To His Excellency N. P. BA.NKS, Governor ood Commandet·­ in- Chief.

Sm,-Chapter 13, section 64, of the General Statutes of the Commonwealth provides that the Adjutant-General shall be "Acting Quartermaster-General and keeper of the public magazines, munitions of war, entrenching tools, and other implements of war belonging to the Commonwealth." Section 27, of the same chapter, provides that he shall be" Inspector­ General of the Militia." In accordance with these and other provisions of law, I have the honor to submit to your Excellency the following Report, which shows the present state of the militia, the condition of the military property of the Commonwealth, and the amount and character of the duties performed by the active volunteer force during the year ending December 31, 1860. 1861.J PUBLIC DOCUMENT-No. 15. 5

The encampments during the present year were held as follows:

The Second Battalion Infantry, First Brigade, First Division, Major Ritchie commander, encamped at Gloucester, on the 25th, 26th, and 27th of July. They were reviewed on the 27th by Brigadier-General Bullock. ~he Oompany of Oadets, attached to the First Division, Lieutenant-Oolonel Holmes commander, encamped at Nahant, on the 26th, 27th, and 28th of July, and were reviewed on the 27th by Major-General Andrews, and on the 28th by the Oom­ mander-in-Ohief. The Oompany of Oadets, attached to the Second Division, Major Foster commander, encamped at South Reading, on the 22d, 23d, and 24th of August. They were reviewed on the 24th by Major-General Sutton. The First Battalion of Light Dragoons, Major White com­ mander, and the Oompanyof Light Artillery, under the com­ mand of Major Nims, severally of the First Brigade, First Division, encamped at Newton, on the 29th, 30th, and 31st of August. They were reviewed on the 30th by the Adjutant­ General, and on the 31st by Brigadier-General Bullock. The Fourth Regiment of Infantry, Second Brigade, First Division, Oolonel Packard commander, encamped at Quincy, on the 29th, 30th, and 31st of August, and were reviewed on the 30th by the Adjutant-General, and on the 31st by Brigadier­ General Peirce. The Tenth Regiment of Infantry, Sixth Brigade, Third Divis­ ion, Oolonel Decker commander, encamped at Greenfield, on the 29th, 30th, and 31st of August. They were reviewed by Brigadiel'-General Richmond. It was the intention of the Adjutant-General to have been present at this camp, but previous engagements prevented his attendance. It has been very highly spoken of by military gentlemen. The ~econd Regiment, First Brigade, First Division, Oolonel Oowdin commander, ell camped on Boston Oommon, on the 4th, 5th, and 6th of September. The Third Brigade, Second Division, composed of Company Light Dragoons, (Waltham,) Captain Moore; the Fifth Regi­ ment of Infantry, Lawrence; the Sixth Regiment of Infantry, Colonel Jones, and the Second Battalion of Riflemen, Major Moore, encamped at North Chelmsford, on the 5th, 6th, and 7th of September. This splendid Brigade was commanded by Brigadier-General Butler, who showed wisdom in the selec­ tion of his camp ground, and much skill in the discipline of his men. Major-General Sutton, who was expected to review the Brigade, was prevented from peforming that duty by indisposi­ tion. They were reviewed by the commanding officer, General Butler. The Third Regiment of Infantry, Second Brigade, First Division, Colonel Wardrop commander, and the Company of Light Dragoons in command of Captain Richmond, encamped at Wareham, on the 5th, 6th, and 7th of September. They were reviewed by the AdJutant-General on the 6th, and by Brigadier-General Peirce on the 7th. This was one of the most successful encampments of the year. The First Battalion of Infantry, Major Briggs commander, and the Company of Cavalry in command of Captain Dennison, severally of the Sixth Brigade, Third Division, encamped at North Adams, on the 11th, 12th, and 13th of September. They were reviewed by Brigadier-General Richmond. Other engage­ ments p.revented the Adjutant-General from being present at this camp. The Seventh Regiment of Infantry, Fourth Brigade, Second Division, Colonel Dike commander, encamped