NOTICE OF OPPOSITION Mr. Gang Cao (“Opposer”) believes he would be damaged by registration of the mark

LIVEPHOTOSKIT (Design) in International Classes 009 and 042, as shown in U.S. Trademark Application Serial No. 87579714 filed by Apple Inc. (“Applicant”), and published for opposition on November 12, 2019. Opposer requested, and was granted, a first extension of time to file his

Opposition through March 11, 2020. Opposer then requested, and was granted, a final extension of time to file his Opposition through May 10, 2020. Opposer timely opposes the Application.

The grounds for this Opposition are as follows:

1. Opposer Mr. Gang Cao owns the domain names LIVEPHOTO.COM and LIVEPHOTO.CA, and has owned these domains since purchasing them in 2011.

2. Opposer is a computer engineer and inventor, and he has developed interactive software designed to display and bring life to still photo images. Opposer plans to use the

LIVEPHOTO.COM and LIVEPHOTO.CA websites, and the terms “live photo” and/or

“livephoto” in connection with the websites, to identify and describe the key feature of his software, namely, adding animation to still photos.

3. On Aug. 22, 2017, Applicant applied to register the LIVEPHOTOSKIT Design mark in International Class 009 for “Computer software used in developing other software applications; application development software; website development software; multimedia development software,” and International Class 042 for “Computer programming; design and development of computer software; computer software consulting services; support services in the nature of consultation services for developing software applications; providing computer software information online; application service provider featuring application programming interface (api) software for website, software and multimedia development,” on a use-in- commerce basis under Section 1(a) of the Lanham Act (15 U.S.C. § 1051(a)), asserting a first use date of April 20, 2017.

4. Generic terms or merely descriptive terms do not function as trademarks and are not registrable. 15 U.S.C. § 1052(e)(1). The Applied-for Mark is not registrable as a trademark because it is generic and, alternatively, because it is merely descriptive of the goods claimed in the Application. 15 U.S.C. § 1052(e)(1).

5. A mark is generic “if its primary significance to the relevant public is the class or category of goods or services on or in connection with which it is used.” TMEP § 1209.01(c)(i).

When a mark is a compound word, the mark is generic if each of its constituent terms is generic and those terms retain their generic significance when joined to form a compound that has “a meaning identical to the meaning common usage would ascribe to those words as a compound.”

In re Gould Paper Corp., 834 F.2d 1017, 1018, 5 USPQ2d 1110, 1111–1112 (Fed. Cir. 1987)

(SCREENWIPE held generic as applied to premoistened antistatic cloths for cleaning computer and television screens); In re Wm. B. Coleman Co., Inc., 93 USPQ2d 2019 (TTAB 2010) (Board held that ELECTRIC CANDLE COMPANY is the combination of two generic terms joined to create a compound).

6. In this case, “live photos” and “kit” are both generic terms and the joining of those terms lends no additional meaning to the terms. “Live photos” and “kit” are widely used generically to identify a key aspect or part of the genus of goods or services identified in the

opposed Application, and consumers will primarily understand the compound term “live photos

kit” to be the generic name or identifier of a key aspect or part of the genus of goods or services identified in the opposed Application.

7. As demonstrated by Exhibits 1-8, 11-15, and 19-22, “live photo(s)” is widely used generically in product reviews and product overviews to identify a camera mode feature that creates photo images incorporating motion or animation.

8. Exhibit 1 is a March 29, 2015 review of the Philips Xenium i908, which highlights the device’s “Live Photo” camera feature.

9. Exhibit 2 is a January 2016 review of the BlackBerry Priv, announced in October 2015 and released in November 2015, which highlights the device’s “live photo mode” camera feature.

10. Exhibit 3 is a May, 2015 overview of Lenovo P70 Specs, which highlights the device’s “Live Photo mode” camera feature.

11. Exhibit 4 is an August 6, 2014 review of HTC Desire 616 dual sim, which highlights the device’s “Live photo” camera feature.

12. Exhibit 5 is a February 22, 2015 review of HTC Desire 526G+, which highlights the device’s “live photo” camera feature.

13. Exhibit 6 is a February 24, 2015 review of the Honor Holly camera app, which highlights the app’s “live photo mode” feature.

23. Exhibit 21 is a July 17, 2014 Facebook post overview of Micromax Unite 2 A106, highlighting the device’s “Live Photo Mode” camera feature.

24. Exhibit 22 is a January 2, 2015 Facebook post overview of Symphony Xplorer ZIV, highlighting the device’s “live photo mode” camera feature.

25. As demonstrated by Exhibits 9-10 and 16-18, “live photo(s)” is widely used generically by competitors to identify a camera mode feature of their devices.

