FOURTH SESSION RESUME OF BUSINESS TRANSACTED DURING THE FOURTH SESSION OF THE THIRTEENTH KERALA LEGISLATIVE ASSEMBLY The summons dated February 19, 2012 for the Fourth Session of the Thirteenth Kerala Legislative Assembly was issued to the Members on February 21, 2012. The session commenced at 9.00 a.m. on Thursday, March 1, 2012 and adjourned sine-die at 12.00 noon on Friday, March 23, 2012. The House met on the following days viz., March 1, 2, 5, 6, 8, 19, 20, 21, 22, 23 (10 days of sittings). The House transacted business for 57 hours and 8 minutes. Governor’s Address The Governor Shri H. R. Bharadwaj addressed the members of the Legislative Assembly at 9.00 a.m. on March 1, 2012. The discussion on the Motion of Thanks to the Governor’s Address commenced on March 5, 2012 with Shri T. A. Ahammed Kabeer moving the following motion: “2012 am¿®v 1˛mw XobXn Kh¿Æ¿ tIcf \nb-a-k-`mw-K-ß-tfmSv sNbvX {]kw-K-Øn\v \nb-a-k-`mw-K-߃ Kh¿Æ¿°v \µn tcJ-s∏-Sp-Øp-∂p.” The discussion on the Motion of Thanks lasted for 3 days, viz. March 5, 6 and 8, 2012. The motion was adopted on March 8, 2012. The House devoted 13 hours and 18 minutes for the discussion on the Motion of Thanks and 43 members including Ministers participated in the discussion. Obituary Reference On March 2, 2012, the Speaker made references on the demise of M.O.H. Farook, who died while holding the office of Governor. Shri Oommen Chandy, Chief Minister and Leaders of various parties associated themselves with the sentiments expressed by the Chair. As a mark of respect to the deceased, the members stood in silence for a while. The House adjourned for the day without transacting other business. On March 5, 2012, the Speaker made references on the demise of Eappen Varghese, P. Vijayadas, A. N. Yousuf, M. I. Markose and K. Sreedharan former members of the House. Felicitation On 20th March 2012, the Speaker made a statement felicitating Shri Sachin Tendulkar for achieving One Hundred ‘Centuries’ in International Cricket. Special Mention On 22nd March 2012, the Speaker made a special mention felicitating Dr. K. J. Yesudas for completing fifty years in cinema playback singing. Rulings by the Speaker On March 5, 2012, the Speaker gave ruling regarding the web-publication of a Private Member Bill for which notice had been given for motion to leave for introduction in the House, but before printing and circulating the Bill among members. On March 8, 2012, the Speaker gave a ruling on a point of order raised against the presentation of the report of the Special Legislature Committee that examined the allegations raised against the Leader of Opposition and another ruling regarding the exclusion of dissent note in the report. 6

On March 19 and 20, 2012 the Speaker gave rulings on the allegation by the Opposition regarding the leakage of budget proposals. Financial Business I. Vote on Account Vote on Account for the first four months of the Financial Year 2012-2013 was laid on the Table of the House on 19-3-2012. The Demands for Grants on Account were discussed and passed by the Assembly on 23-3-2012. Out of 125 cut motions received, none were moved. There were 65 occasions for speech including reply by the Minister for Finance, Law and Housing, in connection with the discussion and voting on Demands for Grants. The Assembly devoted 43 minutes for transacting financial business relating to the Vote on Account for 2012-2013. The Appropriation (Vote on Account) Bill, 2012, in respect of the Vote on Account for the year 2012-2013 was introduced by the Minister for Finance, Law & Housing, on 23-3-2012. SALIENT FEATURES OF THE BILLS

THE PAYMENT OF SALARIES AND ALLOWANCES (AMENDMENT) BILL, 2011 As per the provision in sub-section (6) of section 8A of the Payment of Salaries and Allowances Act, 1951, every Member of the Legislative Assembly shall be entitled to the services of an officer of his choice not above the rank of a Selection Grade Assistant in the Government Secretariat and who is in the service of the Government or a local authority or any Corporation owned or controlled by the Government or any other authority specified by the Government. 2. Requests have been received from the Hon’ble Members of the Legislative Assembly to amend the relevant provisions of the Payment of Salaries and Allowances Act, 1951 with a view to enabling the Members of the Legislative Assembly to have the services of an officer of their choice. The Government have considered the requests and have decided to amend sub-section (6) of section 8A of the Payment of Salaries and Allowances Act, 1951, so as to enable a Member of the Legislative Assembly to have the services of any officer other than a member of an All India Service. 3. The Bill Seeks to achieve the above object.

THE PAYMENT OF SALARIES AND ALLOWANCES (SECOND AMENDMENT) BILL, 2011

The last revision of salaries and allowances of the Ministers, the Speaker, the Deputy Speaker, the Leader of Opposition, the Chief Whip and the Members of the Legislative Assembly was made in the year 2008 by Act 25 of 2008. For the last three years, the price of all the commodities including petrol, diesel, electricity, telephone charges etc. has increased manifold. Considering the above, the Hon’ble Speaker in consultation with the Hon’ble Chief Minister, appointed Mr.Justice R. Rajendra Babu, Retired Judge, High Court of Kerala to study and make recommendations to revise the salaries and allowances payable to the Ministers, the Speaker, the Deputy Speaker, the Leader of Opposition, the Chief Whip and the Members of Kerala Legislative Assembly and also to examine and suggest necessary amendments to the Payment of Salaries and Allowances Act, 1951, the Payment of Pension of Members of Legislature Act, 1976 and matters connected therewith. Justice R. Rajendra Babu Commission submitted its report 59 on 14th October, 2011 containing various recommendations. On the basis of the recommendations of the Commission, the Government have decided to revise the salaries and allowance and to make necessary amendments in the Payment of Salaries and Allowances Act, 1951. 2. The Bill seeks to achieve the above object. THE KERALA APPROPRIATION (VOTE ON ACCOUNT) BILL, 2012 The Bill is introduced in pursuance of Clause (1) of Article 204 of the Constitution of India read with Article 206 there of, to provide for the appropriation out of the Consolidated Fund of the State of Kerala of the moneys required to meet the expenditure charged on the Consolidated Fund of the State 60 and the grants made in advance by the Legislative Assembly in respect of the estimated expenditure of the Government of Kerala for a part of the Financial Year 2012-2013.