at Haverhill, on the 12th, 13th, and 14th of September, and were reviewed by the Adjutant-General, and by Brigadier-General Andrews. This camp was very finely located on high ground, from which an extended and beautiful view of the valley of the Merrimack was obtained. With the exception of rain on the first day, the weather was pleasant, and good order and discipline prevailed. The Eighth Regiment of Infantry, Fourth Brigade, Second Division, Colonel Coffin commander, encamped near Newbury­ port, on the 11th,12th, and 13th of September, and were reviewed by Brigadier-General Andrews and the Adjutant­ General. The camp was visited the first day with a severe storm of wind and rain, which threw down some of the tents, 4 26 ADJUT Ar\ T -GENERAL'S REPORT. [Jan. and rendered the grollnd wet and uncomfortable. Some of the companies took up their quarters for the night in Newburyport, bnt a majority of them staid at the camp, and remained all night on the field . The weather cleared in the morning, and the two last days were pleasant. 'J'he Eighth Regiment is one of the fnllest and best drilled in the State. The Section of Artillery, attached to the Fourth Brigade, Second Division, nnder command of Captain ~fa.nning, encamped at V{ enham, on the 26th, 27th, and 28th of September. They were reviewed on the afteruoon of the 28th, on Salem Common, by Brigadier-General Audrews, accompanied by the Adjutant­ General. This Section of Artillery !;hould be made a full bat­ tery, for reasons which I shall present in another part of this Report. The Ninth Regiment of Infantry,.Colonel Rice commander, the Third Battalion of Infantry, Major Lamb commander, and the Third Battalion of Riflemen, hnder command of Captain Wan], the whole comprising the Fifth Brigade, Third Division, and commanded by Brigadier-General Leonard, encamped at Leominster, on the 26th, 27th, and 28th of September, and were reviewed 011 the 27th by the Adjutant-General, and on the 28th by Major-General Morse. This Brigade is not excelled by any in the State for discipline and good condnct, for which much praise is due to Brigadier-General Leonard, who, I regret, has recently resigned his commissiofl.. The Ninth Regiment is composed of five good companies. The Third Battalion of Infantry is composed, nominally, of three compallies; one of them, Company" A," Milford, did not appear at camp. Com­ pany" B," Worcester, is the only one of the three" which maintains itself without a struggle." It would be advantageous to the service, under existing circumstances, if the Battalion were disbanded, and the companies which now compose it were transferred to the Ninth Regimeut. The First Battalion of Riflemen, Fourth Brigade, Second Division, Major Poore commander, encamped at West Newbury 011 the 8th, 9th and 10th of October, and were reviewed by the Adjlltant-Gene~al, and by Brigadier-General Andrews. 'rhis was the last camp of the year, and was one of the best. The whole number of encampments was fifteen, and, taken together, 1861.J PUBLIC DOCUMENT-No. 15. 27 they will compare favorably with any which have been held in previous years. The law concerning the militia, chapter 13, of the General Statutes, went into effect on the first day of June. It made few changes in the laws which existed prior thereto. By a Resolve of the legislature approved April 4th, 1860, the Adjutant-General was authorized to contract with the State printer to print two thousand copies of the 13th chapter of the General Statutes for distribution among the officers of the militia, which duty has been performed. The great merit of the work is its completeness. The laws relating to the militia passed in former years, and remaining operative, are ill it brought together, placed in proper consecutive order, di,·ided into proper heads and compressed into one general chapter, thus presentillg in a complete and compact foem the entiee militia laws of the Commonwealth. I am opposed to a frequent change of the statutes. The present militia law is nearly perfect, and could be made perfect with a few slight modifications, which I respectfully suggest to the consideration of your Excellency.

