RESOLUTION 2020-

A RESOLUTION AFFIRMING RENO COUNTY RESOLUTION 2017-01, DIVIDING RENO COUNTY INTO COMMISSIONER DISTRICTS PURSUANT TO K.S.A. 19-204

WHEREAS, K.S.A. 19-204 requires the Board of County Commissioners to divide the county into three commissioner districts as compact and equal in population as possible; and

WHEREAS, on January 10, 2017 by Resolution 2017-01, the Board of County Commissioners most recently divided Reno County into three commissioner districts pursuant to K.S.A. 19-204; and

WHEREAS, the 2010 Kansas Census remains the last official census available to the Board of County Commissioners; and

WHEREAS, having considered the census data, the Board of County Commissioners finds that the current composition of the commissioner districts established by Resolution 2017-01 remains as compact and equal in population as possible.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF RENO COUNTY, KANSAS that:

1. The three commissioner districts of Reno County shall continue to be divided and apportioned as follows:

Accårdingly, FBTC shall be rãsponsible for payment of all taxes including Federal, State andlócal t¿xes arising out of the consultant's activities in accordance with this contract, including by way of illustration but not limitation, Federal and State income tax, Social Security tax, Unemployment Insurance taxes, and any other taxes or business license fee as required.

The Consultanlindependent Contractor agrees that it shall be responsible for its own acts and wilt be responsible for all damages, costs, fees and expenses which arise out of the performance of the Agreement and which are due to Consultanflndependent Contractor's own negligence, tortious acts by Consultant/Independent Contractor, its employees, agents, representatives' or anyone else assóciated with said contractor or related claims, paterit, copyright infringement or other unlawful conduct.

10. Release of Liabilitv. As an emergency service delivery evaluation and resulting r"co-*è"¿ationlãre intended tosupport fire service and EMS best practices, it is understood that circumstances may exist or occur that as a result, cannot guarantee the optimum and successful service delivery to save lives and properly in all cases. FBTÒ shall not be held liable for any negative outcomes in actions or outcomes that may result from an emergency response.

11. Modiflcation of Tcrms. This agreement may be modified upon mutual witten agreement of the Parties.

12. Confidential Information. The consultant agrees that any information received by the @erance of the consultant's obligations in accordance with this contraot, whlch ðonr.*r the personal, financial or other affairs of the Agent will be treated by the consultant in fuli confidence and will not be revealed to any other persons, firms or organizations.

13. Goveming Law. This Agreement shall be governed by the Iaws ofthe State of Kansas.

14. Other. Consultant agrees that this contract will be performed in compliance with ffiable laws, incîuding the requirements that there will be no discrimination on the bãsis of race, color, religion, national origin, age, disability' ancestry, or veteran status in employment or any program or activity associated with this agreement

15. Pavment to Consultant.

a. Professional Fees. Professional fees for this project will be billed at $10O/hour, not to exceed $10,000.00.

FIVE BUGLE TRAINING A¡ID CONSULTING' LLC PROPOSAL

Overview: Reno Cormtyo Kansas seeks to have an evaluation of fire and emergency medical service delivery within the county's fire districts to determine how improved ïesponse delivery might be gained. Current concerns regarding fire service delivery include lack of training, staffing and response capabilities, with times when the fire districts are unable provide an adequate response to emergency situations.

The above table describe the general act¡on steps to be taken in order to gain an understanding of the current situation/status of Fire/EMS service delivery within Reno County, to include, but not limited to 1) provider service delivery philosophies, 2)current strengths, weaknesses, opportunities and threats (SWOT), 3) stakeholder (both internal and external) perceptions, and to 4) develop recommendations for improving Fire/EMS service delivery within the County.

Time comm¡tments are estimations, but are based on the 'not-to-exceed' cost factor of the contract. Actual time invested may exceed 100 hours, but any excess hours will not be billed to the County. Any reductions in hours required will result in reduced billing to the County.

lf the County would like FBTC to develop a strategic plan based on the above actions, it would be work considered in addition to the above proposal. As the action steps above include a number of actions taken to develop a strategic plan, onty an additional2ïo/o, or 52,500 would be required to complete the strategic plan and present it in conjunct¡on with the evaluation project. This fee includes review meetings and directed modification(s) of the plan. Travel Costs:

FBTC understands that expenses can potentially threaten the fiscal viability of a valuable project, especially when budget is a concern. To that end, rather than charge a mileage fee, FBTC would charge only the actual cost of car rental and gasoline for the purpose of travel to and back from the project, which can be up to a 50% reduction in travel costs. For this project, onþtwo (2) trips are ant¡c¡pated (one for a full week on-site vis¡t, including any evening hours required), with any additional travel requiring approval of the County Administrator.

To enable a week of on-site research work, FBTC will seek economical lodging or would be willing to overnight at a fire station, if logistically feasible and acceptable to a fire department with such facilities. Meals will be included in 'incidental expenses' at FBTC's expense per the proposed contract.
