Sarma and threc other members had given notice for moving of an adjournment motion regarding the serious situation that has arised consequent on the total neglect to the State in the Railway Budget and reportcd failure of State Govemment to bring in the demands to the notice of the Union Government. 1IIE KT,IRALA PLJBLIC SERVICE COMMISSION (ADDnONAL FUNCTIONS AS RESPECTS 'IIIE LOK AYtn(TA) BILL. 2011

Govemment have decided that all appointrnents by direct recruiftnent of the Staff of the Lok Ayukta shall be made in consultation with the Public Service Commission. The services of the Lok Ayukta does not form part of the public service of the State. Hence the Public Service Commission has to be empowered to exercise additional functions as respects the Lok Ayukta by appropriate legislative measure under Article 321 of the Constitution of India. Moreover, consultation with Public Service Commission on the draft rules relating to the appointment and other conditions of service of the officers and employees of the Lok Ayukta will be possible only if the Posts in the service of the Lok Ayukta are brought within the purview of thc Commission. Hence the Government have decided to bring in a special legislation for the said purpose. 2. 'fhe Bill seeks to achieve the above obiect.

'IIIE KERALA I-AND REFORMS (ANmNDn/mND BII.I,,2013

Section 7E of the Kerala Land Reforms Act, 1963 as amended by Act 2l of 2006 provides that a person who is in possession of any land not exceeding four hectares in extent, acquired by him or his predecessor in interest by way of purchase or otherwise on payment of considcration from any person holding land in excess of the ceiling area during the period between the date of commencement of Kerala Land Reforms Act, 1963 and the date of comrnencement of Kcrala l-and Reforms (Amendment) Ac! 2005 (21 of 2006) shall be deemed to be a tenant. As the said provision would result in reducing the availability of excess land for distribution to the poor landless people as envisagcd by the Zero Landless Programme and for the development activities of the Government. Thcrefore Government have decided to limit the extent of land, a person can hold as per section 7E from 4 hectares to I hectare 6l ares and 87 square metres (4 acres).

2. As per sub-section (a) of section gl of the said Act inserted vide Act 6 of 2012, a person holding plantation' and lands ancillary thereto or interspersed within such plantation, may use not exceeding five per cent of the 93 extent of such holding for floriculture or for the cultivation of vanila or medicinal plants or other agricultural crops or for establishing hotels or resorts or other tourism projects and for pulposes ancillary or connect€d therewith. The said relaxation caused severe problems relating to environment protection, pollution control, conservation of forest and also led to large scale conversion of plantations for non-plantation activities. Hence Government have decided to impose restrictions on the use of the aforesaid extent of land through rules and for that purpose to amend sub-section (4) of section 8l suitably.

3. The Bill seeks to amend the Kerala Land Reforms Act, 1963, to achieve the above object.

THE UNTVF,R^STTY LA\ilS (SECOND AMNDMEI\rT' ru' ,013 The provisions in the University Acts in the State in respect of appointments to the teaching and non-teaching posS are not uniforrn. Therefore' various Universities in the State follow different reservation patterns and communal rotation. There are no specific provisions as to how to treat the category-wise posts for reservation, i.e., whether individual teaching departments or teaching departments as a whole shall be considered, As provided in other University Acts, the provisions relating to reservation pattern for appointment to the teaching and non-teaching posts in the Universities in section 7 of the Cochin University of Science and Technology Act, 1986 (31 of 1986) and in section 40 of the Thunchath Eztruthachan Malayalam University Act, 2013 (24 of 2Ol3) arc not clear and may invite different interpretations. But, the Government consider that the provisions as to reservation and communal rotation in section 6 of the Kannur University Act, 1996 (22 of 1996) is more specific. Therefore, the Government consider that it is necessary to have a uniforrn provision in respect of reservation and communal rotation for appointments to the teaching and non-teaching posts in the Universities in the State and to follow communal rotation category-wise treating all the deparfinents as one unit. For this purpose, the Government have decided to amend the said Acts in tune with the provisions in sub-section (2) of section 6 of the Kannur University Act' 1996'

2. As the state Legislative Assembly was not in session and the above proposals had to be given effect to immediately, the university Laws 94

'fhe Reserve Bank of India directed the to issue instructions to ensure a minimum of 4o/o Capital to Risk-Weighted Asset Ratio (CRAR) by all District Co-operative Banks and Kerala State Co-operative Bank before 30th June, 2013. In order to achieve a minimum of 4Vo Capital to Risk-Weighted Asset Ratio (CI(AR) and to attract more investors, necessary amendments are to be madc in clause (ia) of section 2, which defltnes the term "District Co-operative Bank" and section 18 of the Kerala Co-operative Societies Act, 1969 (21 of 1969).

2. As per section 80A of the said Act Governmcnt have introduced the Self F'inancing Pension Schcme for the cstablishment of a Pension Fund for the payment of pension to the cmployees of Co-operative Societies. Government had received several representations from the employees of the Boards constituted under the provisions of Kerala Co-operative Societies Act, 1969, praying to include them also in the Self Financing Pension Scheme applicable to the employees of Co-operative Societies. The provisions regarding the Pension Scheme formulated exclusively for the employees of Co-operative Societies in the State, i.e., section 80A of the said Act have also to be amended to include the employees of the Boards also in the Self Financing Pension Scheme. Hence the Government decided to amend clause (ia) of section 2 and section 18 and section 80A of the said Act to achieve the above object. 3. As the Legislative Assembly was not in session and as the proposals had to be given immediate effect, the Kerala Co-operative Societies 95

(Third Amendment) ordinance, 2ol3 was promulgated by the Govemor of Kerala on22nd day of November,2013 and the same was published as Ordinance No. 55 of 2013 in the Kerala GazerTe Extraordinary No. 3293 dated 23rd day of November, 2013.

It is, therefore, felt necessary to amend the Calicut University Act, 1975 (5 of 1975) for the above purposes. 3.