26. Exhibit 9 is a 2014 Quick Start Guide for ZTE BGH Joy Smart A4G, which provides instructions on how to switch to the device’s “live Photo mode” camera feature.

27. Exhibit 10 is a 2015 User Manual and Safety Information guide for ZTE Obsidian, which provides instructions on how to switch to the device’s “Live photo mode” camera feature.

28. Exhibit 16 is a 2015 User Guide for BestBuy Insignia 7.85" Wi-Fi Android Tablet, which provides instructions on how to select the device’s “Live Photo mode” camera feature.

29. Exhibit 17 is an Amazon.com listing for Jiayu G5S Smart Phone Android 4.2.1, which highlights the device’s “Live photo mode” camera feature, and includes an October 21,

2014 product review from a customer in the United States.

30. Exhibit 18 is an Amazon.com listing for BLU Studio G, with a customer review from June 7, 2015 highlighting the device’s “live photo mode” camera feature.

31. Exhibits 23 and 24 demonstrate generic use and understanding of “live photo(s)” by consumers using the social media hashtag “#LivePhotoMode.”

32. Exhibit 23 is a July 14, 2015 Tweet by a Twitter user, using the hashtag #LivePhotoMode in connection with Intex brand.

33. Exhibit 24 is a September 4, 2015 Instagram post, using the hashtag #livephotomode, not clearly in connection with any particular brand.

34. All Exhibits referenced above pre-date Applicant’s asserted first use date of April 20, 2017. These Exhibits thus demonstrate that “live photo(s)” has been used generically since

before Applicant first used or tried to assert rights over the term.

35. “Kit” is a generic term that refers to “a set of articles or equipment needed for a specific purpose.” Lexico powered by Oxford (https://www.lexico.com/en/definition/kit).

36. The combination of “live photos” and “kit” thus denotes a set of software tools or equipment for producing or playing “live photos.” This is precisely how Applicant is currently

using LIVEPHOTOSKIT as shown on its website – a set of software tools or kit “to play Live Photos on your web pages.” https://developer.apple.com/documentation/livephotoskitjs. As

such, the compound term LIVEPHOTOSKIT is just as generic as its generic parts and is thus not registrable.

37. A merely descriptive mark “conveys an immediate idea of an ingredient, quality, characteristic, feature, function, purpose or use of the goods.” TMEP 1209.01(b). Applicant’s

mark LIVEPHOTOSKIT is not only generic, but also merely descriptive because it immediately conveys that the product provides tools or equipment for working with or producing

still photos that incorporate motion or animation.

38. All Exhibits cited above with respect to genericness also demonstrate that there is widespread descriptive use of “live photo(s)” as well.

39. Applicant faced an Office Action refusing registration of LIVE PHOTOS (U.S. Ser. No. 86868731) on the same ground of mere descriptiveness. Applicant submitted a written response to this office action on October 5, 2016. In response to this Office Action, Applicant argued that the mark was not merely descriptive because it “does not describe the nature of the goods – it merely hints at it.” (Exhibit 25). To support that argument, Apple asserted that the one purpose of Apple’s LIVE PHOTOS software is that “it automatically records and pairs a still photo with a simultaneously captured video clip.” Id. Apple then argued that because the mark doesn’t refer to or describe any video, the mark cannot be descriptive: “The word VIDEO does not appear in the mark, and the word VIDEO would have to be present in order for consumers to understand that the nature of this photo-plus-video feature.” Id. Based on this and other arguments, the USPTO withdrew the descriptiveness refusal.

40. Apple’s attorneys’ argument is belied by Apple’s own words in announcing the launch of the Live Photos feature the year prior. At Apple’s September 2015 launch event,

Apple’s Senior Vice President of Marketing, Mr. Philip Schiller, publicly stated: “These are still photos, they’re not videos.” (Exhibit 26) https://www.youtube.com/watch?v=PTEj8Gfe144.

Thus, in Apple’s own words, “live photos” is descriptive – they are still photos featuring live

animation.

41. Exhibits 1-24, referenced above, pre-date Applicant’s asserted first use date of April 20, 2017. The Exhibits thus demonstrate that “live photo(s)” has been used descriptively

since before Applicant first used or tried to assert rights over the term.

42. Lastly, Applicant has provided no evidence that its mark LIVEPHOTOSKIT has acquired distinctiveness as a trademark in connection with the services recited in the application,

as is required for a descriptive mark to be registrable. 15 U.S.C. § 1052(f).

