Rescue Cats (Part Retrospective) Grant Permission 1. The development shall be undertaken in strict accordance with the approved documents for this Planning Permission which comprise: 1. the Planning Application Form received 16th August 2018; 2. the Location Plan received 21st August 2018 (Drawing no. D.04); 3. the Site Plan received 21st August 2018 (Drawing no. D.03); 4. the Proposed Floor Plan received 21st August 2018 (Drawing no. D.02); 5. the Elevations received 22nd August 2018 (Drawing no. D.05); 6. the Planning Statement received 16th August 2018; 7. the Supporting Statement received 5th November 2018; 8. the Notice of Decision; 9. any such variation as may subsequently be approved in writing by the local planning authority. Reason: To define the permission. 2. This permission relates to the use of part of the property known as Kershope Lodge which shall be occupied as one planning unit by the applicant and members of her family or those of the successors in title. Under no circumstances shall the applicant or the successors in title subsequently sell, let or in any way dispose of or permit to be used independently of the house and its associated curtilage. Reason: In the light of the interdependent relationship with the existing house the local planning authority are not prepared to permit the establishment of a separate planning unit in accordance with Policy SP2 of the Carlisle District Local Plan 2015-2030. 3. The use hereby permitted shall be confined to the buildings specified in the application. Reason: In order to control the scale of the use and thereby safeguard the living conditions of the neighbouring residents in accordance with Policy H17 of the Carlisle District Local Plan. 4. The premises shall only be used for the accommodation of no more that 100 cats at any one time. Reason: The local planning authority wish to control the precise nature of the use in order to safeguard the living conditions of the neighbouring residents in accordance with Policies CM5 and IP3 of the Carlisle District Local Plan 2015-2030. 5. Within 3 months from the date of this approval, details for the disposal of waste material generated from housing the cats shall be submitted to and approved in writing by the local planning authority. The development shall then be undertaken in accordance with e approved details which the arrangements of which shall be retained thereafter unless otherwise agreed in writing by the local planning authority. Reason: To ensure that adequate collection provisions are made in accordance with Policy CM5 of the Carlisle District Local Plan 2015-2030. 6. Animals must be kept at all times in an environment suitable to their species and condition (including health status and age) with respect to ventilation. Reason: To ensure the formation of an adequate form of development that does not adversely affect the living conditions of property or that of neighbouring properties in accordance with Policy CM5 of the Carlisle District Local Plan 2015-2030. Detached Dwellings Grant Permission 1. The development shall be begun not later than the expiration of 3 years beginning with the date of the grant of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). 2. The development shall be undertaken in strict accordance with the approved documents for this Planning Permission which comprise: 1. the submitted planning application form received 11 October 2018; 2. the Site Location Plan (Drawing No. PA17/694/06) received 11 October 2018; 3. the Proposed Site Layout Plan (Drawing No. PA17/694/04A) received 11 October 2018; 4. the Proposed Plans & Elevations (Drawing No. PA17/694/03) received 13 December 2018; 5. the Notice of Decision; and 6. any such variation as may subsequently be approved in writing by the Local Planning Authority. Reason: In order to ensure that the development is carried out in complete accordance with the approved documents and to avoid any ambiguity as to what constitutes the permission. 3. Notwithstanding any description of materials in the application hereby approved, no external materials for the development shall be used on site until samples of all external materials are made available for inspection on site and the specification of these materials submitted to, and approved in writing by, the Local Planning Authority. The specification of the materials shall include the type, manufacturer’s specification, colour and texture of the materials to be used and any finish to be applied. The developer should have regard to the context of the site in terms of surrounding building materials and should be able to demonstrate why such materials have been chosen. Reason: To ensure that the materials are suitable and do not have an adverse effect on the character and appearance of the surrounding area and conservation area in accordance with policies SP6, SP7 and HE7 of the Carlisle District Local Plan 2015-2030 and the associated requirements of the National Planning Policy Framework. 4. Other than the alterations to the highway access, no further development shall commence until a detailed landscaping scheme has been submitted to, and approved in writing by, the Local Planning Authority. All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the building or the completion of the development, whichever is the sooner, and maintained thereafter to the satisfaction of the Local Planning Authority; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure a satisfactory landscaping scheme is implemented to fulfil the requirements of policy SP6 and HE7 of the Carlisle District Local Plan 2015-2030. 5. Notwithstanding the details shown on the approved plans, prior to the erection or planting of any of any boundary feature, full details of the siting, height, design, materials and finish to be used for all boundary treatments throughout the site shall be submitted to, and approved in writing by, the Local Planning Authority. Reason: To ensure that the appearance of the area is not compromised by a lack of satisfactory screening in accordance with policy SP6 and HE7 of the Carlisle District Local Plan 2015-2030. 6. Prior to their use on site, a detailed specification of the hard surface finishes to all external areas of the development hereby approved shall be submitted to, and approved in writing by, the Local Planning Authority. The specification of the materials shall include the type, manufacturer’s specification, colour and texture of the proposed surface finish. The developer should have regard to the context of the site in terms of surrounding building materials and should be able to demonstrate why such materials have been chosen. Reason: To ensure that the materials are suitable for the site and harmonise with the surrounding area in accordance policy SP6 of the Carlisle District Local Plan 2015-2030. 7. Before any development takes place, a plan shall be submitted to, and approved in writing by, the Local Planning Authority reserving adequate land for the parking of vehicles engaged in construction operations associated with the development hereby approved, and that land, including vehicular access thereto, shall be used for or be kept available for these purposes at all times until completion of the construction works. Reason: The carrying out of this development without the provision of these facilities during the construction works is likely to lead to inconvenience and danger to road users. The facilities are therefore required to comply with Cumbria Local Transport Plan policy LD8 and policies IP2, SP6 and CM5 of the Carlisle District Local Plan 2015-2030. 8. The development shall be carried out in strict accordance with the details and specifications approved under Condition No’s. 3, 4, 5, 6 and 7 of this planning permission and retained as such thereafter. Reason: In order to ensure that the development is carried out in complete accordance with the approved details and to avoid any ambiguity as to what constitutes the permission. 9. The development shall not commence until visibility splays providing clear visibility as shown on Drawing No. PA17/694/04A of 43 metres measured back by 2.4 metres down the centre of the access road and the nearside channel line of the major road have been provided at the junction of the access road with the county highway. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (or any such Order revoking and re-enacting that Order) relating to permitted development, no structure, vehicle or object of any kind shall be erected, parked or placed and no trees, bushes or other plants shall be planted or be permitted to grown within the visibility splay which obstruct the visibility splays.
