TAWAB, Examinateur externe, Université de Kinshasa Samuel TANNER, Représentant de la doyenne de la Faculté des études supérieures et postdoctorales, université de Montréal ii SOMMAIRE Bien que la biopiraterie soit une pratique connue depuis des décennies, il est cependant admis qu’elle a été renforcée par les régimes juridiques internationaux issus de la Convention sur la Diversité Biologique (CBD) et de la propriété intellectuelle établis par les accords de l’Organisation Mondiale du Commerce (OMC). En dépit de l’absence de consensus autour de sa définition, la biopiraterie est néanmoins présentée comme un acte d’appropriation des ressources génétiques et/ou des savoirs traditionnels des communautés autochtones et locales par les firmes biotechnologiques. Situées en majorité dans les pays en développement riches en biodiversité, ces communautés sont désignées comme les acteurs de la conservation de la biodiversité mondiale depuis des générations. Mais en raison des menaces à la survie des communautés autochtones et locales, voire à la sûreté de la planète du fait de l’érosion rapide de la biodiversité qu’elle provoque, la biopiraterie est à ce jour considérée par des spécialistes comme un crime environnemental. Des nombreuses études récentes effectuées dans le domaine de la criminologie verte sont également arrivées à la même conclusion. Malheureusement, la biopiraterie échappe encore au domaine d’infractions des crimes environnementaux tels que définis par les instruments juridiques internationaux actuellement en vigueur. Même si des tentatives de criminalisation de la biopiraterie dans certains pays riches en biodiversité ont suscité de l’espoir en raison du succès qu’elles ont connu, elles n’ont cependant pas apporté des réponses satisfaisantes aux préoccupations des autochtones. D’où, cette thèse examine la possibilité que la mise en œuvre des régimes actuels du droit pénal international de l’environnement soit une avenue à explorer. Mots clés : Autochtones, Biodiversité, Biopiraterie, Bioprospection, Brevet, Criminologie, Crime, Environnement, Génétiques, Savoirs iii ABSTRACT Although biopiracy has been a well-known practice for decades, it has been reinforced by the international regimes established under the Convention on Biological Diversity (CBD), and by the intellectual property framework created under the World Trade Organization (WTO). Despite the lack of consensus surrounding its definition, biopiracy includes acts of appropriation by biotechnology firms of the genetic resources and / or traditional knowledge of Indigenous and local communities. Situated primarily in developing countries that are rich in biodiversity, these communities have played a vital role in the conservation of global biodiversity for generations. But because of threats to the survival of Indigenous and local communities, and perhaps even to the survival of the planet itself due to the rapid erosion of biodiversity that it entails, biopiracy is now considered by experts to be an environmental crime. Numerous recent studies in the field of green criminology have arrived at the same conclusion. Nevertheless, the international legal instruments currently in force do not recognize biopiracy as a criminal act. And while attempts to criminalize biopiracy through legislation in certain biodiversity-rich countries have been successful, giving rise to some hope, these actions have largely failed to provide an adequate response to the environmental concerns of Indigenous peoples. This thesis examines the extent to which the implementation of existing international environmental criminal law could provide an avenue for further exploration in this regard. But the tale is not a fable; it is the amazing story of Brandeis University. For more than a century American Jews had nurtured a dream of creating a university which evoked their ancient heritage of scholarship and their gratitude to a nation which offered them haven and freedom . On October 11, 1948, the dream became a reality. Th e first Jewish-sponsored, nonsectarian university in the United States, named in memory of Supreme Court Justice Louis D. Brandeis , opened its doors on the campus of what had been Middlesex Un iversity . Startling in contrast t o the few buildings which originally dotted the 250-acre campus stood--perhaps as a portend to future greatness--a castle .. This imposing structure, designed after medieval architecture, had been part of Middlesex. Known as the Usen Castle, it is still a campus landmark, but is now surrounded by 70 buildings--some perhaps more impressive, but none so unique . Dr . Abram L. Sachar, historian and teacher , became Brandeis' first president and served in that capacity for twenty years at which time he became chancellor of the University. His recently published book, A Host At Last, chronicles the fantas tic growth of Brandeis--thanks to the steadfast commi t ment and magnificent generosity of the American J ewish community. Dr . Marver H. Bernstein, former dean of the Woodrow Wilson School of Public and International Affairs at Princet on University, has been president since 1972.

    1974 UK Record Releases by Date This is a list of all UK 45 singles and EP’s found on the 45 cat website and any new release sheets as of the 25/10/16. Generally records that don't have a full release are not included. Some spoken word only records are not listed, plus “story” ones. Records that would have had a specific week when they were first released, but which dates have not been found, but are known to have been issued on an actual month are included at the end of each weekly listing for the month in question. Numbers in red indicate ownership on 45 cat for those with 5 or more. In some cases, such as chart hits, the number of “wants” is added on. Caution should be noted with ownership figure, as the record might have only been available as a promo record that wasn’t issued to the public. These however will be popular with collectors of records. If it is known to be never issued to the public, what is called on the 45 Cat site as a “stock” record. Then that will not be included. In some cases records by well known acts were never issued as “stock” and some of these have been included, but such records are shown as “promo only”. They are included to show that the record couldn’t have made the charts in 1974. At least as a UK issue! Records that made the charts of the time are only stated where no specific week has been found or if a chart record fails to score 5 ownership indications - indicated by the term hit.