43. Opposer has a real interest in keeping the generic or merely descriptive term “live photo(s)” in the public domain and freely available for use by all, including Opposer. Opposer

would thus be damaged by the registration of LIVEPHOTOSKIT because the registration

would threaten to impair Opposer’s right to generic or descriptive use of terminology “live photo(s),” a term encompassed in, and likely to cause confusion with, LIVEPHOTOSKIT.

44. Opposer’s interest in utilizing the domain names LIVEPHOTO.COM and LIVEPHOTO.CA, which he owns, to promote his interactive photo software using the terms

“live photo” or “livephoto” in connection with the websites, is directly threatened by the present

Application. In fact, Opposer has already put his plans to advertise and promote his products on

LIVEPHOTO.COM and LIVEPHOTO.CA websites on hold pending the outcome of the opposition proceedings for both Applicant’s LIVE PHOTOS and LIVEPHOTOSKIT applications.

45. If Applicant successfully obtained registration of LIVEPHOTOSKIT, Applicant could argue that it has at least a prime facie exclusive right to use of the mark

LIVEPHOTOSKIT, and Applicant could thus assert exclusive rights over the generic or descriptive use of the term “live photo(s).” Applicant’s registration of LIVEPHOTOSKIT may limit Opposer’s and others’ ability to freely use the generic or merely descriptive term “live photo(s)” because, on the basis of the registration, Applicant could assert proprietary rights and remove the term “live photo(s)” from the public domain.

46. Opposer has reason to believe these concerns are justified—in November 2018, Opposer communicated to Applicant via his attorneys that Opposer was willing to resolve this dispute if Applicant would agree not to sue Opposer for his generic and/or descriptive use of the terms “live photo” and “livephoto” in connection with Opposer’s software and as domain names to promote this software. Applicant would not agree to this, confirming Applicant would consider any use of “live photo” by Opposer as potentially infringing.

47. By reason of the foregoing, Opposer would be greatly damaged by the registration of Applicant’s LIVEPHOTOSKIT mark. //

WHEREFORE, Opposer prays that the Application for Registration of

LIVEPHOTOSKIT, Serial No. 87579714, be denied and that this Opposition be sustained.

There’s also Zero Shutter Delay, Voice Command, Face Detect, Timer and Continuous shot.

You can set up the resolution at 13 MP, 12 MP or 8 MP and ISO up to 1600. The video options include electronic image stabilization, audio mode, time lapse and resolution (Full HD or HD). On the right side we ﬁnd the gallery shortcut and effects. The camera offers a reasonably fast focus, 4X zoom, not very fast picture taking and a strong ﬂash.

We took the photos shown in this gallery on a cloudy day and I have to say that the HDR tends to apply a white hue to the image. The panorama is nice and wide and we’ve got good and fast stitching. The colors of the shots are a bit too saturated, but the details are OK. Focus and white balance are good and the horse macro was quite nice, as well as the one of the red chair.

The pictures that have grey, white or black in them come off with a strange exposure, though. The level of detail in zoomed in shots is quite good and the shadows caught on camera are weak. Colourful shots suit this phone better than white, black or gray ones. On the video side we’ve taken Full HD 30 FPS clips with 17 Mbps bitrate and 3GPP format.

Manufacturer Lenovo can be quite innovative to create an affordable smartphone with high specifications, the smartphone is equipped kitchen runway capable that follow technological development in 2015. Design and Body

Lenovo P70 is designed with a rectangular box shape with a slightly curved hand corner that looks quite elegant that allows you to transform and use the smartphone on when gripped, this P70 Lenovo dimensions 142 x 71.8 with a thickness of 8.9mm, but unfortunately this P70 smartphone Lenovo brings only with only one color variant color midnight blue.

In the front part of Lenovo P70 has a screen size of 5 inches IPS LCD resolution of 720 x1280 pixel density of 294 ppi, at the top of the screen there is a 5 MP camera, sensor, earpiece grill and the Lenovo logo. Section below the screen there are three navigation buttons dock that serves as back, home, and recent app.

Part of his right side there are two physical buttons that function as the lock / power and volume control, the side of it there is audio jack port, on the left side there is nothing, to the bottom there is a USB port, and dual speakers.

On the back of this Lenovo P70 uses bermaterial quality plastic material with finishing dove. Then the back of the upper left corner there is a 13MP camera that comes with LED flash, in the middle there is the Lenovo logo are the same color with the color transparent back cover.