1. To str~e out of the fourteenth section the words, "no new company shall be organized if thereby the whole force shall exceed five thousand officers and men." Every regiment ought to have eight companies. It often happens that companies are disbanded for want of a suffi­ cient number of privates to comply with the requisitions of . the statutes, and it sometimes happens that companies are disbanded for disorderly conduct and disobedience of orders. As the law now stands, the places made vacant by the disband­ ment of companies cannot be filled, and regiments thereby b~come skeleton-like, weak and inefficient. Applications are feequently made to head-quatters for liberty to form new com­ panies to take the places of those which have been disbanded and thus keep the regiments full. These applications have to be summarily rejected. If the question of forming new com­ panies was left to the discretion and judgment of His Excel­ lency the Governor and the Honorable Coullcil, each applica­ tion could be acted upon and disposed of according to its merits. This would be satisfactory. If the legislature should 28 ADJUTANT-GENERAL'S REPORT. [Jan. change the phraseology of the section quoted above so that it would read, " no new regiment shall be fOt'med if thereby, &c.," the objection would be avoided. A provision might be added that no regiment should have more than eight companies, which is the proper number and the one that is fixed by the" Army Regulations." The change here proposed would not materially add to the cost of the service, while it would increase in a vast degree its good discipline and efficiency. 2. As a means of raising the standard of discipline, and of inducing enlistment I would suggest that a law be passed pro­ viding substantially that every person who shall faithfully and honorably perform duty in any company, battalion, regiment brigade or division seven consecutive years, as an officer or a private, according to the laws of the Commonwealth and to the satisfaction of the Commander-in-Chief, shall be entitled to an honorable discharge, and shall not be required (if he should so elect) to serve as a juror in the courts of the Common­ wealth. A law embodying this proposition would have a salu­ tary effect, and as the number of active men is limited by law, and doubtless always will be, no serious abuse of the privilege could possibly arise. 3. I would respectfully recommend that section 144 be amended, so that it shall read, "expenses for travel," instead of " four cents a mile." As the section now stands it is liable to operate unfairly both to companies and to the Common­ wealth, as shown in that part of this Report which relates to the reception and review on the occasion of the visit of His Royal Highness, the Prince of Wales, to Boston.

During the present year, the following companies were ordered by the Commander-in-Chief for special duty:

January 4.-Company of Cadets, Lieutenant-Colonel Holmes, attached to First Division, to escort State government and legislature. July 18.-Company "A," Light Dragoons, Captain Fellows, First Battalion, First Brigade, First Division, to escort His Excellency the Governor and Honorable Council to Cambridge, to attend the Commencement exercises. 1861.J PUBLIC DOCUMENT-No. 15. 29

July 19.-Company "B," Light Dragoons, Captain Peirce, First Battalion, First Brigade, First Division, to escort His Excellency and Honorable Council to Cambridge, to attend the inauguration of President Felton. November 13.-Company "A," Light Dragoons, Captain Fel­ lows, First Battalion, First Brigade, First Division, to escort His Excellency the Governor and Honorable Council to Cam­ bt'idge, to attend the dedication of the Museum of Natural History. The duties performed on the 18th of July and the 13th of November, were not contemplated when the appropriation for the Quartermaster-General's Department was made. On the 20th of July, His Excellency the Governor and Com­ mander-in-Chief authorized the transmission of the following letter:

His Excellency directs me to say that he fully appreciates the ser­ vices of Captain Peirce and his command, rendered particularly ardu­ ous in consequence of the inclement state of the weather His Excellency congratulates Major White upon tho good condition of his splendid Battalion of Cavalry. The most interesting event connected with the Volunteer Militia, during the year, was the visit of His Royal Highness, the Prince of Wales, to this Commonwealth, and the review ordered by His Excellency the Commander-in-Chief, on Boston Common, on the 18th of October, in honor of the distinguished visitor. 30 ADJUTANT-GENERAL'S REPORT. In anticipation of the visit, His Excellency the Governor detailed his senior Aide-de-camp, Lieutenant-Colonel Reed, to proceed to Washington with the following instructions:

