ultimately confessed to their involvement in the attack.

I commend all of you for your professionalism, dedication and your relentless pursuit of the facts, which lead to the arrest of the two perpetrators.

I also want to thank those who dealt directly with the victim for the compassion shown. It is heartwarming to know that such dedicated police officers serve the Town ofTrumbull.

This memorandum will become a permanent part of your personnel file and brought to the attention of the Trumbull Police Commission.

He has been extremely helpful and available to both the synagogue and our nursery school as we look toward establishing better security.

Officer Harry has made multiple visits to B'nai Torah and responded to phone and email inquiries in a timely fashion. This was particularly helpful to me as I applied for a state grant for school security funds with an imminent deadline. He was knowledgeable about the grant and the necessary steps required to apply.

We are very grateful and appreciate the time, attention and professionalism he has demonstrated. You are fortunate to have this kind and caring officer in the Trumbull Police Department.

Item #1: Soeeding and Stop Sign Violations on Sm1set Ave. Case #19-730 The complainant reported Sunset Ave. is being used as a cut through from Reservoir Ave. to White Plains Rd. The complainant requested Sunset Ave. be made a one way street. Sunset Ave. is a two way roadway from Berkshire Ave. to Reservoir Ave. The portion ofSunset Ave. from Berkshire Ave. to White Plains Rd. is one way. The portion of roadway in question measures twenty two feet wide from curb to curb with no issue of two way traffic flow. Sunset Ave. will be added to the selective enforcement list.

Item #2: Tashua Elementary School Pick Up and Drop Of(Issues Case # 19-609 The complainant stated the parents dropping off and picking up their children are not following the designated traffic pattern set by school administration. The complainant has requested police assistance previously (See case #18-8017). The complainant requested a 'no left tum sign' at the driveway to enforce the proper traffic pattern. The complainant is concerned by the number of students both in the front seat as well as unrestrained in the car line. The morning drop off routine was observed on three consecutive days ( 1/1511 9- 111 7/19), and the traffic pattern set by school administration worked welL Several vehicles were observed not following the designated flow pattern, however, there was no back up of vehicles on Dayton Rd. No children were observed unrestrained in their vehicles. There were a handful of elementary school aged children seated in the front seat of vehicles but all wearing seat belts. I spoke to a few school staff members assisting with the drop off and they stated that the majority of the time the traffic pattern works welL Occasionally when it is extremely cold or raining there is more traffic present. Staff also stated that there has not been an issue in regards to unrestrained children. What they have found is once a parent is safely in the parking area lining up a child will unbuckle before it is their tum to exit the vehicle. The complainant was made aware of my findings and thanked me for investigating the issue and stated her overall goal was to remind the parents of the rules and regulations to ensure the safety of the children.

1 Item #3: Erratic Operation on Daniel's Farm Rd. Case #19-1351 MV complaint regarding erratic operation on Daniel's Farm Rd. between the hours of 0645 - 0700 hrs. The complainant stated a white male operating a black Altima bearing CT reg. 388PWS was observed traveling south on Daniel's Farm Rd. from Monroe toRt. 25. The vehicle ignored stop signs and passed the complainant. The complainant stated this has happened once before involving the same vehicle, however, this time he was able to obtain the license plate. The information was passed on to the midnight shift who covers the traffic post on Daniel's Farm Rd. and Strobel Rd. for morning school traffic. I observed traffic on Daniel's Farm Rd. from Aldo Dr. I did not observe any violations or notice the suspect vehicle. The traffic was congested and moving slowly due to the morning school traffic. I spoke to the registered owner of the suspect vehicle who stated he was not operating erratically. He stated a vehicle pulled out in front of him on Daniel's Farm Rd. then slammed on their brakes. He stated he went around the vehicle to avoid a collision.

Item #4: Tas/ma Elementary School Parking Complai11t Case #19-1495 MV complaint at the Dayton Roadffashua Road school crossing. According to the complainant, there was an issue with a parent parking too close to the intersection, causing a hazard to traffic and busses. The crossing guard attempted to inform the operator to move her vehicle, however the operator ignored her requests and created an unsafe condition. The crossing guard said that bus drop off is around 3PM and the operator's child usually walks home, except for a few recent occasions when the parent parked on Dayton Road to pick the student up. It is possible this parent only picks up the student on Tuesdays. The complainant was informed that an attempt will be made to be in the area of the crossing the following Tuesday and for her to call the Police Department directly next time the incident occurs.

12/14 21:51 6448 Main St. 18-16945 Sex Offenses Nursing staff reported isolated incident of inappropriate touching of one elderly female dementia patient to another elderly female dementia patient whom were both roommates. PD investigated, but had no evidence. Both females were then placed in separate living rooms, and no further issues occurred. Case CLOSED 1/3/19.

12/19 15:12 UnityRd. 18-17147 SuspiciousMV While conducting an investigation, a suspicious MY was observed in the area. The information involving this MV was documented. Case CLOSED on 1/3/2019.