To insert the SIM card, you first have to open the back cover, in the back after a back cover removed, there is a dual SIM card slot on the middle left and right, on the left side of the SIM Card for 4G connectivity, 3G and 2G, but on the side just right for 2G connectivity alone, on top of the Labels second SIM card slot is there is a slot for MicroSD external memory supported up to 32GB. Lenovo hasn't made a huge splash in North America in the mobile world. When it comes to PC's though, they are pretty big. Lenovo typically brings over some low-end or mid-range tablets for us to play with in the US, and leaves the higher-end and more interesting tablets for China, their home market. However, I was a fan of the Lenovo Yoga tablets that are available here in the U.S., and I was excited for the Lenovo Tab 2 A10 for one reason. That was the fact that Lenovo was mirroring Motorola's outlook on software for Android. At least outside of China. In the fact that they are going stock Android for the most part. Something that many Android purists love about Motorola.

The Lenovo Tab 2 A10 doesn't have our favorite name. In fact the full name is the Lenovo Tab 2 A10-70. Maybe a bit better than Dell's Venue 8 7000 Series though. It's a sub-$200 tablet with a 10-inch display, as you could probably tell from the name. In a market where less and less people are buying, will the Lenovo Tab 2 A10 go home with you? This probably goes without saying, but many of us hate using Tablets to take pictures. It just looks weird. Lenovo has put a 8MP camera here on the back of the Tab 2 A10, and the pictures are decent. I wasn't expecting anything mind-blowing here, but we do have some decent pictures coming from the device. You can see them all in the gallery down below. The front-facing camera doesn't seem to be as sharp as the camera on the rear of the device for some reason. But it should still do well for those seles and doing video calls on Hangouts, and Skype.

The camera UI is quite simple too. It's not a mirror of what Motorola has however. On the left side you have all your different modes, and there are actually some cools ones here like Multi-angle mode, beauty face, Panorama, Live Photo, and PIP mode. With PIP Mode it basically is using both cameras at the same time. What it does is uses the front facing camera and takes a picture in puts it on top of the picture taken from the rear camera. It's cool, but not sure how often anyone would use it. To be honest.

Overall, I think the camera is adequate for most people, not bad, but not stunning either. If you're out at your kids Soccer game, you can use it to take pictures and get some decent ones, maybe. As is usual with tablet cameras, it doesn't grab moving objects all that well.

wowwwww!!!!! very pleased. all scrathes Next Generation Galaxy Reviewed in the United States on July 6, 2015 Reviewed in the United States on August 10, this phone is the closest thing to perfect I've ever 2018 had. and the looks and the feel of this phone are Arrived un bad condition phenomenal. the colors, screen, video and sound Samsung Galaxy S10 Factory Unlocked A… quality are all very good. the only thing I am not 1,073 liking is the screen when typing. it feels a little $747.00 Shop now thicker than my last phone and harder to text. but other than that I fell in love with this phone. It is large, has a good amount of memory, has a very good sound and a good camera.

I measure the actually screen size at approximately 3 x 5 inches. This is the largest screen I have ever had on a smart phone.

The video quality is excellent. I have watched movies and television shows on the phone and been able to enjoy them thanks to the screen size and video quality. I have watched replays of parts of baseball games and horse races and found the picture quality excellent.

The phone comes with an FM radio. I also listen to music from other sources. The phone comes with an ear piece that I use when listening to the radio. I have listened to music on the phone without the earpiece and the sound quality is excellent considering it is coming from a phone.

The sound quality when I am talking to people on the phone is good as well. I have no trouble hearing someone or being heard.

The camera on this phone is good. It has many features including a ash. It has a main camera and a front camera. It has some nice features like a face beauty mode, normal mode, live photo mode and panorama mode. It has a video camera as well.

Because of the listed 4 GB of internal memory and 512 RAM I have been able to download a good number of apps. I have also been able to store a lot of photos.

I enjoy using all the Google features. Google has become very interactive. If I want to know the weather forecast, the score of a baseball game or the location of the nearest gas station all I do is verbally ask Google and get the answer. Google maps is great on this phone. I once was low on gas and asked the phone where the nearest gas station was and it mapped the route for me.

The voice recognition feature makes it rare that I have to manually type anything on this phone but when I do I am able to do so with my large ngers with ease because of the size of the phone. I have used other smart phones where I often press the wrong letter because they as so small on the screen.

The battery life for this phone is good. The phone comes with a USB cable and charger that can be plugged into and wall outlet.

When I am home or at places that have WIFI I use the WIFI feature. It works ne.

Th phone does come with a screen protector that I have yet to be able to make bubble free. When I called BLU phone support I got no help and was told to go a phone store to see if they could help. I will see about buying a better screen protector when I have the chance.

This is a great phone. It is like a small tablet.