My DEAR SIR,-You will please to present the enclosed note to Lord Lyons, Her Britannic Majesty's Envoy Extraordinary, &c., &c., at Washington, as early as your convenience will permit. You will also express to his Lordship the earnest desire entertained by the Executive Authority of this State, and of the People, to extend to His Royal llighness, the Prince of Wales, during his visit to 1\lassa­ chusetts, such hospitalities as may be consistent with his personal com­ fort and convenience, and not conflict with his matured plans of travel. It would afford me very great pleasure to receive him and his suite as the guests of the State, if it were not inconsistent with his arrange­ ments. It would afford me pleasure also to offer to his Royal llighness the opportunity to review a portion of the volunteer troops of the State. This would seem to be the more convenient method of showing him the respect we feel for him, and I doubt not the arrangements could be made for this without serious discomfort or interference with appoint­ ments made with the government of the City of Boston, or other parties. In case this proposition should be accepted, you will confer with Lord Lyons upon the subject of time and the manner in which he should wish it to be done, suggesting to him the order in which such affairs are usually conducted here. The reviewing cortege, starting from the Capitol, the Gover~or would send to the quarters of the Prince an escort to conduct him to the Capitol, and thence accompany him to the parade. I feel it to be my duty, however, to a:]d, that it will be to myself and to the chivalrous and hospitable people of this Commonwealth, a source of unfeigned regret, if the distinguished visitor who honors us by his presence should depart without some slight manifestation of the high respect entertained for him and the great nation with which his destiny is so closely interwoven-and for which all Americans must forever cherish the most profound regard, as the source of the chief elements of their language, literature and liberty. In this feeling and with the most profound respect, I have requested my Aide-de- Camp, Colonel Reed, to express to you our wishes, and to receive from you such suggestions as you may deem it proper to present upon this subject. Permit me, Sir, to express the hope, that the visit of His Royal Highness to the of America, may tend to strengthen the natural ties of amity and interest which should forever bind together the people of two nations of common origin-and that through the intervention of such courtesies as the present happy opportunity affords, they may learn to interpret the pregnant events of the future in such manner as to perpetuate the great principles of civil and religious liberty that underlie their institutions in common. The review will take place at one o'clock, pre­ cisely. The First Division, (with the exception of Light Dragoons of the Second Brigade,) Major-General Andrews commanding. Companies G of Seventh, and F of Tenth Regiments, will be attached to the Second Regiment, under command of Colonel Cowdin. Companies A of Sixth, E of Seventh, and A and C of the Eighth Regiments, will be attached to the Third Regiment, under command of Colonel Wardrop. Company H of Fifth Regiment, and Company B of Third Battalion of Infantry, will be attached to the Second Battalion of Infant.ry, under command of Major Ritchie. Company C, of Second Battalion, and Company A, of Third Battalion of Riflemen, will constitute a Rifle Battalion, under command of Major Moore, attached to Second Brigade. The Major-General in command will detail Company A, First Bat­ talion Light Dragoons, for escort duty, to report at State House at half­ past twelve o'clock, P. M. General Field and Staff Officers, not on duty, are invited to be pres­ ent at the Review in uniform (not mounted.) The Major-General in command will designate their position within the lines. ~ All officers and troops herein ordered for duty will ,govern themselves accordingly, without waiting for the regular transmission of orders. His Royal Highness and cortege arri.ved in Boston on the afternoon of the seventeenth. He was escorted to his quarters by Oompany A, First Battalion Oavalry, Oaptain Fellows. Lieutenant-Oolonels Thompson and Sargent, Aids-de-Oamp to his Excellency the Oommander-in-Chief, were detailed to meet him at the State Line and accompany him to Boston. On the eighteenth, the orders of His Excellency were carried into execution with soldierlike promptness. The Divisionary Oompany of Cadets were stationed in front of the State House, and received the Royal Guest on his arrival, with appropriate 5 34 ADJUTANT-GENERAL'S REPORT. [Jan. honors. He arrived at Head-Quarters at a quarter before one o'clock, with Lieutenant-Cplonel Reed, senior Aid-de-Camp, who had been detailed for that dnty. His Royal Highness and suite were received in the Council Chamber by his Excellency the Governor, who welcomed him to the Commonwealth and introduced him to His Honor the Lieutenant-Governor and members of the Honorable Council. His Excellency and the Prince with their respected suites, then mounted in State House yard, and were escorted to the Common by Company A, First Battalion Cavalry, Captain Fellows. The escort proceeded down Beacon Street to Charles, and along Charles to Boylston, and entered the Common. The Review proceeded immediately and was one of the best that was ever seen on Boston Common. The numOOr of troops present was 2,558. At the conclusion of the Review, the Division broke into column and escorted the reviewing officers and suites to the State House, and shortly after, was dismissed. The Divisionary Corps of Cadets remained on duty and were detailed for special escort, at five 0' clock, at His Royal Highness' Head-Quarters, Revere House, from which they escorted His Excellency the Commander-in-Chief, His Royal Highness and suites to the Music Hall, and afterwards back to the Revere House, when the Company was dismissed. This concluded the State ceremonies. On the thirtieth of October, the following General Order was issued from Head-Quarters :-