12/29 15:34 1491 Huntington Tpke. 18-17594 Larceny Complainant reported inviting numerous (known and unknown) persons to their residence after a night out partying. These individuals remained in various locations of the residence, drinking, and the complainant had eventually ''blacked out". The last individuals were reported to have left at approximately 6:00AM. Complainant then reported various items and cash missing, however, could not identify everyone who was there. DB investigated, spoke with everyone that could be identified, however, no leads of further information was discovered. Various data bases continually checked for the missing items without success. Case CLOSED 1/22/2019.

1/1 3:26 2775 Nichols Ave. (Mobil) 19-3 Burglary-Business Commercial Burglary where rear door was pried open to gain entry. Cash registers were also pried open~ and orang pry bar was left behind. A DNA swab was also obtained from a piece of chewing gum near the scene. Once suspect dressed in all dark clothing observed. DNA sent to State Lab on 1110. Case ACTIVE.

1/8 2:53 2775 Nichols Ave. (Mobil) 19-305 Burglary-Business PO responded to alarm activation. Upon arrival~ observed North side door glass shattered. Interior A TM had been tampered with. Cash register and JUUL electronic cigarettes stolen. Two unknown suspects in grey minivan fled the area. DB responded~ obtained DNA swabs and seized breaker bar left behind by suspect(s). Case ACTIVE.

Minivan had cash register and JUUL electronic cigarettes inside that were recovered and linked to TPD case #19-305. Minivan was processed for evidence where DNA swabs were taken~ gloves, and an A TM sign were recovered as evidence. Case ACTIVE.

1110 17:11 TPD 19-430 Assist Other Agency Bridgeport Parole advised TPD DB that their client had thousands of dollar's worth of Victoria's Secret merchandise, believed to be stolen from the Trumbull Shopping Park. Search Warrant for cell phone records being applied. This case is being looked into further regarding organized retail theft. Case ACTIVE.

• 01/18 0827 THS 19-798 Assault Officer Duva investigated a report of a student assaulting their mother in the car on the way to school. The student was arrested for assault.

• 01123 1836 Frenchtown 19-1018 Welfare Check Officer Massa followed up with a welfare check on a student that was reported by a third party, the night before, to possibly trying to harm themselves. Officer Massa met with the student and faculty. The case was referred to DCF for follow up and foster placement.

• 01/28 2008 RockinJump 19-1208 TipSoft/Assault Officers Masa and Bartosik followed up on a report of a fight that was going to take place a between two middle school students at Rockin Jump. The report was received via the anonymous tip line. The fight was thwarted by responding officers from the 4-12 shift. Both students families were notified. Discipline was handled within their respective schools. (Madison/Hillcrest)

Repairs to the Spring Hill Road Bridge over the Pequannock River require that we install temporary Traffic Signal to allow closing off a travel lane for a duration of 6 weeks . As with all Traffic Signals we will need endorsement of the Local Traffic Authority before we send it to OSTA. Please let me know when your next meeting is so I can attend. [ looked into the Spring Hill Road overpass of the Peqounnock River and the proposed plans for a temporary traffic control signal to be placed between the commercial driveways of 62 and 8 I Spring Hill Road during the construction phase. This proposal is submitted by Vanasse Hangen Brustlin, Inc (VHB) and the project is estimated to take approximately 6-8 weeks to complete. Throughout the construction process the traffic flow will be limited to one lane of alternating traffic which presents a hazard to motorists and the crew working. My findings ofthis study are attached to this letter and as a result of these findings some concerns arise. Foremost, is the safety of the motorists and construction workers as cars will be alternating traffic in a single lane while navigating through construction equipment, construction materials, and the workers themselves. During the course of the day which the construction will be active it is possible that Police Officers and/or flaggers will be hired in accordance to the list of streets that require the hiring of Police Officers and to ensure that the alternating traffic flow is done safely. However, these Police Officers and/or flaggers will most likely not be available during the inactive duration where the bridge will still be down to one lane of passable traffic. That is that having manual traffic direction twenty-four hours a day for the estimated 6-8 weeks is unlikely. Another option is for a detour to be placed to only allow for traffic to flow in one direction throughout the entire duration of the construction phases. In this option all southwesterly traffic will be detoured from Spring Hill Road, to Trefoil Drive, to Monroe Turnpike (RT Ill), to Main Street/Route 25. All northeasterly traffic will be allowed to flow from Main Street/Route 25 and through the construction zone on the passable lane of traffic. The concern with this option is that it too will have to be monitored throughout the entire construction phase to ensure that motorists do not ignore the detour and cause a head-on encounter. In conclusion, my recommendation is for a request for a temporary traffic control signal be submitted to the Office ofthe State Traffic Administration (OSTA) and that the active construction times be supplemented by Police Officers and/or flaggers. The Town of Trumbull will conduct an informational meeting on February 28111, 2019 at 7:00pm at Trumbull Town Hall in the Nichols Conference Room. The Preliminary design for the "Rehabilitation of Spring Hill Road Over the Pequannock River'' Includes, but is not limited to, bridge deck repairs, replacing the membrane, Installation of guide ralls, and temporary traffic control.