This responds to the office action dated April 5, 2016 refusing registration of LIVE PHOTOS on the premise that the mark is (1) descriptive and (2) likely to be confused with the registered mark HP LIVE PHOTO owned by HP Hewlett-Packard Group LLC (“HP”).

Applicant Apple Inc. (“Apple”) respectfully requests that the refusal be reversed, for the reasons set forth below.

Section 2(e)(1) refusal

Apple’s LIVE PHOTOS software has one purpose, and that purpose sets it apart from ordinary still photography – it automatically records and pairs a still photo with a simultaneously captured video clip. That purpose is the “nature of the goods”, and the phrase LIVE PHOTOS does not describe the nature of the goods – it merely hints at it.

The examining attorney asserts that LIVE PHOTOS “directly describes the video and still capture of a living event occurring during the life of the user”, but the words LIVE PHOTOS do not refer in any way to “the video and still capture of a living event.” The word VIDEO does not appear in the mark, and the word VIDEO would have to be present in order for consumers to understand that the nature of this photo-plus-video feature. LIVE is not a synonym for VIDEO.

In asserting that LIVE PHOTOS is descriptive, the office action cites one definition of “live” out of a dozen that appear in the American Heritage Dictionary:“Of,relatedtoor occurring during the life of one that is living.” Based on this definition, the examining attorney concludes that the “mark directly describes the video and still capture of a living event occurring during the life of the user.” However, there are several reasons why this rationale is not apt.

First, this particular definition is not relevant, and is cited out of context. When one reads the full dictionary entry, it’s clear that the cited meaning of “live” relates to living creatures, and is not applicable to computer software:

“Of, related to, or occurring during the life of one that is living: a live birth; the live weight of an animal before being slaughtered.” (Emphasis added)

If the word “live” were descriptive simply because the good or service involved “a living event during the life of the user”, then LIVE would be descriptive in every mark that involves the activities of a living human being and not a deceased one. That’s obviously not the case -- the word LIVE is disclaimed in only a small fraction of the 5000+ active federal marks in which it appears, just over 10%, so the notion that LIVE is descriptive of anything “occurring during the life” of a human being is clearly not embraced by the examining corps as a whole.

22724618.1.BUSINESS 10/5/2016 6:45 PM A descriptiveness refusal must be based on, and reflect, the way that U.S. consumers actually talk. However, in trying to find a reason why LIVE is descriptive, the office action uses syntax that ordinary people don’t use. The Google search results in Exhibit A show that (1) no one except American Heritage Dictionary definition ever uses the phrase “the life of one that is living”, and (2) no one uses “a living event” as a phrase except to refer to an event that happens to have the word “Living” in the title (e.g., “International Living event”, “Art of Living event”).

Finally, and most important, the definition of “live” cited in the office action is not the definition that consumers would have in mind with respect to “images, video and sound”. The American Heritage Dictionary entry cited in the office action also contains the following definition of “live”:

“Broadcast while actually being performed; not taped, filmed, or recorded: a live television program.”

From the dawn of broadcast radio and television, through 42 seasons of Saturday Night Live, and now with “live streaming” of concerts and events via the Internet, the word “live” has always referred to the transmission of sound and video as events are occurring. If Apple were seeking to register LIVE PHOTOS for a product or service in which consumers viewed images, sounds, or video simultaneously at the time they were captured, then LIVE would be descriptive. However, Apple is not using “live” in that sense, and LIVE is therefore not descriptive in the sense that ordinary American consumers understand it. The goods are limited to “computer software for recording and displaying images, video and sound”, and by definition excludes simultaneous “live” transmission. Indeed, the office action acknowledges that the goods function as a “video recorder” and provide a “still capture” – neither of which is “live” transmission of images, video, or sound.

There is no evidence that the public customarily uses “live photos” as a descriptive phrase or term of art. Another smartphone producer, HTC, offers a camera that offers similar functionality, but that company does not use the term LIVE PHOTOS in describing the feature. (See Exhibit B.)

As used with Apple’s goods, the two-word phrase LIVE PHOTOS does not convey enough information to meet the legal test of descriptiveness. A term is descriptive if it clearly and immediately identifies the nature of the applicant’s goods or services. See In re Southern National Bank of North Carolina,219U.S.P.Q.1231(T.T.A.B.1983). LIVE PHOTOS does not convey a clear, immediate idea of the nature of the goods. In fact, it takes three sentences in the office action to explain what Apple’s software does:

“The underlying goods function jointly as a camera and video recorder. A user captures a digital photograph and the software is able to capture motion pictures of the events leading up to the taking of the photo … Applicant’s specimen of use also notes that the user of the goods can take a photograph and also record