[GENERAL ORDER, No. 6.J The Commander-in-Chief presents to Major-General Andrews, in command, and the officers and troops under Review on the eighteenth instant, at Boston, in honor of the visit of his Royal Highness, the Prince of Wales, his thanks for their prompt appearance, and his approval,-with exceptions referred to in Special Order,-of the spirit and efficiency that distinguished their movements, which reflected honor upon the J\filitia and afforded much gratification to many thousands of the people assembled upon the occasion. The" exceptions" refer to Oaptain Bumpus, Oompany 0, Fourth Regiment, and the command of Oaptain Snow, Oompany G, Second Regiment, charged with disobedience of orders. On the thirteenth of December, the Adjutant-General made the following report to His Excellency the Oommander-ill­ Chief :-

SIR,-I have the honor of transmitting to your Excellency the Pay Roll of Troops on duty, October 18th, for review, agreeably to General Order No.5, dated October 9th, 1860. The cost, according to the accompanying Roll, was $7,271.18. Arrangements were made by me with the several railroads leading to the city, by which the Worcester, and the Eastern roads agreed to carry the troops free of cost both ways. The other roads agreed to carry them for half fare. These arrangements were satisfactory to the several companies, with the following exceptions. . Company A, 8th Regiment, Newburyport, Captain Flanders, writes that his command will waive their claim, of 4 cents a mile for travel, as provided in Section 144, Chapter 13, General Statutes, if the State will pay seventy-four dollars which it cost the company to stay in Boston over night. This company was carried free of cost. Company C, 8th Regiment, Marblehead. This company claims full mileage, amounting to $102.40. It was carried free of cost. Company B, 9th Regiment, Fitchburg. This company claims full mileage, amounting to $292.00. It probably paid half fare. Company A, 9th Regiment, Leominster, claims full mileage, provided "the same is allowed other troops." If allowed, the amount would be $190.80. What they actually paid was $74.20. This company was not named for duty in the original Order, of October 9th, but was sub­ sequently detailed, upon representations made by Major-General Morse. Company A, 3d Battalion Rifles, Worcester, claims full mileage, $182.60. They were carried free of charge. Company B, 3d Battalion Infantry, Worcester, claims full mileage, $168.96. Captain Pratt represents the amount paid for travel of hid command to be $60. Company D, 8th Regiment, Lynn, claims full mileage, $58.56. They were carried free of charge. Cadets, 2d Division, Salem, claim full mileage. $120.00. They passed free. I do not understand Major Foster, however, to press this claim. I presented these cases to 1\11'. Choate, Assistant Attorney-General' He advised me to lay the facts before your Excellency. Should these claims be allowed, they will add materially to the aggre­ gate amount of cost. In the detailed statement which accompanies this, the claim of Com­ pany G, 2d Regiment, Capt. Snow, is inserted. This company dis- 1861.J PUBLIC DOCUMENT-No. 15. 37 obeyed orders and left the field, leaving their muskets stacked on the Common, which were subsequently taken possession of by me, and sent to the Arsenal at Cambridge. I respectfully submit the question to your Excellency, whether they should receive pay. In conclusion, I respectfully call the attention of your Excellency to a Resolve of the Legislature, approved March 24th, 1853, which bears directly upon the mileage question. The petition and the report of Col. Thompson thereon are on file in the Secretary's Office. This report was suhsequently approved by the Commander in-Chief. Captain Bumpus was released from ar"est, and Company G was not allowed per diem. There being no appropriation to meet the expense of this Review, the sums due the field officers and companies remain unpaid. The questions of allowing full mileage will properly be a matter for the legislature to adjust. Should it be allowed to companies which make the claim, tbere is no just reason why full mileage should not be allowed to companies that have not claimed it. Since this Report was in the printer's hands, events have transpired in some of the Southern States and at Washington, which have awakened tlle attention of the people of Massacbusetts ill a remarkable degree to the perpetuity of the Federal Union, and which may require the active militia of the Commonwealth to be greatly augmented. Should our worst fears be realized, and this nation be plunged into the horrors of civil war, upon Massachusetts may rest in no inconsiderable degree, the duty of staying the effusion of blood and of rolling back the black tide of anarchy and ruin. She did more than her share to acllieve the independence of our country and establish the Government under which we have risen to such unparalled prosperity and become the great Power of the American Conti­ nent, and she will be trlle to her history, her traditions and her fair fame. Should it become necessary to increase the number of her active militia to a war footing, the present organization offers 38 ADJUTANT-GENERA.L'S REPORT. [Jan. an easy and a good means. The present companies could be filled to their full complement of men, and the regiments to their full complement of companies. New regiments ofInfantry, new battalions of Riflemen, new companies of Artillery and Cavalry could be formed with which to fill the several Bl'igades and make OUI' present Divisions five thousand men each, with proper apportionment of the several military arms. This, of course would require a large outlay of money, which would doubtless be cheerfully met by our people if their hOllor and the welfare of their country demand it of them. Should your Excellency in view of the present state of the country deem a change in the present organization of the mili­ tary necessary or a large increase of the. active force proper, I would respectfully suggest that a board of officers be called as provided'~n section 163, chapter 13, of the General Statutes, to consider and recommend such changes as their judgment shall approve and their experience sugg~st. In the meantime, I would suggest that a General Order be issued calling upon commanders of the companies of the active force to forward to Head-Quarters the names of the persons composing their commands, also their places of resi­ dence, so that a complete roll of each company may be Oll file in this department. The companies that have not their full quota of men should be filled by new enlistments to the number fixed by law, and whenever new enlistments are made or discharges given, the names of the persolls enlisted and discharged, should be for­ warded immediately to Head-Quarters and placed on file. The undersigned entered upon the duties of his office on the 4th of last April. The appropriations and expenditures for the year were as follows :-

Balance unexpended, $4,932 45 • It is proper to rcmark that in consequence of the extraordi- nary drain upon the Quartermaster's department by the escorts for the Commander-in-Chief on the occasion of the inaugura­ tion of Mr. Felton, President of Harvard College, and of the dedication of th~ Museum of Natural History at Cambridge, and certain expenses incidental to the arrival of His Royal Highness, the Prince of Wales, and also from the fact that a part of the appropriation was consumed by my predecessor to pay certain bills which were properly chargeable to the appro­ priation of the preceding year, ' the appropriation for that department has fallen short about one thousand dollars. The deficiency can be made up by transferring that amount from the balance left of the appropriation for military accounts, which would leave an unexpended balance of the entire appropriations of $3,932.45 and make the entire expenditure of the depart­ ment $59,917.55, which is t 4,116.25 less than it was last year. Showing the expenses of 1860 to be nearly seventeen thousand dollars less than they were in 1854. During the year I have drawn from the United States one hundred new rifles and eight hundred of the new rifled muskets. During the month of October the armory of the company of Cadets of Second Division, (Salem,) was destroyed by fire, and ninety-six. of the new muskets were burnt. During the present month the armory of Company A, 9th Regiment, (Medford,) was burnt and ten of the new muskets were destroyed. On the first of January we shall be entitled to draw eight hundred and three more of the new rifled muskets as our quota for the year 1861, and balance now due. I recommend to your Excellency that the section of artillery attached to the Fourth Brigade, Second Division, Capt. Manting, be formed into a full battery, and also that a new company of artilleq be formed and attached to one of the brigades in the Third Division. This would give a full battery of artillery to each of the three Divisions. I would also rtlcommend the for­ mation of a Rifle Battalion in each of the brigades composillg the First Division. There is no rifle company at present in the whole of the First Division. I hope these suggestions may meet with your Excellency's approval.
